Approval of Minutes - February 26, 2025 - Special Meeting RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Minutes of the February 26, 2025 Special Meeting as presented. Approval of Voucher Detail - March 5, 2025 RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Voucher Detail Report dated March 5, 2025 in the amount of $2,119,305.46 VOUCH DET 030525 D. NOTICE OF INTENT TO BECOME LEAD AGENCY (Multi-Modal Transportation Hub) WHEREAS, the Village of Ossining intends to construct a Multi-modal Transportation Hub (MMHT) behind upper Main Street on the footprint of the existing Brandreth Street Municipal parking Lot; and WHEREAS, the action will be funded in part by two New York State grant funding streams, Empire State Development (ESD) and the New York State Downtown Revitalization Initiative (DRI) program administered by the Department of State; and WHEREAS, the action will include the construction of 240+ parking spaces including ADA to use adjacent public spaces, charging infrastructure for electric/hybrid vehicles, e-bikes/e-scooters, a tie into the Old Croton Aqueduct Trailway, a rooftop solar array and space for an e-bike rental vendor; and WHEREAS, the parcel for the proposed action is a village-owned lot on Brandreth Street (89.19-4-3), bordered to the northeast by the Old Croton Aqueduct, to the east by Leonard Street and to the west by Brandreth Street; and WHEREAS, a Lead Agency must be established for the environmental review of the proposed action pursuant to the requirements of the State Environmental Quality Review Act (SEQRA) and the governing regulations (6 NYCRR Part 617); and WHEREAS, the Village of Ossining Board of Trustees is interested in being designated as Lead Agency for this action; now therefore be it RESOLVED, that the Village of Ossining Board of Trustees declares its intent to become Lead Agency for the action identified as the Multi-modal Transportation Hub; and be it further RESOLVED, that the Village of Ossining Board of Trustees will distribute this resolution along with Part 1 of the Full Environmental Assessment Form to all Involved Agencies; and be it further RESOLVED, that if within 30 calendar days from the date of mailing of this resolution no Involved Agency submits a written objection to the Board of Trustees, then the Board of Trustees will serve as Lead Agency pursuant to 6 NYCRR Part 617. E. Proposed Assessment- 11B Piping Rock Drive Legislative Meeting March 5, 2025 Page 2 of 5  WHEREAS, Anthony Gomez and Quratul Gomez are the owners of property at 11B Piping Rock Drive (89.06-1-3) (“Property”); and WHEREAS, pursuant to section 229-6 of the Village of Ossining Code (Code):  Every owner…or other person having charge of any building…in the Village abutting upon any street, avenue or public place shall within six hours after the cessation of every fall of snow or the formation of any ice on the sidewalk or public way abutting such building…cause the snow or ice to be removed or cleared entirely from the sidewalk or public way abutting such building…  In case the snow or ice on the sidewalk or public way abutting any building…shall not be cleared of snow or ice…the Village Manager shall direct the Superintendent of Public Works or the Building Inspector to promptly clean or cover the sidewalk…The cost or expense of doing such work…shall be ascertained by the Superintendent of Public Works or Building Inspector.  Within ten days of the snow/ice removal from the sidewalk, the Superintendent of Public Works or Building Inspector will send to the owner…a notice of proposed assessment of costs by certified mail.That notice will provide the amount and purpose of the proposed assessment for the work performed; the date, time and location where the Board of Trustees will meet to hear and determine all objections to the proposed assessment; and that the Board of Trustees will determine an assessment that is just and reasonable not exceeding, in the event of default the amount in the notice.The proposed assessment will include a 20% administrative charge.The notice will include a statement that if the amount so assessed is not paid to the Village Treasurer within thirty days of the Board of Trustees’ determination, an action to recover the amount may be maintained by the Village against the property owner…; a special warrant may be issued as directed by the Board of Trustees; or the amount of the assessment may be included in the next annual tax levy to be collected and enforced in the same manner as property taxes; and WHEREAS, the owners failed to timely remove snow and ice on the sidewalk along the North Highland Avenue side of 11B Piping Rock Drive; and WHEREAS, pursuant to section 229-6 of the Code, the Village arranged to have the snow and ice removed and salt applied; and WHEREAS, the snow and ice were removed and salt applied by Diego’s Landscaping & Construction Corp. on January 29, 2025 at the village’s request; and WHEREAS, the owners were sent a Notice of Proposed Assessment of Costs and Notice of Hearing noting the total amount due to be $360 consisting of the invoice for the work performed ($300) plus a 20% administrative fee ($60); WHEREAS, at the hearings on February 19 and March 5, 2025 the Board of Trustees discussed the assessment; now therefore be it RESOLVED, that the itemized costs noted below are just and reasonable; and be it further RESOLVED, that if the amount so assessed is not paid within thirty (30) days after the assessment by this board the Village Treasurer is directed to include the assessment in the next annual tax levy to be collected and enforced in the same manner as property taxes. DPW-Authorization to Advertise for Bids - Contract DPW-25-07, Construction of Multi Modal Transportation Hub RESOLVED, that subject to review by Corporation Counsel, the Village Clerk is Legislative Meeting March 5, 2025 Page 3 of 5  authorized to advertise for bids for Contract DPW-25-07, Construction of Multi Modal Transportation Hub, such bids to be returnable to the Village Clerk. G. Revision to Management Benefit Plan WHEREAS, the Board of Trustees has adopted a Management Benefit Plan for elected officials, managers and appointed personnel; and WHEREAS, the Management Benefit Plan was most recently readopted at the January 8, 2025 annual reorganization meeting; and WHEREAS, the Board of Trustees, following discussions with village staff determined that the plan should be revised; now therefore be it RESOLVED, that the Management Benefit Plan is revised effective immediately; and be it further RESOLVED, that a copy of the revised Management Benefit Plan is reproduced below and will be made part of the village’s personnel policies.
