C. Approval of Voucher Detail - April 2, 2025
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the
Voucher Detail Report dated April 2, 2025 in the amount of $976,161.11.

D. Resolution Declaring Certain Village-owned Vehicle as Surplus
RESOLVED, that the Board of Trustees of the Village of Ossining hereby declares the
following vehicle as surplus equipment and authorizes their disposal in accordance with
New York State law by sale or otherwise “as is” pursuant to the village’s agreement with
Auctions International, Inc.:

E. Referral of proposed zoning text amendment to the Planning Board
WHEREAS, that pursuant to section 270-59 of the Village of Ossining Code, “this
chapter, or any part thereof, may be amended, supplemented or repealed from time to
time by the Village Board on its own motion or upon recommendation by the Planning
Board. Prior to the public hearing…every proposed amendment shall be referred by the
Village Board to the Planning Board for a report which shall be rendered within 62 days
of such referral; and
WHEREAS, the Board of Trustees is considering an amendment to chapter 270
(Zoning), section 270-28.1 (Temporary Moratoria in RDD and SP-N Zoning Districts);
now therefore be it
RESOLVED, that pursuant to section 270-59 of the Village of Ossining Code, the Board
of Trustees refers the proposed zoning text amendment to the Planning Board; and be it
further
RESOLVED, that the Planning Board shall issue its report on the proposed text
amendments to the Zoning Code within sixty-two (62) days of this referral; and be it
further
RESOLVED, that pursuant to section 270-59A(1), the Planning Board shall make
inquiry and determination concerning the items specified below:
a. Whether such changes are consistent with the aims and principles embodied in
the law as to the particular districts concerned.
b. Which areas, land uses, buildings and establishments in the Village will be
directly affected by such changes and in what way they will be affected.
c. The indirect implications of such changes in its effect on other regulations.
d) Whether such proposed amendments are consistent with the aims of the
Comprehensive Plan of the Village and the Local Waterfront Revitalization Program
(LWRP).

RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign the revised proposal from Joseph A. Lecce, P.E., P.C., 297 Knollwood
Road, Suite 211, White Plains, New York to provide construction administration services
for the mechanical and electrical work scope for the HVAC equipment replacement
renovation at the Joseph G. Caputo Community Center.

G. Resolution Authorizing the Village Manager to Sign the Municipal Snow and Ice
Agreement with the State of New York
RESOLVED, that upon review by the Corporation Counsel, the Village of Ossining
Board of Trustees authorizes the Village Manager to sign extension 1 to the Agreement
to Extend Municipal Snow and Ice Agreement D014843 with the State of New York for a
term of July 1, 2024 through June 30, 2029.

H. Supplemental Agreement 3 to Contract D014843 (Snow and Ice)
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign Supplemental Agreement 3 to Contract D014843 between the Village
of Ossining and the New York State Department of Transportation for the 2022/2023
snow and ice season.
I. Supplemental Agreement 4 to Contract D014843 (Snow and Ice)
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign Supplemental Agreement 4 to Contract D014843 between the Village
of Ossining and the New York State Department of Transportation for the 2023/2024
snow and ice season.

RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign Supplemental Agreement 5 to Contract D014843 between the Village
of Ossining and the New York State Department of Transportation for the 2024/2025
snow and ice season.
K. 2025 CABARET LICENSE FOR HACIENDA EL PATIO CORP., 107 MAIN STREET,
OSSINING, NEW YORK
WHEREAS, pursuant to Chapters 100 and 171 of the Code of the Village of Ossining
(“Code”), the authorized representative of the business Hacienda El Patio Corp., 107
Main Street, Ossining, New York presented an application to the Village Clerk, as
licensing officer, for a cabaret license; and
WHEREAS, pursuant to sections 100-3 and 100-5 of the Code, the Village Clerk caused
an investigation into said application and after receiving the results of the investigation
from the Finance Department, Building Department and Police Department the
application was referred to the Board of Trustees for final approval; and
WHEREAS, the Board of Trustees reviewed the application at the March 26, 2025 work
session hearing from Captain Donohue, Lieutenant Lantz, Corporation Counsel Kahan,
Louis Chisari, attorney for the applicant and Jannette Vasquez-Gonzalez, applicant’s
President; and
WHEREAS, the New York State Liquor Authority issued temporary retail licenses to
Hacienda El Patio for the upstairs and downstairs bars, allowing for the serving of beer
and wine, with both temporary licenses expiring on August 9, 2025; now therefore be it
RESOLVED that pursuant to the Code, the Board of Trustees hereby approves a
Cabaret License expiring on August 9, 2025 for Hacienda El Patio as follows:
Days/Hours: Sunday, Monday, Tuesday and Thursday- 12:00 pm to 12:00 am
Friday and Saturday- 12:00 pm to 1:00 am
Hacienda El Patio will be closed on Wednesday.
Type of entertainment: Patron dancing with music provided by a DJ, and on Saturday

night and Sunday live music; and be it further
RESOLVED, that this cabaret license is issued subject to the following conditions:
License is good through August 9, 2025 (date of expiration of temporary retail
permits).
Licensee will return to the Board of Trustees before August 9, 2025 to discuss
extending the cabaret license through December 31, assuming the SLA license is
renewed.
Licensee agrees that none of the former owners/managers of El Manabita Sports
Restaurant Inc., formerly located at 107 Main Street, Ossining, New York
including Fernando Vasquez, Steven Vasquez and Aracelis Gonzalez will work at
Hacienda El Patio in any capacity.
Licensee will provide to the License Officer and Corporation Counsel documents
confirming that employees serving alcoholic beverages and security personnel
have successfully completed a recognized New York State Liquor Authority
Alcohol Training Awareness Program (ATAP).
ATAP certifications shall be kept current.
Licensee agrees not to serve any cubetas (buckets) of beer.
Licensee will advise the License Officer and Corporation Counsel if a manager(s)
will be hired or if Hacienda El Patio will be managed by a principal. All
managers shall be identified prior to commencing operations.
Licensee will communicate with Captain Donohue/Lieutenant Lantz of the
Ossining Police Department no less than once a month to discuss any operational
issues.
Licensee will provide insurance carrier names and policy numbers for workers’
compensation and disability insurance.
Prior to commencing operations, the licensee will provide the License Officer and
Corporation Counsel with the names of all employees.
Licensee agrees that it will not use the rear of the premises at 107-113 Main Street
and be it further
RESOLVED, that the licensee may request from the Village Manager an extension of the
hours for the operation of the cabaret for a specific event on no more than two specific
dates before August 9, 2025 upon a showing of good cause; and be it further
RESOLVED, that no fewer than five (5) business days before the specific date for which
an extension of the hours of operation of the cabaret is sought, the licensee, by its
authorized representative, shall present to the Village Manager a written request for the
extension of hours of operation of the cabaret; and be it further
RESOLVED, that upon receipt of the written request for an extension of the hours of
operation of the cabaret, the Village Manager or designee will contact the Ossining Police
Department and Village of Ossining Building Department to determine if there are any
reasons that the request should be denied or modified; and be it further
RESOLVED, that the Village Manager will advise the licensee of his/her decision on the
written request no fewer than two (2) business days before the date of the specific event;
and be it further
RESOLVED, that where the request for an extension of the hours of operation of the
cabaret is approved, the Village Manager or designee shall notify the Police Department
of the extended hours which extended hours shall not extend past 2:00 am; and be it
further
RESOLVED, that the Village Manager’s or designee’s approval of the request for an
extension of the hours for the operation of the cabaret shall only be for the specific date
and may not be used as a basis to extend the hours of operation for any other date; and
be it further
RESOLVED, that pursuant to section 100-9 of the Village Code, the Board of Trustees
may revoke or suspend any cabaret license issued under chapter 100 where the license
was obtained by fraud or false representation of fact or failing to comply with the
provisions of chapter 171 (Licenses).

M. DPW-Authorization to Advertise for Bids - Contract DPW-25-08 Spring Street Sidewalk
Improvements
RESOLVED, that subject to review by Corporation Counsel, the Village Clerk is
authorized to advertise for bids for Contract DPW-25-08, Spring Street Sidewalk
Improvements, such bids to be returnable to the Village Clerk.
N. Appointment to Civilian Police Complaint Review Board- Ernest Addo
RESOLVED, that the Board of Trustees appoints Ernest Addo to the Civilian Police
Complaint Review Board as a voting member from the unincorporated area of the Town
of Ossining for a two-year term expiring on December 31, 2026.

A. Authorization to Apply to 2026 Congressionally Directed Spending Program for Lead
Service Line Replacement Funding
RESOLVED, that the Village Manager is hereby authorized to submit grant applications
requesting $1M towards the Village of Ossining's Lead Service Line Replacement
Program to New York State Senators Schumer and Gillibrand, and to Congressman
Lawler, under the 2026 Congressionally Directed Spending program, with a minimum
20% cost share requirement from the Village of Ossining.
