Minutes of the September 17, 2025 Regular Meeting as presented.

B. Approval of Voucher Detail - September 30, 2025
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the
Voucher Detail Report dated September 30, 2025 in the amount of $688,818.97.

C. Village Manager-Agreement with Zeltsman Associates dba Down to Earth Market
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign an agreement with Zeltsman Associates, Inc. dba Down to Earth
Market for a one-year term commencing on January 1, 2026; and be it further
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign the Down to Earth Market 2026 Ossining Farmers Market Operating
Plan.

D. DPW - Award of Bid – Spring Street Sidewalk Improvements
RESOLVED, that, subject to review by Corporation Counsel, the Board of Trustees of
the Village of Ossining hereby awards the bid for Contract No. DPW-25-08, Spring
Street Sidewalk Improvements, to Peter J. Landi, Inc., 13 Bradhurst Avenue,
Hawthorne, NY 10532 for the total bid amount of $1,440,585.00 consisting of the base bid
of $1,156,370.00 and additional alternate bid of $284,215.00 as the lowest bid received
from a responsive and responsible bidder; and be it further
RESOLVED, that following review by the Corporation Counsel the Village Manager is
authorized to sign the documents for Contract No. DPW-25-08.
E. Police Department- Approval of price quotations (Evans Consoles)
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign the following price quotations/proposals from Evans Consoles, Inc.,
305 E. Wall Street, Grapevine, Texas 76051 for work in the Ossining Police Department
Communications Room:
Raised floor tiles- $20,000

F. Police Department- Declaring a certain village-owned vehicle as surplus
RESOLVED, that the Board of Trustees of the Village of Ossining hereby declares the
following vehicle as surplus equipment and authorizes its disposal in accordance with
New York State law by sale or otherwise “as is” pursuant to the village’s agreement with
Auctions International, Inc.:

G. Adoption of Local Law 5-2025, “A Local Law amending Chapter 270 (Zoning) of the
Village of Ossining Code”.
WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been
considering the adoption of proposed Local Law -2025, titled, “A Local Law amending
Legislative Meeting September 30, 2025 Page 2 of 6
Chapter 270 (Zoning) of the Village of Ossining Code, Article XX, Moratorium for
submission and processing of Land Use Approvals for cannabis dispensaries, vape shops,
smoke shops, vape lounges and vape consumption businesses”; and
WHEREAS, a public hearing was conducted on September 17, 2025 at 7:30 pm at the
Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via
the Zoom platform affording members of the public an opportunity to be heard; and
WHEREAS, the public hearing was closed on September 17, 2025; and
WHEREAS, pursuant to 6 NYCRR section 617.3(f) of the State Environmental Quality
Review (SEQR) regulations, no determination of significance, environmental impact
statement or findings statement is required for Type II actions; and
WHEREAS, 6 NYCRR section 617.5(c)(36) notes that “adoption of a moratorium on
land development or construction” is a Type II action; and
WHEREAS, there are no impediments to approving the proposed local law; now
therefore be it
RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts as
Local Law 5-2025, A Local Law amending Chapter 270 (Zoning) of the Village of
Ossining Code, Article XX; and be it further
RESOLVED, that Local Law 5-2025 shall become effective upon filing with the Secretary
of State pursuant to the Municipal Home Rule Law.
Local Law (RDD Zoning District- Chapter 270)
H. Overgrowth Assessment- 18 Tompkins Avenue
WHEREAS, Hanson Banfo is the owner of 18 Tompkins Avenue (89.20-2-24)
(“Property”); and
WHEREAS, pursuant to section 88-8 of the Village of Ossining Code (“Code”) the owner
was notified by the Building Department that overgrowth on the Property had to be
removed within 10 days of the notice; and
WHEREAS, the owner failed to remove the overgrowth; and
WHEREAS, pursuant to section 88-10 of the Code, the Village arranged to have the
overgrowth removed; and
WHEREAS, the overgrowth was removed by Diego’s Landscaping & Construction
Corp. on August 2, 2025 at the village’s request; and
WHEREAS, on August 28, 2025 the owner was sent a Notice of Proposed Assessment of
Costs and Notice of Hearing stating the total amount due was $230.40 consisting of the
invoice for the work performed ($192) plus a 20% administrative fee ($38.40);
WHEREAS, a hearing was conducted on September 30, 2025; and
WHEREAS, the Board of Trustees determined that the itemized costs noted below were
just and reasonable; now therefore be it
RESOLVED, that if the amount so assessed is not paid within thirty (30) days after the
assessment by this board an action to recover the amount assessed may be maintained by
the Village against the property owner, or a special warrant may be issued by the board
for the collection of such assessment of the amount thereof to be included in the next
annual tax levy.

I. Public Hearing-Proposed Local Law -2025 amending chapter 270 (Zoning – T zoning
district).
RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a
Public Hearing to take place at 7:30 pm on October 15, 2025 at the Birdsall Fagan Police-
Court Facility, 86-88 Spring Street, Ossining, New York and via Zoom, to consider
proposed Local Law -2025, amending chapter 270 (Zoning – T zoning district); and be it
further
RESOLVED, that the proposed local law would add a new Article XXI, Moratorium in
the T (Two-family) zoning district; and be it further
RESOLVED, that the purpose of the proposed local law is to temporarily suspend the
processing or approval of applications for conditional use permits pursuant to section
270-51 of the Village Code in the T zoning district; and be it further
RESOLVED, that members of the public are invited to attend the public hearing in-
person at the above-referenced location; and be it further
RESOLVED, that those members of the public requiring a reasonable accommodation to
participate in the public hearing due to that person’s disability, shall notify the
Corporation Counsel no later than seven (7) days before the public hearing
(kahan@villageofossiningny.gov) to afford the village sufficient time to provide the
reasonable accommodation; and be it further
RESOLVED, that for those members of the public who want to attend/participate in the
public hearing remotely, access will be available via the Zoom platform; and be it further
RESOLVED, that comments regarding the proposed local law will be accepted by the
Board of Trustees at BOT@villageofossiningny.gov.

Chapter 270 (T zone moratorium)
J. Village Clerk- 2026 Fee Schedule (Train Station Parking Permits)
WHEREAS, the Village Clerk intends to send out 2026 renewal applications for train
station parking on or about October 15, 2025; and
WHEREAS, the Village Board of Trustees and the Village Clerk discussed adjustments
to the 2026 train station parking permit fees at the September 24 work session; now
therefore be it
RESOLVED, that the 2026 railroad station annual parking permit fees will be:
Village of Ossining residents $500
Town of Ossining residents $625
Non-residents $1,250
K. Village Manager- Professional engineering and wetland consulting services
WHEREAS, among the consulting services reviewed by the Board of Trustees and village
staff on a triennial basis are engineering and wetland consulting services; and
WHEREAS, on August 18, 2025 following authorization by the Board of Trustees, the
village issued a Request for Qualifications (RFQ) to interested engineering firms to
provide engineering and wetland consulting services to the village; and
WHEREAS, responses to the RFQ were received and reviewed; and
WHEREAS, the Village Engineer and village staff discussed their recommendations with

the Board of Trustees at the September 24 work session; now therefore be it
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign an agreement with KSCJ Consulting, 500 Main Street, Armonk, New
York 10504 for KSCJ Consulting to provide professional engineering and consulting
services to the village in accord with the RFQ and the proposal dated September 11,
2025; and be it further
RESOLVED, that the term of the agreement will be three years commencing on October
1, 2025 and concluding on September 30, 2028.
L. Village Manager- Construction Management Services
WHEREAS, on December 4, 2024, the Board of Trustees adopted a resolution
authorizing the Village Manager to issue a Request for Proposals (RFP) for Construction
Management Services; and
WHEREAS, the village subsequently issued an RFP for construction management
services, village-wide capital projects; and
WHEREAS, village staff, including the Village Engineer received and reviewed
submissions; and
WHEREAS, at the September 24, 2025 work session, the Village Engineer and Village
Manager presented their recommendation for a firm to provide the desired construction
management services; now therefore be it
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign an agreement with Calgi Construction Company, Inc., 56 Lafayette
Avenue, Suite 360, White Plains, New York 10603 in accord with the village’s Request
for Proposals.
M. DPW – Authorization to Advertise for Bids –Route 9 Road Diet
RESOLVED, that following review by the Corporation Counsel, the Village Clerk is
authorized to advertise for bids for Contract DPW-25-09, Route 9 Road Diet, such bids
to be returnable to the Village Clerk.
N. Village Manager- Agreement with KSCJ Consulting (136-140 Croton Avenue)
WHEREAS, on August 13, 2025, the Board of Trustees adopted a resolution authorizing
the Village Manager to sign an agreement with KSCJ Consulting (Kellard Sessions
Consulting Engineering & Landscape Architecture Planning, D.P.C.) (“KSCJ”) to
provide construction management and inspection services on behalf of the village for the
development of Crescent Manor located at 136-140 Croton Avenue, such agreement to be
based upon the terms in the KSCJ June 2, 2025 proposal; and
WHEREAS, subsequent to the adoption of the resolution and following discussions
between KSCJ and village staff including the Village Engineer and KSCJ’s review of the
developer’s construction cost estimate, KSCJ presented a revised proposal to provide
construction oversight and inspection services on the village’s behalf necessary to oversee
the development of the Crescent Manor site; now therefore be it
RESOLVED, that following review by the Corporation Counsel, the Village Manager or
her designee is authorized to sign the September 24, 2025 proposal with an estimated cost
of services of $30,000; and be it further
RESOLVED, that the aforementioned August 13, 2025 resolution is recalled and of no
force and effect.

A. Police Department- Westchester County Mutual Aid and Rapid Response Plan

RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign an Inter-Municipal Agreement with the County of Westchester
(“Agreement”) for the village’s participation in the Mutual Aid and Rapid Response
Plan for the Police Departments of Westchester County; and be it further
RESOLVED, that the term of the Inter-Municipal Agreement will be from July 31, 2025
until July 30, 2030 unless terminated sooner in accordance with the provisions in the
Agreement.
