WHEREAS, tax certiorari proceedings were instituted against the Assessor, the Board of Assessors and the Board of Assessment Review of the Town of Ossining and the Town of Ossining by Terraces on the Hudson against Petitioner’s property situated at 217 North Highland Avenue in the Village of Ossining and designated by the following section, block and lot number: 89.10-1-2.1 for the 2022/2023-2025/2026 assessment years under index numbers 64990/2022, 66975/2023, 72790/2024 and 72436/2025; and WHEREAS, the Village of Ossining ceased being a tax assessing unit in 1989 and now adopts the Town of Ossining Assessment Roll for the Village of Ossining as prepared by the Assessor of the Town of Ossining for all subsequent years; and WHEREAS, on December 17, 2025 a Consent Judgment was entered in favor of the Petitioner Terraces on the Hudson noting that the assessment on the Petitioner’s property be reduced, corrected and fixed for the assessment years, as set forth in Schedule “A” annexed hereto; and WHEREAS, the aforesaid Consent Judgment, among other things, directs, “the officer or officers having custody of the assessment rolls upon which the above-mentioned assessments and any taxes levied thereon are entered shall correct the said entry in conformity with this Order and shall note upon the margin of said rolls, opposite of said entries, that the same has been corrected by authority of this Order”; and Legislative Meeting March 4, 2026 Page 4 of 12 WHEREAS, that the Consent Judgment further provides, “there shall be audited, allowed, and paid to the Petitioner by the VILLAGE OF OSSINING, the amount, of all Village taxes paid by the Petitioner as taxes against the said erroneous assessments in excess of what the taxes would have been if the said assessments made in the aforesaid years had been determined by this Order together with interest thereon from the date of payment thereof as provided by statute”; and WHEREAS, that the Consent Judgment further provides, “that all tax refunds are to be paid with interest pursuant to section 726 of the Real Property Tax Law of the State of New York, except that in the event the refund of taxes is paid within sixty (60) days from the date of service of a copy of this judgment with Notice of Entry, together with proof of payment on the Westchester County Commissioner of Finance, then interest is waived; together with the amounts of interest and penalties, if any, paid on the excess of any of the aforesaid taxes by reason of delinquent payment”; and WHEREAS, the Consent Judgment with notice of entry was allegedly served upon the Village of Ossining by Petitioner on or about December 18, 2025 by mailing the consent judgment to the following address: Town Attorney, Village of Ossining, Village Hall, 16 Croton Avenue, Ossining, New York 10562; and WHEREAS, neither the Treasurer of the Village of Ossining nor the village’s Corporation Counsel received a copy of the order with notice of entry; and WHEREAS, tax refunds are to be made payable to Cullen & Dykman, LLP, as attorneys for the Petitioner, 333 Earle Ovington Boulevard, Uniondale, New York 11553, who are to hold the proceeds as trust funds for appropriate distribution and who are to remain subject to the further jurisdiction of the court in regard to their attorney’s lien pursuant to section 475 of the Judiciary Law; now therefore be it RESOLVED that the Board of Trustees of the Village of Ossining upon certification by the Village Treasurer that all of the aforesaid taxes have been paid, hereby authorizes and directs the Village Treasurer to make the payment of such refund of real property taxes due to Terraces on the Hudson to Cullen & Dykman, LLP for the benefit of Terraces on the Hudson. as required by said Consent Judgment; and be it further RESOLVED that the Village Treasurer is authorized to make the aforesaid payment so the Village may avoid the payment of any penalties; and be it further RESOLVED that the Village Treasurer shall make a notation in the margin of the Assessment Rolls of the Village of Ossining that said assessments were reduced and payment of a refund of the overpayment of real property taxes was made pursuant to said Judgment. Finance Department- Authorization of small claim assessment review payment for 2025/2026 assessment year. WHEREAS, a Small Claim Assessment Review (SCAR) proceeding was commenced in the Supreme Court of the State of New York, County of Westchester against the Town of Ossining by the following property owner for the 2025/2026 Assessment Year: Noah Goodman Davis, 55 Sherwood Avenue (89.12-4-88), Index Number 94663/2025 and WHEREAS, the Village of Ossining ceased being a tax assessing unit in 1989 and now adopts the Town of Ossining Assessment Roll for the Village of Ossining correcting, fixing and reducing the assessed valuations of the aforesaid properties and improvements situated thereon, as set forth in Schedule “A”, annexed hereto; and WHEREAS, the above-referenced SCAR proceeding was resolved by stipulation approved by the presiding Judicial Hearing Officers; and WHEREAS, pursuant to the stipulation, “the municipal officials having custody of the assessment rolls shall correct the assessment roll to conform to this Stipulation. If any taxes were paid based on the “reduced from” assessment indicated above, a refund of the taxes paid on the amount of the reduction of the above-mentioned assessment shall be made to the Petitioner…” NOW THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Ossining, upon certification by the Village Treasurer that all of the aforesaid taxes have been paid, hereby authorizes and directs the Village Treasurer to make such refund of real property taxes to the petitioners listed above; and be it further RESOLVED, that the Village Treasurer is authorized to make the aforesaid payments so that the Village may avoid the payment of any penalties; and be it further RESOLVED, that a notation shall be made in the margin of the Assessment Roll that the said assessments were reduced and that payment of refunds for the overpayment of real property taxes was made pursuant to the stipulations. Board of Trustees- Denial of request for a hardship exception WHEREAS, US Help Inc. (US Help), 980 King Street, Chappaqua, New York is the owner of 50 North Malcolm Street; and WHEREAS, 50 North Malcolm Street is in the village’s T (two-family) zoning district; and WHEREAS, on November 5, 2025 the Board of Trustees adopted Local Law 7-2025, “Moratorium in the T (Two-family) zoning district” which local law is codified as article XXI of chapter 270 (zoning) of the Village Code; and WHEREAS, section 270-108, Purpose, states, “The purpose of this article is to suspend temporarily the processing or approval of applications for conditional use permits pursuant to section 270-51 in the Village’s T (Two-family) zoning district. This temporary suspension is intended to provide the Village with the time and opportunity to consider potential changes to its zoning and land use regulations in the T zoning district while preserving the status quo. For the T zoning district, the following uses are identified as requiring a conditional use permit: cemeteries, parking uses-nonaccessory, educational uses-elementary or secondary, educational uses- higher learning, places of worship, senior living facilities and home occupation, major” and Legislative Meeting March 4, 2026 Page 6 of 12 WHEREAS, the moratorium is effective as of November 13, 2025 and expires on July 13, 2026, although the Board of Trustees may extend the moratorium for four additional months; and WHEREAS, during the moratorium the Planning Board, Zoning Board of Appeals and Building Department are prohibited from accepting or reviewing applications and issuing permits relating to conditional uses in the T zoning district; and WHEREAS, section 270-112 identifies the process whereby an applicant can request a hardship exception from the Board of Trustees allowing for a variance from strict compliance with article XXI; and WHEREAS, on January 22, 2026, US Help submitted a letter to the Board of Trustees requesting a hardship exception pursuant to section 270-112; and WHEREAS, in the January 22 letter, Dr. Syed Nayeem, US Help’s vice-president wrote in part:  Our organization acquired 50 North Malcolm Street in September 2025.This Property used to operate as a Methodist Church with a 501(c)3 designation and tax-exempt status, but had not been offering formal services for some time.  We are very happy to have a place of worship for the Muslim community in the Village and Town of Ossining.There are approximately 45 to 50 Muslim families who live within 3 to 4 miles distance from this place of worship.In the past they have been praying in a rented hall, but have long outgrown that space-it is too small, and can accommodate approximately 30 persons with only one bathroom total for both men and women, and only four formal parking spots.  Our holy month of Ramadan is commencing on February 17, 2026 and we are in need of a more suitable place of worship.There is no other place of worship within approximately 10 miles for the Muslim families of Ossining.  We are requesting the village of Ossining to consider our request for hardship exemption because of the fast-approaching month of Ramadan and the information above; and WHEREAS, in response to US Help’s request to use the space at 50 North Malcolm Street on specified days and times during Ramadan, the Board of Trustees on February 18 adopted a resolution granting US Help’s request subject to conditions; and WHEREAS, following receipt of the January 22 letter the Board of Trustees, in accord with article XXI called for a public hearing on US Help’s application for a hardship exception; and WHEREAS, the public hearing was conducted on February 18, 2026 at which time the Board of Trustees heard from individuals residing near 50 North Malcolm Street; and WHEREAS, US Help’s application was discussed by the Board of Trustees at the February 25 work session; and WHEREAS, the Corporation Counsel reviewed with the Board of Trustees that pursuant to section 270-112A extraordinary hardship “shall not be considered: i) the mere concern that regulations may be changed or adopted or that the Village Code may be amended or ii) the mere delay in being permitted to make an application or waiting for a decision on the application for land use approval during the period of the moratorium imposed by this article”; and WHEREAS, the Board of Trustees concluded that the applicant failed to meet the requisite criteria for a hardship exception to the T zoning district moratorium; now therefore be it RESOLVED, that the application by US Help for a hardship exception to the T zoning district moratorium is denied. L. Board of Trustees- Adult-Use Cannabis Dispensaries- SEQR determination of significance, Negative Declaration Legislative Meeting March 4, 2026 Page 7 of 12 WHEREAS, the Village Board of Trustees of the Village of Ossining, located in Westchester County, New York, is proposing zoning amendments which would permit adult-use cannabis retail dispensaries (the “proposed action”); and WHEREAS, the proposed project is located within all districts of the Village of Ossining; and (hereinafter referred to as the “Area”); and WHEREAS, the proposed action involves zoning amendments which would permit establishments that focus on adult-use cannabis retail dispensaries, vape shops, smoke shops, and cannabis paraphernalia shops; and WHEREAS, adult-use cannabis retail dispensaries will likely operate similarly to a commercial business and, in the Village, should be viewed akin to a commercial use; and WHEREAS, the proposed zoning amendments adds new definitions for, Adult-Use Cannabis Retail Dispensary, and Vape Shops, Smoke Shops, and Cannabis and Smoke Paraphernalia shops, and supplemental regulations related to this use, with the use being allowed only where authorized under the Village’s zoning regulations, and ensures consistency with the licensing framework established by the New York State Cannabis Control Board; and WHEREAS, pursuant to 6 NYCRR Part 617.2(al), the Proposed Action is classified as a Type I Action; and NOW THEREFORE BE IT RESOLVED, the Village Board finds that pursuant to Article 8 of the State Environmental Conservation Law and 6 NYCRR Part 617, and based upon the review of the EAF Parts I, and II, all application materials, required referrals, and consultant reports that were prepared for this action, the Village Board adopts a Negative Declaration in connection with the Project; and BE IT FINALLY RESOLVED, that this SEQRA Negative Declaration resolution shall have an effective date of February 18, 2026. ATTACHMENT TO AND FORMING A PART OF NEGATIVE DECLARATION: Adult-Use Cannabis Retail Dispensaries Regulations within the Chapter 270 Zoning of the Village of Ossining Code, Village of Ossining REASONS SUPPORTING THIS DETERMINATION - DISCUSSION OF AREAS OF POTENTIAL IMPACTS IDENTIFIED BY THE VILLAGE BOARD AS LEAD AGENCY Reasons Supporting the Negative Declaration: The proposed action is for zoning amendments, which would permit adult-use cannabis retail dispensary establishments and Vape Shops, Smoke Shops, and Cannabis and Smoke Paraphernalia shops only where authorized under the Village’s zoning regulations. Based upon review of the local law, comments by the Board’s professionals and the public made in the course of the public hearing process, and review of the Part I, Part II EAF and supplementary materials, it has been determined that the proposed action will not result in any significant adverse environmental impact. 1. IMPACT ON LAND The Proposed Action will not have a significant adverse environmental impact with respect to the construction on, or physical alteration of, the land surface of the proposed site. However, the zoning amendment enables future applications for cannabis retail and vape shops, smoke shops, and cannabis and smoke paraphernalia shops, but does not authorize construction or site disturbance. This is no different from similar facilities already permitted in the area, which are not known to have any adverse impacts on the land. The Village Board therefore finds that the action will not result in any potential significant adverse environmental impacts on land. 2. IMPACTS ON SURFACE AND GROUND WATER Legislative Meeting March 4, 2026 Page 8 of 12 The Proposed Action will not have a significant adverse environmental impact on any wetlands or other surface water bodies. The Proposed Action will not result in the alteration of, or encroachment into any existing stream, wetland, or water body. The Proposed Action will not create any new water body and will not result in an increase or decrease of the surface area of any body of water. There will be no dredging throughout the proposed area. The Proposed Action will not include construction of any intake for withdrawal of water from surface water, or the construction of any outfall for discharge of wastewater to surface water. The Proposed Action will not have a significant adverse environmental impact with respect to new or additional use of groundwater and will not have a significant adverse environmental impact with respect to the introduction of contaminants to groundwater or an aquifer. The Proposed Action will not require new water supply wells or septic systems. Land uses of this type are not associated with the discharge of contaminants into aquifers or other groundwater sources. The Proposed Action does not include or require wastewater discharged to groundwater. The Proposed Action will not affect the water quality of any water bodies within or downstream of the Site. The Village Board therefore finds that the action will not result in any potential significant adverse environmental impacts on surface water. 3. IMPACT ON FLOODING The Proposed Action will not have a significant adverse environmental impact with respect to drainage or the development of lands subject to flooding. The zoning amendments will not result in development in a designated floodway, a 100-year floodplain or a 500-year floodplain, or steep slopes. However, actions permitted under the zoning amendment have the potential to be developed in these areas, as they are present in the zoning district. While cannabis retail and vape shops, smoke shops, and cannabis and smoke paraphernalia shops could theoretically be proposed in mapped floodplain areas, any such proposal would undergo separate site-specific environmental and engineering review. The legislative action itself does not result in development. The Village Board finds that the action will not result in any potential significant adverse environmental impacts on flooding. 4. IMPACT ON PLANTS AND ANIMALS The Proposed Action will not have a significant adverse environmental impact with respect to the loss of flora or fauna. The action will not cause a significant reduction in the population or the loss of any threatened or endangered species listed by New York State or the Federal government. The action will not result in a reduction or degradation of any habitat used by any rare, threatened or endangered species, as listed by New York State or the Federal government, as the Project area is not a habitat for such species. The Village Board therefore finds that the action will not result in any potential significant adverse environmental impacts on plants and animals. 5. IMPACT ON TRANSPORTATION The Proposed Action will not have a significant adverse environmental impact with respect to infrastructure for mass transit, biking, or walkways. While cannabis retail and vape shops, smoke shops, and cannabis and smoke paraphernalia shops, if established, may theoretically contribute to additional traffic, any such proposal would undergo separate site-specific environmental and engineering review. The proposed project will not result in existing levels of traffic or other means of transportation and does not propose any new transportation infrastructure. The Village Board therefore finds that the action will not result in any potential significant adverse environmental impacts on transportation. Legislative Meeting March 4, 2026 Page 9 of 12 6. IMPACT ON HUMAN HEALTH The Proposed Action will not have a significant adverse environmental impact on human health from exposure to new or existing sources of contaminants. The Village Board therefore finds that the action will not result in any potential significant adverse environmental impacts on Human Health. 1. IMPACT ON AESTHETIC, HISTORIC, AND ARCHAEOLOGICAL RESOURCES The Proposed Action will not have a significant adverse environmental impact on any historic or archaeological resources. However, the proposed area to be affected contains multiple eligible Historic Sites and areas nominated by the NYS Board of Historic Preservation for inclusion on the State or National Register of Historic Places. Because the action is legislative and does not involve physical alteration, no impact to historic or archaeological resources will occur. Nay future proposals will require a site specific SEQR review. The Village Board therefore finds that the action will not result in any potential significant adverse environmental impacts on aesthetic, historic, and archaeological resources. 2. IMPACT ON PLANNING AND ZONING AND CONSISTENCY WITH COMMUNITY CHARACTER The Proposed Action will not have a significant adverse environmental impact because it is consistent with the Village’s adopted land use plans and similar permitted and conditional uses in the districts. The Proposed Action does have potential to be supported by existing infrastructure and no secondary development impacts are proposed; however, some degree of future site-specific development is possible. Any such proposal would undergo separate review under SEQRA. The Proposed Action will not have a significant adverse environmental impact upon community services. The Proposed Action will not replace or eliminate existing facilities, structures, areas of historic importance to the community, or create significant adverse demand for additional community services. The Village’s current community services have the capacity to meet the needs of the Proposed Action. 1. IMPACT ON CRITICAL ENVIRONMENTAL AREAS The project site is located in the Hudson River Critical Environmental Area (“CEA”). The Proposed Action will not have a significant adverse impact on the CEA. The action does not modify land, structures, or natural features within the CEA. There is open space designated by the Village of Ossining in the action area, however no impacts are expected. Other Impacts. No other potentially significant adverse impacts were identified. M. Board of Trustees- Adoption of Local Law 1-2026, “A Local Law amending Chapter 270 (Zoning) of the Village of Ossining Code” WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been considering the adoption of Local Law -2026, titled, “A Local Law amending Chapter 270 (Zoning)” by adding new definitions for adult-use cannabis retail dispensary, public youth facility and vape shops, smoke shops and cannabis and vape paraphernalia shops; amending additional standards for use groups for adult-use cannabis retail dispensaries and vape shops, smoke shops and cannabis and vape paraphernalia shops; and amending use tables and parking tables; and WHEREAS, pursuant to section 270-59, the proposed changes to chapter 270 were referred to the Village of Ossining Planning Board and a response was provided; and WHEREAS, the proposed amendments were referred to the Westchester County Planning Board and a response was provided; and Legislative Meeting March 4, 2026 Page 10 of 12 WHEREAS, a public hearing on the proposed local law was held on February 18, 2026 and members of the public were able to participate both in person and via the Zoom platform as well as by submitting written communication to the Board of Trustees; and WHEREAS, the public hearing was closed on February 18, 2026; and WHEREAS, there are no impediments to adopting this local law; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts this local law as Local Law 1-2026 and directs that said Local Law be filed and/or distributed in accord with applicable law; and be it further RESOLVED, that pursuant to New York Village Law section 7-706(5), the text of Local Law 1-2026 shall be entered in the minutes of the Village Board; and be it further RESOLVED, that Local Law 1-2026 shall become effective upon filing of this local law with the Secretary of State pursuant to section 27 of the Municipal Home Rule Law.
