D. Board of Trustees- Adult-Use Cannabis Dispensaries- SEQR determination of
significance, Negative Declaration
WHEREAS, the Village Board of Trustees of the Village of Ossining, located in
Westchester County, New York, is proposing zoning amendments which would permit
adult-use cannabis retail dispensaries (the “proposed action”); and
WHEREAS, the proposed project is located within all districts of the Village of Ossining;
and (hereinafter referred to as the “Area”); and
WHEREAS, the proposed action involves zoning amendments which would permit
establishments that focus on adult-use cannabis retail dispensaries, vape shops, smoke
shops, and cannabis paraphernalia shops; and
WHEREAS, adult-use cannabis retail dispensaries will likely operate similarly to a
commercial business and, in the Village, should be viewed akin to a commercial use; and
WHEREAS, the proposed zoning amendments adds new definitions for, Adult-Use
Cannabis Retail Dispensary, and Vape Shops, Smoke Shops, and Cannabis and Smoke
Paraphernalia shops, and supplemental regulations related to this use, with the use being
allowed only where authorized under the Village’s zoning regulations, and ensures
consistency with the licensing framework established by the New York State Cannabis
Control Board; and
WHEREAS, pursuant to 6 NYCRR Part 617.2(al), the Proposed Action is classified as a
Type I Action; and
NOW THEREFORE BE IT RESOLVED, the Village Board finds that pursuant to
Article 8 of the State Environmental Conservation Law and 6 NYCRR Part 617, and
based upon the review of the EAF Parts I, and II, all application materials, required
referrals, and consultant reports that were prepared for this action, the Village Board
adopts a Negative Declaration in connection with the Project; and
BE IT FINALLY RESOLVED, that this SEQRA Negative Declaration resolution shall
have an effective date of April 22, 2026.

Adult-Use Cannabis Retail Dispensaries Regulations within the Chapter 270 Zoning of
the Village of Ossining Code, Village of Ossining
REASONS SUPPORTING THIS DETERMINATION - DISCUSSION OF AREAS OF
POTENTIAL IMPACTS IDENTIFIED BY THE VILLAGE BOARD AS LEAD
AGENCY
Reasons Supporting the Negative Declaration:
The proposed action is for zoning amendments, which would permit adult-use cannabis
retail dispensary establishments and Vape Shops, Smoke Shops, and Cannabis and
Smoke Paraphernalia shops only where authorized under the Village’s zoning
regulations. Based upon review of the local law, comments by the Board’s professionals
and the public made in the course of the public hearing process, and review of the Part I,
Part II EAF and supplementary materials, it has been determined that the proposed
action will not result in any significant adverse environmental impact.
1. IMPACT ON LAND
The Proposed Action will not have a significant adverse environmental impact

with respect to the construction on, or physical alteration of, the land surface of
the proposed site. However, the zoning amendment enables future applications for
cannabis retail and vape shops, smoke shops, and cannabis and smoke
paraphernalia shops, but does not authorize construction or site disturbance. This
is no different from similar facilities already permitted in the area, which are not
known to have any adverse impacts on the land.
The Village Board therefore finds that the action will not result in any potential
significant adverse environmental impacts on land.
2. IMPACTS ON SURFACE AND GROUND WATER
The Proposed Action will not have a significant adverse environmental impact on
any wetlands or other surface water bodies. The Proposed Action will not result in
the alteration of, or encroachment into any existing stream, wetland, or water
body. The Proposed Action will not create any new water body and will not result
in an increase or decrease of the surface area of any body of water. There will be
no dredging throughout the proposed area. The Proposed Action will not include
construction of any intake for withdrawal of water from surface water, or the
construction of any outfall for discharge of wastewater to surface water.
The Proposed Action will not have a significant adverse environmental impact
with respect to new or additional use of groundwater and will not have a
significant adverse environmental impact with respect to the introduction of
contaminants to groundwater or an aquifer. The Proposed Action will not require
new water supply wells or septic systems.
Land uses of this type are not associated with the discharge of contaminants into
aquifers or other groundwater sources. The Proposed Action does not include or
require wastewater discharged to groundwater. The Proposed Action will not
affect the water quality of any water bodies within or downstream of the Site.
The Village Board therefore finds that the action will not result in any potential
significant adverse environmental impacts on surface water.
3. IMPACT ON FLOODING
The Proposed Action will not have a significant adverse environmental impact
with respect to drainage or the development of lands subject to flooding. The
zoning amendments will not result in development in a designated floodway, a
100-year floodplain or a 500-year floodplain, or steep slopes. However, actions
permitted under the zoning amendment have the potential to be developed in
these areas, as they are present in the zoning district. While cannabis retail and
vape shops, smoke shops, and cannabis and smoke paraphernalia shops could
theoretically be proposed in mapped floodplain areas, any such proposal would
undergo separate site-specific environmental and engineering review. The
legislative action itself does not result in development.
The Village Board finds that the action will not result in any potential significant
adverse environmental impacts on flooding.
4. IMPACT ON PLANTS AND ANIMALS
The Proposed Action will not have a significant adverse environmental impact
with respect to the loss of flora or fauna. The action will not cause a significant
reduction in the population or the loss of any threatened or endangered species
listed by New York State or the Federal government. The action will not result in
a reduction or degradation of any habitat used by any rare, threatened or
endangered species, as listed by New York State or the Federal government, as the
Project area is not a habitat for such species.
The Village Board therefore finds that the action will not result in any potential
significant adverse environmental impacts on plants and animals.
5. IMPACT ON TRANSPORTATION
The Proposed Action will not have a significant adverse environmental impact

with respect to infrastructure for mass transit, biking, or walkways. While
cannabis retail and vape shops, smoke shops, and cannabis and smoke
paraphernalia shops, if established, may theoretically contribute to additional
traffic, any such proposal would undergo separate site-specific environmental and
engineering review.
The proposed project will not result in existing levels of traffic or other means of
transportation and does not propose any new transportation infrastructure.
The Village Board therefore finds that the action will not result in any potential
significant adverse environmental impacts on transportation.
6. IMPACT ON HUMAN HEALTH
The Proposed Action will not have a significant adverse environmental impact on
human health from exposure to new or existing sources of contaminants.
The Village Board therefore finds that the action will not result in any potential
significant adverse environmental impacts on Human Health.
7. IMPACT ON AESTHETIC, HISTORIC, AND ARCHAEOLOGICAL
RESOURCES
The Proposed Action will not have a significant adverse environmental impact on
any historic or archaeological resources. However, the proposed area to be
affected contains multiple eligible Historic Sites and areas nominated by the NYS
Board of Historic Preservation for inclusion on the State or National Register of
Historic Places. Because the action is legislative and does not involve physical
alteration, no impact to historic or archaeological resources will occur. Nay future
proposals will require a site specific SEQR review.
The Village Board therefore finds that the action will not result in any potential
significant adverse environmental impacts on aesthetic, historic, and
archaeological resources.
8. IMPACT ON PLANNING AND ZONING AND CONSISTENCY WITH
COMMUNITY CHARACTER
The Proposed Action will not have a significant adverse environmental impact
because it is consistent with the Village’s adopted land use plans and similar
permitted and conditional uses in the districts. The Proposed Action does have
potential to be supported by existing infrastructure and no secondary
development impacts are proposed; however, some degree of future site-specific
development is possible. Any such proposal would undergo separate review under
SEQRA.
The Proposed Action will not have a significant adverse environmental impact
upon community services. The Proposed Action will not replace or eliminate
existing facilities, structures, areas of historic importance to the community, or
create significant adverse demand for additional community services. The
Village’s current community services have the capacity to meet the needs of the
Proposed Action.
9. IMPACT ON CRITICAL ENVIRONMENTAL AREAS
The project site is located in the Hudson River Critical Environmental Area
(“CEA”). The Proposed Action will not have a significant adverse impact on the
CEA. The action does not modify land, structures, or natural features within the
CEA. There is open space designated by the Village of Ossining in the action area,
however no impacts are expected.
Other Impacts. No other potentially significant adverse impacts were identified.
E. Board of Trustees- Adoption of Local Law 4-2026, “A Local Law amending Chapter 270
(Zoning) of the Village of Ossining Code”

WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been
considering the adoption of Local Law -2026, titled, “A Local Law amending Chapter
270 (Zoning)” by adding article XXII, Temporary moratorium on Battery Energy
Storage Systems; and
WHEREAS, pursuant to section 270-59, the proposed changes to chapter 270 were
referred to the Village of Ossining Planning Board and a response was provided; and
WHEREAS, the proposed amendments were referred to the Westchester County
Planning Board and a response was provided; and
WHEREAS, a public hearing on the proposed local law was held on March 18, 2026 and
members of the public were able to participate both in person and via the Zoom platform
as well as by submitting written communication to the Board of Trustees; and
WHEREAS, the public hearing was closed on March 18, 2026; and
WHEREAS, the proposed local law is a Type II action under the State Environmental
Quality Review Act pursuant to 6 NYCRR 617.5(b)(36) (“adoption of a moratorium on
land development or construction”); and
WHEREAS, there are no impediments to adopting this local law; now therefore be it
RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts this
local law as Local Law 4-2026 and directs that said Local Law be filed and/or distributed
in accord with applicable law; and be it further
RESOLVED, that pursuant to New York Village Law section 7-706(5), the text of Local
Law 1-2026 shall be entered in the minutes of the Village Board; and be it further
RESOLVED, that Local Law 4-2026 shall become effective upon filing of this local law
with the Secretary of State pursuant to section 27 of the Municipal Home Rule Law.
Chapter 270 (BESS moratorium) (Revised with hardship and definitions)
F. Board of Trustees- Adoption of Local Law 5-2026, “A Local Law amending Chapter 270
(Zoning) of the Village of Ossining Code”
WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been
considering the adoption of Local Law -2026, titled, “A Local Law amending Chapter
270 (Zoning)” by adding new definitions for adult-use cannabis retail dispensary, public
youth facility and vape shops, smoke shops and cannabis and vape paraphernalia shops;
amending additional standards for use groups for adult-use cannabis retail dispensaries
and vape shops, smoke shops and cannabis and vape paraphernalia shops; and amending
use tables and parking tables; and
WHEREAS, pursuant to section 270-59, the proposed changes to chapter 270 were
referred to the Village of Ossining Planning Board and a response was provided; and
WHEREAS, the proposed amendments were referred to the Westchester County
Planning Board and a response was provided; and
WHEREAS, a public hearing on the proposed local law was held on April 8, 2026 and
members of the public were able to participate both in person and via the Zoom platform
as well as by submitting written communication to the Board of Trustees; and

G. Department of Recreation and Parks- Authorize elevator service agreement
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign the April 3, 2026 proposal from TK Elevator Corporation, 11 Oval
Drive, Suite 174, Islandia, New York to maintain the elevator at the community center;
and be it further
RESOLVED, that the proposal is for a term of sixty months which can be renewed for
successive sixty-month periods; and be it further
RESOLVED, that the initial price for the service agreement will be $436 per month plus
an additional charge of $14 per month for the digital service package associated with the
proposal.

H. Department of Public Works- Engineering Planning Grant
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to execute an Engineering Planning Grant (EPG) Agreement with the New
York State Environmental Facilities Corporation (NYS EFC) and any other contracts,
documents and/or instruments necessary to facilitate the EPG project referenced herein
and to fulfill the Village of Ossining’s obligations thereunder; and be it further
RESOLVED, the Village of Ossining Board of Trustees hereby authorizes and
appropriates a minimum 20% local match as required by the Engineering Planning
Grant Program for the Stormwater Infiltration and Inflow Evaluation in the amount of
$10,000 and based upon the total EPG Grant award of $50,000; and be it further
RESOLVED, the source of the local match, and any amount in excess of the required
match, shall be provided by General Fund balance.
I. Board of Trustees-Authorizing the implementation, and funding in the first instance
100% of the federal-aid eligible costs, of a transportation federal-aid project, and
appropriating funds therefore (Supplemental Agreement No. 1 to D040906)
WHEREAS, a Project for the Route 9 Safety Enhancements: Cedar Lane to Cedar Place,
Village of Ossining, Westchester County, PIN 8763.06 (formerly known as the Route 9
Road Diet) (the “Project") is eligible for funding under Title 23 U.S. Code, as amended,
that calls for the apportionment of the costs such program to be borne at the ratio of
80% Federal funds and 20% non-federal funds; and
WHEREAS, the Village of Ossining Board of Trustees adopted a resolution on April 4,
2023approving and agreeing to advance the Project by making a commitment of 100% of
the non-federal share of the costs of Preliminary Engineering work; and
WHEREAS, it subsequently was found necessary to undertake additional preliminary
engineering work not contemplated in the original agreement authorized by the previous
resolution; and
WHEREAS, it has been found necessary to increase the federal and non-federal share of
costs for the additional preliminary engineering work for the project; and
WHEREAS, the Village of Ossining Board of Trustees continues to desire to advance the
Project by making a commitment of 100% of the non-federal share of the costs of
Preliminary Engineering; now therefore be it.

RESOLVED, that the Village of Ossining Board of Trustees hereby approves the above-
subject project including Supplemental Agreement No. 1 to D040906 (amending project
description, increasing finding for a project phase and adding a PIN extension); and it is
hereby further
RESOLVED, that the Village of Ossining Board of Trustees hereby authorizes the
Village of Ossining to pay in the first instance 100% of the federal and non-federal share
of the cost of Preliminary Engineeringwork for the Project or portions thereof; and it is
further
RESOLVED, that the sum of $50,000 ($444,000 minus the previous $394,000) is hereby
appropriated from fund balance and made available to cover the cost of participation in
the above phase of the Project; and it is further
RESOLVED, that in the event the full federal and non-federal share costs of the project
exceeds the amount appropriated above, the Village Board of Trustees shall convene as
soon as possible with the intention of appropriating said excess amount upon notification
by the Village Manager thereof; and it is further
RESOLVED, that the Village Manager of the Village of Ossining be and is hereby
authorized to execute all necessary Agreements, certifications or reimbursement requests
for Federal Aid and/or applicable Marchiselli Aid on behalf of the Village of Ossining
with the New York State Department of Transportation in connection with the
advancement or approval of the Project and providing for the administration of the
Project and the municipality's first instance funding of project costs and permanent
funding of the local share of federal-aid and state-aid eligible Project costs and all
Project costs within appropriations therefore that are not so eligible; and it is further
RESOLVED, that in addition to the Village Manager, the following municipal titles:
Village Engineer, Village Treasurer, and Corporation Counsel are also authorized to
execute any necessary Agreements or certifications on behalf of the
Municipality/Sponsor, with NYSDOT in connection with the advancement or approval of
the project identified in the State/Local Agreement; and be it further
RESOLVED, that a certified copy of this resolution be filed with the New York State
Commissioner of Transportation by attaching it to any necessary Agreement in
connection with the Project, and it is further
RESOLVED, this Resolution shall take effect immediately.
J. Board of Trustees- Public Hearing-Request for hardship exception to T-zoning district
moratorium.
WHEREAS, on November 5, 2025 the Board of Trustees adopted Local Law 5-2025
amending chapter 270 (Zoning) by adding a new article XXI (Moratorium in the T [Two-
family] Zoning District); and
WHEREAS, the purpose of the local law was to temporarily suspend the processing or
approval of applications for conditional use permits in the T (two-family) zoning district;
and
WHEREAS, the moratorium is scheduled to expire on July 13, 2026; and
WHEREAS, section 270-112 of the Village Code details the process for an applicant to
request an extraordinary hardship exception to the moratorium; and
WHEREAS, on or about March 16, 2026 the School for Adaptive and Integrative
Learning (SAIL) at Ferncliff Manor, Inc. and Ferncliff Manor, Inc. (“Ferncliff Manor”)
submitted an application for a hardship exception to the T-zoning district moratorium
relating to property at 25 North Malcolm Street; and
WHEREAS, section 270-112C requires a public hearing on any application for an
exception to the moratorium to be held no later than 45 days after receipt of a complete
application; and

WHEREAS, representatives from Ferncliff Manor appeared at the April 15, 2026 Board
of Trustees’ work session; and
WHEREAS, the application from Ferncliff Manor is considered to be complete; now
therefore be it
RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a
Public Hearing to take place at 7:30 pm on May 6, 2026 at the Birdsall Fagan Police-
Court Facility, 86-88 Spring Street, Ossining, New York and via Zoom, to consider the
application of Ferncliff Manor, 1154 Saw Mill River Road, Yonkers, New York for a
hardship exception to the T zoning district moratorium; and be it further
RESOLVED, that members of the public are invited to attend the public hearing in-
person at the above-referenced location; and be it further
RESOLVED, that those members of the public requiring a reasonable accommodation to
participate in the public hearing due to that person’s disability, shall notify the
Corporation Counsel no later than seven (7) days before the public hearing
(kahan@villageofossiningny.gov) to afford the village sufficient time to provide the
reasonable accommodation; and be it further
RESOLVED, that for those members of the public who want to attend/participate in the
public hearing remotely, access will be available via the Zoom platform; and be it further
RESOLVED, that comments regarding the application will be accepted by the Board of
Trustees at BOT@villageofossiningny.gov.

K. Board of Trustees- Authorizing Request for Proposals
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to issue a Request for Proposals for artists to design the public art scrim at
The Aqueduct Hub (Multi-modal Transportation Hub).
L. Board of Trustees- Application for Hardship Exception (Grand Peconic Ventures)
WHEREAS, on March 2, 2026, Grand Peconic Ventures LLC dba Green Panacea
(“Grand Peconic”) submitted an application pursuant to section 270-103 of the Village
Code for a hardship exception to the moratorium for submission and processing of land
use approvals for cannabis dispensaries, vape lounges, smoke shops, vape lounges and
vape consumption businesses; and
WHEREAS, a public hearing on Grand Peconic’s application was held on April 8, 2026
after which the public hearing was closed; and
WHEREAS, on April 22, 2026, the Board of Trustees adopted Local Law 5-2026, which
local law included standards applicable to adult-use cannabis retail dispensaries and
revised use and parking tables for such dispensaries; and
WHEREAS, pursuant to Local Law 5-2026, adult-use retail cannabis dispensaries will be
a permitted use in the VC (village center) zoning district where Grand Peconic is
proposing to operate (159 Main Street); and
WHEREAS, village code section 270-102B states, “In the event that any new local law
which addresses the substantive issues set forth herein, should be enacted and adopted by
the Board of Trustees prior to the date that the moratorium imposed herein expires, then
the moratorium shall expire on the date the new local law takes effect pursuant to section
27 of the Municipal Home Rule Law”; and
WHEREAS, the Village Clerk will forward Local Law 5-2026 to the Secretary of State
for filing in accord with the Municipal Home Rule Law; now therefore be it

RESOLVED, that in light of the adoption of Local Law 5-2026, Grand Peconic’s
application for a hardship exception is dismissed as moot.
M Finance – 2025 Budget Adjustments

WHEREAS, Village operating budgets for each fund, department, and item type (.10 personnel,
.20 equipment, and .40 contractual) for fiscal year-end 2025 are required to be balanced as of
December 31, 2025, now therefore be it
RESOLVED, the Adopted Budgets of the General, Water, Sewer, and Section 8 Funds are
modified in 2025 to appropriate unexpended appropriations, increased revenues, and/or
accumulated and available fund balance as follows:

N. Finance – 2025 Capital Budget Adjustment PJ 2332 “2024 Spring Street Lead Service Line
Replacement” and Close FY2025
WHEREAS, Village management wishes to adjust the revenue and expenditure budgets to
actual project costs of $135,782.40 for the 2024 Spring Street Lead Service Line Replacement
Capital Project 2332 with a transfer from Water Fund Balance of $21,682.40 to increase the
original project budget of $114,100, now therefore be it
RESOLVED, the following capital project and capital project budget is adjusted, as follows:
O. Finance – 2025 Adjustment of 2022 Improvements Joseph G. Caputo Community Center
Capital Project Inter-Project Transfers and Close
WHEREAS, Village management established a capital project in accordance with the
project resolution approved on May 18, 2022 to establish a capital project for various
improvements at the Joseph G. Caputo Community Center and adjusted the project to
$1,584,639 on April 4, 2023 the project budget requires an adjustment to $1,836,673.15 to

P. Finance – 2025 Capital Budget Establishment PJ 2376 “2025 Water Infra-Structure
Improvements”
WHEREAS, Village management wishes to establish the revenue and expenditure budgets for
the 2025 Water Infra-Structure Improvements project funded by a transfer from Water Fund
settlement revenues received of $1,431,630 to fund on-going water infra-structure
improvements, now therefore be it
RESOLVED, the following capital project and capital project budget is adjusted, as follows:

A. Board of Trustees- Authorizing the Village Manager to sign an agreement with

RESOLVED, that upon the review of the Corporation Counsel, the Village Manager is
authorized to sign a license agreement with Riverkeeper, Inc., 20 Secor Road, Ossining,
New York 10562 regarding the Riverkeeper Sweep planned for May 2, 2026 at Henry
Gourdine Park.
