CITY OF PALM COAST COUNCIL SPECIAL MEETING 160 LAKE AVENUE PALM COAST, FL 32164 TUESDAY, JULY 14, 2020 IMMEDIATELY FOLLOWING THE WORKSHOP Mayor Milissa Holland Vice Mayor Nick Klufas Council Member Eddie Branquinho Council Member Robert G. Cuff MINUTES City Staff Matthew Morton, City Manager William Reischmann, City Attorney Virginia A. Smith, City Clerk A. CALL TO ORDER Mayor Holland called the meeting to order at 2:15 p.m. She read the permissions by the State to hold the meeting CMT/Virtually. B. PLEDGE OF ALLEGIANCE TO THE FLAG C. ROLL CALL City Clerk Virginia Smith called the roll. All members were present. D. DISCUSSION N 1. DISCUSSION ON COUNCIL VACANCY PROCEDURE Attorney Reischmann outlined the process per the City's Charter. The first step is to appoint a temporary position and their will need to be a special election in November 2020 for the District 2 seat. He stressed that he, the City Clerk and the Supervisor of Elections have been working closely. Virginia Clerk, City Clerk reviewed the process. She indicated that she would have advertisements in local newspaper tomorrow; the Supervisor of Election provided a list of Voters in District 2 and Citizens Academy graduates from District 2. The draft timeline was presented: July 24 Noon: the applications will be due. July 28: Council will provide a short list of the applications presented. August 4: Live interviews and select the appointment. Discussion included the appointment not running for the seat in November. It was the direction of Council to advertise in all media outlets. E. RESOLUTION 2. RESOLUTION 2020-72 CALLING FOR A SPECIAL ELECTION FOR VACANT DISTRICT 2 SEAT Attorney Reischmann reviewed the Special Election Resolution with Council. The election is on November 3, 2020. Qualifying Period will be August 31, 2020-noon on September 4. Petitions will be due August 24th at noon. Due to the pandemic, the change in the petition process was discussed. The number of petitions necessary is approximately 150. It was the consensus of Council to move forward with the petition process. The qualifying fee was discussed and it was the recommendation of Counsel to follow the Charter, which is to charge the entire fee. Public Comment No Comments were received Motion by Council Member Branquinho, seconded by Vice Mayor Klufas to approve Resolution 2020-72. The motion carried unanimously after a roll call vote. F. EMERGENCY ORDINANCE 3. EMERGENCY ORDINANCE 2020- 08 AMENDING ARTICLE IV, CITY COUNCIL OF THE CITY OF PALM COAST CHARTER REGARDING “QUALIFYING FOR OFFICE” AND ARTICLE VII, ELECTIONS, WITH LIMITED APPLICABILITY TO ESTABLISHMENT OF QUALIFYING DATES Attorney Reischmann read the title of the ordinance into the record. He gave a brief overview of the ordinance. Attorney Reischmann made it clear that any Emergency Ordinance requires four votes of the Council. Topics discussed included the length of the qualifying period; the qualifying period being a week period; and the Supervisor of Election’s input regarding the Special Election Qualifying Period. Public Comment. There were no comments received. Motion made by Council Member Cuff, seconded by Vice Mayor Klufas to approve Ordinance 2020-08. The motion carried unanimously after a roll call vote.
