MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 5:30 O’CLOCK P.M. August 12, 2008 HELD AT THE PAOLA PUBLIC WORKS BUILDING 29370 Old KC Road in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Councilmembers present: Mayor Stuteville, Council Members Pritchard, Dial, Rowlett, and Bell. Council Members absent: None Also present: Manager Wieland, Clerk Droste, Police Chief Smail, Planner Givens, Public Works Director Bieker, Catherine Odson with the Miami County Republic, Carol Everhart Executive Director of the Paola Chamber of Commerce, Chris Wheaton, Bettie Ore, Le Anne Shields, and Harold Achey. Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Dial, Rowlett, and Bell were all present. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS No one addressed the Council. Agenda Item 4 - CONSENT AGENDA a. Approval of minutes of the meetings of July 22 and August 5, 2008. b. Approval of Salary Ordinance number 08-15. c. Approval of Appropriation Ordinance No. 634. d. Journal Entries Report for the month of July, 2008. Councilmember Dial questioned expenditures for codes enforcement mowing and the payment to Justin Smail for furniture for the Justice Center. Councilmember Pritchard questioned invoices for pump repair for the Waste Water Treatment Plant, car detailing to New Century Dodge, training expense for Larry Kircher, and expenses for the concession stand at the swimming pool. After discussing the items in question, Councilmember Dial made a motion to approve the Consent Agenda including the minutes of the July 22 and August 5, 2008 meetings, Salary Paola City Council Minutes – August 12, 2008 Page 1 Ordinance No. 08-15, and Appropriation Ordinance No. 634, and the Journal Entries Report for July, 2008, and authorize the Mayor to sign. Councilmember Pritchard seconded the motion and all voted aye. The motion passed 4 to 0. Agenda Item 5 - REPORTS OF OFFICERS, BOARDS AND COMMITTEES Agenda Item 5a - Consider a request from the Kiwanis Club to waive the $60 Special Event Permit Fee. Clerk Droste presented a request from the Paola Kiwanis Club to waive the $60 special event permit fee for the Merriweather-Culpepper Circus that is planned for September 8th at Wallace Park. Chris Wheaton with the Paola Kiwanis Club addressed the Council explaining that the event was the primary fund raiser for the club and the funds were used to promote local educational programs in Paola. Councilmember Pritchard made a motion to approve the request to waive the $60 Special Event Permit Fee for the Kiwanis Club circus on September 8th. The motion was seconded by Councilmember Bell and all voted aye. The motion passed 4 to 0. Agenda Item 5b - Consider approval of pay estimate #8 for the Paola Justice Center. Manager Wieland presented pay estimate number 8 from Altmar, Inc. for the Paola Justice Center. He reported that many of the windows have been installed and good progress is being made on the interior construction. Councilmember Pritchard asked about several of the detailed items listed on the pay estimate. Manager Wieland and Clerk Droste explained the individual items and explained that the detail listed on each of the line items allows the architect to determine the percentage of completion for each stage of the project. After discussing the pay request, Councilmember Pritchard made a motion to approve pay estimate #8 in the amount of $283,329.26 to Altmar, Inc. for the Paola Justice Center. The motion was seconded by Councilmember Dial and all voted aye. The motion passed 4 to 0. Agenda Item 5c - Consider approval of pay estimate #1 for the Paola Community Center. Manager Wieland presented the first pay estimate from Legacy Contractors, LLC for the Community Center. He reported that the contractor is making very good progress on the project and is ahead of schedule. After discussing the pay request, Councilmember Dial made a motion to approve pay estimate #1 in the amount of $208,872.00 to Legacy Contractors, LLC. for the Paola Community Center. The motion was seconded by Councilmember Pritchard and all voted aye. The motion passed 4 to 0. Agenda Item 6 – NEW BUSINESS. Paola City Council Minutes – August 12, 2008 Page 2 Clerk Droste presented the City Sales Tax Report for July. He reported that total Sales Tax collections totaled $189,714 and reflects sales activity for the month of May which is the first month that the Federal stimulus payments were delivered to tax payers. Planner Givens thanked the Mayor and Council for their support as he reported that this would be his last City Council Meeting. Manager Wieland indicated that Mr. Givens had accepted the City Planner position for the City of Goddard near Wichita. The Mayor and Council thanked Planner Givens for his service to the City of Paola. Carol Everhart, Executive Director of the Paola Chamber of Commerce, announced that the first free music concert would be held on the Park Square this coming Saturday evening from 7:00 to 10:00 pm. Councilmember Pritchard reported that City employee picnic that was held last Friday was a very nice event and was well attended. Mayor Stuteville asked about the status of accepting credit cards at City Hall. Clerk Droste reported that progress on this service had taken a secondary priority to the budget process. He indicated that the providers have been notified that the credit card project would resume as soon as the budget process is complete. Clerk Droste also reported that the final test for the Automatic Payment program would be completed later this week, and if successful, the program will be offered to all utility customers. Agenda Item 7 – ADJOURNMENT. With no additional business to come before the Council, Councilmember Dial made a motion to adjourn. Councilmember Pritchard seconded the motion and all voted aye.
