MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. May 22, 2012 HELD AT THE PAOLA JUSTICE CENTER 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Councilmembers present: Mayor Stuteville and Council Members Pritchard, Wilhoite, and House. Council Members absent: Council Member Clouse. Also present: City Manager Wieland, City Clerk Droste, City Attorney Tetwiler, Police Chief Smail, City Planner Gotfredson, Richard Lentz, Carol Everhart, Bruce Cordle, Shirley Ferley, Wayne Johnson, Patsy Bortner, Callie Benton, Laurie Johnson, Brooke Douglass, Jamie Glenn, and Brian McCauley with the Miami County Republic. Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, and House were all present. Council Member Clouse was absent. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. Carol Everhart, Bruce Cordle, Shirley Ferley, and Wayne Johnson with the Paola Tourism Committee addressed the Council about recent activities and upcoming events sponsored by the Committee. Upcoming events include the Heartland Car Show on June 23rd, the Art & Wine Stroll on July 14, the Harvest Festival on October 27, and the Christmas Homes Tour on December 1st. Clint Meinig addressed the Council regarding the lack of a Family Season Pass for the Paola Family Pool. He provided information about family passes at other area pools. After a discussion, Mayor Stuteville indicated that the Council would discuss the issue in greater detail later in the meeting under New Business. Agenda Item 4 - CONSENT AGENDA a. Approval of minutes of the meeting of May 8, 2012. Paola City Council Minutes – May 22, 2012 Page 1  b. Approval of Salary Ordinance 12-10. c. Approval of Appropriation Ordinance No 727. Councilmember Wilhoite made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Councilmember House and all voted aye. The motion passed 3 to 0. Agenda Item 5 - REPORTS OF OFFICERS, BOARDS AND COMMITTEES Agenda Item 5a – Consider a Consider a request for a street closure for the Paola Heartland Car Show on June 23rd. Manager Wieland presented a request for the Paola Tourism Committee to close the streets around the Park Square for the annual Car Show on June 23rd and a request from the American Legion Riders to close the north lane of west bound Baptiste Drive at the Veterans Memorial on May 28th from noon to 2:00 pm. After a discussion, Councilmember Pritchard made a motion to approve the temporary closure of portions of Pearl, Wea, Silver, and Peoria Streets around the Park Square for the Paola Heartland Car Show on June 23rd and the temporary closure of the north lane of west bound Baptiste Drive at the Veterans Memorial on May 28th from noon to 2:00 pm. The motion was seconded by Councilmember Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 5b – Consider approval of disbursements from the Transient Guest Tax Fund. Manager Wieland reported that the Paola Convention and Tourism Committee met on Thursday, May 17th to review requests for Transient Guest Tax grant funding. The Committee recommended approval of the following grants: Paola Tourism Inc. $2,000 for the Art & Wine Stroll Paola Tourism Inc. $2,000 for the Harvest Festival Miami County Historical Museum $2,500 Paola Chamber of Commerce $500 for the Kansas Sampler Festival Paola Tourism Inc. $2,000 for the Heartland Car Show Heartland Art Guild $500 for the Miniatures Art Exhibit Paola Farmers Market $500 Paola Roots Festival $2,000 Total $12,000 The Committee declined to approve a $1,000 request from OWLS for an outdoor wildlife learning site. It was felt that the application did not meet grant funding guidelines. After discussion, Councilmember House made a motion to approve disbursements from the Transient Guest Tax Fund as presented. The motion was seconded by Councilmember Pritchard and all voted aye. The motion passed 3 to 0. Agenda Item 6 – NEW BUSINESS Paola City Council Minutes – May 22, 2012 Page 2 Clerk Droste presented an invitation from US Senator Pat Roberts who is hosting a Town Hall Meeting at the Miami County Commissioner’s Meeting Room at the County Administration Building on Friday, June 1st at noon. The public is invited to attend. Clerk Droste reminded the Council about the Chamber of Commerce Annual Dinner on Thursday, June 7th. Public Works Director reported that Osage Street will be closed temporarily tomorrow while workers install the tap and connection for the East Street water line project. He also reported that the parking along the east and north side of the Firehouse Gym will be paved later this summer and that the Castle Street project will start on the Tuesday after Memorial Day. Police Chief Smail reported that Police Office Adam Hale responded to a call involving an electrocution on Thursday evening. Officer Hale was able to revive the victim by using a defibrillator that was recently purchased by a grant from the Baher Foundation. Chief Smail went on to publicly thank the Baher Foundation for the grant and stated that without the defibrillator it would have been unlikely that the victim would have survived. Manager Wieland reported that City Hall completed the move to a new temporary location at 10 W Peoria on Friday. He thanked Great Southern Bank for their generosity in providing the use of the building during the renovation of the City Hall building. Manager Wieland and Clerk Droste presented a discussion on the background behind the absence of a Family Season Pass being offered at the Paola Family Pool. They explained that the reason that a family pass was no longer offered was that the original pricing structure encouraged abuses and that defining a “family member” became problematic. Clerk Droste reported that after surveying the pricing structure of area pools, he indicated that the City of Louisburg offers an “Adult / Child Season Pass” for their pool. The unique thing about this pass is that the only requirements are that the “adult” must be anyone 18 years of age or older and that there is a limit of 6 passes per group. This pricing structure provides both a discount for families, and eliminates the need for defining who is or is not a family member. Clerk Droste proposed that the pricing for a similar pass for the Paola Family Pool could be priced at $45 for the adult, and $35 for each additional person. When compared to the price for an Individual Season Pass, the cost savings would be as follows: Individual Pass Adult / Child Pass Savings 1 person $60 n/a n/a 2 persons $120 $80 $40 3 persons $180 $115 $65 4 persons $240 $150 $90 5 persons $300 $185 $115 6 persons $360 $220 $140 Paola City Council Minutes – May 22, 2012 Page 3 After discussing the issue at length, City Staff recommended that the City Council consider approving an Adult / Child Season Pass for the Paola Family Pool at a rate of $45 for the adult and $35 for each additional pass. The adult must be any responsible person 18 years of age or older and there is a limit of 6 passes per group. All of the individuals receiving the passes must come in to City Hall to purchase the passes at one time, additional individuals cannot be added once the initial passes are purchased. Councilmember House made a motion to approve the Adult / Child Season Pass for the Paola Family Pool as presented by City Staff, and authorize staff to change or make a refund for any season pass that has already been purchased for this year. The motion was seconded by Councilmember Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 7 – EXECUTIVE SESSION Councilmember Wilhoite made a motion to adjourn to Executive Session, to include the Mayor, Council, City Manager, City Clerk and City Attorney, for 20 minutes for purpose of a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship. K.S.A. 75-4319(B)(2) is the authority for this recess; the regular meeting to reconvene at 7:30 p.m. The motion was seconded by Councilmember House and all voted aye. The motion passed 3 to 0. At 7:30 pm, Councilmember Wilhoite made a motion to reconvene the adjourned meeting. The motion was seconded by Councilmember House and all voted aye. The motion passed 3 to 0. Pursuant to the Executive Session, Councilmember Wilhoite made a motion to approve an Agreement with Miami County Fire District No. 1 and authorized the Mayor to sign. The motion was seconded by Councilmember Pritchard and all voted aye. The motion passed 3 to 0. Agenda Item 8 – ADJOURNMENT With no additional business to come before the Council, Councilmember Pritchard made a motion to adjourn. Councilmember House seconded the motion and all voted aye.
