MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
March 12, 2013
HELD AT THE PAOLA JUSTICE CENTER
805 North Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee Gee
Wilhoite, and Aaron Nickelson.
Council Members absent: Council Member Leigh House.
Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney
Lee Tetwiler, Police Chief Dave Smail, Public Works Director
Browning, City Planner Gotfredson, Richard Lentz, and Brian
McCauley with the Miami County Republic.
Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor
Stuteville.
Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, and
Nickelson were present. Council Member House was absent.
Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS:
Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is
not an agenda item. No one addressed the Council.
Agenda Item 4 - CONSENT AGENDA:
a. Approval of minutes of the meeting of February 12 and 26, 2013.
b. Approval of Salary Ordinance 13-4 and 13-5.
c. Approval of Appropriation Ordinance No 746 and 747.
d. Approval of the Journal Entries Report for January, 2013.
e. Approval of the Pledged Securities Report for January, 2013.
f. Approval of a leak allowance for 1006 E Wea in the amount of $39.46.
Councilmember Pritchard made a motion to approve the Consent Agenda as presented and authorize
the Mayor to sign. The motion was seconded by Council Member Wilhoite and all voted aye. The
motion passed 3 to 0.
Agenda Item 5 - REPORTS OF OFFICERS, BOARDS AND COMMITTEES:
Agenda Item 5a – Consider a Resolution restricting parking along Panther Drive near Paola
High School.
Manager Wieland presented a request from USD 368 to restrict parking on Panther Drive from 7:00
am to 5:00 pm on Monday through Friday to alleviate the problem with school busses and trucks
entering and leaving the teacher’s parking lot during school hours.

After additional discussion, Councilmember Pritchard made a motion to approve A RESOLUTION
AMENDING THE OFFICIAL TRAFFIC CONTROL DEVICE SCHEDULES FOR THE CITY OF
PAOLA, KANSAS. The motion was seconded by Council Member Wilhoite and all voted aye. The
motion passed 3 to 0 and the Resolution was assigned number 2013-004.
Agenda Item 5b – Consider bids for the purchase of a new rotary cutter for the Public Works
Department.
Public Works Director Browning presented bids for the purchase of a new rotary cutter as follows:
• Olathe Tractor & Equipment Co.: 12’ - 2013 Model 2212R-1 Bush Hog = $11,895.00-Single
10 gauge deck and 7 gauge side skirts.
• Olathe Tractor & Equipment Co.: 12’ - 2013 Model 2810R2 Bush Hog = $12,737.00-Double
10 gauge deck and ¼” side skirts.
• Greeley Farm Implement: 12’ - 2013 Land Pride 2512 = $9,700.00-Single 10 gauge deck and
7 gauge side skirts.
• Coleman Equipment Inc.:12’ - 2013 Rhino TS12 = $9,130.00–Double 10 gauge deck and
wings with ¼” side skirts.
• Heritage Tractor – Baldwin: 12’ - 2013 Land Pride 2512 = $8,026.20-Single 10 gauge deck
and 7 gauge side skirts.
Public Works Director Browning indicated that with this type of equipment, durability is a concern
and he recommends that a mower built with heavier and thicker steel is preferred. He recommended
that the bid from Coleman Equipment be accepted based on price and the durability of the equipment.
After additional discussion, Councilmember Nickelson made a motion to accept the bid from
Coleman Equipment in the amount of $9,130.00 for the purchase of a 2013 Rhino TS12 for the Public
Works Department. The motion was seconded by Council Member Pritchard and all voted aye. The
motion passed 3 to 0.
Agenda Item 5c – Consider bids for the 2013 Residential Sidewalk Program.
Manager Wieland presented the contractor bids for the 2013 Residential Sidewalk Program as
follows:
• Wilson Concrete: $5.75 per square foot
• SH Flatworks: $6.12 per square foot
• Lickteig Construction $7.20 per square foot
• Holiday Contracting $8.92 per square foot
Manager Wieland reported that the Public Works Department will be performing inspections on
behalf of the Community Development Department for the sidewalk program and building permits
will be issued for each property.
Public Works Director Browning reported that 9 applications have been received for new sidewalks
and that there were sufficient funds to add one more property to the 2013 program.
After additional discussion, Councilmember Wilhoite made a motion to accept the bid from Wilson
Concrete in the amount of $5.75 per square foot for the 2013 Residential Sidewalk Program. The
motion was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0.

Agenda Item 5d – Consider bids for the sale of surplus equipment from the Public Works
Department.
Public Works Director Browning reported that On March 2nd, 2013 the Public Works Department
opened sealed bids on a 2009 Ex-mark mower and a 1998 Bush Hog Rotary mower. The high bid for
the Ex-mark mower was $3,100 and for the Bush Hog it was $1,700 for a total of $4,800. The high
bids for both pieces of equipment were submitted by Jim Lowe.
After additional discussion, Councilmember Pritchard made a motion to accept the bid in the amount
of $4,800.00 for the sale of a 2009 Ex-mark Mower and a 1998 Bush Hog Rotary Mower. The motion
was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0.
Agenda Item 5e – Consider bids for the purchase of two new pickup trucks for the Public
Works Department.
Public Works Director Browning presented bids for the purchase of two new pickup trucks as
follows:
• Louisburg Ford
Two (2) New 2013 Ford F-150 regular cab XL 4x2 - $17,426.00 each.
Trade package for our 4 trucks = $2,000.00
Package Total = $32,852.00
• Lang Chevrolet
Two (2) New 2013 Chevy Silverado 1500 regular cab work trucks - $18,649.00 each
Trade package for our 4 trucks = $5,148.00
Package Total = $32,150.00
• New Century Dodge
Two (2) New 2013 Dodge Tradesman 1500 regular cab - $21,324.00 each
Trade package for our 4 trucks = $4,950.00
Package Total = $37,698.00
He reported that the four oldest pickup trucks in the Public Works fleet will be traded in as a part of
the purchase of the new vehicles. The cost of the purchase of these new trucks was included in the
2013 Budget with $10,000 coming from the Street Department Budget and $22,150 from the MERF –
Equipment Reserve Fund.
After additional discussion, Councilmember Pritchard made a motion to accept the bid from Lang
Chevrolet in the amount of $32,150.00 for the purchase of two 2013 Chevrolet Silverado work Trucks
for the Public Works Department, including the trade in of the 1991 Chevrolet, 1994 Ford, 1996 Ford,
and 1997 GMC pickup trucks. The motion was seconded by Council Member Wilhoite and all voted
aye. The motion passed 3 to 0.
Agenda Item 6 – NEW BUSINESS
Clerk Droste reported that sales tax revenues for the month of February totaled $201,833 bringing the
year to date total to $391,613 which is $38,719 more than the same time period last year.
Public Works Director Browning reported that work on the intersection of Castle and Miami started
this week and should be completed within 2 weeks depending on the weather. Additionally,
permanent repairs to a large pothole at the east entrance to Walmart will also be completed before the

Street Department redirects its efforts to the Grandview Drive reconstruction. The Parks Department
will soon begin working on opening the Lake Miola Campgrounds, the Wallace Park Comfort Station
and the Swimming Pool.
Manager Wieland reported that the City Hall Dedication Ceremony is scheduled for Saturday, March
16th at 1:00 pm with an Open House to follow until 3:30 pm.
Manager Wieland reported that the City hosted the Miami County Intergovernmental Meeting at 7:30
am today. The meeting was well attended.
Council Member Pritchard complimented the Public Works Department for their snow removal
efforts during the recent snow storms. He also asked about tree limb pickup from the storms. Public
Works Director Browning reported that limbs were picked up on Monday and Tuesday of last week
and again this week. Anyone who was missed can call Public Works and they can still be picked up.
Council Members Wilhoite and Nickelson also thanked the Public Works Department for their efforts
during the recent snow storms. Council Member Nickelson asked how the police vehicles were able
to handle the deep snow. Police Chief Smail reported that chains were used on the patrol units, but
they were still unable to travel on hilly streets that were unplowed. He thanked New Century Dodge
for providing 4 wheel drive vehicles for the Police Department to use during the worst part of the
storms and several employees used their personal 4 wheel drive vehicles as well.
Mayor Stuteville inquired about the salt and sand supplies. Public Works Director Browning reported
that the latest round of storms depleted the majority of that supply. However, it has been a couple of
years since the City has needed to replenish that supply.
Agenda Item 7 – ADJOURNMENT
With no additional business to come before the Council, Council Member Wilhoite made a motion to
adjourn. Council Member Pritchard seconded the motion and all voted aye. The motion passed 3 to
0.
