MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
August 26, 2014
HELD AT THE PAOLA JUSTICE CENTER
805 North Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee
Gee Wilhoite, Leigh House and Aaron Nickelson.
Council Members absent: None.
Also present: City Manager Jay Wieland, City Clerk Dan Droste, City
Attorney Lee Tetwiler, Public Works Director Craig Browning,
Police Chief Dave Smail, Richard Lentz, and Brian McCauley
with the Miami County Republic.
Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by
Mayor Stuteville.
Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite,
House, and Nickelson were all present. No one was absent.
Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS:
Mayor Stuteville asked the audience if anyone desired to address the Council about any issue
that is not an agenda item. No one addressed the Council.
Agenda Item 4 - CONSENT AGENDA:
a. Approval of minutes of the regular meeting of August 12, 2014.
b. Approval of Salary Ordinance 14-19.
c. Approval of Appropriation Ordinance No 783.
d. Approval of a request from USD 368 to waive a building permit fee in the amount of
$392.00.
Council Member Wilhoite made a motion to approve the Consent Agenda as presented and
authorize the Mayor to sign. The motion was seconded by Council Member Pritchard and all
voted aye. The motion passed 4 to 0.
Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES:
Agenda Item 5a – Consider the approval of two Street Closure Applications for the First
Lutheran Church for a Discipleship Day Event on September 14th and for Trunk-or-
Treat on October 25th.

Clerk Droste presented two applications from the First Lutheran Church requesting a
temporary street closure of the 400 Block of East Piankishaw Street to accommodate upcoming
events. Their Discipleship Day Event will be held on September 14th from 9:00 am until 12:30
pm and their Trunk-or-Treat is scheduled for October 25th from noon until 4:00 pm. He
indicated that the church owns all of the properties bordering the 400 Block of East Piankishaw
so none of the neighboring residences will be isolated by the street closures.
After additional discussion, Council Member Pritchard made a motion to approve the
applications from the First Lutheran Church to temporarily close the 400 block of East
Piankishaw on September 14th from 9:00 am until 12:30 pm and also on October 25th from
noon until 4:00 pm. The motion was seconded by Council Member Wilhoite and all voted aye.
The motion passed 4 to 0.
Agenda Item 5b – Consider an Ordinance increasing the monthly charge for trash and
recycling collection from $15.50 to $16.00 and increasing the commercial contractor
hauler permits from $75.00 to $150.00 per year for each truck.
Manager Wieland presented an ordinance that proposes an increase in the monthly charge for
trash and recycling collection from $15.50 to $16.00. The increase would be effective with
the utility bill mailed on September 30th. He noted that the contract with L&K Services for
trash and recycling collection contains a 3% annual increase. He also noted that the fee for
contractor hauler permits had not been increased since 1992 and the ordinance would increase
that fee from $75.00 to $150.00 per year for each truck.
After additional discussion, Council Member Wilhoite made a motion to approve AN
ORDINANCE AMENDING SECTION 725.170: CHARGES FOR COLLECTION AND
DISPOSAL, CHAPTER 725: REFUSE, TRASH AND SOLID WASTE, TITLE VII:
UTILITIES, OF THE CODE OF THE CITY OF PAOLA, KANSAS, 2009. The motion was
seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0 and the
Ordinance was assigned number 3072.
Agenda Item 5c – Consider the approval of Payment Request No 12 for the Library
Addition and Renovation Project #2013-001 – Part A.
Manager Wieland reported that pace of progress on the Library addition and renovation project
is beginning to slow as much of the final trim and finishes are being installed. He noted that
the main stairway is nearing completion and the refinishing of the old stairway will begin soon.
After additional discussion, Council Member Nickelson made a motion to approve payment
request #12 from Legacy Contractors, LLC in the net amount of $25,554.00 for the Library
addition and renovation project #2013-001-Part A. The motion was seconded by Council
Member Wilhoite and all voted aye. The motion passed 4 to 0.
Agenda Item 5d – Consider the approval of Payment Request No 8 for the Library
Addition and Renovation Project #2013-001 – Part B.

Pursuant to the previous discussion, Council Member House made a motion to approve
payment request #8 from Legacy Contractors, LLC in the net amount of $26,916.00 for the
Library addition and renovation project #2013-001-Part B. The motion was seconded by
Council Member Nickelson and all voted aye. The motion passed 4 to 0.
Agenda Item 6 – NEW BUSINESS
Manager Wieland presented a proposal from the City’s financial advisor, Piper Jaffray, to
refinance the City’s General Obligation Bond Series 2007A. The outstanding balance of the
bonds is $2,355,000 with an average interest rate of approximately 4.3%. By refinancing the
bonds, the City could be able to lower the average interest rate to 2.977% which will save the
City $89,623.80 in total debt service over the life of the bonds.
After additional discussion, Council Member Pritchard made a motion to authorize City staff
to proceed with the necessary documentation to refinance the General Obligation Bond Series
2007A. The motion was seconded by Council Member Wilhoite and all voted aye. The motion
passed 4 to 0.
Clerk Droste reported that sales tax revenues for the month of August amounted to $200,422
bringing the year to date total to $1,522,540 which is 3.29% more than the same time period in
2013.
Clerk Droste reported that the League of Kansas Municipalities Annual Conference will be
held in Wichita from October 11th through the 13th. The early registration discount deadline is
September 26th.
City Attorney Tetwiler commented that the new Uniform Public Offense Code and Standard
Traffic Ordinance books have numerous updates and changes due to all of the State legislative
action during the past year.
Police Chief Smail reported that the Roots Festival was a very quiet event for the Police
Department.
Manager Wieland reported that the response to the Standard & Poors bond rating questionnaire
was sent in today.
Council Member Pritchard asked about the status of stop signs for Wea Street cross streets
west of Iron Street. After a discussion, Manager Wieland indicated that a traffic study would
be completed to make sure that the signs are warranted.
Council Member Wilhoite complimented the Miami County Sheriff’s Deputy that recently
stopped to assist her with a flat tire on the highway.
Council Member Nickelson asked about Project 17 and reported that he had received an
invitation be a part of the program. Manager Wieland stated that Project 17 is a new program
to train and develop future leaders in our 17 county area of southeast Kansas.

Council Member Nickelson asked about any feedback from the schools on the new bike lanes.
Public Works Director Browning reported that he has received many positive comments on
the lime green crosswalks, but not as much on the bike lanes. They will be installing markings
that indicate that the new bike lanes accommodate traffic in both directions.

With no additional business to come before the Council, Council Member Wilhoite made a
motion to adjourn. The motion was seconded by Council Member House and all voted aye.
The motion passed 4 to 0.
