MINUTES OF THE REGULAR COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. April 28, 2015 Held in the Municipal Court Room at the Paola Justice Center 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Leigh House, and Aaron Nickelson. Council Members absent: Council Member Gee Gee Wilhoite. Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney Lee Tetwiler, Public Works Director Craig Browning, Police Chief Dave Smail, Kirk Keller, Ben Keller, Emily Keller, Ruth Storch, Michelle Boyer, C. Todd Allenbrand, and Brian McCauley with the Miami County Republic. Agenda Item 1 - CALL TO ORDER: A regular meeting of the City Council was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, House, and Nickelson were all present. Council Member Wilhoite was absent. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS: Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. No one else addressed the Council. Mayor Stuteville read and presented an proclamation naming April as Autism Awareness Month. Clerk Droste administered the Oath of Office to Council Member Pritchard. Agenda Item 4 - CONSENT AGENDA: a. Approval of minutes of the regular meeting of April 14, 2015. b. Approval of Salary Ordinance 15-08. c. Approval of Appropriation Ordinance No 801. Council Member Nickelson made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member House and all voted aye. The motion passed 3 to 0. Paola City Council Minutes – April 28, 2015 Page 1 Agenda Item 5 - REPORTS OF OFFICERS, BOARDS AND COMMITTEES: Agenda Item 5a Consider approval of replat of units 6 and 7 in the Miami County Medical Center Doctor’s Building Condominium. City Planner Gotfredson presented a request for a replat of units six and seven of Miami County Medical Center Doctor’s Building Condominium, First Plat. He reported that there has been some remodeling of this space and so the condominium plat is being updated to reflect these changes. This issue was presented to the Paola Planning Commission at their meeting on April 21, 2015 and they unanimously recommended approval. After additional discussion, Council Member Pritchard made a motion to approve Miami County Medical Center Doctor’s Building Condominium, Third Plat, A Replat of Units 6 and 7. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0. Agenda Item 5b – Consider a Street Closure Application for The Night at the Museum 5K. Clerk Droste presented a request from Janis Grandon, Principal at Cottonwood Elementary School who is organizing the second annual “Night at the Museum” 5k Run/Walk. The event is being planned to take place at Wallace Park on the same route used for the Paola Pathways 5K event. The event is planned for Thursday, May 21st at 6:30 pm and it is estimated that there will be 100 participants. After additional discussion, Council Member House made a motion to approve the Street Closure Application for The Night at the Museum 5K on May 21st as presented. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0. Agenda Item 6 – NEW BUSINESS Clerk Droste reported that sales tax revenue for the month of April amounted to $180,346 which brings the year to date total to $774,161 which is 3.08% higher than the same time period in 2014. Public Works Director Browning reported that the mill and overlay portion of the 2015 street repair program should be completed by next Monday. The project is going very well. City Manager Wieland reported that the agreement with Midwest Connections to place equipment on the MDCPUA water tower has been signed, however there are some conflicts with communications frequencies that need to be worked out. City Manager Wieland reported that the new fire truck will be delivered on Friday and the manufacturer will be training the Fire Department on the operation and features of the vehicle on Saturday. City Manager Wieland reported that the former Elliott Insurance building has been raised by the County to prepare for the construction of the new jail complex. City Manager Wieland reported that the Kansas Legislature’s Conference Committee on Elections will be meeting Thursday and Friday to consider legislation to change local elections to the month Paola City Council Minutes – April 28, 2015 Page 2 of November in even years, including a requirement to hold all bond and sales tax elections only in the month of November. City Manager Wieland explained the difficulties of the proposed legislation and encouraged the Council to contact our representatives by telephone to urge them to oppose the legislation. Council Member Pritchard commented on the wonderful experience that he had while accompanying his father on the Kansas Veterans Honor Flight to Washington DC. He indicated that the trip was well planned and that veterans from the ages of 86 to 96 participated. Mayor Stuteville nominated the following individuals to serve additional terms on Boards or Committees: Debbie Berckefeldt to the Library Board; Steve Cowman to the Planning Commission; Gary Keller to the Community Center Board; and Barb Dillenbeck, Alan Hire, and Michelle Kaiser to the Convention & Tourism Committee. Council Member Pritchard made a motion to approve the Mayor’s nominations. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0. Agenda Item 7 – EXECUTIVE SESSION for the purpose of a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship. K.S.A. 75-4319(B)(2) is the authority for this recess. Council Member Nickelson made a motion to adjourn to Executive Session, to include the Mayor, Council, City Manager, City Clerk, and City Attorney for 10 minutes for the purpose of a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship; the special meeting to reconvene at 6:30 p.m. The motion was seconded by Council Member House and all voted aye. The motion passed 3 to 0. At 6:30 pm, the City Council came out of Executive Session and Council Member Nickelson made a motion to reconvene the adjourned meeting. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0. No action was taken pursuant to the Executive Session. Agenda Item 8 – ADJOURNMENT With no additional business to come before the Council, Council Member Nickelson made a motion to adjourn. The motion was seconded by Council Member House and all voted aye.
