MINUTES OF THEREGULARCOUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. August 11, 2015 Held in the Municipal Court Room at the Paola Justice Center 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee Gee Wilhoite, and Leigh House. Council Members absent: Council Member Aaron Nickelson. Also present: City Manager Jay Wieland, City Clerk Dan Droste, Police Chief Dave Smail, City Planner Mike Gotfredson, Public Works Director Craig Browning, Richard Lentz, Dave Tucker, Bryce Smith, and Brian McCauley with the Miami County Republic. Agenda Item 1 -CALL TO ORDER: A regular meeting of the City Council was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, and House were all present. Council Member Nickelson was absent. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS: Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. Mr. Dave Tucker, owner of the Purple Rose Tatoo Parlor, addressed the Council in regard to issues that he was having with a neighboring business. He explained that he has registered complaints with the City’s Community Development Department regarding fumes from the nail salon that is a neighboring tenant in the building that he rents. After a discussion, City Manager Wieland indicated that he would consult with the City Attorney to see if the City has a means by which to resolve the matter. No one else addressed the Council. Agenda Item 4 -CONSENT AGENDA: a. Approval of minutes of the meetings of July 14 and July 22, 2015. b. Approval of Salary Ordinance 15-15. c. Approval of Appropriation Ordinance No 807. d. Approval of the renewal of a Drinking Establishment License for Casa Grande Paola. Council Member Pritchard made a motion to approve the Consent Agenda and authorize the Mayor to sign. The motion was seconded by Council Member House and all voted aye. The motion passed 3 to 0. Paola City Council Minutes – August 11, 2015 Page 1 Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES Agenda Item 5a – Public Hearing for and adoption of the proposed 2016 Paola City Budget. Council Member Wilhoite made a motion to open the public hearing on the proposed 2016 Paola City Budget. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 3 to 0. Mayor Stuteville announced that it was time for the Public Hearing for and adoption of the proposed 2016 Paola City Budget and she asked if there was anyone in attendance that wished to address the Council. No one came forward to address the Council in regard to the 2016 Paola City Budget. Council Member Pritchard made a motion to close the public hearing. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 5b – Consider adoption of the 2016 Budget. Council Member House made a motion to adopt the 2016 Paola City Budget in the amount of $14,688,985 pursuant to the Notice of Budget Hearing published in the Miami County Republic on July 29, 2015. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 5c – Consider a new contract with L&L Services for trash and recycling collection. Manager Wieland presented the final draft of a contract with L&K Services for trash and recycling collection in the City of Paola. He highlighted the following enhancements that are included in the new contract:  10 year term at the current rate with 2% annual increases (instead of the 3% in the current contract).  Elimination of the fuel surcharge clause.  Free monthly bulk item pick up. On the first collection day of the month, each resident can place one bulk item out for collection at no additional charge.  Other items such as liability insurance, hold harmless clause, assignment of contract, and force majeure were also discussed.  New contract effective date is September 1, 2015. Bryce Smith with L&K Services addressed the Council about the new contract, answered questions, and thanked the Council for the continued relationship with the City. After additional discussion, Council Member Pritchard made a motion to approve the contract with L&K Services for trash and recycling collection as presented. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 5d – Consider the approval of a Street Closure Application for a portion of Holly Lane on August 15th. Paola City Council Minutes – August 11, 2015 Page 2 Clerk Droste presented a request from Clint Meinig to close a portion of Holly Lane for a block party on August 15th. He reported that the street would be closed from 53 Holly Lane to 46 Holly Lane where a cul-de-sac and a round-about will provide easy means for vehicles to turn around. After a discussion, Council Member Pritchard made a motion to approve Street Closure Application from Clint Meinig on behalf of the Holly Lane Block Party to close a portion of Holly Lane on August 15, 2015 form 3:00 pm to 8:00 pm. The motion was seconded by Council Member House and all voted aye. The motion passed 3 to 0. Agenda Item 5e – Consider letters of thanks from the City Council to Senator Molly Baumgardner and Representative Jene Vickery for their service and support of local government. City Manager Wieland presented drafts of letters to Senator Molly Baumgardner and Representative Jene Vickery for their service and support of local government during the 2015 Legislative Session. After reviewing the letters, Council Member Wilhoite made a motion to approve the letters as presented. The motion was seconded by Council Member House and all voted aye. The motion passed 3 to 0. Agenda Item 6 - NEW BUSINESS Council Member Pritchard thanked the City Manager and City Staff for their work on the 2016 Budget. Council Member Wilhoite thanked City Staff for the pool passes that were distributed as part of the County Fair Parade. Council Member House also thanked the City Manager and City Staff for their work on the 2016 Budget. Mayor Stuteville thanked the Public Works Department for picking up tree limbs from the recent storms. She also asked the Public Works Department about spraying weeds at the curb and sidewalk along Hospital Drive. Agenda Item 7 – ADJOURNMENT With no additional business to come before the Council, Council Member Wilhoite made a motion to adjourn. The motion was seconded by Council Member Pritchard and all voted aye.
