MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. January 26, 2016 Held in the Municipal Court Room at the Paola Justice Center 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee Gee Wilhoite, Leigh House and Aaron Nickelson. Council Members absent: None. Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney Lee Tetwiler, City Planner Mike Gotfredson, Interim Police Chief Don Poore, Public Works Director Craig Browning, Melissa Browning, Reese Browning, Emersyn Browning, Ken Berra, and Richard Lentz. Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, House, and Nickelson were all present. No one was absent. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS: Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. No one addressed the Council. Agenda Item 4 - CONSENT AGENDA: a. Approval of minutes of the meeting of January 12, 2016. b. Approval of Salary Ordinance16-02. c. Approval of Appropriation Ordinance No 819 & 820. d. Approval of the Journal Entries Report for December, 2015. Council Member Wilhoite made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member House and all voted aye. The motion passed 4 to 0. Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES: Agenda Item 5a – Consider approval of a preliminary plat for Hidden Meadows Estates, Phase II. Paola City Council Minutes – January 26, 2016 Page 1 City Planner Gotfredson presented a preliminary plat for Phase II of Hidden Meadows Estates. He reported that this phase of the subdivision includes 15 lots covering a total of 4.3 acres. A planned third phase would complete the subdivision connecting Hidden Meadows Drive with Redbud Drive creating an additional access point for both Hidden Meadows Estates and Indian Hills subdivisions. A final plat for Phase II will be presented to the City Council for approval once the final engineering and utility plans are completed. At its meeting on January 19, 2016 the Planning Commission voted unanimously to recommend approval of the preliminary plat. Developer Craig Browning reported that there are only 2 lots remaining in phase I of Hidden Meadows Estates that have not been sold. He went on to answer questions about the plat and also discussed plans for the third phase. The anticipated sales price for homes in Phase II is between $215,000 and $245,000. After additional discussion, Council Member Nickelson made a motion to approve the preliminary plat for Hidden Meadows Estates, Phase II as presented. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 4 to 0. Agenda Item 5b – Report by the City Clerk on Candidates who have filed for City Offices to be placed on the ballot on April 5, 2016. Clerk Droste reported that the deadline for filing for the positions of City Council Member for Wards 2 and 4 was at 12:00 Noon today, Tuesday, January 26, 2016. Gee Gee Wilhoite and Michael Oldfield have filed as candidates for the City Council Seat in Ward 2 and Aaron Nickelson was the only candidate to file for the City Council Seat in Ward 4. The general election will be held on Tuesday, April 5, 2016. Agenda Item 5c – Preliminary Financial Report for Budget Year 2015. Manager Wieland presented the preliminary financial reports for the 2015 Budget Year. He reported that total revenues for all budgeted funds totaled $14,755,277 or 99.4% of the amended budget. Expenditures for the same funds amounted to $11,543,311 or 97.9% of the amended budget. Specifically, the General Fund revenues totaled $4,478,286, or 98.5%. Likewise, expenditures in the General Fund amounted to $3,826,849, or 99.0% of the amended budget. Clerk Droste added that the end of year cash balances for all budgeted funds amounted to $3,211,966 which exceeded the amended budget estimate by $150,197. The preliminary financial report was discussed in further detail. City Manager Wieland thanked all of the City’s Department Heads for doing such a good job managing their budgets. Agenda Item 6 – NEW BUSINESS Clerk Droste reported that sales tax revenues for the month of January amounted to $193,490. This compares to $204,659 collected in January of 2015. Paola City Council Minutes – January 26, 2016 Page 2 City Attorney Tetwiler reported on a recent Municipal Court case that was appealed and heard in Miami County District Court. The case was decided in favor of the City of Paola. City Manager Wieland reported on the annual State of the City Breakfast that was held earlier today at Town Square. The event was attended by approximately 75 residents and was very positive. City Manager Wieland reported that he attended the KDOT K-68 regional meeting that was held last evening. He reported that the meeting was well attended. Council Member Wilhoite thanked the Police Department for increased patrols in Ward 2. Mayor Stuteville thanked the Public Works Department for their hard work clearing the streets following the recent winter weather events. Agenda Item 7 – EXECUTIVE SESSION for the purpose of a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship. K.S.A. 75-4319(B)(2) is the authority for this recess. Council Member Wilhoite made a motion to adjourn to Executive Session, to include the Mayor, Council, City Attorney, City Manager, City Clerk and Kenneth J. Berra, Attorney at Law, for 15 minutes for the purpose of a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship; the regular meeting to reconvene at 6:55 p.m. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 4 to 0. At 6:55 the Council came out of Executive Session and Council Member Wilhoite made a motion to reconvene the adjourned meeting. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 4 to 0. No action was taken pursuant to the Executive Session. Agenda Item 8 – ADJOURNMENT With no additional business to come before the Council, Council Member Hosue made a motion to adjourn. The motion was seconded by Council Member Wilhoite and all voted aye.
