MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. April 26, 2016 Held in the Municipal Court Room at the Paola Justice Center 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee Gee Wilhoite, Leigh House and Aaron Nickelson. Council Members absent: None. Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney Lee Tetwiler, City Planner Mike Gotfredson, Police Chief Paul Jokerst, Deputy Police Chief Don Poore, Public Works Director Craig Browning, Human Resources Director Vicki Belt, Chief Building Inspector Bill Trout, Paul Jokerst Jr., Sue Jokerst, Kathryn Jokerst, Kaliek Jokerst, Todd Kassabum, Lisa Kassabaum, Jeff Veenstra, Wayne Schwalm, Bob Kratzberg, Pam Thompson, Bill Thompson, Travis Hardwick, Michael Oldfield, Richard Lentz, Brian McCauley with the Miami County Republic, and others. Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, House, and Nickelson were all present. No one was absent. Agenda Item 3 – Pinning Ceremony for the new Chief of Police: Mayor Artie Stuteville introduced and welcomed Paul Jokerst as the City’s new Chief of Police. Clerk Droste administered the Oath of Office to Chief Jokerst and the ceremony was concluded with Chief Jokerst’s children, Kathryn and Kaliek, pinning his badge and collar rank emblems on his uniform. Chief of Police Jokerst addressed the Governing Body and all those in attendance. He thanked the Mayor, City Council and City Manager for their confidence in his ability to lead the Paola Police Department. He went on to discuss his goals and objectives for the Paola Police Department. Agenda Item 4 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS: Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. No one addressed the Council. Paola City Council Minutes – April 26, 2016 Page 1 Agenda Item 5 - CONSENT AGENDA: a. Approval of minutes of the meeting of April 12, 2016 b. Approval of Salary Ordinance 16-08. c. Approval of Appropriation Ordinance No 826. Council Member Pritchard made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0. Agenda Item 6 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES: Agenda Item 6a – Conduct a Dangerous Structure Hearing for the property located at 401 E Kaskaskia. Council Member Wilhoite made a motion to open the Dangerous Structure Hearing for the property located at 401 E Kaskaskia pursuant to K.S.A. 12-1752 and City of Paola Resolution No. 2016- 004. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 4 to 0. City Planner Gotfredson reported that since the adoption of Resolution No 2016-004 on March 8th, the owners and several individuals have removed several trailer loads of items from the house. Much of this work has occurred over the last couple of weeks. This has allowed a space to be cleared from the doorway and from some of the vents. This represents a good start, but much remains to be done. Chief Building Inspector Trout also commented on the progress on eliminating the unsafe conditions at the property. William Thompson addressed the Council stating that it is a slow process and that they could use some additional help. They have removed 4 dump trailer loads so far, but they have a long way to go. Council Member Pritchard made a motion to close the Dangerous Structure Hearing for the property located at 401E Kaskaskia. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 4 to 0. Agenda Item 6b – Consider Resolution declaring the structure on the property located at 401 E Kaskaskia, Paola, KS as unsafe and dangerous and directing the structure to be removed as provided for in K.S.A. 12-1752. City Attorney Tetwiler advised that the Council should establish a completion date for the clean-up and repairs. Mayor Stuteville asked Mr. & Mrs. Thompson if 60 days would be an adequate period of time to complete the process. After additional discussion, it was agreed that the owners would be given until June 28, 2016 to complete the clean-up and repair of the property located at 401 E Kaskaskia. If additional time were needed, the owners could petition the Council for additional time. Council Member Wilhoite made a motion to approve A RESOLUTION FINDING THAT THE STRUCTURE LOCATED AT LOT FIVE (5), BLOCK ONE HUNDRED TWO (102), CITY OF PAOLA, MIAMI COUNTY, KANSAS; COMMONLY KNOWN AS 401 E KASKASKIA STREET, PAOLA, KANSAS 66071 IS UNSAFE OR DANGEROUS AND DIRECTING THAT Paola City Council Minutes – April 26, 2016 Page 2 THE STRUCTURE BE REMOVED AND THE PREMISES MADE SAFE AND SECURE. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0 and the Resolution was assigned number 2016-006. Agenda Item 6c – Consider approval of the site plan for the new Sonic restaurant. City Planner Gotfredson presented a site plan for a new Sonic restaurant that is planned for the site located at 12 S Hedge Lane. He noted that the new restaurant will be similar to the Sonic in Osawatomie. It will be 1,717 square feet with 17 parking spaces and 20 ordering stations. The property will be accessed with a one-way entrance and a one-way exit. A drive-through lane is also being constructed. He reported that the Planning Commission approved the site plan subject to satisfactory plans for the retaining wall and the trash enclosure. City Planner Gotfredson also reported that this development has the potential to change traffic patterns on Hedge Lane and Holly Lane. The City Manager has appointed a committee including the City Planner, Police Chief, Fire Chief, and Public Works Director to evaluate the traffic situation and make recommendations as necessary. After additional discussion, Council Member Pritchard made a motion to approve the site plant for Sonic at 12 S Hedge Lane subject to satisfactory plans for the retaining wall and the trash enclosure. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0. Council Member Nickelson excused himself from the meeting to attend a school program. Agenda Item 6d – Consider approval of the site plan for the addition to the Lighthouse Church. City Planner Gotfredson presented a site plan for an addition to the Lighthouse Church. This is a request for site plan approval for a new youth center addition to Lighthouse Church with approximately 11,000 square feet. Additions of this size require site plan review. He noted that 20 new parking spaces are being provided and the exterior of the building will be done in stucco with stucco accent bands. He reported that the Planning Commission approved the site plan without condition. Council Member House made a motion to approve the site plan for Lighthouse Church at 1402 E 303rd Street as presented. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 6e – Consider approval of the final plat for Phase 2 of Hidden Meadows Estates. City Planner Gotfredson presented the final plat for a final plat for a 7 lot subdivision west of Hidden Meadows Estates subdivision. This is the 2nd phase for this development and future phases of this property will occur to the north and east. Additionally, upon full development, Hidden Meadows Drive will connect with Redbud Drive in the Indian Hills subdivision creating an additional access point for both developments. All lots meet the minimum requirements for lot area and lot width. He reported that the Planning Commission approved the final plat subject to satisfactory completion of the engineering comments. Paola City Council Minutes – April 26, 2016 Page 3 After additional discussion, Council Member Pritchard made a motion to approve the final plat for Phase 2 of Hidden Meadows Estates subject to the satisfactory completion of the engineering comments. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 7 – NEW BUSINESS Public Works Director Browning reported that the swimming pool was in the process of being filled and that the recent rain has delayed the street paving projects throughout town. Clerk Droste reported that sales tax revenues for April amounted to $194,236 bringing the year-to- date total to $767,985 which is 0.80% lower than the same time period in 2015. Deputy Police Chief Poore presented Mayor Stuteville with a photograph of he and the Mayor with “Elvis Presley” after his performance at the Paola Community Center on Sunday evening. Manager Wieland reported that work will begin soon on the angle parking at the Miami County Courthouse. He reported that a crosswalk will be incorporated into the new design. Manager Wieland reported that additional concrete and curb repairs will be necessary on Pearl Street. Also, the Walnut Street project will begin within the next 2 weeks. Manager Wieland reported that the State legislative session re-convenes tomorrow with budget issues taking center stage. No resolution seems to be forthcoming for the Osawatomie State Hospital. Council Member Pritchard asked about the painting of the slides at the swimming pool. Manger Wieland reported that it will be completed before the pool opens. Mayor Stuteville made the following nominations: Larry Criddle, Wayne Oberheide, and Janna Pfefferkorn for the Paola Community Center Board, and Starla Medlin and Marjorie Brown for the Paola Housing Authority Board. Council Member Pritchard made a motion to approve the Mayor’s nominations as stated. The motion was seconded by Council Member Wilhoite and all vote aye. The motion passed 3 to 0. Agenda Item 8 – ADJOURNMENT With no additional business to come before the Council, Council Member Wilhoite made a motion to adjourn. The motion was seconded by Council Member House and all voted aye.
