MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
May 10, 2016
Held in the Municipal Court Room at the Paola Justice Center
805 North Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee
Gee Wilhoite, and Aaron Nickelson.
Council Members absent: Council Member Leigh House.
Also present: City Manager Jay Wieland, City Clerk Dan Droste, City
Attorney Lee Tetwiler, City Planner Mike Gotfredson, Police
Captain Kevin Colwell, Loralei Crum, and Brian McCauley with
the Miami County Republic.
Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by
Mayor Stuteville.
Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite,
and Nickelson were all present. Council Member House was absent.
Agenda Item 3 –PETITIONS, REMONSTRANCES, AND COMMUNICATIONS:
Mayor Stuteville asked the audience if anyone desired to address the Council about any issue
that is not an agenda item. No one addressed the Council.
Agenda Item 4 - CONSENT AGENDA:
a. Approval of minutes of the meeting of April 26, 2016
b. Approval of Salary Ordinance 16-09.
c. Approval of Appropriation Ordinance No 827.
d. Approval of the Pledged Securities Report for April, 2016.
e. Approval of the Journal Entries Report for April, 2016.
Council Member Pritchard made a motion to approve the Consent Agenda as presented and
authorize the Mayor to sign. The motion was seconded by Council Member Wilhoite and all
voted aye. The motion passed 3 to 0.
Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES:
Agenda Item 5a – Consider the approval of a Community Event Permit and Street
Closure Application for the annual Heartland Car Show on June 11th.

Clerk Droste presented a Community Event Permit and Street Closure Application for the 14th
annual Paola Heartland Car Show is scheduled to take place in and around the Park Square on
Saturday, June 11th. He reported that all of the required paperwork has been submitted for
this event.
After a discussion, Council Member Wilhoite made a motion to approve Community Event
Permit and Street Closure Application for the annual Heartland Car Show on June 11 th as
presented. The motion was seconded by Council Member Nickelson and all voted aye. The
motion passed 3 to 0.
Agenda Item 5b – Consider the approval of a Community Event Permit and Street
Closure Application for The Midwest Meltdown Triathlon at Lake Miola.
Clerk Droste reported that the 8th annual Midwest Meltdown Triathlon is scheduled to take
place at Lake Miola on Sunday, May 22nd. In order to facilitate the event, the streets around
the lake need to be closed for the protection and safety of the athletes. Traffic will be restricted
to residents only from 7:00 am until 11:30 am on the day of the race. He reported that the
organizers of the even have filed the appropriate applications for the event including the
requested street closure.
After additional discussion, Council Member Pritchard made a motion to approve Community
Event Permit and Street Closure Application for The Midwest Meltdown Triathlon on May
22nd as presented. The motion was seconded by Council Member Wilhoite and all voted aye.
The motion passed 3 to 0.
Agenda Item 5c – Consider approval an Ordinance amending Section 220.270 of the
Municipal Code Book.
Manager Wieland reported that for several weeks, there has been a fairly large sailboat that has
been moored at various locations at Lake Miola. The vast majority of the time, this boat has
been unattended creating safety issues at the Lake. In reviewing City Code, we were unable to
come up with anything that specifically addresses this issue. The proposed ordinance would
prohibit the storage of boats in this manner.
After additional discussion, Council Member Nickelson made a motion to approve AN
ORDINANCE AMENDING TITLE II PUBLIC HEALTH SAFETY AND WELFARE,
CHAPTER 220 PARKS AND PUBLIC PROPERTY, ARTICLE II LAKE MIOLA – IN
GENERAL, SECTION 220.270. STORAGE OF BOATS, BOAT PARTS, BOAT
TRAILERS, VEHICLES AND OTHER PRIVATE PROPERTY PROHIBITED, TO THE
MUNICIPAL CODE OF THE CITY OF PAOLA, KANSAS. The motion was seconded by
Council Member Pritchard and all voted aye. The motion passed 3 to 0 and the Ordinance was
assigned number 3096.

Clerk Droste reported that the City received a dividend in the amount of $15,005.25 from EMC
Insurance Company.
Clerk Droste reported that there will be a “pop up concert” at the small gazebo near the skate
park in Wallace Park from 11:00 am to 2:00 pm on Saturday, May 14th.
City Planner Gotfredson reported that the Kansas Housing Resource Corporation has approved
the application from Dean Development for the 42 until senior housing complex in Paola.
Loralei Crum with the Paola Chamber of Commerce reported on her attendance at the Kansas
Sampler Festival in Winfield, Kansas.
Manager Wieland reported that he would be attending the meeting on June 3rd to discuss recent
legislative action that will affect planned KDOT projects.
Manager Wieland reported that the contractor for the Miami County Detention Center will be
temporarily storing semi-trailers loaded with cell units at the City’s Public Works Facility until
they are ready to be installed.
Council Member Nickelson reported that he has received several comments from residents in
Indian Hills and on Holly Lane about a foul taste and odor in the water. Manager Wieland
stated that he was not aware of any issues and asked for the addresses so that the Public Works
Department can follow up.
Mayor Stuteville asked about the installation of street signs to make it is easier for visitors to
find their way around the cemetery. Manager Wieland indicated that he would discuss the
issue with the Public Works Director.
Agenda Item 7 – ADJOURNMENT
With no additional business to come before the Council, Council Member Wilhoite made a
motion to adjourn. The motion was seconded by Council Member Pritchard and all voted aye.
The motion passed 3 to 0.
