MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. August 9, 2016 Held in the Municipal Court Room at the Paola Justice Center 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Council Vice President Nickelson presiding. Council Members present: Council Members Jim Pritchard, Gee Gee Wilhoite, and Aaron Nickelson. Council Members absent: Mayor Artie Stuteville and Council Member Leigh House. Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney Lee Tetwiler, City Planner Mike Gotfredson, Public works Director Craig Browning, Chief of Police Paul Jokerst, Human Resources Director Vicki Belt, Lee Mott, Richard Lentz, and Brian McCauley with the Miami County Republic. CALL TO ORDER: The regular council meeting was called to order by Council Vice President Nickelson. ROLL CALL: Council Members Pritchard, Wilhoite, and Nickelson were present. Mayor Stuteville and Council Member House were absent. Amendment to Agenda: Council Vice President Nickelson announced that there would be an Executive Session just prior to the adjournment of this meeting. The purpose is a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship. K.S.A. 75-4319(B)(2) is the authority for this recess. Agenda Item 1 - CONSENT AGENDA a. Approval of minutes of the meeting of July 26, 2016 b. Approval of Salary Ordinance 16-16. c. Approval of Appropriation Ordinance No 833. d. Approval of the Pledged Security Report for July, 2016 e. Approval of the Journal Entries Report for July, 2016 f. Approval of a Leak Allowance for 115 Waterworks Road in the amount of $547.50. g. Approval of the renewal of a Drinking Establishment License for Casa Grande, LLC. Council Member Pritchard made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Paola City Council Minutes – August 9, 2016 Page 1 Agenda Item 2 - COMMENTS FROM THE PUBLIC Council Vice President Nickelson asked the audience if anyone desired to address the Council about any issue that is not an agenda item. No one addressed the Council. Agenda Item 3 - UNFINISHED BUSINESS - None. Agenda Item 4 - NEW BUSINESS Agenda Item 4a - Report from Lee Mott on the 2016 Roots Festival. Lee Mott, President of the Paola Roots Festival Committee, addressed the Council regarding the upcoming Roots Festival. He reported that this is the 27th year for the festival which will be held on August 26th and 27th. On Friday evening, the featured band will be Wakter Trout and on Saturday evening the headline act will be the Kenny Ray Shepherd Band. The festival also is the home of the East Central Kansas BBQ Contest. Single day admission for the festival is $15 and children 10 and under are free. A two day pass can also be purchased for $25. Mr. Mott reported that the budget for this year’s festival is nearly $95,000 and the entire event is run by more than 200 unpaid volunteers. He acknowledged all of the individuals who help organize the event every year. He also thanked the Public Works Department and the Police Department for all of their help and support. After additional discussion, Mr. Mott thanked the City for its support of the Roots Festival. Agenda Item 4b - Consider a Street Closure Application The 2016 Roots Festival. Clerk Droste presented the map for the Street Closure Application for the 2016 Roots Festival noting changes from prior years due to the construction at the Miami County Detention Center. After additional discussion, Council Member Pritchard made a motion to approve the Street Closure Application for the Paola Roots Festival from August 25th through the 27th as presented. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 3 to 0. Agenda Item 4c - Consider an application for street closure for the Miami County 4-H Foundation “Clover Run 5K” on November 5th. Clerk Droste presented a request from the Miami County 4-H Foundation to close Wallace Park drive for their annual “Clover Run” scheduled for Saturday, November 5 th at Wallace Park. After additional discussion, Council Member Wilhoite made a motion to approve the street closure request to close a portion of Wallace Park Drive on November 5th to accommodate the Miami County 4-H Foundation “Clover Run 5K” as presented. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 3 to 0. Human Resources Director Belt presented renewal options for the City’s group health, life and dental insurance policies. She reported that renewal options for the existing health insurance plans included a premium increase of 22%. After exploring options with our insurance broker, it was recommended that the City offer three new plans that are similar to the City current base health insurance plan. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 4e - Consider acknowledgement of the submission of the 2015 Independent Audit Report to the Electronic Municipal Market Access (EMMA) system. Clerk Droste reported that in compliance with that the City’s Continuing Disclosure Policy, the 2015 Independent Audit Report was electronically filed on the Electronic Municipal Market Access (EMMA) system on July 26, 2016. This information was filed with EMMA by Piper Jaffray. He noted that also in compliance with the policy, the City Council was notified via a written memorandum on July 29th that the filing had been completed. After additional discussion, Council Member Pritchard made a motion to acknowledge that in compliance with Section II (2) of the Continuing Disclosure Policy for the City of Paola, the City Clerk did provide to the Governing Body written confirmation from EMMA that the 2015 Independent Audit Report for the City of Paola has been submitted and filed properly with the Municipal Securities Rulemaking Board through EMMA on July 26, 2016. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 3 to 0. Agenda Item 5 - COMMITTEE REPORTS There were no Committee Reports presented. Agenda Item 6 - STAFF REPORTS City Attorney reported that the law students from Moldova had the experience of being “arrested” by the Paola Police Department. He went on to describe the event as one of the highlights of their visit to Paola and he thanked Police Chief Jokerst and the Police Department for their assistance. Manager Wieland reported that Chief of Police Jokerst graduated from the Kansas Law Enforcement Academy. Manager Wieland reported that on Thursday afternoon he will be accompanying the Paola delegation as they visit the City of Mulvane as part of the Kansas State University “First Impressions Program”. Agenda Item 7 - MISCELLANEOUS MATTERS FROM THE COUNCIL Council Member Wilhoite congratulated Chief of Police Jokerst on his graduation from the Kansas Law Enforcement Academy. Council Member Wilhoite made a motion to adjourn to Executive Session, to include the Council, City Manager, City Clerk, Chief of Police, and City Attorney, for 10 minutes for the purpose of a consultation with an attorney for the governing body which is deemed privileged in the attorney-client relationship.; the regular meeting to reconvene at 6:50 p.m. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 3 to 0. At 6:50 pm the Council came out of Executive Session and Council Member Nickelson made a motion to reconvene the adjourned meeting. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 3 to 0. No action was taken pursuant to the Executive Session.
