MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. May 12, 2020 With Council in-person at 202 E Wea and Public to join by Zoom The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Dave Smail, Trent Upshaw, Leigh House and Aaron Nickelson. Council Members absent: None Also present: City Manager Sid Fleming, Assistant City Manager Randi Shannon, City Clerk Stephanie Marler, Public Works Director Kirk Rees, Police Chief Don Poore, Brian McCauley with the Miami County Republic, Greg Vahrenberg with Raymond James and others CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. ROLL CALL: Mayor Stuteville and Council Members Smail, Upshaw, House and Nickelson were all present. PROCLAMATION: Mayor Stuteville presented a proclamation naming May 2020 as Community Action Month. Agenda Item 1 - CONSENT AGENDA a. Approval of minutes of the meeting of April 14, 2020. b. Approval of Salary Ordinances 20-8 and 20-9. c. Approval of Appropriation Ordinances 925 and 926. d. Approval of the Pledged Collateral Report for April 2020. e. Approval of the Journal Entries Reports for April 2020. Council Member Nickelson made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member House and all voted aye. The motion passed 4 to 0. Agenda Item 2 - COMMENTS FROM THE PUBLIC: Agenda Item 3 – NEW BUSINESS Paola City Council Minutes – May 12, 2020 Page 1 Agenda Item 3a – Consider the annexation of property containing 11.62 acres of land, located east of Old KC Road and north of Rockwood Estates in Miami County, Kansas. Manager Fleming explained on April 9, 2020 Chance and Dennis Doherty submitted a Consent for Annexation of an 11.62-acre tract of land north of Rockwood Estates. He stated the landowner intends on using the land for residential development but there have not been any formal utility extension plans submitted at this time. Manager Fleming noted once the consent is filed with the city, the city only has to pass an Ordinance to accomplish annexation of the land. Council Member Nickelson asked how the land is zoned. Manager Fleming stated currently the land is agriculture but once construction begins it will change to residential. With no further discussion Council Member Smail made a motion to approve AN ORDINANCE ANNEXING LAND TO THE CITY OF PAOLA, KANSAS. The motion was seconded by Council Member Upshaw and all voted aye. The motion passed 4 to 0 and was given Ordinance No 3158. Agenda Item 3b – Consider an Ordinance authorizing the refunding of General Obligation bonds. Manager Fleming introduced Mr. Greg Vahrenberg with Raymond James to discuss the issuance of Refunding Bond 2020. Mr. Vahrenberg reminded the Council at the April 14th Council meeting they adopted Resolution 2020-008 declaring it necessary to offer the sale of the City’s 2012 GO refunding bond. Mr. Vahrenberg explained the city received an A+ rating with Standard & Poore so the bond was favorable to investors. The City received a savings of $232,727 that will be taken up front as opposed to spread out over the 11-year life of the $4,140,000 bond. Mr. Vahrenberg said the current interest rate is 3.01% and will drop to 1.90% with the sale. Mr. Vahrenberg explained the Council would need to take action to adopt the Bond Ordinance and the Bond Resolution. Upon adoption the closing of the bond would take place on June 4th. With no further discussion Council Member Upshaw made a motion to approve AN ORDINANCE OF THE CITY OF PAOLA, KANSAS, AUTHORIZING THE ISSUANCE OF THE CITY’S GENERAL OBLIGATION REFUNDING BONDS, SERIES 2020, IN THE PRINCIPAL AMOUNT OF $4,140,000, FOR THE PURPOSE OF REFUNDING CERTAIN OUTSTANDING GENERAL OBLIGATION BONDS OF THE CITY; PROVIDING FOR THE LEVY AND COLLECTION OF AN ANNUAL TAX TO PAY PRINCIPAL OF AND INTEREST ON SUCH BONDS; AUTHORIZING RELATED DOCUMENTS AND ACTIONS; AND MAKING COVENANTS WITH RESPECT TO THE BONDS. The motion Paola City Council Minutes – May 12, 2020 Page 2 was seconded by Council Member Smail and all voted aye. The motion passed 4 to 0 and was given Ordinance No 3159. Agenda Item 3c - Consider a Resolution authorizing the refunding of General Obligation bonds. Council Member House made a motion to approve A RESOLUTION PRESCRIBING THE FORM AND DETAILS OF AND AUTHORIZING AND DIRECTING THE SALE AND DELIVERY OF GENERAL OBLIGATION REFUNDING BONDS, SERIES 2020, IN THE TOTAL PRINCIPAL AMOUNT OF $4,140,000, OF THE CITY OF PAOLA, KANSAS, PREVIOUSLY AUTHORIZED BY ORDINANCE NO. 3158 OF THE CITY; MAKING COVENANTS AND AGREEMENTS PROVIDING FOR THE PAYMENT AND SECURITY OF THE BONDS; AND AUTHORIZING RELATED DOCUMENTS AND ACTIONS. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0 and was given Resolution No 2020-009. Agenda Item 4 - COMMITTEE REPORTS – None. Agenda Item 5 - STAFF REPORTS Manager Fleming notified the Council Waste Management will resume the 1 bulky item per month pickup on June 1st. He mentioned staff is working on a plan for spring cleanup. Manager Fleming gave an updated on the re-opening of City buildings. Due to COVID-19 restrictions the buildings will resume services in phases. Chief Poore asked for prayers for the Police Officer killed in Overland Park and said he and his staff will attend services. Chief Poore thanked Public Works for all the work they have done for the dog park. He said the dog park now has signs and waste receptacles so the committee would like to do a soft opening on May 18th with a grand opening at a later date. Public Works Director Rees said he would like for the City to get more involved in right of way work being done in town. Agenda Item 7 - MISCELLANEOUS MATTERS FROM THE COUNCIL Council Member Smail asked if progress had been made on the dangerous structure at 115 W Wea. Assistant Manager Shannon said the door has been secured but no plans have been submitted. Council Member House announced Harvesters, who distribute food from Cross Point Church, have given out 100,000 pounds of food in the last 2 months. She mentioned several businesses have gotten involved and donated to Harvesters. Paola City Council Minutes – May 12, 2020 Page 3 Council Member Nickelson asked if a crosswalk could be installed at the curve on Hospital Dr. at 303rd. Council discussed the 2020 pool season and due to staffing, time-line, and COVID-19 restrictions decided it would not be possible to open the pool. Agenda Item 8 - MISCELLANEOUS MATTERS FROM THE MAYOR Mayor Stuteville asked the Council to consider the appointment of Sid Fleming to the Miami County Economic Advisory Board. Council Member Nickelson made a motion to approve the appointment of Sid Fleming to the Miami County Economic Advisory Board. The motion was seconded by Council Member Smail and all voted aye. Agenda Item 11 – ADJOURNMENT With no additional business to come before the Council, Council Member Upshaw made a motion to adjourn. The motion was seconded by Council Member Smail and all voted aye.
