MINUTE RECORD PAPILLION CITY COUNCIL MINUTES TUESDAY, NOVEMBER 7, 2023 (&. 7: 00 P. M. The City Council of the City of Papillion met in open and public session in the City Council Chambers at Papillion City Hall, 122 E Third St, on November 7, 2023, at 7: 00 PM. City Clerk Nicole Brown called the roll. Present were Councilmembers Steve Sunde, Tom Mumgaard, Jason Gaines, Jim Glover, David Fanslau, Bob Stubbe, Steve Engberg, and Mayor David P. Black. Councilmember Lu Ann Kluch was absent. Also present were City Administrator Amber Powers, Deputy City Administrator Mark Stursma, Finance Director Nancy Hypse, Recreation Director Tracy Stratman, Parks and Facilities Director Tony Gowan, Deputy Police Chief Orin Orchard, City Attorney Nicole Rutter, Planning Director Travis Gibbons, Fire Chief Robb Gottsch, Public Works Director Michael Kleffner, Human Resources Director Carrie Svendsen, Library Director Matt Kovar, Assistant City Attorney Carla Heathershaw Risko, and Communications Manager Trent Albers. Mayor Black led those present in the Pledge of Allegiance. Public announcement that a current copy of the Open Meetings Act is posted in the Council Chambers. Proclamation: Mayor Black presented a Proclamation to Michael Simmons from the Parks and Facilities Department for being named Sarpy County District 1 Veteran of the Year. Presentation: Fire Chief Gottsch introduced Russ Zeeb and Lisa Beacom from PVFD Inc. Mr. Zeeb briefly explained their AED donation program. Ms. Beacom presented donated AEDs for City Hall and the Papillion Landing Softball Complex. ADMINISTRATOR' S REPORT: Administrator Amber Powers provided an update: ( 1) City Congratulations to Mr. Simmons for being Sarpy County District 1 Veteran of the Year; ( 2) A successful Halloween Safe Night was held on October 26th; ( 3) Seventh Street Park has new installed; ( 4) Winter Wonderland is on November 25th; ( 5) There will be a game equipment Day Ceremony at Veterans Park on November 11th; ( 6) City Offices will be closed on Veteran' s November 10th in observance of Veteran' s Day. ORDINANCES FIRST READING: ORD. 2015 - An ordinance to amend the FY2023- 2024 Budget- Nancy Hypse- 597- 2020. Introduced by Councilmember Engberg. ORDINANCES SECOND READING AND PUBLIC HEARING: ORD. 2013 - An ordinance to approve a Change of Zone from AG ( Agricultural) to MU Mixed Use), R- 4 ( Multiple- Family Residential), and RE ( Residential Estates) for the property legally described as part of Tax Lot 7, Section 12, T13N, R12E of the 6th P. M., Sarpy County, NE, generally located on the SE corner of S 72nd St and Capehart Rd. The applicant is Gene Graves. ( Oak Leaf Phases 2- 5)- Travis Gibbons- 597- 2077. Mayor Black opened the public hearing and called for proponents and opponents. Proponents: Larry Jobeun, Fullenkamp, Jobeun, Johnson & Beller, 11440 W Center Rd, Omaha, provided a brief overview of the project. Jake Hoppe, Hoppe Development, 301 S 57th St, Omaha, explained the multi- family residential area being proposed. Mr. Hoppe stated that the multi- family residential area will consist of affordable housing and explained the proposed design of the development. Ben Kunz, Hoppe Development, 5631 S 48th St, Lincoln, explained the different housing types proposed to be built and the different types of housing for the various levels of affordability. Councilmember Mumgaard asked what triggered the request to revise the Preliminary Plat. Mr. Jobeun explained that these revisions are specific to the proposed development. Councilmember Mumgaard stated that he generally likes what is being proposed. 4 November 7, 2023  Councilmember Engberg asked if the design of the affordable housing is similar to what the missing middle concept defines as cottages. Mr. Kunz briefly explained what the different housing types would look like and their varying square footage. Councilmember Engberg asked if they are separate housing units. Mr. Kunz stated they are row housing. Councilmember Engberg clarified that some of the units could be privately purchased and some would be rentals. Mr. Kunz stated that is correct. Councilmember Fanslau asked if more information could be provided about how the development would assure affordability. Mr. Hoppe explained that the key affordable housing program they are using is low-income housing tax credits that are administered by the state of Nebraska. Mayor Black briefly explained the tax credits and their requirements. Mr. Hoppe stated that there is long- term oversight to ensure affordability is maintained. Councilmember Stubbe asked for more information on the proposed collaboration with Habitat for Humanity. Mr. Hoppe explained Habitat for Humanity' s role in this project. Councilmember Engberg asked if Omaha' s Front Porch Program is similar to the program that will be used for this development. Mr. Hoppe noted the differences between the two programs. R23- 0173 — PUBLIC HEARING AND VOTE — A resolution to approve a Revised Preliminary Plat for the property legally described as part of Tax Lot 7, Section 12, T13N, R12E of the 6th P. M., Sarpy County, NE, generally located on the SE corner of S 72nd St and Capehart Rd. The applicant is Gene Graves. ( Oak Leaf)— Travis Gibbons— 597- 2077. Mayor Black opened the public hearing and called for proponents and opponents. Proponents: Larry Jobeun, Fullenkamp, Jobeun, Johnson & Beller, 11440 W Center Rd, Omaha, briefly explained the Revised Preliminary Plat and stated that he was available for any questions. Mayor Black stated for the record that all previous comments during the public hearing for El. ORD. 2013 would be carried over to this public hearing. Councilmember Gaines asked how many total units are in this development. Mr. Jobeun stated 600. Councilmember Gaines asked how many of those units are the government subsidized units that were being discussed. Jake Hoppe, Hoppe Development, 301 S 57th St, Omaha, explained that 200 units will be part of the tax credit program and an additional 45 units will be for sale with some sort of a supportive sale model. Councilmember Gaines asked if there are any single-family homes attached to any of these tax credit programs. Mr. Hoppe stated those are part of different funding programs and not the tax credit program. Councilmember Gaines asked what the average price of single- family homes will be. Mr. Hoppe explained that right now they would be around 300, 000, but the effective sales price to the family based on the funding program would be around $ 250, 000; Habitat's model will likely be lower. Councilmember Sunde asked if this is the federal government tax credit program. Mr. Hoppe stated that it is a federal tax credit program under the Nebraska Investment Finance Authority. Councilmember Sunde asked if there are rules established regarding eligibility. Mr. Hoppe confirmed there are. Councilmember Sunde asked if the federal government would have a say in 5 November 7, 2023  who gets to move into these particular units. Mr. Hoppe explained that the federal government regulates what income levels qualify for housing. Councilmember Sunde asked if demographic information will be considered. Mr. Hoppe stated that it is strictly income based. Opponents: None. No one else came forward and the public hearing was closed. Motion to approve RES. Mayor Black reminded those of upcoming present events: ( 1) There will be a Veteran' s Day Ceremony on November 11th at Veterans Park; (2) There will be Ribbon Cuttings for Chirpy' s Play Café on November 14tn and for the newly renovated Super Target on November 21st; ( 3) Winter Wonderland is on November 25th. Councilmember Stubbe asked for an update on the issue of red light runners brought forward by a citizen. Closed Session: Mayor Black stated for the record that the purpose of the closed session was to protect the public interest to discuss potential litigation. Councilmember Sunde requested that there be a five minute break prior to entering closed session so the public may meet with Council members and staff briefly. Mayor Black stated that closed session would begin in five minutes. Upon roll call vote, Sunde, Mumgaard, Gaines, Glover, Fanslau, Stubbe, and Engberg all voted yes. Voting no: none. Absent: Kluch. Motion passed. Mayor Black restated for the record that the purpose of the closed session was only to discuss potential litigation. Mayor Black then stated that the closedAdministrator, Deputy session would include the following: Mayor, City Council, City Administrator, City Clerk, City City Attorney, Assistant City Attorney, and Human Resources Director. The closed session began at 7: 48 PM. Upon returning from closed session, Mayor Black stated for the record that the only item discussed in closed session was potential litigation. Motion by Councilmember Gaines, second 6 November 7, 2023 by Councilmember Glover to come out of closed session. Upon roll call vote, Sunde, Mumgaard, Gaines, Glover, Fanslau, Stubbe, and Engberg all voted yes. Voting no: none. Absent: Kluch. Motion passed. Council returned from closed session at 8: 29 PM.
