PAPILLION PLANNING COMMISSION MEETING MARCH 27, 2019 T'he Papillion Planning Commission met in open session at the Papillion City Hall Council Chamber's on Wednesday, March 27, 2019 at 7: 00 PM. Chairwoman Rebecca Hoch called the mleetinig to order. Planning Assistant Andrea Blevins called the roll. Planning Commission members present were Howard Carson, John E. Robinson 111, Leanne Sotak, and Herb Thompson. David Barker, Raymond Keller Jr., Jim Masters, Judy Sunde, and Wayne Wilson were absent. Planning Director Mark Stursma, Assistant City Attorney Amber Rupiper, City Planner Michelle Riomeol, and Staff Engineer Derek Goff were also present. Chairwoman Hoch lead those present in the Pledge of Allegiance, Notice of the, meeting was given in advance by publication in the Papillion Times on March 13, 2019 and March 27, 2019. A copy of proof of publication is on file at the office of the City Clerk. Chairwoman Hoch announced that a copy of the Open Meetings Act is posted in the City Council Chambers. Motion carried. FINAL PLATS Finall Plat —A Final Plat for the property legally described as Tax Lot 3A1A1 , located in the SW 1/ 4 of Section 2, ' T13N„ R1 1 E of the 61"1 P. M., Sarpy County, NE, generally located on the NW 150th corner of S Street and Capehart Road. The applicant is Raven Northbrook, LLC. ( Sarpy County Power Park West Addition) FP -19- 0003 David Madden,, 1601 Dodge Street, Suite 3700 ( Omaha), stepped forward to represent the applicant. He contended that the applicant is confident that it can resolve the pending contingencies. Chairwoman Hoch called for discussion amongst the Commission. Mr. Carson iinuired as to whether the applicant has discussed the proposed realignment of S 150` Street with adjacent property owners. Mr. Madden confirmed that the applicant has been working with the west adjoining property owner, and that the applicant is working with this property owner to find a solution regarding access to the newly aligned street. Mr. Carson suggested that, in fairness to the adjacent property owner at 15306 Capehart Road, access should be provided to the newly aligned street at the developer' s cost. Mr. Madden reiterated that the applicant is vetting access for the aforementioned property owner. With ono further discussion, Motion was made by Mr. Robinson 111, seconded by Mr. Carson, to recommend approlval: of the Sarpy County Power Park West Addition Final Plat ( FP -19- 0003) because pit is generally consistent with the Comprehensive Plan as amended by City Council, compatiblie with adjacent uses, and compliant with Zoning and Subdivision regulations, contingent upon the resolution of staff comments. Roll Call: Five yeas, no nays. Motion carried. Final Plat —A Final Plat for the property legally described as Lot 15, 370 North, a subdivision in Siarply, County, NE,, generally located on the NW corner of S 1501h Street and HWY 370. The applicant is, Dowd Grain Co., Inc. ( 370 North Replat Two) FP -19- 0004 Chairwoman Hoch noted that consideration of thi's item would occur after the Motion and Vote for the 3701 North ' eplat Two Preliminary Plat. upon completion of the Motion and Vote the 370 North Replat Two Plat, on Preliminary Chairwoman Hoch called for consideration of the 370 North Replat Two Final Plat. Doug Kellner, 10836 Old Mill Road ( Omaha), stepped forward to represent the applicant and offered to answer questions. Chairwoman Hoch called for discussion amongst the Commission. Mr., Carson asked whether the engineering firm is responsible for sediment and erosion control. Mr. Kellner noted that the engineers design sediment and erosion control; however, contractors install and maintain such measures. Mr. Carson requested that the applicant remain cognizant of the development' s proximity to 1- 80 and HWY 370 while designing the necessary sediment and erosion control methods for the site. Mr. Carson asked about the timing of completion for the traffic signals at S 15011 Street and HWY 3170. Mr. Kellner,explained that the lights are installed and will be turned on once NDOTinspection 11 is final. He, noted that there is one temporary pole that will be replaced once the proposed S 1501h Street lane eXP,ansion is complete on the south side of HWY 370. With no further discussion, Motion was made by Mr. Carson, seconded by Ms. Sotak, to recommend approval of the 370 North Replat Two Final Plat FP -19 -coo because it is generally consistent with the Comprehensive Plan, compatible with adjacent uses, and compliant with Zoning and Subdivision regulations, contingent upon the resolution of staff comments. Roll Call: Five yeas, no nays,. Motion carried. Final RIalt A Final P'lat for the property legally described as part of the W1/ 2 of the NW1/ 4 of Section 1219, T14N, R12E of the 6th P. M., Sarpy County, NE, generally located NE of S 12001 Street and Lincoln Road, The applicant is Pine Crest Homes, LLC. ( North Shore 2) FP -19- 0005 The applicant was not present. Chairwoman Hoch called for discussion amongst the Commission 2 Planning Commission March 27, 2019 Mr., Carson asked whether the Planning Commission should continue consideration of this item to a time when the applicant can be present. Ms. Rupiper and Mr. Stursma noted that the applicant is not required to be present. Chairwoman Hoch suggested that she would be comfortable recommending approval without the applicant present due to the minor nature of the contingencies. With no further discussion, Motion was made by Mr. Robinson 111, seconded by Mr. Carson, to recommend approval of the North Shore 2 Final Plat ( FP -19- 0005) because it is generally the Comprehensive Plan, compatible with adjacent uses, and compliant with consistent with Zoning and Subdivision regulations, contingent upon the resolution of staff comments. Roll Call: Five yeas,, no, nays. Motion carried. PUBLIC HEARINGS Spielc1all fuse Permit —A z5pecial Use Permit to allow Commercial Recreation ( Controlled Impact) as a permitted use on the property legally described as Tax Lot 3A1A2, located in Section 2, T1 X11 E of the 6th P. M., , harpy County, NE, generally located at 12370 S 15011 Street. The 13N$ applicant is, Haven150. ( Haven150) SUP -19- 0002 Chairwoman Hoch opened the public hearing. Kelvin, Zach, 12370, S 150th Street, stepped forward as the applicant. He explained that he intends to create a venue that would host events geared toward the special needs community. He noted that a barn has been moved onto his property that he intends to restore. Mr. Zach added that the venue would likely also host other events such as corporate retreats to generate revenue. Mr. Zach described that accessibility takes priority at the site. Chairwoman Hoch called for further proponents and opponents. Seeing no public input, Chairwoman Hoch closed the public hearing and called for Commission Discussion. Mr. Carson asked why the Planning Commission Staff Report refers to the proposed use as temporary. Mr. Stursma explained that the permitted use would not run with the land, and would only be applicable to the current property owner. Ms. Sotak offered her support to the project. She inquired as to the proposed or existing use of the land to the north this property, Mr. Stursma explained that the Omaha Box aired west of Company developing pis a warehouse on the property to the north. He added that the properties. to the west are rural in nature. Ms. Sotak inquired to the potential for increased traffic. Mr. Zach explained that he anticipates that most groups, would travel to the site via van or small bus, which would limit traffic during such events,. He suggested that once development of the adjacent Facebook campus is complete, traffic on S 15,001 Street should significantly decrease. Ms. Soltak asked about the proposed capacity of the 'Indoor venue. Mr. Zach explained that the maximum capacity would be approximately 260; however, he anticipates that the majority of events will host 50- 100 people. Mr. Thompson the asked whether proposed parking is adequate. Doug Kellner, 1081361 Old Mill Road ( Omaha), stepped forward to represent the applicant. He explained that the request is to replat Lot 15, 370 North. He noted that the applicant anticipated that this, replat would be necessary during the platting of the 370 North subdivision. Chairwoman Hoch called for proponents and opponents. Seeing no further public input, Chairwoman Hoch closed the public hearing and called for Commission Discussion. Mr. Carson askeld about the anticipated users on the replatted lots. Mr. Kellner stated that there would be something large, however, he could not divulge who the prospective buyers are at this time. He niot,eld that several of the lots have potential buyers. With no further discusisilon,, Motion was made by Mr. Robinson III, seconded by Mr. Carson, to recommend approval of the 370 North Replat Two Preliminary Plat ( PP- 19- 0001) because it is generally consistent with the Comprehensive Plan, compatible with adjacent uses, and compliant with Zoning and Subdivision regulations, contingent upon the resolution of staff comments. He explained that this annexation encompasses the property pending platting for Sarpy County Plower Piarlk 'West Addition. He added that the purpose of this annexation is to support Raven Northbrook LLC with the proposed realignment of S 150th Street, Mr. Stursma explained that 4 Planning Commission March 27, 2019 bringing this property within city limits would allow for the appropriate right-of-way exchange necessary for the aforementioned realignment. Ms. Rupiper added that bringing the property within Papillion city limits would also allow this portion of the camplus to be served by the Papillion/ La Vista Fire Department, which is important to the applicant. Chairwoman Hoch called for proponents and opponents. Seeing no further public input, Chairwoman Hoch closed the public hearing and called for Commission Discussion. With ono further disicussion, Motion was made by Mr. Carson, seconded by Mr. Robinson 111, to recommend approval of the version of Ordinance No. 1838 — 2019 Annexation No. 1 ( MISCO - 19- 7) based on consistency with the Annexation Policy found in the Comprehensive Plan. Ordinance No. 18319 oning Map Amendment - An ordinance to change the official Zoning Map of the, City, of Papillion in accordance with Section 205-32 of the Papillion Municipal Code to adopt a Zoning Map and to apply existing or future zoning regulations, property use regulations, building ordinances, electrical ordinances, plumbing ordinances, and all other regulatory ordinances, of the, City, of Papillion pursuant to Neb. Rev. Stat. § 16- 901. The applicant is the City of Papillion. MISC- 1119- 10008 Chairwoman Hoch opened the public hearing 31d Planning Director Mark Stursma, 122 E Street, stepped forward to represent the applicant. He explained that anytimle an annexation extends the City' s extra -territorial jurisdiction, a zoning map amendment is necessary. He summarized the zoning conversion for those properties being brought into the extra -territorial jurisdiction from Sarpy County. Chairwoman Hoch called for proponents and opponents. Seeing no further public input, Chairwoman Hoch c1losed the public hearing and called for Commission Discussion. With no further discussion, Motion was made by Mr. Robinson 111, seconded by Mr. Carson, to recommend approval of the version of Ordinance O. 1839 —Zoning Map Amendment ( MISC- 19_ CCC 18based on consistency with § 205- 32 of the Zoning Regulations.
