PRE-COUNCIL MEETING CITY OF PASADENA October 15, 2019 – 5:30 p.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. Mayor Wagner announced that Pastor Gary Hamrick was unable to attend meeting; he would find someone else to give the invocation before the meeting started. (15) PERSONNEL CHANGES: Councilmember Casados – Questioned if there were any plans to lay off employees or police officers. Mayor Wagner responded “Absolutely not”. (19) (A) (1) – FINAL READINGS: Ordinance 2019-168 – Mayor Wagner advised this ordinance would be deferred. Ordinance 2019-175 – Councilmember Harrison requested this item be deferred. Stated he needed more information in order to support it at this time. Mayor Wagner asked Kathy Perez, Health Director, to clarify. Short question/answer session and comments followed between Councilmembers Harrison, Ybarra and Schoenbein and Kathy Perez. (19) (A) (2) – FIRST READINGS: Item O & Item Q – Mayor Wagner advised both of these items would be deferred. Item A – Councilmember Ybarra asked Robin Green, Public Works Director, to explain item. Robin responded. Item H – Councilmember Casados asked if this is Federal money being given. Mayor Wagner asked Melissa Quijano, Housing Director, to respond. Item I – Councilmember Ybarra questioned if this was the same group that had some compliance issues. Melissa Quijano responded. Go Astros. Councilmember Bass – Go Astros. Acknowledged former Councilmember LeRoy Stanley in the audience. Councilmember Schoenbein – Wished everyone a good evening. Also wished the Astros good luck. Stated he had the opportunity to attend the open house of Kirby Fire Station #6. Thanked the volunteer firemen for all they do. Announced the El Jardin community would be having a festival on Saturday, October 19 th. Encouraged everyone to go and enjoy the activities. Councilmember Ybarra – Wished Jim Dilley a happy retirement, thanking him for his years of service with the Police Department. Noted he attended training on a new law that passed concerning Legislative Code 551.007 - Public Testimony, proceeded to read the code to audience. City of Pasadena – Council Meeting 2 Minutes: 10-15-19 6:00 p.m. Councilmember Leamon – Thanked everyone for coming to the meeting. Also thanked Jim Dilley for the CD he was given, commenting he has heard Jim sing many times and appreciates the gift. Stated this year, for the first time, he had four neighborhoods in his district participate in National Night Out. Thanked everyone for coming out for that. Councilmember Harrison – Thanked Officer Jim Dilley for the music CD he was given. Gave current score of the Astros game, predicted they will go to the World Series this year. Councilmember Casados – Thanked everyone for coming to the meeting. Apologized for not wearing his suit and tie to Council, stating he just got off of working a shut down. Thanked Jim Dilley for his years of service as well as for the music CD. Councilmember Wheeler – Thanked everyone for coming out. Also thanked Jim Dilley for his service to the City. Recognized the Scouts and American Legion in the audience. CITIZENS WISHING TO ADDRESS COUNCIL Robert Jeter III – Read a section of the Texas Transportation Code 720.002 – Prohibition on Traffic Offense Quotas. Stated it has been brought to his attention that quotas have been implemented in the City and asked that a memo be sent department wide to discontinue this policy. Jim Dilley – Stated he wanted to first and foremost thank God for “allowing me to be living proof of a loving God to a watchful world”. Thanked all the Mayors and City Council through the years for being able to serve the City. Gave background of his 35 years of service being an officer. Commented he has had some ups and downs in his career but has no regrets, he is now going to be a lot more active in his community. Sylvia Mourtakos – Water Billing Manager. Explained she was at the meeting to provide information and clarification of the Water Department’s regulations. Referenced the City’s Code of Ordinances Chapter 37. Addressed complaints received concerning citizens not receiving bills, the process of calling or emailing after past due date and current status of eBill options. Urged citizens to call if they have any questions or concerns. John Quinlan – Announced that he was the owner of the mall next door to City Hall. Has been working with the City for over a year to try and redevelop this property. Stated that time is critical and unless the City agrees to a deal the mall will not survive after the holiday season. Gave reasons he feels that redevelopment of this property will positively affect Pasadena. Joseph Thomas – 22nd District Commander, American Legion. Thanked Mayor Wagner for attending the Veterans Town Hall meeting the previous Saturday. Stated at that meeting they announced plans to work with Congresswoman Sylvia Garcia to help provide a community based out-patient clinic for veterans to supplement what is being done at the V.A. hospital. They are also working on redeveloping an American Legion Baseball team, as well as the American Legion Junior Shooting Sports program. Councilmember Wheeler – Stated that during Pre-Council he asked Mayor Wagner about unfounded rumors he had heard regarding the City laying off employees and police officers, was assured by the Mayor that those rumors were not true. City of Pasadena – Council Meeting 5 Minutes: 10-15-19 6:00 p.m. Councilmember Schoenbein – Congratulated Jim Dilley on his retirement, commented it is “well deserved and well earned”. Councilmember Bass – Also congratulated Jim Dilley, stating he has been a friend for a long time. Councilmember Ybarra – Commented on an internal email that went out concerning the Police Department compressed pay scale. Explained why he was against the 14-year pay scale and would rather see a 12-year pay scale. Would like to negotiate with administration on this. Councilmember Harrison – Stated it has been said the City employees were going to get a cost of living increase and the Police Department will get a compressed pay scale, he supports this and is waiting for it to come up on the agenda so he can vote for it. Councilmember Casados – Advised Mayor Wagner he wished to make an amendment. Councilmember Casados moved, seconded by Councilmember Wheeler that Personnel Changes be AMENDED as follows: “To delete the position of Chief of Staff.” Mayor Wagner – Stated that the motion is not going to be granted as it is not part of Personnel Changes. Councilmember Casados – Remarked that it is part of what they are doing. Mayor Wagner – Ruled against amendment. Councilmember Harrison – Raised Point of Information, noting this amendment did fall under Personnel Changes, that following Robert’s Rules of Order and City Charter it has been done before and can be done. Mayor Wagner – Explained that the motion was not written and handed into his office, the motion will not be granted. **NOTE** At this time, there was a short exchange between Councilmember Casados and Mayor Wagner. Councilmember Cayten - Commented the only way to delete a position is at budget time by making an amendment to the budget. Mayor Wagner – Stated the motion would not be accepted at this time. **NOTE** At this time, Councilmembers Casados, Wheeler and Harrison began talking simultaneously, at which time Mayor Wagner gaveled meeting back to order, noting they were “out of order”. Following this exchange, there were comments and back/forth exchange between Councilmembers Wheeler, Casados and Leamon and Mayor Wagner. Mayor Wagner gaveled meeting back to order. ORDINANCE 2019-170 - Approving agreement with HR Green, Inc. for construction phase and additional services for Shaw Street Reconstruction Project (CIP #S107) for a total appropriation of $77,100.00 to be funded from the 2008 Street Bond Account. City of Pasadena – Council Meeting 7 Minutes: 10-15-19 6:00 p.m. Councilmember Casados moved, seconded by Councilmember Wheeler that Personnel Changes be AMENDED as follows: “To add the Fire Marshal employees under the compressed pay scale with the police officers.” **NOTE** At this time, there was an exchange between Mayor Wagner and Councilmembers Casados and Wheeler regarding this amendment. Councilmember Wheeler – Raised Point of Information, commenting on the process of making an amendment. Councilmember Leamon – Commented that the previous administration had the same policy. Councilmember Cayten – Stated he agrees with Councilmember Leamon’s comments regarding the previous administration having the same process. Councilmember Harrison – Disagrees with an earlier comment made by a Councilmember that you can only make a Personnel amendment during budget. Mayor Wagner – Motion to amend denied. **NOTE** At this time, there was an exchange between Councilmember Wheeler and Mayor Wagner regarding this amendment. Councilmember Schoenbein – Explained that in order to vote on an item you have to know what you are voting on. The process is in place in order to be able to be informed before voting. **NOTE** At this time, there was another exchange between Councilmember Wheeler and Mayor Wagner regarding this amendment. Councilmember Casados stated a member from the audience wanted to speak. Mayor Wagner denied the request. The audience member started speaking; INAUDIBLE, Mayor Wagner stated she could not speak at that time. Councilmember Ybarra – Called for Point of Information. Mayor Wagner – Explained the new law states citizens can speak “before or after” meeting. **NOTE** Councilmember Ybarra continued talking over Mayor Wagner. Mayor Wagner continued with meeting. MOTION CARRIED, UNANIMOUS. ORDINANCE 2019-173 - Accepting a grant award of $42,000.00 from the State of Texas Office of the Attorney General, Victim Coordinator and Liaison Grant program. ORDINANCE 2019-174 - Approving contract with Horseshoe Construction, Inc. for the 2015 CDBG-DR Sanitary Sewer Rehabilitation Project (CIP #WW061) in the amount of $398,351.00, with a contingency of $23,265.64 which is about 5.8%, for a total appropriation of $421,616.64 from the Community Development Block Grant Disaster Recovery 2015 Flood Allocation. Councilmember Ybarra moved, seconded by Councilmember Leamon that Ordinance 2019-175 be passed on second and final reading. Councilmember Ybarra - Stated he will be voting on this item but would like to get some more information. Councilmember Harrison – Explained reasons he was hesitant at first to support this item but received clarification in Pre-Council. ORDINANCE 2019-182 - Purchase of two 2020 Pierce Impel Pumper Trucks from Siddons-Martin Emergency Group; $1,298,648.30. ORDINANCE 2019-183 - Agreement with The Bridge Over Troubled Waters for Emergency Solutions Grants (ESG) funds of $46,637.77 to provide rapid re-housing services. City of Pasadena – Council Meeting 11 Minutes: 10-15-19 6:00 p.m. ORDINANCE 2019-186 - Commitment between Community Development Department and Parks and Recreation Department (Madison Jobe Senior Center) for Community Development Block Grant (CDBG) funds of $154,812.45 to provide transportation services to elderly and/or disabled residents.
