PRE-COUNCIL MEETING CITY OF P AS ADENA May 19, 2020 – 5:30 p.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. Absent: Councilmembers Ybarra, Casados and Wheeler (13) PROGRESS PAYMENTS – Councilmember Schoenbein commented on how fortunate Pasadena is to be in a good financial position and can pay its bills; that this is not the case for many other cities with the ongoing pandemic situation. (19) (A)-(1) – FINAL READINGS: It was agreed by Mayor and Council that Final Readings be read as consent agenda items. Ordinance 2020-058 – Councilmember Schoenbein talked about how now may be an opportunity to expand hike and bike trails in our city. Councilmember Harrison discussed some property that was purchased during the Manlove Administration that could possibly be utilized for a hike and bike trail. (19) (B) – RESOLUTIONS: Item (A) – Councilmember Harrison requested that this item be read and voted upon separately. Mayor Wagner asked if he (Harrison) would like to discuss it now to perhaps get answers to any questions he may have; Councilmember Harrison declined, stating he would discuss it at the council meeting. Mayor Wagner noted this item would be read separately. OTHER ISSUES: Councilmember Leamon – Asked how much longer before our city would open parks for kids. Mayor Wagner responded that hopefully by June 1st; however, that City has to “follow guidelines”. ADJOURNMENT 5:43 p.m. – Mayor Wagner adjourned the Pre-Council Meeting. Wagner. ROLL CALL COUNCIL PRESENT: Jeff A. INVOCATION – Pastor Ken Durham, Juncture Church PLEDGES OF ALLEGIANCE – Councilmember Phil Cayten COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Cayten – Urged all to continue to be safe and to have a safe Memorial Day. Councilmember Bass – Cautioned everyone to be safe. Announced the Pet Food Distribution is scheduled May 21st from 10:00 a.m. until 12 noon at Pasadena Memorial Park. This will be a “first-come first-serve” event. Lineup begins at 9:30 a.m. with no early arrivals. Announced the birth of his first grandson, Logan Edward Bass, born on May 18th weighing 6 lbs. and 14 oz. Proud parents are son, Brandon Bass and his wife, Tina. Mayor Wagner – Extended congratulations to Councilmember Bass on his grandson. Councilmember Schoenbein – Congratulated Councilmember Bass on his new grandson. Mentioned the proactive actions taken by our city regarding the coronavirus to keep City employees and citizens safe during this time. Noted it will take time for things to get back to normal and that the administration is working hard on this process. Asked that everyone be patient and continue to be safe as things open up. Councilmember Ybarra – Reminded everyone that Monday is Memorial Day and for us all not to forget what the meaning of this holiday is – the ultimate sacrifice of our men and women in the military. Congratulated Councilmember Bass on his grandson. Councilmember Leamon – Commented that although some things are returning to normal, everyone should continue to practice social distancing and other precautions City of Pasadena – Council Meeting 2 Minutes: 05-19-20 6:00 p.m. put in place during this time. Hopes all will be safe over the Memorial Day weekend. Congratulated retirees and wished them well on their retirement, commenting he has known Lloyd Hatley since high school. Wished wife, Sylvia, a happy 45 th wedding anniversary. Councilmember Harrison – Extended happy wedding anniversary wishes to Councilmember Leamon and wife, Sylvia, commenting Sylvia is “one of the kindest persons he ever met”. Talked about Houston raising its homestead exemption from $200,000 to $280,000 for seniors and the disabled. Reminded all of Memorial Day on May 25th, noting that we will “never forget” those men and women who sacrificed their lives. Also, that we keep our active veterans in our minds as well. Discussed the importance of participating in the 2020 Census and how it affects our city and community. Urged everyone to fill out the census paperwork by the extended deadline of mid-August. Mayor Wagner – Thanked Councilmember Harrison for his remarks regarding the 2020 Census. CITIZENS WISHING TO ADDRESS COUNCIL **NOTE** At this time, Councilmember Ybarra raised a Point of Information asking whether or not those addressing Council could speak on any topic or just topics relating to the Agenda. Mayor Wagner responded that comments were not limited to just those pertaining to Agenda. Discussion followed between Mayor Wagner and Councilmembers Ybarra and Harrison followed by a Point of Information raised by Councilmember Schoenbein on remarks allowed from citizens, commenting on the importance of listening to them. Councilmember Leamon responded to discussion. Robert Jeter III – Talked about the incident at last council meeting when he was not allowed to complete his remarks to Council. Discussed Texas Penal code 39.03 “Titled Official Oppression” and discussed how it affects members of Council. Also, mentioned selective discrimination and the issue he has when councilmembers “praise another elected official on a regular basis” but with statements that are not always factual. Further, discussed how he feels such statements should be handled. Cristina Womack – President & CEO, Pasadena Chamber of Commerce. Opened her remarks noting that the Chamber continues to support initiatives for our community. Made several announcements and discussed upcoming events: (1) weekly webinar this Thursday, May 21st (2) “Paint the Town for Pasadena Seniors”. Discussed ways that people and businesses can participate with this initiative to honor our seniors who have been impacted by school closures due to the coronavirus and (3) Breakfast with Champions on June 3rd – a drive-by event being hosted by South Main Baptist Church in its parking lot. High school principals will be talking about how they have had to adapt for the graduation of 2020 seniors. Information on all these events are available at www.pasadenachamber.org. Stephen Alvarez – Discussed the medical condition of his mother, how he cares for her and how her condition prompted him to make renovations at his home for the handicapped. Explained problems he has incurred from beginning of this process to where it stands now and issues he has encountered with the City following a complaint City of Pasadena – Council Meeting 3 Minutes: 05-19-20 6:00 p.m. by his neighbor regarding those renovations. Stated he was at meeting to urge help from Council on this matter. Michael Courtney – Stated he was at meeting to “plead for help from Council”. Proceeded to discuss why he feels City should give the disabled a reduction on water bills. Discussed reasons why he likes Councilmember Harrison, commenting he feels that he (Harrison) “has the City’s interest at heart”. Finally, cautioned City on situation at Little Caesar’s Pizza, advising there was “almost another wreck last weekend”. Appreciates all going on in the City. Robert Marquez – Stated he is a new homeowner in Pasadena after purchasing a relative’s house that was built in 1965. Mentioned the heavy rain last Friday in our area resulting in five inches of water which caused flooding in areas of the City. Noted that he has talked with his neighbors and learned that flooding was never a problem in his neighborhood until after construction off Fairmont. Further, that following repeated calls to City over the years regarding this issue, nothing to date had been resolved. Discussed measures that could be taken by City to help alleviate this problem. Advised he had contacted the City previously and has had conversations with some employees over this issue, but wanted to address it at Council for “public record”. ORDINANCE 2020-064 - Granting to BAYMARK PIPELINE, LLC (BAYMARK) the right, privilege, and franchise and permit to lay, replace, construct, repair, maintain, operate, and remove one (1) 12” Ethylene pipeline(s) routed on and across parcels of land the centerline and route of which as shown on the attached plats and the courses and distances descriptions in the attached Exhibit “A”, incorporated herein for all purposes, all in the corporate limits of the City of Pasadena, Texas, and in accordance with plans and specifications heretofore filed with the Department of Public Works, and the Department of Planning; prescribing the terms and conditions under which said right, privilege, franchise, and permit is granted; and providing for acceptance. Councilmember Schoenbein – Strongly suggests that the City enforces language in pipeline contracts to ensure that land is replaced to the condition it was in prior to any work performed by contractors. EMERGENCY READINGS ISSUANCE OF OBLIGATIONS RESOLUTIONS RESOLUTION 2020-080 – Authorizing and approving a grant application by the City of Pasadena, Texas under the Congestion Mitigation Air Quality’s (CMAQ) Commuter and Transit Pilot Projects, Grant #TRN18-06 to fund the Pasadena Micro Transit Initiative, if awarded for three years with a 20% match. Councilmember Cayten moved, seconded by Councilmember Bass that Resolution 2020-080 be passed, approved and adopted. Councilmember Ybarra – Understands this is for a grant. However, stated that during the nine years he has served on Council, he does not recall a single resident asking about mass transit. He will not be voting for this item. Councilmember Harrison – He too understands this is a grant. Explained why he feels there is a need for public transportation in our city. Also, discussed reasons why he will not support this resolution. Councilmember Schoenbein – Responded to a comment by Councilmember Harrison pertaining to “public transportation for profit”. Explained that this grant will provide the City with funds which will enable the City to offer a transit system without a “massive undertaking financially”. Further, that this system will allow the flexibility to move routes around as needed and give a three-year window of time to evaluate transit needs for our city, etc. MOTION CARRIED AS FOLLOWS: “Ayes” – Councilmembers Leamon, Cayten, Bass, Schoenbein and Mayor Wagner “Nays” – Councilmember Ybarra and Harrison RESOLUTION 2020-081 – Authorizing and approving adoption of the 2020 Harris County Multi-Jurisdiction Multi-Hazards Mitigation Plan (HMP) as the Multi-Hazards Mitigation Plan for the City of Pasadena. Councilmember Harrison moved, seconded by Councilmember Bass that Resolution 2020-081 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2020-082 – Accepting an award from the Coronavirus Emergency Supplemental Fund Grant from the U.S. Department of Justice, Office of Justice City of Pasadena – Council Meeting 9 Minutes: 05-19-20 6:00 p.m. Programs, Bureau of Justice Assistance for the federally allocated amount of $157,518.00. Councilmember Harrison moved, seconded by Councilmember Bass that Resolution 2020-082 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2020-083 – Accepting an in-kind donation of services to Pasadena Historical Museum in the amount of $1,250.00 from Modern Plumbing.
