RECORD OF PROCEEDINGS SPECIAL COUNCIL MEETING CITY OF PASADENA September 14, 2021 – 10:00 a.m. CALL TO ORDER The regular Council Meeting of the City of Pasadena, Harris County, Texas, was called to order by Mayor Jeff Wagner. INVOCATION – Councilmember Cary Bass PLEDGES OF ALLEGIANCE – Councilmember Phil Cayten COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Cayten – Thanked audience for being a part of city government. Hopes all fared well during the storm Councilmember Bass – Thanked audience for attending the meeting. Remarked on the storm; thinks people are resilient and will get through it okay. Councilmember Schoenbein – Noted how Tropical Storm Nicholas strengthened to a Category 1 hurricane before reaching landfall on the Texas coast and that Pasadena had sustained damages from the storm. Stated he had driven throughout his district and observed downed fences and power lines and damaged business signs, but did not see any street flooding. Further, not aware of any bayous or creeks out of their boundaries. Thankful that our area “dodged the bullet” with this storm. Councilmember Valerio – Thanked audience for attending the meeting. SPECIAL COUNCIL MEETING 1 Minutes: 09-14-21 10:00 a.m. Councilmember Harrison – Passed; no comments. Councilmember Van Houte – Announced Pasadena Police Department’s upcoming “Coffee with a Cop” event scheduled Monday, September 20, 2021 from 8:00 a.m. until 10:00 a.m. at Starbucks located at 5510 Spencer Highway and Beltway 8. Councilmember Estrada – Good to see so many police officers in the audience. He is aware of power outages near Golden Acres, commenting that situation is being monitored. Appreciates all coming to the meeting today. Mayor Wagner – Noted no amendment would be necessary on Ordinance 2021-136. CITIZENS WISHING TO ADDRESS COUNCIL Sgt. Brian Linthicum – President of the Pasadena Police Officers Union. Stated he represents the Pasadena Police Officers, Pasadena’s PSOs and City employees. Explained why he is not pleased about the special meeting being held today, commenting “there is no sense of urgency to have this council meeting”. Remarked that the agenda contains “two of the most important items, medical benefits and the budget, that affect the employees greatly”. Noted he served on the committee that reviewed presentations from insurance providers. Stated he had been contacted by employees who expressed discontent with the current provider. He is disappointed that the City is moving forward with United Healthcare. Regarding the City’s budget, noted there is a two percent COLA included in it; does not think this is sufficient, taking into consideration the rate of inflation and current financial status of the City. Urged Council not to approve the budget and to take another look at the healthcare provider. ORDINANCE 2021-130 - An Ordinance ratifying the property tax increase reflected in the Annual Budget for the City of Pasadena, Texas for the fiscal year beginning October 1, 2021 and ending September 30, 2022. A roll call vote is required for adoption. Councilmember Bass moved, seconded by Councilmember Cayten that Ordinance 2021- 130 be passed on second and final reading. Mayor Wagner called for a Roll Call vote; ROLL CALL VOTE CARRIED AS FOLLOWS: Councilmember Valerio Aye Councilmember Harrison Aye Councilmember Van Houte Aye Councilmember Estrada Aye Councilmember Cayten Aye Councilmember Bass Aye Councilmember Schoenbein Aye Mayor Wagner Aye ORDINANCE 2021-131 - An Ordinance proposing the adoption of a property tax rate for 2021 tax year of $0.515909/$100 value for the City of Pasadena, Harris County, Texas, SPECIAL COUNCIL MEETING 3 Minutes: 09-14-21 10:00 a.m. consisted of $0.421393/$100 value maintenance and operation rate and $0.094516/$100 value debt rate, per the specific requirements provided under Tex. Property Tax Code; authorizing the levy, assessment and collection of ad valorem taxes based upon the established rate; declaring distribution of said tax rate in the general fund and the debt service fund of the City; and providing for a severability clause. Councilmember Schoenbein moved, seconded by Councilmember Bass that Ordinance 2021-131 be passed on second and final reading. Councilmember Estrada – Explained reasons why he would not be supporting this agenda item. **NOTE** City Secretary noted that language for this motion should be read verbatim as required into the record. Mayor Wagner agreed. Councilmember Valerio moved “that the property tax rate be increased by the adoption of a tax rate of 0.515909, which is effectively a 4.30 percent increase in the tax rate”. Councilmember Valerio’s motion was seconded by Councilmember Schoenbein. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-132 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-133 - Authorizing and approving the annual maintenance agreement by and between the City of Pasadena, Texas and Tyler Technologies, Inc. for Incode Court software used by Municipal Courts in the amount of Ninety-one Thousand Two Hundred One and 75/100 ($91,201.75) Dollars. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-133 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. SPECIAL COUNCIL MEETING 4 Minutes: 09-14-21 10:00 a.m. ORDINANCE 2021-134 - An Ordinance authorizing and approving an agreement by and between the City of Pasadena, Texas and Clark Condon Associates, Inc. for design services for Preston/Crenshaw Park Improvements Project Phase I (CIP #R055) for a total appropriation of $337,840.00 to be funded from the General CIP Fund Balance Account. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-134 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-135 - Authorizing and approving an agreement by and between the City of Pasadena, Texas and HR Green, Inc. for design services for Cascade Water Tank Improvements Project (CIP #W070) for a total appropriation of $296,100.00 to be funded from the 2017 Certificate of Obligation Fund Balance Account. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-135 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-136 - Authorizing and approving an agreement by and between the City of Pasadena, Texas and John Thomas for tennis pro/concessionaire services at the Harry P. Taylor Tennis Center. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-136 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-137 - Authorizing and approving an Administrative Services Agreement between the City of Pasadena, Texas and Aetna to provide dental care benefits for plan year 2022. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-137 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-138 - Agreement between the City of Pasadena, Texas and MetLife to provide a fully insured Vision plan for plan year 2022. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-138 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-139 - Approving the rates for Medical, Dental, Vision, Voluntary Life, Accidental Death and Dismemberment, and Cobra for Active Employees, as well as Flexible Spending and Dependent Care maximums for Plan Year 2022, and 2022 Pre-65 Retiree Medical, Dental Rates and Post-65 and older Retiree Medicare Supplement Contribution Rates. Councilmember Bass moved, seconded by Councilmember Schoenbein that Ordinance 2021-139 be passed on second and final reading. Councilmember Schoenbein – Commented there are many challenges with selecting insurance providers for employees, in particular with network services. Stated he would like to challenge, going forward, a careful examination of network coverage for City employees. SPECIAL COUNCIL MEETING 5 Minutes: 09-14-21 10:00 a.m. Councilmember Van Houte – Discussed employee dental rates and how the City was paying its portion of these rates. Noted the City was “penalizing the employee for adding their family to the dental insurance”. With this in mind, proceeded with an amendment to this ordinance as follows: Councilmember Van Houte moved, seconded by Councilmember Schoenbein that Ordinance 2021-139 be AMENDED as follows: “Amend Ordinance 2021-139 to change the monthly rates for dental coverage as attached. The estimated additional cost is $10,000 for one year, which will come from Health Insurance Fund, fund balance (069- 35101).” ORIGINAL MOTION, AS AMENDED, CARRIED UNANIMOUS. ORDINANCE 2021-140 - Authorizing and approving an Administrative Services Agreement between the City of Pasadena, Texas and United HealthCare Services, Inc. for plan year 2022. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-140 be passed on second and final reading. MOTION CARRIED AS FOLLOWS: “Ayes” – Councilmembers Valerio, Harrison, Van Houte, Cayten, Bass, Schoenbein and Mayor Wagner “Nays” – Councilmember Estrada ORDINANCE 2021-141 - Authorizing and approving the purchase by the City of Pasadena, Texas of two (2) 2022 Ford Transit Connect Cargo Vans and four (4) 2022 Ford F450 Trucks from Silsbee Ford utilizing the GoodBuy Cooperative Contract #21- 8F000; in the amount of Two Hundred Twenty-four Thousand Eight Hundred Sixty-nine and 50/100 ($224,869.50) Dollars. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-141 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-142 - Authorizing and approving extension of an annual contract for automotive and light truck transmission repair or exchange services for a period of one year approved by Ordinance 2019-112 and extended by Ordinance 2020-090 between the City of Pasadena, Texas and A-1 DTS Corporation. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-142 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-143 - Authorizing and approving the purchase by the City of Pasadena, Texas and installation of playground equipment for Sunset Park from Fun SPECIAL COUNCIL MEETING 6 Minutes: 09-14-21 10:00 a.m. Abounds, Inc., using the BuyBoard Contract #592-19 in the amount of Three Hundred Sixty-three Thousand Four Hundred Sixty-five and 37/100 ($363,465.37) Dollars. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-143 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-144 - Authorizing and approving contracts between the City of Pasadena, Texas and Galls, LLC for the purchase of police uniforms by the City of Pasadena Police Department for a period of one year. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-144 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-145 - An Ordinance adopting the Annual Budget for the City of Pasadena, Texas for the fiscal year beginning October 1, 2021 and ending September 30, 2022; and appropriating those amounts to those object accounts, containing a severability clause. A roll call vote is required for adoption. Councilmember Cayten moved, seconded by Councilmember Bass that Ordinance 2021- 145 be passed on second and final reading. ORDINANCE 2021-147 - Authorizing a contract with Polk Mechanical Company for City Hall Air Handlers and Automation Project Phase I (CIP #M053) for a total appropriation of $671,082.50 from the 2017 & 2018 Certificates of Obligation Fund Balance Account, the General Fund CIP Fund Balance Account and the FY 2021 Operating Budget. SPECIAL COUNCIL MEETING 7 Minutes: 09-14-21 10:00 a.m. ORDINANCE 2021-148 - Authorizing and approving an agreement by and between Harris County, Texas and the City of Pasadena, Texas relating to the June 15, 2021 Joint Runoff Election conducted by Harris County. Councilmember Harrison moved, seconded by Councilmember Valerio that Ordinance 2021-148 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-149 - Authorizing and approving a contract between the City of Pasadena, Texas and Tyler Technologies, Inc. regarding Tyler Technologies EnerGov Community Health software that includes: Citizen Self Service – Community Health (CH). This contract is for a one-time Implementation Cost/Training Cost and first year annual Saas fee. This contract is for an added module to the original Energov agreement on Ordinance 2020-119, using Sourcewell Contract #090320-TTI in the amount of Seventy- seven Thousand Seven and No/100 ($77,007.00) Dollars.
