PRE-COUNCIL MEETING CITY OF PASADENA December 21, 2021 – 5:30 p.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. (7) DOCKETED CITY COUNCIL HEARINGS: (15) PERSONNEL: Item A-1 – Councilmember Ybarra stated he had questions relating to the recommended employment of the Volunteer Pasadena Manager. Questioned the “organizational chart” for this position and asked to whom this employee would be reporting. Rick Guerrero, Neighborhood Network Manager, responded. Councilmember Van Houte questioned the job requirements for this position; Mr. Guerrero responded and read the job description. Discussion followed between Mr. Guerrero, Councilmembers Van Houte, Harrison, Estrada, Ybarra and Valerio and Assistant City Attorney, Matt Montes, over matters including whether the recommended employee meets the qualifications for the position, the “chain of command” for this position, the number of applicants for position, number of interviews that took place, why Mr. Guerrero chose the recommended person for the position, the length of time Mr. Guerrero has been in his current position and his prior position and the “legality” of this hire as it relates to “degree of separation”, etc. (19) (A)-(1) – FINAL READINGS: Ordinance 2021-193 – Councilmember Van Houte questioned why this item was placed on hold and just now getting back on agenda following the first reading. Discussion followed between Councilmembers Harrison, Van Houte and Schoenbein; Robin Green, Public Works Director, and Mayor Wagner on topics including appraisal on the property, whether the appraisal has changed, the number of demo bids, minimum bid amount, savings based upon increased number of demo bids and who would be responsible for demolition of the building, etc. (19) (A)-(2) – FIRST READINGS: Item (D) – Councilmember Harrison questioned the definition of “net value” as it relates to this item. Julie St Jean, City Controller, explained. Short question/answer session followed between Councilmembers Harrison and Schoenbein and Ms. St Jean. Item (G) – Councilmember Valerio had a question relating to this item; however, no one was present who could respond; will get to it at later time. (19) (B) – RESOLUTIONS: City of Pasadena – Council Meeting 1 Minutes: 12-21-21 6:00 p.m. Item (A) – Councilmember Van Houte questioned a handwritten note at the bottom of page 7 of the agreement; Julie St Jean responded. Discussion followed between Councilmembers Van Houte and Schoenbein, Julie St Jean and Mayor Wagner over topics including how funds will be administered, whether the City would be required to submit a project to the state, the criteria for the use of funds and whether funds would be commingled with other City accounts, etc. ADJOURNMENT 5:51 p.m. – Mayor Wagner adjourned the Pre-Council Meeting. INVOCATION – Rex Lindberg, Director of Community Relations PLEDGES OF ALLEGIANCE – Councilmember Thomas Schoenbein COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Schoenbein – Good to see audience at the meeting. Extended condolences to Councilmember Estrada and his family on the loss of both his grandfather and grandmother. Announced the loss of former Councilmember James Guthrie and noted that he served the community in many ways over the years. Extended thoughts and prayers to his wife, Pam, and daughter, Moriah, on their loss. Described what he referred to as a “miracle” when a firefighter at Fire Station 4 was struck and thrown 30 feet by a hit-and-run vehicle during the Fire Department’s Santa Clause Project; having been discharged from the hospital the next day. Encouraged all to put 2021, a “year filled with grief”, behind us and to look forward to a better 2022; God bless. City of Pasadena – Council Meeting 2 Minutes: 12-21-21 6:00 p.m. Councilmember Ybarra – Wished all a Merry Christmas and a Happy New Year. Extended Happy Birthday wishes to Councilmember Valerio. Thanked the La Fiebre band for attending meeting to accept their award, referring to them as the “pride of Pasadena” and noted that he, along with many others, grew up listening to their music. Extended a special thanks to the Rochas for their many years of service with the City. Councilmember Valerio – Wished everyone a Merry Christmas. Excited to see La Fiebre at the meeting, noting this Tejano band originated in Pasadena. Councilmember Harrison – Noted that Mayor Wagner’s wife, Ginny, had minor surgery today; wished her a speedy recovery and Happy Holidays. Wished all a Merry Christmas and Happy Holidays. Councilmember Van Houte – Clarified that the firefighter mentioned earlier who was struck by a vehicle is doing fine and has been released by his doctor. Regarding the loss of former Councilmember James Guthrie, advised there are no details on a service at this time. Mentioned some of the boards he served on throughout his years, in addition to serving four years on Council as follows: Chaired Pasadena Chamber of Commerce, Rotary Club, San Jacinto College Foundation, PISD Education Foundation, The Bridge, Founding Member of Habitat for Humanity in Pasadena, Armand Bayou Nature Center, Pasadena Philharmonic and Bay Area Houston Economic Partnership, to name a few. Extended condolences to Councilmember Estrada on the loss of his grandparents. Noted that today is the first day of winter, commenting that “astronomically we are beginning a new year in the Northern Hemisphere” and Councilmember Valerio is beginning a new year with her birthday today. Wished all a Merry Christmas. Councilmember Estrada – Expressed thanks to Mayor, Council and the City for their support following the loss of his grandparents, who were married over 60 years and lived in Pasadena over 25 years; commented he will “truly miss them and will have them in his heart forever”. Pleased to see La Fiebre at meeting. Wished Councilmember Valerio a Happy Birthday. His thoughts and prayers are with the firefighter who was struck by a vehicle. Councilmember Cayten – Thanked audience for attending meeting and being a part of city government. Wished all a Merry Christmas and a Happy New Year. Asked that everyone keep the families of former Councilmember James Guthrie and Councilmember Estrada in their thoughts and prayers. Extended get well wishes to Ms. Ginny Wagner. Councilmember Bass – Welcomed audience to meeting. Looking forward to Christmas. Expressed condolences to Councilmember Estrada on the loss of his grandparents. Regarding the loss of James Guthrie, noted that he was a good friend of his, a “great man”. Noted that James had been very ill and was hospitalized since February of 2021. Wished Mayor Wagner’s wife, Ginny, a speedy recovery. His prayers continue for the injured firefighter; thankful to God that he is okay. Extended Happy Birthday wishes to Councilmember Valerio. Mayor Wagner – Noted that James Guthrie had been a personal friend of his. Regarding the boards Councilmember Van Houte mentioned that James served on, noted they were just some of the many boards that he, along with his family, were involved with. Remarked that a man like James Guthrie will be missed. CITIZENS WISHING TO ADDRESS COUNCIL Robert Jeter III – Wished to join in the condolences expressed today. Commented that James Guthrie served our city well, had a lot of experience and will leave a “very impactful legacy”. Wished Councilmember Valerio a Happy Birthday. Noted that citizens in the Golden Acres area are beginning to complain about a retention pond and street repair project taking so long to get completed; hopes to see this issue resolved. Again, regarding the appointment of Mike Sullivan to represent Pasadena on the Appraisal Board, stated he had nothing against Mr. Sullivan, but would like to see an appointee on this board who lives in Pasadena representing our citizens. Commented the City is “doing a great job”. Wished all a Merry Christmas and a Happy New Year. DOCKETED CITY COUNCIL HEARINGS PRESENTATION OF PROCLAMATIONS, AWARDS AND COMMUNITY EVENTS (A) Sponsorship Award Tree Lighting Sponsors Parks and Recreation **NOTE** At this time, Jed Aplaca, Parks and Recreation Director, discussed the annual Christmas Tree Lighting that was held on December 3rd. Expressed thanks to the Parks and Recreation staff, City departments that helped and especially to the sponsors of this “great event”. Announced the event sponsors as follows: HEB, Chick-fil-A, Waste Management, Kelsey Seybold Clinic, Sunbelt Rentals, Clark Freight Lines, Peter Piper Pizza and Savannah Café and Bakery. Presented plaques to those in attendance, noting that those unable to attend will receive their plaques from the City. (B) Presentation by the Pasadena Strawberry Festival to the winners of the Holiday Lighted Parade. **NOTE** At this time, Murline Staley, Executive Director, wished everyone a Merry Christmas and a Happy New Year with “love and prayers to all”. Talked about how “spectacular” the parade was with approximately 30,000 people in attendance. Also, stated that their office had received many calls complimenting and thanking the City of Pasadena on how “safe and wonderful” this event was. Invited Oscar Garza, President of the Pasadena Strawberry Festival and Dan Masera, Director of the Holiday Lighted Parade, to come forward and assist with the presentations. Announced the categories and winners of the parade as follows: Best Lighted Entry, Pasadena Panthers; Best Holiday Spirit, PISD; Best City Entry, Pasadena Library; Most Unique Entry, Habitat for Humanity; Best Fire Unit, Station #4; Chairman’s Choice, Kerr High School Parade Band; President’s Choice, Chick-fil-A; Mayor’s Choice, Clearpoint Church and Best Overall Entry, McDonald’s. Plaques were presented to the winners in attendance, along with photo ops with Mayor and Council. (C) Mayoral Proclamation City of Pasadena – Council Meeting 4 Minutes: 12-21-21 6:00 p.m. **NOTE** At this time, Rex Lindberg, Director of Community Relations, stated he was honored to be presenting a proclamation, on behalf of Mayor Wagner, proclaiming today as “La Fiebre Day” in the City of Pasadena. Proceeded to read the proclamation, which noted that this band was founded in 1986 as a rock band, but quickly shifted to a Tejano band. Further, noted that La Fiebre has received national recognition, along with several Grammy nominations. After reading the proclamation, presented it to the band, followed by a photo op with Mayor Wagner and Council. Mayor Wagner – Expressed thanks to the band, commenting “the City of Pasadena is very proud of them”. CITY BOARDS AND COMMISSIONS REPORTS REPORTS OF COMMITTEES MAYOR’S REPORT ORDINANCES City of Pasadena – Council Meeting 7 Minutes: 12-21-21 6:00 p.m. FINAL READINGS ORDINANCE 2021-193 - Authorizing and approving Ordinance determining AT&T building at 1031 E. Lee Ave. in Pasadena, Texas is not needed for City purposes and has been appraised for advertisement for sale of property. Councilmember Ybarra moved, seconded by Councilmember Bass that Ordinance 2021- 193 be passed on second and final reading. Councilmember Harrison – Stated he would be voting “no” on this item. Councilmember Van Houte – Mentioned the discussion had on this agenda item during Pre-Council. Explained several matters regarding this item including the background of the building, what has transpired since the first reading and deferral of this item, the land valuation, obligation of buyer to remove asbestos and tear down building, minimum bid listing, bid on the demo and possibility of the Economic Development Corporation making a bid, etc. Expressed her confusion over Councilmember Harrison voting against this item and would like to understand why. **NOTE** At this time, Councilmember Van Houte indicated she would like Councilmember Harrison to explain his vote. Mayor Wagner responded there would be no further discussion; that it had already been discussed. There was a short back/forth exchange between Mayor Wagner and Councilmembers Harrison and Van Houte. Following that exchange, Councilmember Van Houte noted that she would be voting “no” on this ordinance. Councilmember Valerio – Stated she wished to vote “no” as well. MOTION CARRIED AS FOLLOWS: “Ayes” – Councilmembers Ybarra, Estrada, Cayten, Bass and Schoenbein and Mayor Wagner “Nays” – Councilmembers Valerio, Harrison and Van Houte ORDINANCE 2021-206 - An Ordinance granting to TPC Group, LLC the right, privilege, and franchise and permit to lay, replace, construct, repair, maintain, operate, and remove one (1) 6-inch LPG C-4 pipeline(s) routed on and across parcels of land the centerline and route of which as shown on the attached plats and the courses and distances descriptions in the attached Exhibit “A”, incorporated herein for all purposes, all in the corporate limits of the City of Pasadena, Texas, and in accordance with plans and specifications heretofore filed with the Department of Public Works, and the Department of Planning; prescribing the terms and conditions under which said right, privilege, franchise, and permit is granted; and providing for acceptance. ORDINANCE 2021-210 - An Ordinance amending Ordinance 2021-139 authorizing the approval of the 2022 Accidental Death and Dismemberment (AD&D) rates. ORDINANCE 2021-211 - An Ordinance modifying Ordinance 1990-216 by replacing Sections 4, 5, 6, and 7 and adding a Section 8 (Exhibit A) in order to change the criteria for the selection of Employee Activity Committee members and establishing limited paid time off (PTO) to be distributed annually to eligible employees for such public purposes as recommended by the Employee Activity Committee and approved by the Mayor. ORDINANCE 2021-212 - Authorizing and approving an agreement by and between the City of Pasadena, Texas and HR Green, Inc. for design services for Red Bluff Road Drainage Improvements Project (CIP #D066) for a total appropriation of $244,144.00 to be funded from the 2018 Certificate of Obligation Fund Balance Account and amending CIP Ordinance 2021-065. ORDINANCE 2021-213 - Authorizing and approving the annual appropriation of $300,000.00 for yearly permit & water systems fees with TCEQ. ORDINANCE 2021-214 - An Ordinance to approve the salary structures (Exhibit A, B, C, and D) and provide a cost-of-living increase of 2.0 percent of base salary for all full-time non-classified civilian employees, part-time non-classified civilian employees whose standard hours equal 20 or more (excluding both seasonal lifeguards in Class Code 2840 in 15220 and seasonal recreation employees in Class Code 2851 in 15230), and Pasadena Police Officers. Salary structures to be adjusted accordingly are the Exempt and Non-Exempt Civilian Personnel (Exhibit A), Pasadena Police salary chart (Exhibit B), Fire/City Marshal salary chart (Exhibit C), and Police Service Officer salary chart (Exhibit D); effective for employees hired on or before November 28, 2021. ORDINANCE 2021-215 - Authorizing and approving a contract between the City of Pasadena, Texas and ACT Pipe and Supply for purchase by the City of Pasadena of full circle repair clamps for a period of one (1) year. ORDINANCE 2021-216 - Authorizing and approving a contract with DBS Texas-Houston for the purchase by the City of Pasadena, Texas of uniforms, clothing and accessories utilizing BuyBoard Contract #587-19. ORDINANCE 2021-217 - Authorizing and approving the annual maintenance agreement by and between the City of Pasadena, Texas and Superion, LLC for the One Solution Software Systems with Superion, LLC, a Central Square Company; and appropriating the amount of One Hundred Eighty-six Thousand One Hundred Thirty-six and 44/100 ($186,136.44) Dollars. ORDINANCE 2021-218 - Authorizing and approving the annual maintenance agreement by and between the City of Pasadena, Texas and Tyler Technologies, Inc. for the EnerGov-EAM software; and appropriating the amount of Two Hundred Twenty-five Thousand Two Hundred Thirty-two and No/100 ($225,232.00) Dollars. ORDINANCE 2021-219 - Authorizing and approving an agreement by and between the City of Pasadena, Texas and Ground Water Consultants for design services for Sycamore Water Well Improvements Project (CIP #W079) for a total appropriation of $50,000.00 from the System Fund Account. Councilmember Ybarra moved, seconded by Councilmember Bass that Ordinance 2021- 219 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-220 - An Ordinance authorizing and approving Consulting Agreement by and between the City of Pasadena, Texas and Contour Engineering, LLC to provide Environmental Consulting support for the USOR Superfund Site. Councilmember Ybarra moved, seconded by Councilmember Bass that Ordinance 2021- 220 be passed on second and final reading. MOTION CARRIED, UNANIMOUS. FIRST READINGS ORDINANCE 2021-221 - Amending Ordinance 2020-113, which adopted the Annual Budget for the Fiscal Year 2021, for the City of Pasadena, Texas. Councilmember Ybarra moved, seconded by Councilmember Schoenbein that Ordinance 2021-221 be passed on first reading only. MOTION CARRIED, UNANIMOUS. ORDINANCE 2021-222 - Authorizing and approving an agreement by and between the City of Pasadena, Texas and the Harris County Flood Control District (HCFCD) for the Red Bluff Rd. Drainage Improvements Project (CIP #D066) in which HCFCD will fund an amount not to exceed $1,046,738.95. Councilmember Ybarra moved, seconded by Councilmember Schoenbein that Ordinance 2021-222 be passed on first reading only. MOTION CARRIED, UNANIMOUS. City of Pasadena – Council Meeting 10 Minutes: 12-21-21 6:00 p.m. ORDINANCE 2021-223 - Adopting and approving a proposed Capital Improvement Plan (CIP) for FY 2022 - FY 2026 as its official Capital Improvement Plan (approved CIP) for the Fiscal Year 2022. Councilmember Ybarra moved, seconded by Councilmember Schoenbein that Ordinance 2021-223 be passed on first reading only. Councilmember Estrada – Stated there had been a workshop prior to the council meeting where he expressed his concerns over an area in his district in the Golden Acres vicinity. Explained his concerns, noting he could not support this agenda item at this time and would be voting “no” on it. MOTION CARRIED AS FOLLOWS: “Ayes” – Councilmembers Ybarra, Valerio, Harrison, Van Houte, Cayten, Bass and Schoenbein and Mayor Wagner “Nays” – Councilmember Estrada ORDINANCE 2021-224 – Accepting, approving and adopting the valuation and assessment of Industrial District properties lying within the extraterritorial jurisdiction of the City of Pasadena for the 2021 tax year; and, based upon the provisions of the contract agreements, distributing the applicable funds in the appropriated General Fund accounts of the City; providing for a repealing clause; and containing a severability clause.
