(19) (A) - (2) FIRST READINGS: Item (H) – Mayor Wagner advised this item would be deferred. After a short discussion between Amanda Mueller, City Secretary, Sherry Womack, Director Financial Planning, Jay Dale, City Attorney and Mayor Wagner regarding corrections that had been made, it was decided the item would be read during the meeting. ADJOURNMENT 5:32 p.m. – Mayor Wagner adjourned the Pre-Council Meeting. INVOCATION – Jose Santos, Iglesia Restauraciòn PLEDGES OF ALLEGIANCE – Councilmember Thomas Schoenbein City of Pasadena – Council Meeting 1 Minutes: 12-20-22 6:00 p.m. COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Schoenbein – Wished everyone a Merry Christmas and blessed New Year. Commented that it has been wonderful to see several organizations give back to the community and youth over the last several weeks. Thanked everyone that participated. May God bless and looking forward to a new year. Councilmember Ybarra – Wished everyone a Merry Christmas and Happy New Year. Councilmember Valerio – Passed, no comment. Councilmember Harrison – Announced that the previous weekend there was a celebration of life for his friend John Moon Sr. Commented that Mr. Moon was one of the great people who helped build the city. Sending his deepest sympathy to the family. Merry Christmas to all and to all a Happy New Year. Councilmember Van Houte – Noted the City would be closed on Friday, December 23 rd and Monday, December 26th for Christmas. Advised there would not be trash pick up on those days. Also noted that the City would be closed on Monday, January 2nd. Commented that a freeze is expected. Asked everyone to wrap their pipes, bring pets and plants inside and to drive very carefully as there might be ice. Also asked that people not shoot guns in the air on New Year’s Eve, stating that whatever goes up will come down just as fast. Merry Christmas and Happy New Year. Councilmember Estrada – Wished everyone a Merry Christmas and Happy New Year. Please stay safe. Councilmember Bass – Thanked everyone for coming to the meeting. Recognized former Councilmember Bruce Leamon in the audience. Wished everyone a Merry Christmas and a happy 2023. Stated that his heart goes out to the Moon family. Commented that Mr. Moon was a great guy and will be dearly missed. CITIZENS WISHING TO ADDRESS COUNCIL Stephen Alvarez – Wished everyone a Merry Christmas. Sending prayers to his neighbors who lost their house to a fire in October. Stated he was at the meeting again because all of his speeches have fallen on deaf ears and the people that can do something does not do anything and does not care. Commented that his mother is suffering and he is doing everything he can to help her out. Stated he was given permits by the City and had passed the inspections but then the City Attorney filed a motion against him saying he was in violation. Explained that he had been told to turn in signatures from his neighbors, which he submitted to the City Attorney, and it was ignored. Commented that he has to move forward, that someone has to help his mother out and he was the one chosen and will continue to fight for her. Went on to state that there are people who could have helped him to make her life comfortable but they have “cruel hearts”. Talked about a discussion he had with Mayor Wagner in which he “had to call him a coward”, further stated the Mayor wouldn’t even look at him. Proceeded to point at City Attorney Jay Dale, who was in the audience, and commented that at the last meeting Mr. Dale asked him to leave. Remarked that he has the right to be at the meeting and they can’t walk up to citizens, City of Pasadena – Council Meeting 2 Minutes: 12-20-22 6:00 p.m. tell them to leave and try to be a bully. Commented that all he needs is for the City to “get out of the way” and let him take care of a senior citizen suffering from dementia. Mentioned that the north side of Pasadena needs sidewalks but they put the new sidewalks in his neighborhood to try and encourage his neighbors to sign against him. **NOTE** At this time, Mayor Wagner advised Mr. Alvarez that his three minutes were over. Mr. Alvarez continued to talk over Mayor Wagner. Mayor Wagner gaveled and again let Mr. Alvarez know his time to speak was over. Murline Staley – Representative, Pasadena Strawberry Festival. Wished Mayor and Council a good evening. Expressed thanks to the City for the job they do and for allowing the Holiday Lighted Parade to take place for people to have a wonderful and fun time. Noted that there were approximately 25,000 people in attendance. Commented that the City did an “amazing job” making sure that everyone was safe and had a good time. Mentioned that the Pasadena Strawberry Festival will be celebrating 50 years in May. ORDINANCE 2022-222 - Authorizing and approving the Parks & Recreation Department to seek funding in the amount of $85,000.00 from KaBoom for the Build it with KaBoom grant to replace the play structure at Pasadena Highlands Park and authorizing the Pasadena Parks and Recreation Department to sign the KaBoom agreement. ORDINANCE 2022-227 - Authorizing and approving accepting a grant award from the State of Texas Office of the Governor, Criminal Justice Division, General Victim Assistance Grant program; $70,642.55. ORDINANCE 2022-228 - An Ordinance amending Ordinance 2021-220, which authorized and approved a contract between the City of Pasadena, Texas and Consulting Agreement by and between the City of Pasadena, Texas and Contour Engineering, LLC to provide Environmental Consulting support for the USOR Superfund Site, to add $20,000.00 and to be appropriated from Account 30300-7107. FIRST READINGS ORDINANCE 2022-229 - An Ordinance granting to Energy Transfer Mont Belvieu NGL Pipelines, LLC the right, privilege, and franchise and permit to lay, replace, construct, repair, maintain, operate, and remove one (1) 10 inch propane pipeline(s) routed on and across parcels of land the centerline and route of which as shown on the attached plats and the courses and distances descriptions in the attached Exhibit “A”, incorporated herein for all purposes, all in the corporate limits of the City of Pasadena, Texas, and in City of Pasadena – Council Meeting 6 Minutes: 12-20-22 6:00 p.m. accordance with plans and specifications heretofore filed with the Department of Public Works, and the Department of Planning; prescribing the terms and conditions under which said right, privilege, franchise, and permit is granted; and providing for acceptance. ORDINANCE 2022-231 - Authorizing and approving renewal of Karate Programming contract by and between the City of Pasadena, Texas and Bill Gray for programming until December 31, 2023 through the Parks and Recreation Department. ORDINANCE 2022-233 - Authorizing and approving an agreement by and between the City of Pasadena, Texas and IGET Services, LLC for professional services for Lift Station evaluations for a total appropriation of $200,000.00. ORDINANCE 2022-234 - Authorizing and approving annual radio service agreement for maintenance and repairs to the dispatch center and four towers located at 1201 Davis, 1114 Davis, 7601 Red Bluff and mobile radio tower at 3124 Red Bluff, by and between the City of Pasadena, Texas and Motorola Solutions, Inc., using H-GAC Contract #RA05- 21; and appropriating the amount of One Hundred Four Thousand Six Hundred Sixty- nine and 35/100 ($104,669.35) Dollars. City of Pasadena – Council Meeting 7 Minutes: 12-20-22 6:00 p.m. ORDINANCE 2022-236 - Authorizing and approving extension of an annual contract for landscaping services for a period of one year approved by Ordinance 2018-155 and extended by Ordinance 2021-201 between the City of Pasadena, Texas and Merriam Group dba Econocuts. ORDINANCE 2022-237 - Authorizing and approving a contract between the City of Pasadena, Texas and Stonewall Constructors to clear and make accessible the six (6) acre tract of land directly adjacent to the Police Academy Gun Range funded from Project Development’s Operating Budget Account #11700-7103, using Harris County Department of Education (HCDE)/Choice Partners Cooperative Contract #20/017MR-11 for a total amount of Eighty Thousand Ninety-one and 13/100 ($80,091.13) Dollars. ORDINANCE 2022-239 - An Ordinance authorizing and approving the purchase by the City of Pasadena, Texas of ammunition for police training through BuyBoard Contract #603-20 from GT Distributors, Inc.; and appropriating the amount of Ninety-nine Thousand Four Hundred Twenty-seven and 50/100 ($99,427.50) Dollars. Councilmember Ybarra moved, seconded by Councilmember Schoenbein that Ordinance 2022-239 be passed on first reading only. MOTION CARRIED, UNANIMOUS. ORDINANCE 2022-240 - An Ordinance accepting, approving and adopting the valuation and assessment of Industrial District properties lying within the extraterritorial jurisdiction of the City of Pasadena for the 2022 tax year; and, based upon the provisions of the contract agreements, distributing the applicable funds in the appropriate general fund accounts of the City; providing for repealing clause; and containing a severability clause. ORDINANCE 2022-241 - Authorizing and approving an Interlocal Agreement by and between the City of Pasadena, Texas and Harris County Flood Control District for public recreational areas. City of Pasadena – Council Meeting 8 Minutes: 12-20-22 6:00 p.m. ORDINANCE 2022-242 - An Ordinance authorizing and approving extension of the closing date of the purchase of the property (15.1659 acres tract at Genoa Red Bluff Road) to Pleasantville Road Partners, LLC for $4,658,370.00 from City of Pasadena, Texas to January 13, 2023 subject to the terms and conditions it has previously agreed to and finds acceptable and as otherwise provided herein as described on the attached Exhibit “A”. Councilmember Ybarra moved, seconded by Councilmember Schoenbein that Ordinance 2022-242 be passed on first reading only. MOTION CARRIED, UNANIMOUS. EMERGENCY READINGS ISSUANCE OF OBLIGATIONS RESOLUTIONS RESOLUTION 2022-230 – A Resolution to amend Resolution 2021-021 and adopt revised policies and procedures for Community Development Financial and Administrative systems. Councilmember Harrison moved, seconded by Councilmember Bass that Resolution 2022-230 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2022-231 – Accepting donations from various donors in the combined amount of $2,514.00 for use by Animal Shelter for the medical care of the animals housed in the animal shelter. Councilmember Harrison moved, seconded by Councilmember Bass that Resolution 2022-231 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2022-232 – Accepting an in-kind donation of lunch for Lunch & Movie event valued at $329.45 from Village Medical for use by the Parks and Recreation Department in connection with Madison Jobe Senior Center. Councilmember Harrison moved, seconded by Councilmember Bass that Resolution 2022-232 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2022-233 – A Resolution authorizing the Mayor, on behalf of the Pasadena Police Department, to accept a donation of Two Thousand Five Hundred and No/100 ($2,500.00) Dollars from Port of Houston Authority of Harris County for use by the Pasadena Police Department in connection with Trunk or Treat Event held each year for Halloween. Councilmember Harrison moved, seconded by Councilmember Bass that Resolution 2022-233 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2022-234 – Accepting an in-kind donation of prizes for BINGO event valued at $70.00 from Cigna for use by the Parks and Recreation Department in connection with Madison Jobe Senior Center.
