PRE-COUNCIL MEETING CITY OF PASADENA May 2, 2023 – 9:30 a.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. Proceeded to go over agenda. (19)(A)-(3) EMERGENCY READINGS: Item (A) – Councilmember Schoenbein noted that the City has had a relationship with Waste Management for 25 years. Understands that a bid went out and there has been back and forth negotiations. Expressed concerns he has with this contract. Asked that the item be deferred. Discussion followed between Councilmembers Cayten, Estrada, Van Houte, Bass, Harrison and Schoenbein and Rex Lindberg, Director of Community Relations, Dan Pennington, Chief of Staff, and Julie St. Jean, City Controller, regarding the following issues: pricing difference between Waste Management and Frontier Waste Solutions, the use of side loading trucks, citizens having to use special trash cans, the length of transition phase, if there would be a loss in tax revenue, who would be responsible for heavy trash pickup and why deferring this item would push the contract into the City’s “Lame Duck” period which could lead to no garbage service from Election Day until July. Dan Pennington mentioned there would be an amendment on this Ordinance. ADJOURNMENT 9:45 a.m. – Mayor Wagner adjourned the Pre-Council Meeting. City of Pasadena – Council Meeting 1 Minutes: 05-02-23 10:00 a.m. INVOCATION – Julie St. Jean, City Controller PLEDGES OF ALLEGIANCE – Councilmember Pat Van Houte CITIZENS WISHING TO ADDRESS COUNCIL Murline Staley – Representative, Pasadena Strawberry Festival. Announced that the 50th annual Pasadena Strawberry Festival will be a 4-day event which begins on May 18th. Also announced that the festival parade will be May 13th with Jim McIngvale “Mattress Mack” as the Parade Marshall. Invited all the citizens of Pasadena to come out and enjoy the activities. Discussed several events that will take place including the Guiness World Record for largest strawberry shortcake, mud volleyball, beauty pageants, fireworks and spectacular acts. Urged any Councilmember interested in judging activities to contact the festival office. Thanked the citizens and guests that have been coming to the festival for all these years. {Photo op with Mayor and Council} Selina Bellar – Wished everyone a good morning. Stated she is aware that Council is considering replacing Waste Management as the City’s refuse contractor and wanted to remind everyone of the value of a dedicated community partner such as Waste Management. Commented that Waste Management is locally operated within Pasadena and is a member of the Pasadena Chamber of Commerce. Mentioned various events they have sponsored and partnered with the City as well as donations made after Hurricane Harvey. Hopes Council will consider these things before making their decision. Shanna Lopez – Representative, Waste Management. Wished Mayor and Council a good morning. Apologized, stating this is emotional for her as she considers all of Council as part of the WM family. Noted that their company has serviced, lived in and been a part of the Volunteer Network for the City of Pasadena for many years. Urged Council to defer the Emergency Reading and give WM more time to talk with the City. Commented that this is “personal” and they have put in a lot of effort and love to the community. Discussed different hardships that WM and the City have gone through together such as hurricanes, tornadoes, winter storms and Covid. Robert Jetter III – Commented that he thinks Waste Management has done a “phenomenal” job across the City. Discussed items of clothing he has seen in the streets while walking in Pasadena. Asked citizens to do a better job of keeping their dirty laundry off the streets. Cristina Womack – President & CEO, Pasadena Chamber of Commerce. Commented that April has been a busy month for the Chamber. Congratulated the Bridge Over Troubled Waters for being the 2023 Non-Profit of the Year. Reminded everyone election day is Saturday, May 6th. Mentioned the Meet the Candidate resource page on the Chambers website. Thanked the City for their partnership in the 2nd annual Put Pasadena to Work job fair which was held the previous week. Urged anyone looking for employment to go to the Workforce Center on the Chamber website. Stated this site has additional resources for job seekers such as resume support and information on student internship programs. Invited businesses to post their jobs on this site so they can continue to help people discover their future in the community. Announced the Industry Appreciation Luncheon to be held on May 17th at San Jacinto College. Invited everyone to attend this luncheon as they honor the 2023 Industry of the Year, Kaneka. Also invited anyone City of Pasadena – Council Meeting 2 Minutes: 05-02-23 10:00 a.m. looking to learn more or partner with the Chamber to join them on May 11th for Membership 101. John Mata – Wished Mayor Wagner and Council a good morning. Noted that he is a licensed plumber and Director of Field Services for the International Association of Plumbing and Mechanical Officials (IAPMO). Stated he was at the meeting to speak in support of the adoption of the 2021 Uniform and Mechanical Code. Gave brief history and purpose of the IAPMP group. Urged Council to vote in support of the updated codes. Looks forward to partnering with the City and staff as they implement the updated codes. COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Van Houte – Thanked the Strawberry Festival for the basket of strawberries. Joked that now she has to “sit here and smell this sweet stuff”. Noted new street and sidewalks being completed on Boyd Court and other areas in District D. Councilmember Estrada – Thanked everyone for coming to the meeting. Reminded everyone of the election on Saturday, May 6th. Councilmember Cayten – Thanked everyone for coming out to be part of City government. Thanked Mrs. Staley for the strawberry package. Announced the 50th Annual Strawberry Festival will start on May 18th. Councilmember Bass – Thanked everyone for being at the meeting. Also thanked Mrs. Staley for the strawberry basket. Councilmember Schoenbein – Stated it was wonderful to see everyone at the meeting and to hear them speak before council. Thanked the Strawberry Festival for being such great partners for 50 years. Encouraged everyone to go out and have a good time. Commented that summer is coming and students will be out of school and walking on the streets, asked for everyone to pay attention to how they are driving and have a good summer. City of Pasadena – Council Meeting 8 Minutes: 05-02-23 10:00 a.m. ORDINANCE 2023-093 - An Ordinance to amend Ordinance 2021-185, extended under Ordinance 2022-190, a professional services agreement with Concept Engineers, Inc. for services related to construction management for the City of Pasadena Home Investment Partnerships Program (HOME) and reduce funding in the amount of $19,412.26. Councilmember Bass moved, seconded by Councilmember Schoenbein that Ordinance 2023-093 be passed on first reading only. MOTION CARRIED, UNANIMOUS. EMERGENCY READINGS ORDINANCE 2023-094 - An Ordinance for an emergency and urgent public necessity establishing contract with Frontier Waste Solutions for garbage, heavy trash, and recycling collection. Councilmember Bass moved, seconded by Councilmember Valerio that Ordinance 2023- 094 be passed on first and final reading. Councilmember Villarreal moved, seconded by Councilmember Van Houte that Ordinance 2023-094 be AMENDED as follows: Amendment and correction to second sentence of the Frontier K2, LLC Solid Waste Services Contract page 13, paragraph entitled Modification of Rates to clarify the ambiguities of this sentence as determined by the parties; by omitting the second sentence of this paragraph in its entirety and to substitute for this omitted sentence the following sentence; “Commencing on October 1, 2024, continuing annually on October 1 of each subsequent year that this agreement remains in force and effect, upon 60 days notice to the City, the Base Rates for services shall be adjusted by the same percentage as the Consumer Price Index for All Urban Consumers (published by the United States Bureau of Labor Statistics, Consumer Price Index, U.S. City Average, All Urban Consumers, Garbage and Trash Collection, Not Seasonally Adjusted.” Councilmember Schoenbein – Explained reasons he would not be supporting this item and would be voting no. Commented it would impact families and local businesses that put back into the community. Stated the cost is 59 cents difference. Feels that they need to support local businesses wholeheartedly. Mayor Wagner – Stated that it is not just a 59 cents difference. Councilmember Van Houte – Stated that because there is an amendment on the table, Council will vote on the amendment first. Commented that the amendment was to clear up things in the contract and this a good thing. Explained that she does have some misgivings on the contract itself but wants to clear up the wording with the amendment then move on to see if they pass the ordinance. Councilmember Estrada – Commented that Waste Management services part of his district and his constitutes are happy with their service. Will not be supporting this contract. City of Pasadena – Council Meeting 9 Minutes: 05-02-23 10:00 a.m. MOTION TO AMEND CARRIED UNANIMOUS. Councilmember Cayten – Thanked Shanna Lopez with Waste Management. Stated that he has enjoyed working with her and she is very good in management of the facility but the corporate office makes the final decisions on cost. Commented that as a City Councilman he has to look at the effect a contract has on all of the citizens of Pasadena and any increase in their bills. Councilmember Van Houte – Stated that she does not like having to change companies; however, the information they received from Waste Management shows they will be switching to sideloading trucks which means everyone would have to use trash cans. Expressed concerns she has with the use of sideloading trucks, the placement of trash cans, the limitation on trash picked up and how it would need to be bundled. Would not have minded if this item had been deferred in order to look into it more, but doesn’t want to vote down a contract and leave the City without anything going forward.
