PRE-COUNCIL MEETING CITY OF PASADENA March 5, 2024 – 9:30 a.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. Proceeded to go over agenda. (19) – (A)-(1) FINAL READINGS: Ordinance 2024-039 – Councilmember Valerio stated that she has gone over a bunch of contracts for technology and would like to speak to a couple of departments regarding these systems. Mayor Wagner approved. At this time, discussion and question/answer session followed between Councilmembers Valerio, Schoenbein and Ybarra, Mayor Wagner, Julie St. Jean, City Controller, Johnson Joy, IT Director, Russell Stav, IT Applications Manager, and Sherry Womack, Director of Financial Planning, over topics including when the different software systems were introduced to the City departments, how payments are procured with the different systems, how the payment systems were selected, the increase in fees for collection of payments, news articles concerning another city that experienced a data breach with a payment system associated with one that the City of Pasadena uses and the decision to use a different software based on that security concern, the amount of money being spent on all of the contracts, what the expected go- live date is for the Tyler Technology system and the request for additional personnel in the Controller’s Office. Following discussion, Councilmember Ybarra requested an Executive Session for the Council to address the hiring of personnel for the Controller’s Office. Mayor Wagner agreed with Councilmember Ybarra, commenting this was a discussion that is needed and for them to place it on the next agenda. Councilmember Van Houte questioned if this subject would qualify for Executive Session. Mayor Wagner confirmed that it would. (19) – (A)-(2) FIRST READINGS: Item (C) – Councilmember Van Houte noted that wording within sections of this item didn’t flow; requested the wording be changed. Short discussion followed between Councilmember Van Houte, Mayor Wagner, Police Chief Jerry Wright and Jay Dale, City Attorney. Item (H) – Councilmember Van Houte asked, rather than a moratorium, why don’t they void the ordinance that was done as an emergency reading and redo this item as a standard two-vote ordinance. Mayor Wagner asked Jay Dale to comment. Mr. Dale explained that the Council heard testimony about the nature of the emergency and how billboards are a distraction to the driving public, which consequently, create an unwanted risk of accidents; commented that testimony substantiated the emergency reading. Short discussion followed between Councilmembers Ybarra and Van Houte, Mayor Wagner and Jay Dale. (19) – (B) RESOLUTIONS: City of Pasadena – Council Meeting 1 Minutes: 03-05-24 10:00 a.m. Item (H) – Councilmember Ybarra questioned if there would be a fee to the City for this item. Julie St. Jean responded that there would not be a fee. At this time, Mayor Wagner noted that Items (H) and (I) would be read separate. Councilmember Dow – Passed, no comment. Councilmember Ybarra – Congratulated the service award recipients. Recognized Mirtha Cantu from the Controller’s Office. Stated that he has seen her grow throughout the City for 25 years. Thanked Mrs. Cantu for her years of service. Also recognized Mrs. Cantu’s husband in the audience, commenting that he retired from the City with 30 years of service. Thanked the Parks and Recreation Department for their outstanding work on getting the field ready for the Girls Softball League. Councilmember Schoenbein – Congratulated the service award recipients. Commented that it is truly remarkable the friendships they have made and the impact they have on the citizens and community. Councilmember Villarreal – Passed, no comment. Councilmember Valerio – Congratulated and thanked the service award recipients for being part of and taking care of the City for all these years. Recognized School Board Member Casey Phelan. Thanked Mr. Phelan for attending the meeting. Councilmember Guerrero – Wished everyone a good morning. Recognized the service award recipients. Stated that seeing all the years of service is a testimony of the commitment, dedication and equality of people that work for the City. Noted that he had the pleasure to attend the kickoff of the 2024 Girls Softball season. Commented that it was amazing to see all the activity and energy. Mentioned that the Little League reached out to him regarding students not being able to pay to participate. Explained that as someone who came from a single parent household and at times was not able to afford sports, he understands the challenges. Thanked Councilmembers Ybarra, Schoenbein, Villarreal and Dow, Officer David Garza and family, Russell Ybarra (Gringo’s) and Bernie Aldape (Aldape Legal) for their support in sponsoring 25 children. Commented that this is why Pasadena is beautiful. CITIZENS WISHING TO ADDRESS COUNCIL Cristina Womack – President & CEO, Pasadena Chamber of Commerce. Stated she wanted to again thank the City departments that helped put on a successful State of the City event. Advised anyone that would like a copy of the 2024 Discover Pasadena magazine to come by the Chamber to pick one up. Commented this was a joint publication. Thanked the City, Laura, Julianne and Stanley for their contributions in the articles. Announced the following upcoming events: 1) Generations Collide Workshop. This is free event open to the community to learn how to communicate across all of the generations. 2) 3rd Annual Pasadena Loves Local Job Fair to be held at the Pasadena Convention Center on April 24th. Encouraged anyone looking for employment or looking to hire, to attend or visit the Workforce Center on the Chamber’s website. 3) The 2024 Nonprofit of the Year celebration and luncheon for The Rose will be held on April 18th. 4) The Chamber’s golf tournament will be held in May; celebrating the work of industry and honoring Oxy as 2024 Industry of the Year. Commented there are plenty of things to get involved with whether you’re a small business, an industry partner or a citizen and the Chamber looks forward to partnering with you and advocating for Pasadena. ORDINANCE 2024-047 - Authorizing and approving a one year extension of an annual contract approved by Ordinance 2022-015 for fire extinguisher suppression services between the City of Pasadena, Texas, and Firetron Inc. ORDINANCE 2024-048 - Authorizing and approving the purchase by the City of Pasadena, Texas, of twenty-nine (29) vehicles from Lake Country Chevrolet, Ten (10) vehicles from Silsbee Ford, and One (1) vehicle from Silsbee Toyota utilizing the TIPS Cooperative Contract #210907; and appropriating the amount of $1,999,723.81. City of Pasadena – Council Meeting 9 Minutes: 03-05-24 10:00 a.m. ORDINANCE 2024-049 - An Ordinance enacting a moratorium on and prohibiting the applications for and/or issuance of permits for conversion of existing off-premises ground sign structures (static face billboards) to support electronic faces (digital billboards) within the city limits of Pasadena for a period of ninety (90) days, to allow the city time to review its regulation of such off-premise signs/billboards in relation to public health, safety and welfare. Councilmember Dow moved, seconded by Councilmember Schoenbein that Ordinance 2024-049 be passed on first reading only. MOTION CARRIED, UNANIMOUS. EMERGENCY READINGS ISSUANCE OF OBLIGATIONS RESOLUTIONS RESOLUTION 2024-036 – Authorizing the Mayor, on behalf of the Pasadena Police Department, to accept a donation of $3,000.00 from Dolan Dow for use by the Proactive Policing Unit to purchase equipment. Councilmember Schoenbein moved, seconded by Councilmember Ybarra that Resolution 2024-036 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-037 – Accepting an in-kind donation of prizes for BINGO event valued at $80.00 from Suvida Healthcare for use by the Parks and Recreation Department in connection with Madison Jobe Senior Center. Councilmember Schoenbein moved, seconded by Councilmember Ybarra that Resolution 2024-037 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-038 – Authorizing the Pasadena Parks and Recreation Department to apply for the Bay Area Coalition on Drugs & Alcohol (BACODA) Pasadena Community Coalition funding. Councilmember Schoenbein moved, seconded by Councilmember Ybarra that Resolution 2024-038 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-039 – A Resolution to amend Resolution 2023-243 and adopt revised policies and procedures for the Community Development Department’s HOME Investment Partnerships Program (HOME). City of Pasadena – Council Meeting 10 Minutes: 03-05-24 10:00 a.m. RESOLUTION 2024-040 – A Resolution to amend Resolution 2020-147 and adopt revised policies and procedures for the Community Development Department’s Community Development Block Grant (CDBG) Program. RESOLUTION 2024-041 – A Resolution to amend Resolution 2022-230 and adopt revised policies and procedures for Community Development Financial and Administrative Systems. RESOLUTION 2024-042 – A Resolution to amend Resolution 2020-092 and adopt a revised citizen participation plan for federally funded programs administered through the Community Development Department. Councilmember Schoenbein moved, seconded by Councilmember Ybarra that Resolution 2024-042 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-043 – A Resolution, after having provided adequate notice as required by Sec. 2254.1036 of the Texas Government Code, the Agreement for Professional Collection Services with Linebarger Goggan Blair & Sampson, LLP is approved and the Mayor of the City of Pasadena, Texas is authorized to execute this Agreement. After exercising its due diligence, the City of Pasadena, Texas finds that: l. There is a substantial need for the legal services to be provided pursuant to the Agreement for Professional Collection Services for unpaid fees, fines and court costs and delinquent tax collection services; 2. These legal services cannot be adequately performed by the attorneys and supporting personnel of the City at a reasonable cost; 3. These legal services cannot reasonably be obtained from attorneys in private practice under a contract providing only for the payment of hourly fees, without regard to the outcome of the matter, because of the natures of the collection fee authorized by Texas Code of Criminal Procedure Article 103.0031 and the delinquent tax penalties provided by Texas Property Tax Code Sections 6.30, 33.07, 33.08, 33.11 , 33.22 and 33.48 and because the City does not have the funds to pay the estimated amounts required under a contract only for the payment of hourly fees.
