Upon motion made by Council Member Garcia and seconded by Council Member Patel the aforementioned meeting minutes were approved. ROLL CALL AYES: Munk, Love, Melo, Patel, Schwartz, Garcia, CP Schaer ABSENT: HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. WHEREAS, the city of Passaic assesses cell towers as real property; and 8 Passaic City Council October 24, 2019 Minutes WHEREAS, during the 2016 revaluation of all properties within the City of Passaic, real property identified on the official tax map of the City of Passaic as Block: 3279 Lot: 1.01 Qual: T01 located at 435 Van Houten Ave, Passaic, NJ, owners: LG Van Houten, LLC was assessed as having a cell phone tower on the property; and WHEREAS, upon inspection of the property records the Tax Assessor concluded the cell phone tower located at the subject property was assessed in error and should be removed from the assessment for the 2019 Tax year and it had been determined that the tax amounts attached hereto are uncollectable; WHEREAS, a subsequent investigation confirmed that the subject property was improperly assessed for the cell phone tower for 2016, 2017 and 2018 tax years. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Passaic, that the Tax Collector is hereby authorized to void the below listed amounts in property taxes wrongly imposed for a cell phone tower, as well as any and all interest accrued to date: 2016 taxes $7,200.78 2017 taxes $7,455.21 2018 taxes $7,692.52 BE IT FURTHER RESOLVED that the Tax Assessor and the Tax Collector are hereby authorized and directed to immediately undertake any and all actions necessary to effectuate this Resolution. ------------------------------------------------------------ CITY OF PASSAIC RESOLUTION #19-10-315 RESOLUTION AUTHORIZING TAX SALE CERTIFICATE PREMIUM ESCHEAT ON THE FOLLOWING FORECLOSED PROPERTY WHEREAS, the City of Passaic Tax Collector sold Tax Sale Certificate 15-00107 at the June 9, 2015 Tax Sale, in the amount of $6,600.09 and collected a Premium of $16,500.00, the certificate was sold to Glia Group LLC, Brooklyn, New York, for real property identified on the official tax map of the City of Passaic as Block 3219 Lot 17 also known as: 96 Grant St., Passaic, New Jersey; and WHEREAS, pursuant to N.J.S.A. 54:5-33, any tax sale certificate premium payments shall be help by the collector in a City dedicated premium trust account, and returned to the purchaser of the fee if and when redemption is made.
