HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. CITY OF PASSAIC RESOLUTION NO.20-05-144 RESOLUTION DESIGNATING BLOCK 4113, LOT 24 (82-100 CENTRAL AVENUE) AS AN AREA IN NEED OF REDEVELOPMENT WITH CONDEMNATION WHEREAS, on February 4, 2020 the City Council of the City of Passaic authorized the preparation of a Preliminary Investigation Study regarding the determination of an area of land in need of redevelopment, with condemnation, identified on the Tax Map of the City of Passaic as Block 4113, Lot 24 also known as 82-100 Central Avenue; and WHEREAS, the Planning Board of the City of Passaic, with the assistance of a licensed professional planner, prepared a Preliminary Investigation Report of the designated area, which consisted of approximately 22,000 square feet located at 82-100 Central Avenue, where on site there was an older three story apartment building and basement with approximately ten (10) different front and rear entrances into the building, as well as nineteen (19) residential apartments and a vacant storefront on Central Avenue and Jackson Street; and WHEREAS, pursuant to N.J.S.A. 40A:12A-1 et. seq., the Planning Board of the City of Passaic conducted a public hearing at a meeting held on May 6, 2020 in order to hear comments from the public and others who might be affected by future action based upon the Preliminary Investigation Report; and Page 11 of 23 Passaic City Council May 19, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, it was testified to at the public hearing by the professional planner that there was lack of both short term and long term maintenance of the subject property, that there was numerous fire and health code violations, that the design of the building access and internal circulation of the building was obsolete, that there was significant criminal activity and incidents requiring police action on the subject property, and that the needs and interests of health, safety, and general welfare of the current and future residents, as well as the surrounding neighborhood, were not being met; and WHEREAS, after the public hearing and review of the contents of the Preliminary Investigation Report, the Planning Board of the City of Passaic concluded that there was sufficient credible evidence to support findings that satisfy the criteria set forth in the Local Redevelopment and Housing Law, N.J.S.A 40A:12A-5 et. seq., for designating Block 4113, Lot 24 as an Area in Need of Redevelopment with Condemnation; and WHEREAS, the Planning Board of the City of Passaic has recommended to the City Council to proceed with the determination of the need of development with condemnation in this matter; and WHEREAS, the Planning Board of the City of Passaic has authorized the redevelopment plan and its adoption; and WHEREAS, the Planning Board of the City of Passaic has approved and memorialized these determinations and recommendations on May 6, 2020; and WHEREAS, it is the desire of the City Council to accept these determinations and recommendations of the Planning Board of the City of Passaic and commence with all redevelopment efforts regarding Block 4113, Lot 24. CITY OF PASSAIC RESOLUTION #20-05-145 RESOLUTION DIRECTING A RECOMMENDATION FROM THE PASSAIC CITY PLANNING BOARD REGARDING BLOCK 2175.02, LOT 45 (473-477 HARRISON STREET) AS AN AREA IN NEED OF REDEVELOPMENT/REHABILITATION WHEREAS, it has been determined by the planning officials of the City of Passaic that certain properties located at 473-477 Harrison Street (Block 2175.02, Lot 45) in the City of Passaic qualify as an area in need of redevelopment/rehabilitation under the conditions for determination for redevelopment/rehabilitation in N.J.S.A. 40:12A-14; and WHEREAS, those conditions are that: (1) a program of rehabilitation is expected to prevent further deterioration and promote the overall development of the community; and (2) the designation will prevent vacancy of properties; and, (3) to prevent the deterioration which would accompany any vacancy; and WHEREAS, this designation as an area in need of redevelopment/ rehabilitation is not intended to confer the power of condemnation; and WHEREAS, the City of Passaic is encouraging the redevelopment/ rehabilitation of the aforementioned properties; and WHEREAS, a designation of an area in need of redevelopment/rehabilitation would assist the City and potential developers in the rehabilitation of the area. CITY OF PASSAIC RESOLUTION NO.20-05-146 RESOLUTION APPROVING EMERGENCY PURCHASE OF KN95 MASKS CITY OF PASSAIC PASSAIC COUNTY WHEREAS, on March16, 2020 the State of New Jersey issued Executive Order #104 implementing social distancing to mitigate the spread of Covid-19; and WHEREAS, on April 8, 2020 Governor Murphy expanded the order through Executive Order #122 requiring the use of face masks; and WHEREAS, emergency purchases and contracts may be negotiated and awarded without public advertising for bids pursuant to N.J.S.A. 40A:11-6; and WHEREAS, it is the determination of Health Officer, John Biegel that this pandemic posed a serious Public health Emergency; and WHEREAS, several vendors were contacted for pricing, conformity and availability; and WHEREAS, careful consideration was given to consider only vendors who have been in the Personal Protection Equipment industry as opposed to vendors who started their businesses in light of the Covid-19 pandemic and have no former experience in this industry; and WHEREAS, the following vendors responded to the above criteria: Fastenal, E. CITY OF PASSAIC RESOLUTION # 20-05-147 RESOLUTION AUTHORIZING THE PURCHASE OF LED SOFTBALL FIELD LIGHTING SYSTEM FOR ROBERTO CLEMENTE BALLFIELD, PULASKI PARK PASSAIC, NEW JERSEY WHEREAS, the City of Passaic Recreation Department wishes to purchase LED Softball Field Lighting System for Roberto Clemente Softball Field, Pulaski Park offered under Sourcewell Cooperative Purchasing System Contract #071619-MSL from Musco Sports Lighting of Oskaloosa, IA ;and WHEREAS, N.J.S.A.40A:11-11 authorizes the purchase of any materials, supplies or equipment which has been approved by the Division of Purchase and Property in the Department of the Treasury to purchase under Cooperative pricing system or joint purchasing system without the necessity for public bidding; WHEREAS, the cost of this equipment is $121,490.00; and WHEREAS, two existing poles from Christopher Columbus Park will be re-used for this project; and Page 15 of 23 Passaic City Council May 19, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that a contract be awarded to Musco Sports Lighting of Oskaloosa, IA in the amount of $ 121,490.00 as per Sourcewell Cooperative Purchasing System Contract #071619-MSL. BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute a contract for the above on a form approved by City Attorney. CERTIFICATION OF FUNDS Funds for the above is available in Account # G-02-40-GA9- 019-000 CITY OF PASSAIC RESOLUTION NO.20-05-148 RESOLUTION AUTHORIZING GRANT AGREEMENT BETWEEN THE CITY OF PASSAIC AND COUNTY OF PASSAIC FOR CARES ACT FUNDING PROGRAM WHEREAS, the City of Passaic, having an office at 330 Passaic Street, Passaic, New Jersey, 07055 (“City”), wishes to enter into a Grant Agreement to receive a portion of the Coronavirus Relief Fund established by the CARES Act (“Agreement”) with the County of Passaic, having an office at 401 Grand Street, Paterson, New Jersey 07505 (“County”); and WHEREAS, on March 9, 2020, New Jersey Governor Philip Murphy, in order to protect the health, safety, and welfare of the people of the State of New Jersey, signed Executive Order No. 103, declaring a Public Health Emergency and State of Emergency exist in the State of New Jersey; and WHEREAS, on March 27, 2020, the Coronavirus Aid, Relief, and Economic Security Act, 2020 (“CARES Act”) was federally enacted; and WHEREAS, the CARES Act established the Coronavirus Relief Fund (“Fund”) and appropriated $150 billion, which is to be used to make payments for specified uses to States Page 16 of 23 Passaic City Council May 19, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK and certain local governments, the District of Columbia, and United States Territories, and Tribal governments; and WHEREAS, as part of the CARES Act, the County received funds directly from the Fund for the purpose of reimbursement to the County and the local governments within the County for expenses paid directly related to COVID-19; and WHEREAS, the County was appropriated eighty seven million five hundred sixty four thousand seven hundred and sixty seven dollars and twenty cents ($87,564,767.20) from the Fund, to be used for expenditures incurred due to the public health emergency with respect to COVID- 19, which were not accounted for in the budget most recently approved as of March 27, 2020, and were incurred during the period that begins March 1, 2020 and ends on December 30, 2020; and WHEREAS, the Passaic County Board of Chosen Freeholders (“Board”) shall appropriate a portion of the Fund received by the County to its sixteen (16) municipalities, based on population, and pursuant to the terms and conditions as set forth in the Agreement attached hereto, as part of a grant to offset eligible expenses in responding to the Public Health Emergency; and WHEREAS, the City is being appropriated four million seventy-one thousand seven hundred and thirty-five dollars ($4,071,735.00) by the Board from the Fund, to be distributed by way of reimbursement, and subject to the conditions as set forth in the Agreement; and WHEREAS, the City and County have set forth their intentions within the attached Agreement and mutually agree to the terms therein. CITY OF PASSAIC RESOLUTION #20-05-149 RESOLUTION TO AMEND CY2020 MUNICIPAL BUDGET (N.J.S.A. 40A:4-87) COUNTY CARES ACT GRANT $4,071,735 WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Finance may approve the insertion of any special item been made available by law and the amount thereof was not determined at time of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Passaic hereby request the Director of the Division of Local Finance to approve the insertion of an item of revenue in the budget of the CY2020 as follows: County CARES Act Grant $4,071,735 BE IT FURTHER RESOLVED, that a like sum be and that same is hereby appropriated as follows: County CARES Act Grant $4,071,735 Account #G-02-40-020-CCA-000 Page 18 of 23 Passaic City Council May 19, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK CITY OF PASSAIC RESOLUTION #20-05-150 RESOLUTION TO AMEND CY2020 MUNICIPAL BUDGET (N.J.S.A. 40A:4-87) CENSUS PARTICIPATION GRANT $30,000 WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Finance may approve the insertion of any special item been made available by law and the amount thereof was not determined at time of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Passaic hereby request the Director of the Division of Local Finance to approve the insertion of an item of revenue in the budget of the CY2020 as follows: Census Participation Grant $30,000 BE IT FURTHER RESOLVED, that a like sum be and that same is hereby appropriated as follows: Census Participation Grant $30,000 Account #G-02-40-020-CPG-000 CITY OF PASSAIC RESOLUTION #20-05-151 RESOLUTION AUTHORIZING THE ISSUANCE OF ESTIMATED TAX BILLS WHEREAS, in light of the disruption caused by the coronavirus outbreak to municipal and county operations, the Division of Local Government Services issued Local Finance Notice No. 2020-07 strongly recommending the issuance of Estimated Tax Bills for 2020 in the case of any additional delays where the county does not strike the tax rate for 2020 by the statutory dates required; and Page 19 of 23 Passaic City Council May 19, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, N.J.S.A. 54:4-66.2 provides that in the above circumstance the governing body may authorize and direct the Tax Collector to prepare and issue estimated tax bills for the third quarter 2020, as provided by statute, and such bills must be mailed to tax payers by June 30, 2020; and WHEREAS, N.J.S.A. 54:4-66.2 also provides that in the event that Estimated Tax Bills are issued, that Reconciled Tax Bills must also be issued for the same tax year; WHEREAS, the City of Passaic has determined that the Municipal Tax Collector will be unable to complete the mailing and/or delivery of tax bills by June 15, 2020 as required by law, since the City’s tax rate has not yet been certified by the County; and WHEREAS, it is in the best interests of the City of Passaic that said authorization be granted; WHEREAS, the Chief Financial Officer and the Tax Collector have computed an estimated tax levy in accordance with N.J.S.A. 54:4-66.3 and has attached a certification showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic as follows: 1. The Tax Collector be and hereby is authorized and directed to prepare and issue estimated tax bills for the City for the third installment of 2020 taxes. The Tax Collector shall proceed and take such actions as are permitted and required by New Jersey statutes, specifically N.J.S.A. 54:4-66.2 and 54:4-66.3. 2. The entire estimated tax levy for 2020 is hereby set at $110,625,908 and the tax rate is set at $3.742 per $100 of assessed valuation. 3. In accordance with the law, the third installment of 2020 taxes shall not be subject to interest until the later of August 10 or the 25th calendar day after the date the estimated tax bills are mailed. Page 20 of 23 Passaic City Council May 19, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK CITY OF PASSAIC RESOLUTION NO.20-05-152 RESOLUTION AUTHORIZING SUBMISSION OF AN APPLICATION FOR AND ACCEPTANCE OF THE NEW JERSEY DIVISION OF CRIMINAL JUSTICE SAFE AND SECURE COMMUNITIES GRANT PROGRAM 2020 WHEREAS, the City of Passaic Police Department wishes to submit an application for and subsequently accept the New Jersey Division of Criminal Justice Safe and Secure Communities Grant Program being offered through the New Jersey Division of Criminal Justice (“Program”); and WHEREAS, through the Program, the New Jersey Division of Criminal Justice supports municipal police departments in their efforts to add law enforcement personnel based on the needs of the community; and WHEREAS, as a municipal police department, the City of Passaic Police Department is eligible to receive funding through this Program; and WHEREAS, in order to maintain eligible status, the City of Passaic must pay all fringe benefit costs associated with the personnel hired, as well as all costs in excess of the grant application, and agree that it will not reduce its baseline regular complement of police officers and other law enforcement personnel (as of December 31, 1993 or as reported in the 1993 UCR); and WHEREAS, allocation of funding is formula based; and WHEREAS, the grant, having the subaward number: 20- 1607, shall be in the amount of $90,000.00 for the subaward period of 1/22/20 to 1/21/21.
