PRESENTATION Upon motion made by Council Member Garcia and seconded by Council Member Love the resolution was adopted. CITY OF PASSAIC RESOLUTION NO. 21-01-020 RESOLUTION HONORIFICALLY DESIGNATING A SEGMENT OF HUDSON STREET AS “DON HERMINIO GARCIA WAY” WHEREAS, Herminio Garcia was raised on a small rural ranch in Mexico as part of a large twelve (12) member family; and WHEREAS, Herminio Garcia traveled to “El Norte” (United States of America) to work towards a dream of eradicating poverty; and WHEREAS, Herminio Garcia worked many jobs, including as a shoemaker and cleaning staff for assembly lines, until he was offered an opportunity to become a headwaiter as a prestigious and well-known New York City restaurant, The 21 Club; and WHEREAS, Herminio Garcia married Martha R. Garcia and relocated to New Jersey in the City of Passaic, becoming one of the first Mexican families to establish themselves within the City; and WHEREAS, Herminio Garcia embarked on an entrepreneurial journey, founding Nicamex, Inc. which provided rental properties to more than one hundred (100) low-income families in the City of Passaic; and WHEREAS, Herminio Garcia formed the first Mexican non-profit organization, OMAU (Organizacion de Mexicanos Americanos Unidos) in 1978; and Page 2 of 26 Passaic City Council January 26, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, through Herminio Garcia’s efforts, Governor Corzine and Governor Christie respectively during their terms marched in the OMAU’s annual parade, which until 2019 was the largest Mexican parade in commemoration of Mexican independence held in the United States, drawing global participants; and WHEREAS, Herminio Garcia has unfortunately passed away, falling victim to the COVID-19 disease; and WHEREAS, Herminio Garcia’s legacy shall be carried on by his daughter, Tamara Morales; and WHEREAS, the City of Passaic wishes to highlight the invaluable contributions made by Herminio Garcia within the City of Passaic community and beyond. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Tom Lee L. The many schools and synagogues already cause too much congestion and traffic. Parking is difficult when all the school in the area are open. This redevelopment will not improve quality of life. CITY OF PASSAIC RESOLUTION # 21-01-024 RESOLUTION DIRECTING A RECOMMENDATION FROM THE PASSAIC CITY PLANNING BOARD REGARDING BLOCK 2207, LOTS 25, 26, & 27 (445-451 MAIN AVENUE) AS AN AREA IN NEED OF REDEVELOPMENT/REHABILITATION WHEREAS, it has been determined by the planning officials of the City of Passaic that certain properties located at 445- 451 Main Avenue (Block 2207 Lots 25, 26 & 27) in the City of Passaic qualify as an area in need of redevelopment/rehabilitation under the conditions for determination for redevelopment/rehabilitation in N.J.S.A. 40:12A-14; and WHEREAS, those conditions are that: (1) a program of rehabilitation is expected to prevent further deterioration and promote the overall development of the community; and (2) the designation will prevent vacancy of properties; and, (3) to prevent the deterioration which would accompany any vacancy; and WHEREAS, this designation as an area in need of redevelopment/ rehabilitation is not intended to confer the power of condemnation; and WHEREAS, the City of Passaic is encouraging the redevelopment/ rehabilitation of the aforementioned properties; and WHEREAS, a designation of an area in need of redevelopment/rehabilitation would assist the City and potential developers in the rehabilitation of the area. CITY OF PASSAIC RESOLUTION NO. 21-01-025 RESOLUTION AUTHORIZING THE CITY OF PASSAIC TO ACCEPT AN AWARD FROM THE NEW JERSEY DEPARTMENT OF LAW AND PUBLIC SAFETY, OFFICE OF THE ATTORNEY GENERAL OFFICE, FOR THE SAFE AND SECURE COMMUNITIES GRANT PROGRAM FY 2021 WHEREAS, the City of Passaic Police Department wishes to submit and subsequently accept an application to the State of New Jersey, Department of Law and Public Safety, in the amount of $48,600.00 under the Safe and Secure Communities Grant Program, Grant No. 20-1607, with a Match-Fringe Benefits, for a total project cost of $546,025.66; and WHEREAS, through the Program, the New Jersey Department of Law and Public Safety supports municipal police departments in their efforts to add law enforcement personnel based on the needs of the community; and WHEREAS, in order to maintain eligible status, the City of Passaic must pay all fringe benefit costs associated with the personnel hired, as well as costs in excess of the grant application, and agree that it will not reduce its baseline regular complement of police officers and other law enforcement personnel (as of December 31, 1993 or as reported in the 1993 UCR); and WHEREAS, allocation of funding is formula based for the Subaward Period of January 22, 2021 to January 21, 2022; and Page 13 of 26 Passaic City Council January 26, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, the City of Passaic Police Department wishes to apply for and accept the maximum grant award being allotted through this Program. CITY OF PASSAIC RESOLUTION NO. 21-01-026 RESOLUTION AWARDING CONTRACT FOR EMERGENCY SANITARY SEWER REPAIR COLUMBIA AVENUE & ROSZ PLACE PASSAIC, NEW JERSEY WHEREAS, on December 31, 2020 there was a sanitary sewer collapse on Columbia Avenue & Rosz Place, Passaic, NJ; and WHEREAS, it was the determination of the City Engineer, that this sanitary sewer collapse posed a serious potential for a health and safety hazard; and WHEREAS, a private contractor had to be hired to repair the sanitary sewer collapse; and WHEREAS, emergency purchases and contracts may be negotiated and awarded without public advertising for bids pursuant to N.J.S.A. 40A:11-6; and Page 14 of 26 Passaic City Council January 26, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, the following contractors were contacted and prices obtained: John Garcia Construction $ 8,250.00 Clifton, NJ Delgado Brothers General Contractors $ 9,500.00 Passaic, NJ Your Way Construction $ 13,000.00 Irvington, NJ WHEREAS, John Garcia Construction’s final cost for this job was $ 7,556.50. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that payment to John Garcia Construction of Clifton, NJ be made in the amount of $ 7,556.50. CERTIFICATION OF FUNDS Funds for the above are available in Account #0-07-55- 502-000-9ER. CITY OF PASSAIC RESOLUTION NO. 21-01-027 RESOLUTION AUTHORIZING APPOINTMENT OF PUBLIC AGENCY COMPLIANCE OFFICER FOR THE CITY OF PASSAIC WHEREAS, N.J.A.C. 17:27-3.1 requires that each public agency designate an individual to serve as its Public Agency Compliance Officer (“P.A.C.O.”) and that person is a liaison between the Division of Local Government Services and the City of Passaic; and WHEREAS, the P.A.C.O. officer is the point of contact for all matters concerning the implementation and administration of the status concerning contracting procedures including equal employment opportunity requirements; and Page 15 of 26 Passaic City Council January 26, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, the Council has determined that it is in the best interest of the City of Passaic that the Director of Purchasing be the person to be designated as the Public Agency Compliance Officer for the City of Passaic. WHEREAS, there shall be no compensation provided for the additional responsibilities of the City of Passaic Public Agency compliance officer. NOW THEREFORE, BE IT RESOLVED that Doris Dudek, as the Director of Purchasing for the City of Passaic is hereby designated as the Public Agency Compliance Officer for the City of Passaic for the period January 1, 2021 through December 31, 2021. BE IT FURTHER RESOLVED that the Public Agency Compliance Officer shall have all of the duties and authority as set forth in the statutes and regulations. BE IT FURTHER RESOLVED that the City of Passaic shall submit Doris Dudek’s name, title, address, telephone number, fax and e-mail address to the Department of the Treasury on or before January 10th of each year, as the Public Agency Compliance Officer for Passaic. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to the New Jersey Transit, Local Programs and Minibus Support (LPS) 5310 Grant Program. CITY OF PASSAIC RESOLUTION NO. 21-01-030 RESOLUTION AUTHORIZING CONTRACT FOR SALE OF REAL ESTATE BY AND BETWEEN THE CITY OF PASSAIC AND JEFFERSON MANAGEMENT, LLC WHEREAS, the City of Passaic, having an office at 330 Passaic Street, Passaic, New Jersey, 07055 (“Buyer”) Page 18 of 26 Passaic City Council January 26, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK wishes to enter into a Contract for the Sale of Real Estate (“Agreement”) with Jefferson Management, LLC, having an office at 128 Main Avenue, Passaic, New Jersey 07055 (“Seller”); and WHEREAS, the real property to be sold is commonly known as 69 Jefferson Street, Passaic, New Jersey 07055, referred to on the Tax Map of the City of Passaic as Block 1086, Lot 14 (“subject property”); and WHEREAS, the Buyer shall purchase the subject property from the Seller for $350,000.00; and WHEREAS, the Buyer and Seller have set forth their intentions within the Agreement attached hereto and mutually agree to be subject to the terms and conditions therein.
