Lora updated the council and residents on the following: Passaic City Council May 13, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK • Next school year PHS graduated; he is excited for all graduates. • COVID statistics from March 2020 to present: • 8330 positive cases • 299 deaths • Count for each ___ for both vaccines and tests • 390 Paulison: • Gratitude to teachers/nurses/staff • 48,000 adults and 20,000 have been vaccinated • As per the state of NJ we all must follow guidelines • Malkin vaccines partnered with Hackensack Hospital • In the Heights premier was a success. Drive in movie theater is a great way to bring community together. • Sunday-Thursday food program distribution has helped the community. • Madison Street work starts this week with sidewalks being paved. • Police bike patrol and increased policing presence is being continued. • 208 Passaic Avenue cleanup issue has been resolved. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. CITY OF PASSAIC RESOLUTION NO. 21-05-118 RESOLUTION AUTHORIZING SUBMISSION OF AN APPLICATION FOR NEW JERSEY DIVISION OF HIGHWAY TRAFFIC SAFETY FY2021 BODY-WORN CAMERA GRANT PROGRAM WHEREAS, the City of Passaic has learned of the availability of funding from the New Jersey Division of Highway Traffic Safety, Body-Worn Camera Grant Program; and WHEREAS, said grant requires no matching contributions from the City of Passaic; and WHEREAS, the City of Passaic Police Department wishes to submit an application for this grant. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to the New Jersey Department of Health Strengthening Local Public Capacity Program. Page 16 of 24 Passaic City Council May 13, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK CITY OF PASSAIC RESOLUTION NO.21-05-120 RESOLUTION AUTHORIZING PASSAIC ALLIANCE TO RENEW APPLICATION FOR SUBSTANCE USE DISORDER (SUD) FEE-FOR-SERVICE (FFS) NETWORK INITIATIVES CONTRACT SFY 2022-2023 WHEREAS, the State of New Jersey, Department of Human Services, Division of Mental Health and Addiction Services (DMHAS) has announced that renewal applications for Substance Use Disorder (SUD) Fee-For-Service (FFS) Network Initiatives Contract for SFY 2022-2023, a contract period from July 1, 2021 through June 30, 2023, are now being accepted; and WHEREAS, the application for the SUD FFS contract is for renewal only; and WHEREAS, the Passaic Alliance has had a contract to provide outpatient substance abuse treatment for service initiatives and currently provides substance abuse treatment services on a fee-for-service basis; and WHEREAS, the Passaic Alliance wishes to renew the SUD FFS contract to continue to provide substance abuse treatments, including Passaic County’s only full Spanish language out-patient treatment program; and WHEREAS, the DMHAS shall provide reimbursement to the City of Passaic for the services provided in accordance with their fee schedule, which is as follows: Individual Session (1 hour) $81.23 Group Session $49.50 Family Counseling $81.23 Intensive Outpatient $98.53 per diem Case Management $12.00 Urine Drug Screens $8.00 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Passaic that the Passaic Alliance is hereby authorized to submit an application to renew the Substance Use Disorder (SUD) Fee-For-Service (FFS) contract being offered through the State of New Jersey, Department of Human Page 17 of 24 Passaic City Council May 13, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK Services, Division of Mental Health and Addiction Services in order to provide treatment services for clients referred to the City of Passaic through the Driving Under the Influence Initiative (DUII), Drug Court, Mutual Agreement Program State Parole Board (MAP-SPB), Substance Abuse Initiative (SAI) and any other appropriate program; and BE IT FURTHER RESOLVED that the Mayor, City Clerk and Passaic Alliance are hereby authorized and directed to execute any documents and/or undertake any and all such actions necessary to effectuate the purpose of this Resolution. CITY OF PASSAIC RESOLUTION NO._21-05-121 RESOLUTION ACCEPTING PAYMENT FROM PENNINGTON PASSAIC, LLC IN ACCORDANCE WITH AMENDED FINANCIAL AGREEMENT WHEREAS, Ordinance No. 2257-20, an “Ordinance Approving the Application For A Long-Term Tax Exemption and Authorizing the City of Passaic to Enter Into A Financial Agreement With Pennington Passaic, LLC For Property Identified On The Official Tax Map Of The City of Passaic as Block 3236 Lot 36; Block 3237 Lot 47 and Block 3254 Lot 37 (176 Pennington Avenue; 191 Pennington Avenue and 199-231 Pennington Avenue) Passaic, New Jersey” was adopted by the City Council of the City of Passaic on March 17, 2020; and WHEREAS, the Financial Agreement was not executed and the terms thereof were not implemented; and WHEREAS, Ordinance No. _______ An Ordinance Amending Ordinance No. 2257-20 was adopted by the City Council of the City of Passaic on May 17, 2021; and WHEREAS, Ordinance No. ______amends the terms of the Financial Agreement to take into account the correct properties to be included (Block 3254 Lot 37 and Block 3237 Lot 47) and to eliminate credits as a result of prior tax court judgments; and Page 18 of 24 Passaic City Council May 13, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK WHEREAS, a payment has been made by Pennington Passaic in the amount of $388,622.87 representing all taxes and interest for the year 2019 and payments of land taxes required pursuant to the Financial Agreement in the amount of $30,000.00 (PILOT payments through May 2021 in the amount of $330,000.00 less the judgment credit of $300,000.00 = $30,000.00). The calculation of the payment is attached as Exhibit “A”; and WHEREAS, the City Council has determined to waive any interest that may have been due for the years 2020 and 2021 on Block 3254 Lot 37 and Block 3237 Lot 47 as a result of the delay in payment; and WHEREAS, applying the judgment credit to the land taxes through the second quarter of 2021 will result in a substantial reduction in any amount that was due to the City of Passaic; and WHEREAS, it is in the best interests of the City of Passaic to waive any interest charges that may be due on land taxes for the years 2020 and 2021 (through second quarter) pursuant to the Financial Agreement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic as follows: • Any interest that accrued with respect to land taxes as set forth in the Financial Agreement for the period January 1, 2020 through May 1, 2021 is hereby waived. • The Tax Collector is hereby authorized to take the appropriate actions to correct the tax records to adequately reflect that any interest that may have been due is hereby waived as a result of the judgment credit provided. • The Tax Assessor is hereby directed to establish the land value assessment in accordance with the terms of the Financial Agreement. • A certified copy of this Resolution shall be provided to Special Tax Counsel for the City of Passaic, Nylema Page 19 of 24 Passaic City Council May 13, 2021 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK Nabbie, Esq., and also the property owner, Pennington Passaic, LLC BE IT FURTHER RESOLVED that the Mayor, City Clerk and City’s Tax Appeal Attorney are hereby authorized and directed to execute any other documents necessary to effectuate the purpose of this Resolution.
