ROLL CALL Munk Love Melo Schwartz Garcia CP Schaer ABSENT X X X X X Council Member Munk took his on the dais at 7:09 p.m. MAYOR’S UPDATE • The mayor offered prayers regarding the Nashville shooting. • Two firefighters retired: Shawn Allen after 28 years of service and Thomas Colavitti. • NAACP flag raising ceremony took place on Saturday. • The 2nd floor of VFW veterans center is up; looking for volunteers for habitats for humanity. • Passaic celebrated Chinese new year, year of the rabbit. • A new ATM machine from North Jersey Federal Credit Union placed outside of City Hall. • Dignity House is at full capacity because of cold weather; in a partnership with school #19, Passaic held a sock and scarf drive. • The mayor’s office implemented emergency response because of frigid weather; homeless were taken off street to shelters or to hospital. • Passaic Business Administrator and mayor met with new Business Administrator of Passaic County, Matt Jordan to discuss new initiatives and infrastructure projects. • A townhall outreach program and workshop was held recently. • The mayor is working on creating a program for subsidized renters to purchase homes through rent to own program. • The mayor wished happy birthday to Danny Rodriguez, board president and Ricki Columbo, former counselor. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. She has difficulty paying the rent, and she is afraid of being evicted. CITY OF PASSAIC RESOLUTION NO. 23-01-041 RESOLUTION AUTHORIZING THE APPLICATION AND ACCEPTANCE OF FUNDING FOR THE REGIONAL STATION HOUSE ADJUSTMENT PROGRAM 2023 WHEREAS, the Passaic County Department of Human Services has recommended that the City of Passaic Police Department (“City”) receive funding for the Regional Station House Adjustment Program (“Program”) for the period of January 1, 2023 through December 31, 2023; and WHEREAS, the City shall provide the Program to the prioritized towns listed and described in the Program Profile subject to the terms and conditions therein; and WHEREAS, the City has been notified that the total allocation of funds being awarded to use for the Program is potentially a maximum of $45,000.00; and WHEREAS, the actual award is subject to funding availability; and WHEREAS, the actual award shall be made by Resolution of the Passaic County Board of County Commissioners. CITY OF PASSAIC RESOLUTION NO. 23-01-042 RESOLUTION AUTHORIZING THE APPLICATION AND ACCEPTANCE OF FUNDING FOR THE LOCAL STATION HOUSE ADJUSTMENT PROGRAM 2023 WHEREAS, the Passaic County Department of Human Services has recommended that the City of Passaic Police Department (“City”) receive funding for the Local Station House Adjustment Program (“Program”) for the period of January 1, 2023 through December 31, 2023; and WHEREAS, the City shall provide the Program to the prioritized towns listed and described in the Program Profile subject to the terms and conditions therein; and WHEREAS, the City has been notified that the total allocation of funds being awarded to use for the Local Station House Adjustment Program is potentially a maximum of $39,801.00; and WHEREAS, the actual award is subject to funding availability; and WHEREAS, the actual award shall be made by Resolution of the Passaic County Board of County Commissioners. CITY OF PASSAIC RESOLUTION NO. 23-01-043 RESOLUTION AWARDING CONTRACT FOR EMERGENCY SANITARY SEWER CLEANING AND INSPECTION BETWEEN HUDSON STREET AND MERCER STREET PASSAIC, NEW JERSEY WHEREAS, on December 21, 2022 there was an emergency sanitary sewer cleaning and TV inspection between Hudson Street and Mercer Street, Passaic, NJ; and WHEREAS, it was the determination of the City Engineer, that this sanitary sewer emergency posed a serious potential for a health and safety hazard; and WHEREAS, a private contractor had to be hired to repair the sanitary sewer main; and WHEREAS, emergency purchases and contracts may be negotiated and awarded without public advertising for bids pursuant to N.J.S.A. 40A:11-6; and WHEREAS, the following contractors were contacted and prices obtained: Page 14 of 35 Passaic City Council February 7, 2023 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC Your Way Construction Inc. ($7,000.00) Irvington, NJ Montana Construction ($7,500.00) Lodi, NJ WHEREAS, Delgado General Contractors LLC was contacted and did not submit an emergency bid and Your Way Construction Inc was the low bidder and was authorized to mobilize onsite and proceed with the sanitary sewer cleaning and camera inspection; and WHEREAS, the final cost of the cleaning and camera inspection was $7,000.00; and NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that payment to Your Way Construction of Irvington, NJ be made in the amount of $7,000.00. CERTIFICATION OF FUNDS Funds for the above are available in Account #G-02-40-021- ARP-020. CITY OF PASSAIC RESOLUTION NO. 23-01-044 RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR THE BLOOMBERG PHILANTHROPHIES PUBLIC ART CHALLENGE GRANTS PROGRAM FY22 WHEREAS, the City of Passaic has learned of the availability of funding from the Bloomberg Philanthropies Public Art Challenge Grants Program; and WHEREAS, through the Public Art Challenge Grants Program, Bloomberg Philanthropies supports municipalities to build temporary public art projects that celebrate creativity, enhance urban identity, encourage public- private collaborations, and strengthen local economies; and Page 15 of 35 Passaic City Council February 7, 2023 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, said grant requires no matching funds from the City of Passaic; and WHEREAS, the City of Passaic wishes to apply for the maximum award of $1,000,000 to create a sculpture in honor and recognition of the City of Passaic’s Native American History. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to the Bloomberg Philanthropies Public Art Challenge Grants Program. BE IT FURTHER RESOLVED that the Mayor, and City Clerk are hereby authorized to take all necessary actions to file this application and to accept grant funds from Bloomberg Philanthropies Public Art Challenge Grants Program. ROLL CALL Munk Love Melo Schwartz Garcia CP Schaer X X X X X X Council President Schaer read said Ordinance by title: CITY OF PASSAIC ORDINANCE NO. 2385-23 AN ORDINANCE AMENDING CHAPTER 295 OF THE CODE OF THE CITY OF PASSAIC ENTITLED “VEHICLES AND TRAFFIC” ARTICLE XII, “SCHEDULES” SECTION 20, “SCHEDULE I: PARKING PROHIBITED AT ALL TIMES” TO INCLUDE A PORTION OF DWAS LINE ROAD WHEREAS, pursuant to N.J.S.40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order arid protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this ·subtitle, or by any law; and WHEREAS, Chapter 295 of the Code of the City of Passaic, “Vehicles and Traffic,” Article XII, Section 20, Page 33 of 35 Passaic City Council February 7, 2023 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC “Schedule I: Parking Prohibited at All Times,” provides the streets, or portions thereof, where no person shall park a vehicle at any time upon any of the following described streets or parts of streets in accordance with the provisions 295-4; and WHEREAS, in the interests of good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, the City of Passaic wishes to amend Section 20, “Schedule I: Parking Prohibited at All Times,” to include a portion of Dwas Line Road. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Passaic, that Chapter 295 of the Code of the City of Passaic, “Vehicles and Traffic,” Article XII, “ Parking Prohibited at All Times,” Section 20, “Schedule I: Parking Prohibited at All Times,” is hereby amended as follows: SECTION I 295-20 Schedule I: Parking Prohibited at All times. In accordance with the provisions of 295-4, no person shall park a vehicle at any time upon any of the following described streets or parts of streets: NAME OF STREET SIDE LOCATION Dwas Line Road East Beginning at the southerly curb line of Brook Avenue and extending to a point 365 feet southerly therefrom to the City of Passaic Municipal Boundary SECTION II This ordinance shall take effect upon final passage and publication as provided by law.
