Council Member Chaim Munk joined the meeting at 7:04 p.m. REV. DR. MARTIN LUTHER KING CELEBRATION DAY 2024 PRESENTATION Councilman Dr. Terrance Love moderated the MLK celebration. MAYOR’S UPDATE: Mayor Hector C. Lora shared that normally, at council meetings, I update the city regarding various initiatives and the city's progress. Mayor Lora provided an update reflecting on recent personal challenges and not feeling like himself due to the loss of Sheriff Berdnik, which has given him perspective on relationships and what is important. He expressed gratitude for Councilman Dr. Terrence Love, Mr. Place, educators and students of PACE, community leaders, and all who participated in the MLK Ceremony that uplifted spirits and emphasized unity and rejection of divisiveness. Drawing from personal anecdotes, Mayor Lora connected his early experiences of learning about Dr. Martin Luther King Jr. to broader themes of humanity, imperfection, and the pursuit of justice. He highlighted the importance of recognizing and celebrating flawed individuals who strive to make a difference, underscoring that perfection is not a prerequisite for impact. The Mayor praised the legacy of civil rights leaders, stressing that standing firm in one's convictions might not be immediately rewarding but is crucial for future generations. Reflected on Sheriff Berdnick commitment to community events. PUBLIC HEARINGS: GREEN ACRES GRANT PROGRAMS Notice published in the newspaper on January 12, 2024 on posted on the City of Passaic website on January 09, 2024 • The purpose of the hearing is to obtain public comment on a park development grant application to be submitted to the New Jersey Department of Environmental Protection’s Urban Parks and Green Acres Grants Program. The City of Passaic is seeking funding for improvements at Colonel Johnson Park located at 190 Harrison Street, Passaic, New Jersey (situated on Harrison Street between Van Winkle Avenue and Hope Avenue). The City of Passaic proposes to create the following new facilities at Colonel Johnson Park: installation of new spray pad, bicycle racks, new park benches, rain gardens along low points, trees, recycling systems to reduce water consumption and waste, and to revitalize the park’s cracked surface. • The purpose of the hearing is to obtain public comment on a park development grant application to be submitted to the New Jersey Department of Environmental Protection’s Green Acres Grants Program. Ricardo Fernandez, Business Administrator, Presentation: Page 3 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC PowerPoint presentation and described the application for improvements to Colonel Johnson Park located at 190 Harrison Street, Passaic, New Jersey (situated on Harrison Street between Van Winkle Avenue and Hope Avenue) converting the part into a full water park including other playground amenities. Public Comments: Joe Conoscenti: Highlighted the historical issue of gang presence on Harrison Street. He expressed his support for changes to the park and his concerns about the disappearance of a plaque dedicated to Colonel Johnson, which he had brought up in previous occasions. He advocated preserving Colonel Johnson's name as a tribute to the community's heritage. Luis Daniel Rodriguez: Reflected on transforming Colonel Johnson Park from a less desirable space to a beautiful, community-friendly one, advocated for further enhancements to make the park a unique and special place for children city-wide, emphasizing unity and inclusivity. He expressed appreciation for the Mayor and his administration's creative ideas for park improvements and the positive impact on city parks, sharing a personal connection with Colonel Johnson Park and his appreciation for the potential of the future water park. Dr. Garcia: As a high school assistant principal, highlighted the need for Colonel Johnson Park to be a space that caters to teenagers who often care for younger siblings. Suggested that creating "cooler," more appealing spaces could encourage teenagers to spend more time outdoors with their siblings, bridging the gap between small, child-focused parks and areas where older kids prefer to spend time. He emphasized the importance of such spaces for fostering family and community engagement. Rene Griggs: Shared a nostalgic recount of enjoying local parks years ago, supporting the move towards developing a waterpark for current and future generations. Ms. Griggs expressed a desire for such developments earlier, highlighting their value in providing affordable recreational options for families within the city. Parker Joseph Brown, Jr.: Mr. Brown stated he visited the park and agrees that Coronel Johnson Park needs improvements. Questioned the financial and planning aspects of the park's redevelopment, including concerns over the community's input being potentially limited by survey options. Sherri Grier: Praised the concept of Colonel Johnson Park's redevelopment but raised concerns about the distribution and accessibility of the survey intended to gather community feedback. Questioned the extent of outreach and whether efforts were made to include diverse community segments beyond social media, suggesting broader outreach methods. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Rene Griggs • Thanked the Mayor and his wife for allowing her to use their space on December 16 to raise funds for programs that help kids who have lost their parents to cancer. • Thanked Council President for getting better Christmas decorations are being displayed all over the city. Aryeh Mack • On January 16, the city had a major storm, causing large blocks of ice; two individuals got injured but are doing well, no salt was put out. • He mentioned he contacted DPW and did not get an answer, asked for emergency phone number to contact; there were numerous cars stuck outside. Yosef Wolf • Re Resolution No. 15, was that bid out or was it an emergency that did not have a bid? • When does it become illegal for commercial vehicles to park overnight, when does it take effect? Many robberies have occurred; when he moved to Passaic, insurance rates went up due to Passaic being unsafe. His neighbor’s car was stolen. • Why can’t the public speak on Zoom but the council can attend meetings in Zoom? And why is there not a time set for the public to speak? She also has seen commercial vehicles being used to save parking spots and being moved. Joe Conoscenti • I am here with a banner that has fallen, banners that have been put up for our veterans, God forbid any of these banners get someone hurt. • Why is UEZ using funds for holiday window celebration? • A month ago there was a fire on Van Buren • Passaic has a low pressure problem with fire hydrants. • At 161 Lexington, the hydrant was removed when driveway was built and was never replaced, leaving the area vulnerable; the water company needs to look into it. • Four veteran banners were found on the ground. Page 11 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC CITY OF PASSAIC RESOLUTION # 24-01-014 RESOLUTION AUTHORIZING AMENDMENT OF CONTRACT FOR ENGINEERING/ARCHITECTURAL SERVICES FOR THE DESIGN AND CONSTRUCTION MANAGEMENT SERVICES MUNICIPAL PARKING DECK – NEW PARKING STRUCTURE WHEREAS, on May 21, 2019, the City Council of the City of Passaic adopted Resolution #19-05-131 (attached) approving a contract with Desman Design Management for Engineering/Architectural Services for the Design and Construction Management Services for Municipal Parking Deck-New Parking Structure in the amount of $ 233,100.00; and WHEREAS, on July 20, 2021, the City Council of the City of Passaic adopted Resolution #21-07-175 (attached) approving a change order in the amount of $ 39,000.00 for additional design services increasing the contract amount to $ 272,100.00; and WHEREAS, on February 7, 2023, the City Council of the City of Passaic adopted Resolution #23-02-051 (attached) approving a change order in the amount of $ 28,000.00 for additional design services and scope of work changes inclusive of an additional parking level and a vehicle counting system increasing the contract amount to $ 300,100.00; and WHEREAS, additional design services are needed as this project needs to be re-bid and the specifications revised to include all of the amendments that were part of the first bid in the amount of $ 6,500.00; and WHEREAS, it is necessary to amend the original contract and increase the contract amount to $ 306,600.00. NOW THEREFORE BE IT RESOLVED that the contract with Desman Design Management shall be amended to increase the contract amount to $ 306,600.00. CITY OF PASSAIC RESOLUTION NO. 24-01-015 RESOLUTION AWARDING CONTRACT FOR EMERGENCY RETAINING WALL RECONSTRUCTION ACKERSON PLACE RIGHT OF WAY AND SPRING STREET INTERSECTION PASSAIC, NEW JERSEY WHEREAS, on September 10, 2023, there was an Emergency Retaining Wall Reconstruction – Ackerson Place Right of Way and Spring Street Intersection, Passaic, NJ; and WHEREAS, it was the determination of the City Engineer, that this retaining wall collapse posed a serious potential for a safety hazard; and WHEREAS, emergency purchases and contracts may be negotiated and awarded without public advertising for bids pursuant to N.J.S.A. 40A:11-6; and WHEREAS, the following contractors were contacted: TNS Construction Stanhope, NJ $ 200,000.00 Joseph Sanzari Hackensack, NJ $ 243,500.00 Montana Construction Lodi, NJ $ 299,669.00 Page 13 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, TNS of Stanhope, NJ was contracted to repair the emergency retaining wall collapse; and WHEREAS, during construction, the City Engineer, Yasseen Saad, directed TNS Construction to replace the footing of the retaining wall in its entirety for an additional $ 25,000.00; and WHEREAS, the final cost of the repair was $ 225,000.00; and NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that payment to TNS Construction, Stanhope, NJ be made in the amount of $ 225,000.00. CITY OF PASSAIC RESOLUTION NO. 24-01-016 RESOLUTION AUTHORIZING AMENDMENT OF CONTRACT FOR PHYSICIAN SERVICES FOR SUBSTANCE ABUSE TREATMENT PROGRAM CY 2024 WHEREAS, on October 24, 2023, the City Council of the City of Passaic adopted Resolution #23-10-323 (attached) approving a contract with Dr. Trivedi, of Flemington, NJ, for Physician Services For Substance Abuse Treatment in a not to exceed amount of $ 48,000.00; and WHEREAS, the not-to-exceed amount should have been $62,400.00. Enhancing Local Public Health Infrastructure CITY OF PASSAIC RESOLUTION NO. 24-01-023 RESOLUTION AUTHORIZING APPOINTMENT OF PUBLIC AGENCY COMPLIANCE OFFICER FOR THE CITY OF PASSAIC WHEREAS, N.J.A.C. 17:27-3.1 requires that each public agency designate an individual to serve as its Public Agency Compliance Officer (“P.A.C.O.”) and that person is a liaison between the Division of Local Government Services and the City of Passaic; and WHEREAS, the P.A.C.O. officer is the point of contact for all matters concerning the implementation and administration of the status concerning contracting procedures including equal employment opportunity requirements; and WHEREAS, the Council has determined that it is in the best interest of the City of Passaic that the Director of Purchasing be the person to be designated as the Public Agency Compliance Officer for the City of Passaic. CITY OF PASSAIC RESOLUTION NO. 24-01-031 RESOLUTION AWARDING CONTRACT FOR BULK ROCK SALT 2023-2025 WINTER SEASON WHEREAS, the City of Passaic and the County of Passaic have entered into a Cooperative Purchasing Pricing agreement for certain supplies; and WHEREAS, the City of Passaic desires to purchase bulk rock salt utilizing the Passaic County Cooperative Pricing System; and WHEREAS, the bid received under the Passaic County Cooperative Pricing System from Morton Salt, Chicago, IL, is the lowest responsible, responsive bid at $65.30/ton, for approximately 3000 tons at a not to exceed amount of $ 195,900.00 effective December 1, 2023, through November 30, 2025; and WHEREAS, for an additional pricing comparison the Morris County Coop pricing was compared and found that the low bidder for delivery of rock salt to Passaic County was $94.31/ton; and WHEREAS, it is the recommendation of Doris Dudek, Director of Purchasing, that the contract be awarded to Morton Salt, Chicago, IL at a price of $65.30/ton, for approximately 3000 tons for a not to exceed amount of Page 30 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC $195,900.00.00 effective December 1, 2023 through November 30, 2025; and NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City hereby award the contract for Bulk Rock Salt to Morton Salt, Chicago, IL at a price of $ 65.30/ton, for approximately 3000 tons for a not to exceed amount of $195,900.00. BE IT FURTHER RESOLVED that the City of Passaic has made no commitment to purchase the total quantity of rock salt from Morton Salt, Chicago, IL. These commodities will be ordered on an as needed basis; and BE IT FURTHER RESOLVED by the City Council that the Mayor and City Clerk are authorized to execute a contract for same, on a form prepared by the City Attorney. CERTIFICATION OF FUNDS Funds are available for the above in Acct. #4-01-26- 290-000-131 and subsequent 2025 budget pending approval by the City Council. CITY OF PASSAIC RESOLUTION NO. 24-01-032 RESOLUTION IN SUPPORT OF ESTABLISHING AND ADOPTING A COMPLETE STREETS POLICY IN THE CITY OF PASSAIC WHEREAS, safe, convenient, accessible, equitable, healthy, and environmentally and economically beneficial transportation for all users is a priority of City of Passaic; and WHEREAS, Complete Streets is a means to provide a comprehensive, integrated, connected multi-modal network of transportation options through planning, design, construction, maintenance, and operation of new and Page 31 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC retrofit transportation facilities along the entire right- of-way for all roadway users of all ages and abilities; and WHEREAS, Complete Streets allow for safe, accessible, and convenient travel, reducing serious injuries and fatalities for all users of the roadway; and WHEREAS, “all users” include motorists, bicyclists, pedestrians, public transportation vehicles and their passengers, delivery trucks and movers of commercial goods, persons with disabilities, older adults, and residents of Priority Communities; and WHEREAS, Complete Streets allow for multiple modes of travel, aside from personal automobiles, so that those who are unable to drive, who cannot afford a car, or choose to reduce their car usage may travel by transit, by bicycle, or on foot safely; and WHEREAS, Complete Street policies support the goals of the City of Passaic’s master plan and supporting elements; and WHEREAS, New Jersey is federally designated as a Pedestrian and Bicycle Safety Focus State due to high numbers of pedestrian/bicycle-involved fatalities, and New Jersey’s pedestrian fatality rate continues to significantly exceed the national average; and WHEREAS, traffic crashes are preventable and the only acceptable number of traffic deaths for the City of Passaic is zero; and WHEREAS, Complete Streets that incorporate sustainable Green Streets design elements, such as green storm water infrastructure, traffic calming treatments, shade trees, and the use of recycled materials, protect and create a healthier natural and social environment, improve air and water quality, and reduce localized flooding; and Page 32 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, Complete Streets implementation enhances access to local businesses, encourages reinvestment, increases property values and employment, and WHEREAS, Complete Streets encourage an active lifestyle through increased physical activity, social connectivity, and sense of community belonging, thereby lowering risk of obesity, reducing chronic disease, improving mental health, and promoting wellness; and WHEREAS, Complete Streets implementation provides the opportunity to enhance the historic character of our communities and our understanding of our shared history in a way that promotes the economic and social vitality of our communities and should be considered in the design of infrastructure improvements; and WHEREAS, procedures should be implemented that ensure fair treatment, equitable funding and resource distribution and meaningful involvement of all communities in all phases from selection, planning, and design to construction and long-term maintenance; and WHEREAS, a balanced and flexible transportation system where all people can easily and safely walk and bicycle to everyday destinations — such as schools, shops, restaurants, businesses, parks, transit, and jobs — enhances neighborhood economic vitality and livability; and WHEREAS, low- and moderate-income areas, whether in rural, urban, or suburban communities, are typically the least safe for pedestrians and bicyclists, especially for children walking and biking to school, due to long- standing infrastructure disparities and higher concentration of streets with faster-moving and higher- volume traffic; and WHEREAS, implementation of the Complete Streets policy should not negatively impact the affordability of the neighborhood for current residents; and Page 33 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, the Complete Streets policy applies to new, reconstruction, retrofit, and resurfacing projects, including design, planning, construction, maintenance and operations, for the entire right-of-way; and WHEREAS requests for all exceptions must be submitted in writing, with supporting documentation, and made publicly available with a minimum of 30 days allowed for public input; and WHEREAS, all initial planning, concept and design studies of infrastructure projects consider design elements that improve public health, environment, economy, equity, and safety. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Passaic that the City of Passaic supports the Complete Streets Policy; and BE IT FURTHER RESOLVED, that copies of this Resolution shall be forwarded to all City departments within thirty (30) days of the adoption of this Resolution. CITY OF PASSAIC RESOLUTION NO. 24-01-033 STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION GREEN ACRES ENABLING RESOLUTION WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides grants and/or loans to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition, development, and stewardship of lands for outdoor recreation and conservation purposes; and Page 34 of 41 Passaic City Council Minutes: January 25, 2024 Approved: May 7, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, the City of Passaic desires to further the public interest by obtaining funding in the amount of $2,397,843.00 in the form of a $2,397,843.00 matching grant, and if available, a $0 loan from the State to fund the following projects: to make improvements to Colonel Johnson Park at a cost of $2,397,843.00 WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of funding award; and WHEREAS, the applicant is willing to use the State’s funds in accordance with such rules, regulations and applicable statues, and is willing to enter into an agreement with the State for the above-named project; NOW, THEREFORE, the City Council of Passaic resolves that: 1. Ricardo Fernandez or the successor of the Business Administrator is hereby authorized to: a. make application for such a loan and/or such a grant, b. provide additional application information and furnish such documents as may be required, and c. act as the authorized correspondent of the above-named applicant; 2. The applicant agrees to provide its matching share to the Green Acres funding request, if a match is required in the amount of $0; 3. In the event the State’s funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project; 4. The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and 5. This resolution shall take effect immediately.
