ROLL CALL Colon- Munk Love Melo Schwartz Garcia CP Schaer Montanez X ABSENT X X X X X Council Member Love joined at 7:06 p.m. MAYOR’S UPDATE The Mayor provided key updates on city developments and initiatives, welcoming students back to school and recognizing educators, staff, and police officers. Public safety efforts include regulating large vehicles on 9th, South, 10th, and Passaic Streets through axle- based trailer restrictions and improved enforcement. Discussions are underway with the City Attorney and police to regulate food delivery vehicles like Uber Eats, potentially requiring registration. To address parking issues, designated parking lines are being painted on streets such as Hudson and Myrtle. Three retired officers were sworn in as school resource officers to enhance school safety. Community events included the Mexican American Community Center’s Frida Art Exhibit, the upcoming Mexican Parade, and the Passaic football team’s opening game. The Mayor also recognized Karma’s retirement after 30 years in finance. The Passaic Youth Council was commended for its work on addiction and mental health, alongside Ms. Peralta’s organization, Opioid Free, which distributes Naloxone kits and educates families on opioid addiction. Alicia’s Place was named in honor of Alicia Troche Caraballo for her contributions to local recreation and community life. Free tickets were distributed to an HBCU event at MetLife Stadium for the Passaic football team and community members. The Silver Seniors’ *Golden Years* performance was promoted. Job training opportunities, including phlebotomy and CDL programs funded by a HUD grant, were announced to support career advancement. The Mayor also led a 9/11 commemoration honoring first responders. He concluded by reminding residents to request mail-in ballots for the November election and reaffirmed his commitment to public safety, community engagement, and city growth. HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Susan Weiss • Expressed concerns regarding resident safety in Passaic, sharing three personal incidents: • While dining at a restaurant in Passaic, she was confronted by a homeless woman who threw a liquid in her face after she refused to give money. • She was threatened by a man at Chase Bank who attempted to rob her. • She felt harassed by a man while attempting to get into her car. Aleema Mohamad • Recently purchased a home on 4th Street and regrets the decision due to parking issues. She stated that residents are parking in a manner that hoards parking spots, limiting space for others. She requested that the city draw parking lines to prevent this issue. Page 3 of 17 Passaic City Council Minutes: September 17, 2024 Approved: December 3, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC Joe Conoscienti • Thanked the mayor and council for the new lights in the city council chambers and new street signs. He raised concerns about double parking and parking in bus stops, which he identified as parking hazards. He noted a recent shooting on Martha Place and that despite the presence of a sheriff’s camera and police substation, these measures were not effective. He also mentioned the need for more "Curb Your Dog" signs on Paulison Avenue and Broadway. Lastly, he informed the council that he will report non-working streetlights to PSE&G and inquired about the city’s plans regarding electric bikes, especially those used for food delivery. Eric Calderon • Informed the council that the mattress factory on 9th Street is leaving mattresses outside, their delivery trucks are taking up residential parking, and they are working seven days a week, causing noise disturbances. CERTIFICATION OF FUNDS Funds for the above are available in the Byrne Memorial Justice Assistant Grant Account #G-02-40-022-BMJ-061 CITY OF PASSAIC RESOLUTION NO. 24-09-245 RESOLUTION AUTHORIZING $860,000.00 HOME INVESTMENT PARTNERSHIP PROGRAM (HOME) FUNDS TO NEW HORIZON COMMUNITY ACTION CORPORATION FOR THE DEVELOPMENT OF FIVE (5) AFFORDABLE HOMEOWNER UNITS WHEREAS, a proposal has been received from New Horizon Community Action Corporation (New Horizon) located at 689 Main Avenue, Passaic, New Jersey 07055 for development of the property known as 24 Broadway (Block 2154, Lot18), Passaic, New Jersey and; WHEREAS, subject property development will consist of five (5) affordable homeowner units, consisting of two 2- bedroom units and three 1-bedroom units; (as well as a commercial space which will be solely funded by the Developer) and; WHEREAS, upon completion of the Department of Community Development’s underwriting it has been determined that New Horizon is eligible to receive funding in an amount not to exceed EIGHT HUNDRED SIXTY THOUSAND DOLLARS AND NO CENTS ($860,000.00) to be used towards the development and construction five (5) affordable homeowner units and; Page 11 of 17 Passaic City Council Minutes: September 17, 2024 Approved: December 3, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, upon review of the Department of Housing and Urban Development’s (HUD’s) regulations at 24 CFR 92.250(b)(1), prior to final approval of these HOME funds, the City must ensure New Horizon submits the following documentation: • Site control documentation • Final architectural plans from their Architect • Final zoning and building approvals • Final approval of building plans from the City • Commitment of financing in the amount of $450,000.00 from their Mortgage Lender • Commitment from New Horizon’s acquisition and closing costs in the amount of $422,159.00 • Completion of a Phase II environmental that is reviewed and approved by the City • Written guaranty from the Contractor relative to completion of the project and any and all cost overruns and; WHEREAS, all five (5) affordable housing units will be made available to households that qualify as low- moderate families seeking affordable housing here in the City of Passaic; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Passaic hereby authorize New Horizon Community Action Corporation to receive an amount not to exceed EIGHT HUNDRED SIXTY THOUSAND DOLLARS AND NO CENTS ($860,000.00) in HOME funds for the development and construction of five (5) affordable homeowner units, located on Block 2154/Lot 18, 24 Broadway, in the City of Passaic, New Jersey. CITY OF PASSAIC RESOLUTION NO. 24-09-246 RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION, ACCEPTANCE OF A GRANT, EXECUTION OF AN AGREEMENT AND EXPENDITURE OF FUNDS FOR THE PASSAIC UEZ 2025 BUSINESS LOAN PROJECT TO THE NJ URBAN ENTERPRISE ZONE AUTHORITY Page 12 of 17 Passaic City Council Minutes: September 17, 2024 Approved: December 3, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, The Passaic Enterprise Zone Development Corporation desires to apply for and obtain a grant from the Urban Enterprise Zone Authority in an amount not to exceed $600,000 to fund the Passaic UEZ 2025 Business Loan Project for the period of January 1, 2025 to December 31, 2026; and WHEREAS, the PEZDC Board of Trustees approved Resolution 24-21 on September 11, 2024 to submit a grant application to fund the Passaic UEZ 2025 Business Loan Project to the NJ Urban Enterprise Zone Authority in the amount not to exceed $600,000; and WHEREAS, a loan program is a permitted activity in the UEZ legislation and is in the best interest of supporting Passaic UEZ businesses; and WHEREAS, the UEZA also requires the municipal approval of the submission, acceptance and expenditure of grant funds. NOW, THEREFORE BE IT RESOLVED that: (1) the City Council of the City of Passaic does hereby authorize the application for a grant for the Passaic UEZ 2025 Business Loan Project an amount not to exceed $600,000; and (2) recognizes and accepts that the Urban Enterprise Zone Authority may offer a lesser or greater account and therefore upon receipt of the grant agreement from the Urban Enterprise Zone Authority, does further authorize the execution of any such grant agreements; and also, upon receipt of the fully executed agreement from the Urban Enterprise Zone Authority, does further authorize the expenditure of funds pursuant to the terms of the agreement between the Passaic Enterprise Zone Development Corporation and the Urban Enterprise Zone Authority. BE IT FURTHER RESOLVED that the Mayor and City Clerk and/or the Executive Director and Secretary of the Passaic Enterprise Zone Development Corporation as deemed appropriate by the NJ UEZA are authorized to sign the application, and that they or their successors in said Page 13 of 17 Passaic City Council Minutes: September 17, 2024 Approved: December 3, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC titles are authorized to sign the agreement and any other documents necessary in connection therewith ROLL CALL Colon- Munk Love Melo Schwartz Garcia CP Schaer Montanez X X X X X X X ORDINANCE FOR INTRODUCTION AND FIRST READING Council President Schaer read said Ordinance by title: CITY OF PASSAIC ORDINANCE NO. 2462-24 ORDINANCE AUTHORIZING THE PRIVATE SALE OF PROPERTY AT 24 BROADWAY, CITY OF PASSAIC, NEW JERSEY, TO DESIGNATED REDEVELOPER NEW HORIZON COMMUNITY ACTION CORPORATION PURSUANT TO N.J.S.A. 40A:12-13(C) AND N.J.S.A. 40A:12A-8(G) WHEREAS, the City of Passaic (the "City") is the owner of certain real property located at 24 Broadway, City of Passaic, New Jersey, designated as Block 2154, Lot 18 on the City's tax maps (the "Property"); and WHEREAS, by resolution dated ______, 2024, the City Council designated NEW HORIZON COMMUNITY ACTION CORPORATION, a New Jersey not-for-profit corporation (the “Redeveloper”) as redeveloper of the Property; and WHEREAS, the Property is located within the Main Avenue Redevelopment Area, an area that has been designated by the City as an area in need of redevelopment pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq., and is subject to the Main Avenue Redevelopment Plan (the “Redevelopment Plan”) duly adopted by the City; and Page 14 of 17 Passaic City Council Minutes: September 17, 2024 Approved: December 3, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, the City desires to sell the Property to the Redeveloper so that it may be redeveloped in accordance with the Redevelopment Plan; and WHEREAS, N.J.S.A. 40A:12-13(c) and N.J.S.A. 40A:12A- 8(g) authorize the City to sell the Property to the Redeveloper at private sale, without public bidding, as the Redeveloper has been designated as the redeveloper of the Property; and WHEREAS, the City has obtained an appraisal report dated February 29, 2024 from McNerney & Associates, Inc. that values the Property at $395,000 in its current partially constructed state as of a February 27, 2024 date of valuation; and WHEREAS, the City Council finds it to be in the best interests of the City to sell the Property to the Redeveloper as redeveloper for the negotiated price of $396,522.32, which represents the fair market value of the Property as determined by the appraisal [and which also includes the City's costs incurred in acquiring the Property through tax foreclosure]; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Passaic as follows: Section 1. The aforementioned recitals are incorporated herein as though fully set forth at length. Section 2. The City is hereby authorized to sell the Property "as is" to NEW HORIZON COMMUNITY ACTION CORPORATION, a New Jersey not-for-profit corporation (also referred to herein as the Redeveloper), for the price of $396,522.32, pursuant to N.J.S.A. 40A:12- 13(c) and N.J.S.A. 40A:12A-8(g). The City makes no representations regarding the environmental condition of the Property. Section 3. The Redeveloper shall be responsible, at its sole cost and expense, for any remaining costs Page 15 of 17 Passaic City Council Minutes: September 17, 2024 Approved: December 3, 2024 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC to complete the redevelopment project in accordance with the Redevelopment Plan. The City shall have no further obligations with respect to the Property beyond delivering title. Section 4. The Mayor, City Administrator, City Attorney, City Clerk and other appropriate City officials are hereby authorized to negotiate and execute an Agreement of Sale and any other documents necessary to effectuate the sale of the Property to the Redeveloper as authorized herein. Section 5. The sale of the Property shall be contingent upon the Redeveloper executing a Redevelopment Agreement with the City providing for the redevelopment of the Property in accordance with the City’s Redevelopment Plan. Section 6. If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective. Section 7. This Ordinance shall take effect upon final passage and publication as required by law. Council Member Love moved the Ordinance be approved on first reading. Comments from the Council • Council Member Melo requested that additional lights be placed in the garden areas on Main Street, near the 7- 11. • Council Member Love asked the Mayor to clarify the difference between street lights and city lights.
