THE REGULAR MEETING OF THE PARKING AUTHORITY OF THE CITY OF
PASSAIC WAS HELD ON October 23, 2019 AT 7:00 P.M. IN THE
COUNCIL CHAMBERS.
Amada D. Curling, Secretary read the following notice into
record:
IN ACCORDANCE WITH CHAPTER 231 PUBLIC LAWS OF 1975, ADEQUATE
NOTICE OF THIS MEETING WAS PROVIDED BY RESOLUTION OF THE
PASSAIC PARKING AUTHORITY ADOPTED ON OCTOBER 24, 2018 SETTING
FORTH A SCHEDULE OF REGULAR MEETINGS FOR THE YEAR 2019 WHICH
WAS PUBLISHED AND PLACED ON THE CITY HALL BULLETIN BOARD BY
THE OFFICE OF THE CITY CLERK.

On a motion by Commissioner Ritz and Commissioner Perez,
the minutes of July 17, 2019 were accepted and approved.

HEARING OF CITIZENS
The public portion was opened:
Jaroslaw Jackiw, 266 Lafayette Ave. Requesting Parking Authority Director for an
update on Parking situation on Monroe Street and Parking Lot next to Polish People’s
home.
Joe Conoscenti, 170 Broadway, concerns regarding School #20 Parking on Howe
Ave. Henry, Madison and Main Avenue Traffic situation in these areas
After ample time given and no one else responding on a
motion by Commissioner Ritz and Commissioner Perez the
Public Portion was closed.

On a motion by Chairman Buckstein and seconded Commissioner
Perez communications were received and filed, all members

City of Passaic Council Ordinance No. 2225-19 “Ordinance Authorizing a Short-Term Tax
Exemption for Property Identified on the official Tax Map of the City of Passaic as Block 1130,
Lot 17 (684 Main Avenue Passaic, New Jersey. (Adopted on August 6, 2019)

OR ANYTIME THEREAFTER TO DISCUSS PENDING LITIGATION;
CONTRACT NEGOTIATIONS AND PERSONNEL MATTER.

Commissioner Balbi the following Resolutions was adopted.

PASSAIC PARKING AUTHORITY CERTIFICATION OF THE ANNUAL AUDIT
(2017-2018)
RESOLUTION No.PA 19-10-016
WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of
every local unit to have made an annual audit of its
books, accounts and financial transactions, and
WHEREAS, the Annual Report of Audit for the year ended
December 31, 2017-18 has been filed by a Registered
Municipal Accountant with the Secretary of the Passaic
Parking Authority pursuant to N.J.S.A. 40A:5A-15, and a
copy has been received by each member of the governing
body; and,
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance
Board of the State of New Jersey to prescribe reports
pertaining to the local fiscal affairs; and,

WHEREAS, the Local Finance Board has promulgated N.J.A.C.
5:31-7.6, a regulation requiring that the governing body shall by
resolution certify to the Local Finance Board of the State of New
Jersey that all members of the governing body have reviewed, as a
minimum, the sections of the annual audit entitled “Comments and
Recommendations”, and,
WHEREAS, the members of the governing body have personally
reviewed as a minimum the Annual Report of Audit, and
specifically the sections of the Annual Audit entitled “General
Comments and Recommendations”, as evidenced by the group
affidavit form of the governing body attached hereto; and,
WHEREAS, such resolution of certification shall be adopted
by the Governing Body no later than forty-five days after the
receipt of the annual audit, pursuant to N.J.A.C. 5:31-7.6; and,
WHEREAS, all members of the governing body have received
and have familiarized themselves with, at least, the minimum
requirements of the Local Finance Board of the State of New
Jersey, as stated aforesaid and have subscribed to the affidavit,
as provided by the Local Finance Board, and
WHEREAS, failure to comply with the regulations of the
Local Finance Board of the State of New Jersey may subject the
members of the local governing body to the penalty provisions of
R.S. 52:27BB-52, to wit:
R.S. 52:27BB-52: A local officer or member of
a local governing body who, after a date
fixed for compliance, fails or refuses to
obey an order of the director (Director of
Local Government Services), under the
provisions of this Article, shall be guilty
of a misdemeanor and, upon conviction, may be
fined not more than one thousand dollars
($1,000.00) or imprisoned for not more than
one year, or both, in addition shall forfeit
his office.
NOW, THEREFORE BE IT RESOLVED, That the governing body of the
Passaic Parking Authority, hereby states that it has complied
with N.J.A.C. 5:31-7.6 and does hereby submit a certified copy
of this resolution and the required affidavit to said Board to
show evidence of said compliance.

2020 AUTHORITY BUDGET RESOLUTION

FISCAL YEAR: FROM: TO:
2020 2020
WHEREAS, the Annual Budget and Capital Budget for the
Passaic Parking Authority for the fiscal year beginning,
January 1, 2020 and ending, December 31, 2020 has been
presented before the governing body of the Passaic Parking
Authority at its open public meeting of October 23, 2019;
and
WHEREAS, the Annual Budget as introduced reflects Total
Revenues of $ 1,160,000 , Total Appropriations, including
any Accumulated Deficit if any, of $ 1,160,000 and Total
Unrestricted Net Position utilized of -0-; and
WHEREAS, the Capital Budget as introduced reflects Total
Capital Appropriations of $2,250,000 and Total Unrestricted
Net Position planned to be utilized as funding thereof, of
$-0-; and
WHEREAS, the schedule of rates, fees and other charges in
effect will produce sufficient revenues, together with all
other anticipated revenues to satisfy all obligations to the
holders of bonds of the Authority, to meet operating
expenses, capital outlays, debt service requirements, and to
provide for such reserves, all as may be required by law,
regulation or terms of contracts and agreements; and
WHEREAS, the Capital Budget/Program, pursuant to N.J.A.C.
5:31-2, does not confer any authorization to raise or expend
funds; rather it is a document to be used as part of the
said Authority's planning and management objectives.
Specific authorization to expend funds for the purposes
described in this section of the budget, must be granted
elsewhere; by bond resolution, by a project financing
agreement, by resolution appropriating funds from the
Renewal and Replacement Reserve or other means provided by
law.
NOW, THEREFORE BE IT RESOLVED, by the governing body of the
Passaic Parking Authority, at an open public meeting held on
October 23, 2019 that the Annual Budget, including all
related schedules, and the Capital Budget/Program of the
Passaic Parking Authority for the fiscal year beginning,
January 1, 2020 and ending, December 31, 2020 is hereby
approved; and
BE IT FURTHER RESOLVED, that the anticipated revenues as
reflected in the Annual Budget are of sufficient amount to
meet all proposed expenditures/expenses and all covenants,
terms and provisions as stipulated in the said Authority's
outstanding debt obligations, capital lease arrangements,
service contracts, and other pledged agreements; and
BE IT FURTHER RESOLVED, that the governing body of the
Passaic Parking Authority will consider the Annual Budget
and Capital Budget/Program for adoption on December 11,
2019.

Directors Report: Rick Fernandez, Director of the Parking
Authority updated the board on the progress of the Design
Municipal Parking Deck at a cost of approximately eight to
ten million dollars for approximately 340 parking spaces. .
The city is in the process of conducting a parking study
for the need of parking in this area. There is a strong
possibility that the city will receive in funding from the
State around three million dollars for the Parking Deck.
The City is also reviewing the possibilities of Residential
Parking Permits.
CFO REPORT: Omar J Garcia Asst. to the CFO, presented to
the Board the Financial Report
ADJOURNMENT
There being no further business to come before the Board,
on a motion by Chairman Buckstein and seconded by
Commissioner Perez the meeting was adjourned all members
voting “AYES” as the roll was called.
