Discussion on Ancillary Alcohol License – There was discussion concerning amending the Alcoholic Beverages portion of the code of the City of Peachtree Corners in order to authorize ancillary alcohol sales of wine and/or malt beverages by retail establishments, who are licensed to sell alcoholic beverages for consumption on the premises. This item will be placed on the next City Council agenda for consideration. 4. MRPA Certificate PH2019-011 4248 Ridgegate Drive – This item will be placed on the next City Council agenda for consideration. 5. MRPA Certificate PH2019-012 4260 Gatewood Lane – This item will be placed on the next City Council agenda for consideration. 6. Crosswalk on West Jones Bridge Road – There was discussion concerning adding a beacon crosswalk at the South Entrance to Pinckneyville Middle School (Clinchfield Trail). After discussion it was determined that this item would move forward for construction costs. 7. LMIG sidewalk project survey/design – There was discussion concerning adding sidewalks to Gunnin Road. After discussion it was determined that there would be a community meeting with residents on Gunnin Road to determine a sidewalk plan. 8. Census activity update – Strategies for promoting the Census were provided to the Mayor and Council. These strategies include but are not limited to the use of a Billboard, Career Night at the Paul Duke High School, Social Media, and information distributed at the library. 9. Redevelopment Authority – There was discussion concerning implementing a Redevelopment Authority and plan. It was determined that the city will hire a consultant to create a redevelopment plan. 10. Micromobility Device Ordinance – MOTION TO AMEND THE AGENDA TO ADD THE FIRST READ AND CONSIDERATION OF ORDINANCE 2020-01-159 TO AMEND THE CITY OF PEACHTREE CORNERS CODE OF ORDINANCES CHAPTER 14, BUSINESSES, BY ADDING ARTICLE XXVII, SHARED MICROMOBILITY DEVICE OPERATORS, TO AUTHORIZE A PILOT SHARED MICROMOBILITY DEVICE PERMIT PROGRAM AND PROHIBIT DEPLOYMENT OF SUCH DEVICES WITHOUT A PERMIT; ESTABLISHING A SUNSET DATE FOR THE PILOT PROGRAM, REPEALING ALL CONFLICTING ORDINANCES, AND SETTING AN EFFECTIVE DATE. Alternatives: None O2020-01-160 CITY OF PEACHTREE CORNERS COUNTY OF GWINNETT, STATE OF GEORGIA ORDINANCE 2020-01-160 AN ORDINANCE TO AMEND CHAPTER 6 (“ALCOHOLIC BEVERAGES”) OF THE CODE OF THE CITY OF PEACHTREE CORNERS, GEORGIA, TO AMEND AND AUTHORIZE ANCILLARY ALCOHOL SALES OF WINE AND/OR MALT BEVERAGE BY RETAIL ESTABLISHMENTS LICENSED TO SELL ALCOHOLIC BEVERAGES FOR CONSUMPTION ON THE PREMISES; WHEREAS, the Mayor and Council of the City of Peachtree Corners are charged with the protection of the public health, safety, and welfare of the citizens of Peachtree Corners; and WHEREAS, Chapter 6 of The Code of the City of Peachtree Corners, Georgia, currently prevents retail establishments licensed to sell alcoholic beverages to be consumed on the premises from selling wine and/or malt beverages as ancillary sales to their business; and WHEREAS, the Mayor and Council further desire to allow such licensees the ability to sell wine and/or beer for consumption on premise on the licensees’ premises under the conditions set forth below; and NOW THEREFORE, the Council of the City of Peachtree Corners hereby ordains, as follows: Article III: Chapter 6 of The Code of the City of Peachtree Corners, Georgia, is hereby amended by adding an ancillary alcohol sales license under Section 6-110, “Ancillary Alcohol Sales License” to read as follows: Sec. 6-110. – Ancillary alcohol sales license (a) The city manager or his/her designee may grant a license for ancillary alcohol sales where it is determined that the sale, service or consumption of alcohol is not the primary business of the licensed establishment. (b) An ancillary alcohol sales license permits the licensee to sell a patron either two (2) six (6) ounce glasses of wine or two (2) twelve (12) ounce serving of beer or other malt beverage per day. (c) In no event shall a licensee’s total annual gross alcohol revenue exceed ten (10) percent of the licensee’s gross annual revenues. (d) Ancillary alcohol sales licensees shall be required to obtain a state alcohol license for consumption on the premises an except as expressly provided for herein, shall be subject to all state and local laws, rules and requirements, including licensing requirements and other provisions of this chapter related to the sale of alcohol for consumption on the premises. (e) Notwithstanding other provisions in this chapter regarding penalties for violation of this chapter upon a determination that a holder of an ancillary sales license has violated any provision of this chapter the license shall be revoked and the holder shall be ineligible to obtain an ancillary sales license of a period of five (5) years following the effective date of the revocation. WHEREAS, the City of Peachtree Corners is a municipal corporation duly organized and existing under the laws of the State of Georgia; and WHEREAS, Article IX, Section 2, Paragraph 3, of the Constitution of the State of Georgia authorizes municipal corporations to exercise certain powers and provide certain services; and WHEREAS, Article IX, Section 2, Paragraph 6, of the Constitution of the State of Georgia authorizes municipal corporations to create special districts within its territorial limits for the exercise of such powers and provision of such services; and WHEREAS, the provisions of this chapter shall be used to promote the public health, safety, and welfare of persons or properties within a designated area. NOW THEREFORE, IT IS HEREBY ORDAINED by the governing authority of the City of Peachtree Corners, Georgia that the City of Peachtree Corners Code of Ordinances is hereby amended as follows: Chapter 63 – SPECIAL DISTRICTS Article I. – GENERAL PROVISIONS Section 63-1. – Creation of special districts. There is hereby created and established special districts for the provision of services within such districts. Fees, assessments and taxes may be levied and collected within such districts to pay, wholly or partially, the cost of providing such services therein and to construct and maintain facilities therefor. Article II. – ENHANCED PUBLIC SAFETY MEASURES Section 63-25. - Program established. There is established an enhanced public safety program whereby eligible neighborhoods may petition the city to authorize installation of license plate readers, video cameras, lighting, and other such enhanced public safety measures within said neighborhoods. The city manager, or designee, shall create and maintain an enhanced public safety policy for the establishment of enhanced public safety districts and implementation of enhanced public safety measures. Section 63-26. – Council approval. Prior to the installation of any enhanced public safety measure, the city council shall approve by resolution the establishment of each such public safety district, pursuant to the policy created by the city manager or designee. Sections 63-27—63-29. – Reserved. Article III. – TRAFFIC CALMING MEASURES Section 63-30. - Program established. There is established a traffic calming program whereby eligible neighborhoods may petition the city to authorize installation of traffic calming measures within said neighborhoods. The city manager, or designee, shall create and maintain a policy for the establishment of traffic calming districts and implementation of traffic calming measures. Section 63-31. – Council approval. Prior to the installation of any traffic calming measure, the city council shall approve by resolution the establishment of each traffic calming district, pursuant to the policy created by the city manager or designee. Section 2. This ordinance shall become effective immediately upon adoption. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict. Six construction companies responded to the solicitation, and the bid summary is below for your review. Vertical Earth, Inc. came in as the lowest & most responsive bidder. They have not yet completed any work for the City, but they are on GDOT’s preapproved contractors list and have completed projects for Keck and Wood, the design engineers, and they performed in a satisfactory manner on those projects. Staff recommends authorizing the City Manager to execute a construction agreement with the lowest, most responsive bidder, Vertical Earth, Inc. for a base bid amount of $1,191,967.47 for PTC 18.01.
