Jeff Conkle, Planning and Zoning Administrator, informed the Commissioners that the
applicant is seeking approval of a special use permit to allow for used auto sales at an
existing building and property along Buford Highway just northeast of the intersection
with South Old Peachtree Road. The property adjoins other C-2 zoning across Buford
Highway in unincorporated Gwinnett County. It also adjoins C-2 zoning in Peachtree
Corners to the southwest but is otherwise surrounded by M-2 zoning.
The existing C-2 zoning permits used auto sales on at least 1.5 acres with an approved
special use permit. The property is 0.85 acres in size, thus necessitating the variance
request that is part of this application. The proposal for used auto sales is consistent with
C-2 zoning and the Character Area along Buford Highway. However, this use is required
to be on a site of at least 1.5 acres in size. The applicant’s property is 0.85 acres.
The applicant describes their hardship as being unable to expand the property to meet
the minimum size. However, the property was this size and configuration prior to the
applicant being involved. Based on Staff’s analysis, none of the hardship criteria has been
met. After review of the applicant’s proposal and other relevant information, it is
recommended that SUP2020-002/V2020-006 be denied.
The applicant representative, Stanton Kincaid, gave a brief overview of the request
and stated that the applicant has no problem with staff conditions.
Chairman Kaplan comment open the floor for public comment. There were no
comments from the public.
After review, the Commissioners moved forward with staff recommendation to deny
the request.
MOTION TO DENY SUP2020-002 & V2020-006 ATLANTA AUTO SALES.

CIC2020-002 Pet Boarding. Request to approve a change in conditions to
permit a pet boarding business at 5075 Peachtree Pkwy. Ste. 107, Dist. 6,
Land Lot 318, Peachtree Corners, GA.
Diana Wheeler, Community Development Director, informed the commissioners that the
applicant would like to establish a pet boarding facility in the space adjacent to her
existing pet grooming salon at the Ingles Shopping Center. The pet grooming
establishment currently occupies a 1700-square-foot space known as Suite 106 and has
been operating without complaint since its approval in early 2018. The applicant’s
proposal is to provide a facility for overnight boarding for 16 pets and day care for 20
additional pets in a 1750 sq. ft. space. In order to accommodate this use, the applicant is
seeking to change the conditions of a past rezoning case at the shopping center property
which prohibits kennels. The property consists of a main shopping center parcel
containing an Ingles grocery store as well as numerous smaller retail shops and
restaurants. There are five outparcels containing a mix of retail, restaurant, educational,
and medical office uses. These parcels are located on the west side of Peachtree Parkway
just north of East Jones Bridge Road. These properties are adjacent to R-75 single-family

properties to the rear. The applicant requests to change a condition of past case CIC2017-
002 which itself was approved to allow for a pet grooming salon in the adjacent suite.
When approval for this case was granted, a condition was imposed which states that “no
overnight stays or kennel-type business is permitted.”
Pet services facilities are generally consistent with C-2 zoning and are typically permitted
in shopping centers, as evidenced by the applicant’s adjacent pet grooming salon.
However, unlike most pet service uses, a boarding facility with overnight accommodations
has the added burden of providing space for pet exercise and outdoor activity. The letter
of intent included with the application states that the business will offer, “high quality pet
suites with plenty of exercise time”. However, at 1750 sq. ft., there is no space within the
facility to accommodate exercise. There is also no space outside the shopping center that
has been identified for this purpose. Use of the front parking lot or the service alley
behind the shopping center would not be acceptable solutions. And walking multiple
pets in and near the adjacent neighborhood would be burdensome to nearby residents.
In conclusion, it appears that the tenant space at this location is inadequate to
accommodate the proposed pet boarding use. After review of the applicant’s proposal and
other relevant information, it is recommended that CIC2020-002 be Denied.
The applicant could not be present, however the property manager, Linda Smalls, spoke
on behave of the applicant and stated that she is in support of the approval of the boarding
facility.
Chairman Kaplan opened the floor for public comment. There was one comment in
favor and one comment in opposition stating noise and smell.
After review, the Commissioners moved forward with staff recommendation to deny
the request.
MOTION TO DENY CIC2020-002 PET BOARDING. REQUEST TO APPROVE
A CHANGE IN CONDITIONS TO PERMIT A PET BOARDING BUSINESS AT
5075 PEACHTREE PKWY. STE. 107, DIST. 6, LAND LOT 318,

CIC2020-003 Veterinarian’s Office. Request to approve a change in
conditions to permit a veterinarian business at 5075 Peachtree Pkwy.
Ste. 101, Dist. 6, Land Lot 318, Peachtree Corners, GA.
Diana Wheeler, Community Development Director, informed the commissioners the
applicant would like to provide veterinary services in a 2,000 sq. ft. vacant space at the
southern end of the Ingles Shopping Center. The office hours for the vet clinic would be
M-F 8AM – 6PM and every other Saturday 8AM -noon. In order to accommodate this use,
the applicant is seeking to change the conditions of a past rezoning case at the shopping
center property which prohibits veterinary clinics. The property consists of a main
shopping center parcel containing an Ingles grocery store as well as numerous smaller
retail shops and restaurants. There are five outparcels containing a mix of retail,
restaurant, educational, and medical office uses. These parcels are located on the west
side of Peachtree Parkway just north of East Jones Bridge Road. These properties are

adjacent to R-75 single-family properties to the rear. The applicant requests to change a
condition of past rezoning case RZ1996-134. The condition states that animal hospitals
and veterinary clinics are prohibited uses. In 2017, an adjacent suite requested a change
in conditions (CIC2017-002) which was approved to allow for a pet grooming salon which
was also previously prohibited by RZ1996-134.
The proposal for a veterinary clinic is consistent with C-2 zoning and is a use that is
typically permitted, along with other animal-related businesses, such as the adjacent pet
grooming salon. Given the commercial character of the area and the substantial distance
to the nearest residential property, it is unlikely to be a detriment to surrounding
properties.
After review of the applicant’s proposal and other relevant information, it is recommended
that CIC2020-003 be approved subject to the following conditions.
1. Case RZ1996-134 shall be amended to remove “animal hospitals and veterinary
clinics” as a prohibited use.
2. The applicant shall ensure that the parking lot, sidewalks, and landscaped areas
within 100 feet of the business in all directions shall be maintained free of dog
waste.
3. Signage shall be in conformance with Chapter 54 of the City Code and the Activity
Center/Corridor Overlay District standards.
4. The applicant shall maintain in sanitary condition any outdoor pet relief areas
serving the business.
5. No overnight pet accommodations shall be permitted except as needed for post-
surgery care.
The applicant, Jamie Cho, gave a brief overview of the request and stated that she is very
excited to open the clinic in Peachtree Corners and assured that there will be no boarding
of pets unless is a necessary hospital stay.
Chairman Kaplan open the floor for public comment. There were three comments in
support and one in opposition.
After review, the Commissioners moved forward with a recommendation of support for
CIC2020-003 with the following amended conditions:
1. Case RZ1996-134 shall be amended to remove “animal hospitals and veterinary
clinics” as a prohibited use.
2. The applicant shall ensure that the parking lot, sidewalks, and landscaped areas
within 100 feet of the business in all directions shall be maintained free of dog pet
waste by inspecting area twice a day or more as needed.
3. Signage shall be in conformance with Chapter 54 of the City Code and the Activity
Center/Corridor Overlay District standards.
4. The applicant shall maintain in sanitary condition any outdoor pet relief areas
serving the business. Detail plans of relief area shall be submitted to staff for
approval prior to a certificate of completion being issued.
5. No overnight pet accommodations shall be permitted except as needed for post-
surgery care or medical care.

6. The applicant shall install and maintain a pet waste station within proximity to the
front entrance.

RECOMMENDATION: APPROVE WITH CONDITION
PROJECT BACKGROUND:
The elevations for the Town Center retail and restaurant buildings were approved in 2017
because they were deemed to be in compliance with Ordinance 2015-06-49 that identifies
specific appearance standards for all the buildings in the Town Center. Criteria for building
elevations listed in the ordinance address items such as building walls, roof lines, parapets,
building materials, and landscaping. In addition to this ordinance, Table ‘B’, the development
regulations for the Town Center also includes building requirements.
PH2020-011
The 600 Building, where Fire & Stone is located, was part of that approval. However, the
applicant wishes to construct a covering over the existing open-air patio. This change requires
approval through a new public hearing process.
PLAN REVIEW:
Most of the changes proposed by the applicant are in conformance with the overall design
standards. The patio covering supports will be made of black metal which complements the
appearance of the restaurant and Town Center. Additionally, an operable roll-up curtain system
will wrap the patio, allowing for outdoor dining in inclement weather. However, the bright red
color shown on the roof material is not in conformance with Town Center design standards
which limit bright, primary colors to accents which cover a very small percentage of the façade.
This roof will be a large component of the façade and should be changed to a more muted or
earth-tone color to comply with Town Center regulations.
RECOMMENDATION:
After review of the applicant’s proposal and other relevant information, it is
recommended that PH2020-011 be approved with the condition that the canopy
roof color is similar to the color of the stone wall to which it will be attached.

This letter of intent is for a change in conditions for Fire & Stone Italian Pizza Kitchen located in
Peachtree Corners Town Center, 5215 Town Center Boulevard, Suite 610, Peachtree Corners,
GA. Fire & Stone is proposing to add an awning with exterior walls (rollup) for the purpose of
increasing seating during the colder months. Due to the Corona Virus Epidemic, we have limited
inside seating capacity and will need to enclose the patio so it can be used during the colder
months but still give the feeling of being outdoors when the weather permits.
Materials and Colors -
The awning supports are to be constructed of 4” aluminum surface mount posts with black
powder coat. The frame will be constructed of 1” x 4” with a Red Coastline Plus Vinyl. The
projection will be 18’ with 4’ drop, 8” valance and a width of 64’.
Operable Rollup Curtain System -
The five curtains adjacent to the sidewalk and the two on either end will be capable of being
manually rolled up. When the weather allows the side panels will be capable of being rolled up
to give the feel of being outdoors. There will be fences installed between the vertical post in all
spaces where the curtains rollup with the exception of a removable fence or no fence in the
section in front of the outdoor bar.

PROJECT BACKGROUND:
The elevations for the outparcel “900 Building” of the Town Center were approved in 2019
because they were deemed to be in compliance with Ordinance 2015-06-49 that identifies
specific appearance standards for all the buildings in the Town Center. Criteria for building
elevations listed in the ordinance address items such as building walls, roof lines, parapets,
building materials, and landscaping. In addition to this ordinance, Table ‘B’, the development
regulations for the Town Center, also includes building requirements. However, the applicant
wishes to construct a larger fenced patio area by adding a new railing along the exterior of the
patio.

PLAN REVIEW:
The changes proposed by the applicant are in conformance with the overall design standards.
The patio railing will match that which was approved for the fenced portion of the patio and
has an appearance that complements that of the restaurant. However, moving the railing (which
also contains planter boxes) further out means that plain metal columns will extend down from
the metal canopy and that the enlarged portion of the outdoor seating will have no overhead
covering. If approval is granted for the proposed location of the planter box railing, the seating
area located beyond the canopy may utilize table umbrellas and space heaters; however, no
awning, canopy or similar overhead covering should extend beyond the previously approved
canopy.
RECOMMENDATION:
After review of the applicant’s proposal and other relevant information, it is
recommended that PH2020-012 be approved and the patio railing be extended to
the perimeter of the patio area subject to the condition that the portion of the
patio area not covered by the previously approved canopy shall remain uncovered.
The uncovered portion of the patio seating may utilize umbrella tables and gas
heaters, but cannot otherwise be covered by an awning, roof, plastic, or other
weather protection material.

SUBJECT: Amendment to MUD District
The Mixed-Use Development (MUD) zoning classification exists on the City’s zoning map and in the Zoning
Code; however, an application of the MUD district exists in only one place in Peachtree Corners: The Town
Center. Recently, there has been increased interest in potential rezoning applications for this district.
Because the MUD zoning classification has been relatively unused and the effectiveness of its regulations
has not been assessed since the development of the Town Center, staff has been looking at ways to enhance
and refine the ordinance in anticipation of receiving applications.
The proposed ordinance changes on the attached draft include incentives for project upgrades, density
bonuses, building height reductions, and increased property size. The words on the attached draft that have
been struck through are proposed to be removed and the underlined words are proposed to be added.
After discussion of the attached draft, staff will make the necessary modifications and bring this item back
for formal consideration at the January 21, 2021 Planning Commission meeting.
