Luft, Village Manager DATE: April 10, 2024 SUBJECT: Revisions to Pelham Manor Vehicle & Traffic Code As a local municipality in New York State, the Village of Pelham Manor (Village) Board of Trustees (BOT) has the authority to regulate traffic within Village boundaries pursuant to Chapter 71 of New York State law. Traffic control devices in New York State (NYS) are regulated by two documents: the Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD) and 17 NYCRR Chapter V (NYS Supplement). The incorporated revisions to this chapter of our Village code demonstrate our continued commitment to safety. It is important to recognize that this revision builds upon a long-standing history of incorporating public safety measures related to public roadways. When considering regulations, we must take in account emergency vehicles and operations, vehicular traffic, pedestrians, and all other factors that affect the roadways. This effort supports our on-going commitment to evaluation and improvement, and is not intended to be a stand- alone action item. If enacted, there will be an implementation period that must be conducted. I will provide further information on this during my introduction. As your Chief Executive Officer, I have collaboratively conducted an in-depth review of Pelham Manor Village Code Chapter 202. This process has spanned roughly eight months and involved numerous interested stakeholders. The overarching goal is to simplify, streamline, and further solidify the regulations of our roadways.  Local Law No. 1 of 2024 This local law shall be known as “Pelham Manor Code Chapter 202 – Vehicle and Traffic”. BE IT ENACTED by the Board of Trustees of the Village of Pelham Manor Sec�on 1 – Purpose: The Village of Pelham Manor (Village) hereby intends to reduce the Village-wide speed limit to twenty-five (25) miles per hour. The Village further intends to streamline, revise, and establish other regula�ons and specifica�ons contained in Pelham Manor Code Chapter 202 – Vehicle and Traffic. The words and phrases used in this chapter shall for the purpose of this chapter have the meanings respectively ascribed to them by Article I of the Vehicle and Traffic Law of the State of New York. B. The following words and phrases which are not defined by Article I of the Vehicle and Traffic Law of the State of New York shall have the meanings respectively ascribed to them in this section for purposes of this chapter. COMMERCIAL VEHICLES — Every type of motor-driven vehicle used for commercial purposes on the highways, including without limitation trucks, trailers, semitrailers and tractors, but excluding buses. HOLIDAYS – New Year’s Day, Lincoln’s Birthday, Washington’s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day SCHOOL HOURS – 7:00 am to 4:00 pm on any day which students are required to report to a Pelham Public Schools District education facility. VILLAGE — The Village of Pelham Manor. ARTICLE II Traffic-Control Devices § 202-2. Authority to install traffic-control devices. The Village Manager shall be responsible for installing and maintaining traffic-control devices when and as required under the provisions of this chapter to make effective the provisions of said chapter and may install and maintain such additional traffic-control devices as the Board of Trustees of the Village may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York subject to the provisions of §§ 1682 and 1684 of that law. ARTICLE III Exclusion of Vehicles § 202-3. Temporary exclusion of vehicles. The Board of Trustees of the Village may temporarily exclude from any portion of any Village street any vehicle with a gross weight of over four or more tons or any vehicle with a gross weight in excess of any designated weight on any wheel, axle, any number of axles, or per inch width of tire when in its opinion such highway would be materially injured by the operation of any such vehicle thereon. Such exclusion shall take effect upon the erection of signs on the section of highway from which such vehicles are excluded and a notice that such vehicles are excluded shall be published in a newspaper in the county of Westchester. The exclusion shall remain in effect until the removal of the signs as directed by the Board of Trustees. Upon written application, the Board of Trustees may issue a permit providing appropriate exemption of such vehicle, if it is deemed that said vehicle is performing essential local pickup or delivery service and that a failure to grant such permit would create a hardship. Every such permit may designate the route to be traversed and contain other reasonable restrictions or conditions deemed necessary. Every such permit shall be carried on the vehicle to which it refers and shall be open to inspection of any peace officer. Such permits shall be for the duration of the restriction imposed under this section. 4  ARTICLE IV Traffic Control Signals § 202-4. Traffic control signals. Traffic control signals shall be installed at the locations set forth in Schedule A (§ 202-39) to this chapter, and shall be obeyed in the manner set forth in the Vehicle and Traffic Law of the State of New York. ARTICLE V One-Way Roadways § 202-5. One-way roadways. The streets set forth in Schedule B (§ 202-40) to this Traffic Code are hereby designated and shall be observed as one-way streets. ARTICLE VI Pedestrian Crossings § 202-6. Pedestrian crossings. A. Unless otherwise provided, the Village Manager shall authorize the application of crosswalk markings which indicate a pedestrian crossing pursuant to the specifications and guidance in the most recent edition of the National Manual on Uniform Traffic Control Devices and New York State Supplement. B. The Village Manager shall maintain a list of all authorized crosswalk markings. ARTICLE VII Turning Movements § 202-7. Movements restricted. The turning movements set forth in Schedule D (§ 202-41) to this Traffic Code are prohibited at the designated locations. ARTICLE VIII Stop and Yield Intersections § 202-8. Through streets. (Reserved) § 202-9. Stop intersections. A. The intersections set forth in Schedule E (§ 202-42) to this Traffic Code are hereby designated as stop intersections and stop signs shall be erected on the indicated entrances thereto. § 202-10. Yield intersections. A. The intersections set forth in Schedule F (§ 202-43) to this Traffic Code are hereby designated as yield intersections and yield signs shall be erected on the indicated entrances thereto. ARTICLE IX Speed Regulations 5 § 202-11. Maximum speed limits. A. The maximum speed limit is 25 miles per hour (mph) on all Village roads except those posted in accordance with Subsection B of this section. Such speed limit shall not apply to streets and highways for which speed limits are established by the State of New York or the County of Westchester. B. The maximum school speed limit is 15 mph in the following designated areas: • Oak Lane between Clay Avenue and Washington Avenue • Clay Avenue between Between Oak Lane and Hudson Street • Hudson Street between Clay Avenue and Washington Avenue • Washington Avenue between Oak Lane and Peace Street • Siwanoy Place for the entire length • Manor Lane for the entire length C. No vehicle shall exceed any maximum speed limit. ARTICLE X Parking, Standing and Stopping § 202-12. Application of article. The provisions of this article shall apply unless it is necessary to stop a vehicle to avoid conflict with other traffic or unless otherwise directed by a police officer or official traffic control device. § 202-13. All-night parking. It shall be unlawful for any person to park, or to leave parked, any vehicle on any street between the hours of 2:00 a.m. and 7:00 a.m.; provided, however, that this section shall not apply to fire, police and other Village department vehicles, public service corporation vehicles while performing emergency work, ambulances or vehicles operated or driven by a physician when actually engaged in responding to an emergency call. § 202-14. Parking prohibited in certain locations during specified times. A. The parking of vehicles is hereby prohibited in certain locations during specified times set forth in Schedule G (§ 202-44). B. The parking of vehicles is hereby prohibited in posted fire zones and designated no parking areas. C. The parking of vehicles is hereby prohibited on public sidewalks and any unpaved portion of right- of-way. D. The parking of commercial vehicles is hereby prohibited on any public street or in any parking lot or on other property owned or maintained by the Village, except for such period of time as shall be necessary to permit the driver or crew of such vehicle to make deliveries to or otherwise service properties immediately adjacent to the place where such vehicle shall be parked. E. The parking of vehicles is hereby prohibited on any public street within five feet of any driveway. § 202-15. Parking in Public Parking Lot. 6 Village Hall Parking Lot. All that plot or parcel of land bounded on the north by Prospect Avenue, on the west by Penfield Place and particularly designated on the Assessment Map as 167.29-1-67. A. The Village Manager has the authority to designate spaces for employee parking in accordance with operational demands. B. Residents of the Village may park their vehicle, if it does not have commercial plates, in the Village Hall Parking Lot starting at 4:30 pm on a first-come first-served basis. All such vehicles must be removed from the lot by 8:00 am on weekdays. § 202-16. Standing prohibited in designated locations. The standing of vehicles is hereby prohibited in the locations set forth in Schedule H (§ 202-45) to this Traffic Code. § 202-17. Stopping prohibited in designated locations. The stopping of vehicles is hereby prohibited in any of the locations set forth in Schedule I (§ 202-46) to this Traffic Code. § 202-19. Abandoned motor vehicles. A. A motor vehicle shall be deemed to be an abandoned motor vehicle if left unattended: (1) With no identification plates affixed hereto, for more than six hours on any public highway or other public space; (2) For more than forty-eight (48) hours, after the parking of such motor vehicle shall have become illegal; or (3) For more than ninety-six (96) hours on property of another, if left without permission of the owner of that property. B. Any motor vehicle deemed to be abandoned under § 202-18 shall be removed by the Village in accordance with this chapter and with the New York State Vehicle and Traffic Law, Article 33, § 1224(2), Abandoned Vehicles. C. An abandoned vehicle shall be disposed of in accordance with the New York State Vehicle and Traffic Law, Article 33, § 1224(2), Abandoned Vehicles. ARTICLE XI Parking Meters § 202-19. (Reserved) ARTICLE XII Removal and Storage of Vehicles § 202-20. Authority to tow and impound vehicles. A. In addition to any other penalties or fines imposed for the violation of any law, rule, or regulation, this article shall apply to motor vehicles parked which: 7  (1) Either violate any provision of any municipal, state, or county ordinance, law rule, or regulation or have three (3) or more outstanding and unpaid parking violations issued against them for parking violations that occurred in the Village; and (2) Are located on: (a) On any property owned by, leased by, or in the possession and control of the Village; (b) On any public highway or private road located in the Village, whether or not open to public travel, paved, or unpaved; (c) In any public parking lot located in the Village; or (d) In any parking area of an office building, office building complex, place of public assembly, shopping center, private apartment complex, private condominium complex, or cooperative apartment complex located in the Village whose owner, or the person in general charge of the operation and control of such area, has made a written request to the Village pursuant to New York Vehicle and Traffic Law § 1660- a. (3) For the purpose of this article, “outstanding and unpaid parking violations” do not include parking tickets which, by their terms, are not yet required to be paid or parking tickets which are outstanding and unpaid because the owner or lessee of the motor vehicle has pleaded “not guilty” to such ticket and there has not yet been an adjudication of such ticket. § 202-21. Costs to be paid. Before the owner of any vehicle taken into custody, as above provided, shall be allowed to repossess or to secure the release of said vehicle, the owner or the owner's agent must pay the following: A. All sums due to the Village for any outstanding and unpaid violations of this chapter or the New York State Vehicle & Traffic Law that occurred within the Village, including penalties and interest, if any; B. The cost of towing; C. The cost of storage for each day or portion of a day that such vehicle is so stored; and D. The fine established in § 202-24. § 202-22. Removal of motor vehicles. A. A police officer is authorized to provide for the removal of any motor vehicle meeting the description contained in § 202-18 and § 202-20 to an impound yard or storage facility maintained by a company or individual with which the Village has entered into a contract to tow, impound, or store motor vehicles. B. If the removed motor vehicle is registered with the State of New York, the Police Department shall advise the owner of the place where the motor vehicle may be recovered and the conditions under which it will be released by sending a certified letter with such advice to the motor vehicle’s registered owner or lessee, at the address shown on records of the New York State Department of Motor Vehicles. Such letter shall be mailed no later than first business day after a motor vehicle has been removed. If the removed motor vehicle is not registered with the State of New York, the Police Department shall use its best efforts to advise the owner of the place where the motor vehicle may be recovered and the conditions under which it will be released. The Police Department’s failure to comply with this section shall not entitle the owner or the lessee to recover the removed motor vehicle without paying the amounts required to be paid pursuant to § 202-21. 8 § 202-23. Identification required for release. No such vehicle shall be released to anyone other than its registered owner, that owner’s representative, or the motor vehicle’s lessee has established his identity and right to possession and has signed a proper receipt therefor. Such person must establish their identity and, in the case of a person other than the registered owner or lessee, must establish that they have the registered owner’s or the motor vehicle’s lessee’s permission to take possession of such motor vehicle. No removed motor vehicle shall be released unless the person to whom it is released has signed a receipt therefor. § 202-24. Penalties for offenses. Any persons who, after having had his vehicle towed, shall remove such vehicle without complying with this article shall, in addition to the other charges provided for herein, be liable for a fine of up to $250. ARTICLE XIII Truck Exclusions § 202-25. All trucks excluded. All trucks are hereby excluded from all streets within the limits of the Village with the exception of Pelhamdale Avenue, Boston Post Road, Wolfs Lane and streets west of the Hutchinson River Parkway. § 202-26. Commercial vehicles over 2 1/2 tons excluded. A. Prohibitions. Except as provided in Subsection B below all commercial vehicles having a maximum weight exceeding 2 1/2 tons or 5,000 pounds are prohibited from using and are excluded from Pelhamdale Avenue between Colonial Avenue and the Shore Road, Wolfs Lane and Secor Lane east of the Hutchinson River Parkway. B. Exceptions. The prohibitions of Subsection A above shall not apply to commercial vehicles which are proceeding directly to or returning from a delivery to or pickup from a location within the corporate limits of the Village of Pelham Manor if such location is: (1) East of the Hutchinson River Parkway; and (2) Not abutting upon the Boston Post Road or Wynnewood Road south of the Boston Post Road. C. Vehicles using refuse transfer station. Nothing in this chapter shall prohibit commercial vehicles owned or leased by a municipal corporation from using Pelhamdale Avenue in order to proceed directly to or return directly from the Village Refuse Transfer Station. ARTICLE XIV Truck Route System § 202-27. (Reserved) ARTICLE XV Pavement Markings § 202-28. (Reserved) ARTICLE XVI Safety Zones 9  § 202-29. Safety Zones Police Safety Zone. Parking of vehicles, other than those authorized by the Chief of Police, is prohibited in a police safety zone. Police Safety Zones are established as follows: Name of Street Side Location Penfield Place East 3 spaces for a distance of approximately 66 feet directly in front of the entrance to Police Headquarters. This section shall be identified with a sign stating “Parking for Authorized Vehicles Only”. ARTICLE XVII Center Lane Allocation § 202-30. (Reserved) ARTICLE XVIII Lane Designation § 202-31. Lane designation. All commercial vehicles weighing 2 1/2 tons and over must, while proceeding on Boston Post Road, Route US 1, between the westerly and easterly boundaries of the Village of Pelham Manor travel in the extreme right lane exclusively unless said extreme right lane is occupied by a vehicle stopped, parked or left standing. ARTICLE XIX Dead-End Streets § 202-32. (Reserved) 10  ARTICLE XX Unregistered Motor Vehicles § 202-33. Unregistered motor vehicles. A. Prohibitions. No person, being a parent of or having the care and custody of a minor child shall suffer, allow or permit such child to operate any motor vehicle as defined in § 125 of the Vehicle and Traffic Law of the State of New York upon any public highway, street, sidewalk, path or other public place, unless such vehicle is duly registered under the laws of the State of New York and such child has a valid license to operate such vehicle. The operation of any unregistered motor vehicle upon any public highway, street, sidewalk, path or public place by a minor child shall be presumed to be with the sufferance, permission or consent of the parent or person having care and custody of such child. B. Penalties. Notwithstanding the provisions of § 202-35 of this chapter, any person convicted of a violation of this section shall be punished by: (1) A fine of not less than $25 nor more than $50 for a first conviction; (2) A fine of not less than $50 nor more than $100 for a second conviction within 18 months of the first conviction; and (3) A fine of not less than $100 nor more than $200 for a third or subsequent conviction within 18 months of the prior conviction. ARTICLE XXI Automobiles For Hire § 202-34. Automobiles for hire. A. It shall be unlawful for any person to maintain or operate any place of business where automobiles are offered for rent to be driven by the person who has hired the automobile unless the owner or operator of such place of business shall first have obtained a license from the Village Clerk, in accordance with this section, and such license shall then be in full force and effect. Automobiles which may be offered for hire shall be only passenger automobiles. Passenger automobiles may be offered for hire only in connection with an automobile service station legally operated in the district in which automobile service stations are permitted. Automobiles available for hire shall not be parked or stored on the streets or public places, but such place of business shall have separate parking space or garage space, or both, sufficient in size to accommodate automobiles available for hire. Such place of business shall not store or have available on the premises more than five such automobiles for hire. All automobiles for hire shall be kept clean and in good repair and shall be properly licensed and insured as required by law. B. Licenses issued by the Village Clerk pursuant to this section shall be subject to the approval of the Chief of Police of the Village, evidenced by the Chief’s endorsement thereon, and shall be further subject to suspension or revocation if said Chief of Police shall at any time find that the licensee has violated the terms of this section of such license. A license fee, payable upon filing of each application for a license pursuant to this section, shall be $100. Each license issued hereunder shall extend for the period specified therein, but not exceeding one year. 11  ARTICLE XXII Penalties § 202-35. Penalties for offenses. Every person convicted of a violation of any provision of this chapter shall for a first conviction of such provision be punished by a fine of not more than $50; for a second such conviction within 18 months thereafter such person shall be punished by a fine of not more than $100; upon a third or subsequent conviction within 18 months after the first conviction such person shall be punished by a fine of not more than $250. ARTICLE XXIII Repeal of Prior Laws § 202-36. Ordinances, regulations and local laws repealed. The following ordinances, regulations and local laws or parts of ordinances, regulations and local laws of this Village regulating traffic are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter: A. Sections 10, 10A, 11, 12, 14, 15, 16A, 16B, 16C, 16 and 17 of Chapter III of the Code of General Ordinances of the Village of Pelham Manor. B. Schedules A, B, B-1 and C of Chapter IX of the Code of General Ordinances of the Village of Pelham Manor. C. Traffic Regulations A, 1, 2, 3, 4, 5, 6, 7, 8 and 9. D. Local Law Nos. 2-1975, 9-1976, 12-1976, 1-1977 and 1-1980. E. Chapter 202 - Vehicles and Traffic of the Code of the Village of Pelham Manor prior to the effective date of Local Law 1 of 2024. ARTICLE XXIV Amendments by Resolution; Recording in Book § 202-37. Changes made by resolution. All changes in the schedules made a part of Article V, VI, VII, VIII, and X of this chapter may be made by the adoption of a resolution of the Board of Trustees.
