Chairman Varone opened the meeting and introduced the members of the Board.

MINUTES
The minutes of the December 8, 2021 meeting were approved.
Manager Pierpont presented the application of Ms. Theresa Balducci, 682 Timpson
Street, 163.83-1-4, for a variance to allow an unenclosed off-street parking space nearer
than 25 feet to the street line.
Member Varone recused himself from this matter. The hearing was held open until next
month due to the lack of a quorum for this particular application.

The Board reserved decision.

Manager Pierpont presented the application of Mr. & Mrs. Higgins, 128 Reed Avenue,
163.76-1-21, for a variance to allow the extension of a house with a street setback of 16.8
feet where 20 feet are required and an existing lot coverage of 3,239 square feet where
2,700 feet is permitted and 3,198 square feet is proposed.
John Iannacito, RA appeared to review the proposal. Lot coverage was discussed, A/C
and lighting was discussed.
James Rodriguez 129 Reed Avenue spoke in favor of the application. No other
comments.

Manager Pierpont presented the application Ms. Emily Tuckman & Peter Bell, 999
Prospect Avenue, 166.36-1-57, for a special permit for a swimming pool (hot tub).
Domenick Ragno & Tracee Neumann rose to present the application. Fencing,
landscaping and lighting was discussed.

The Board reserved decision.

Manager Pierpont presented the application of Mr. & Mrs. Teller, 30 Shore Road,
167.55-1-10, for a variance for A/C Units located in required sideyard, and a shed not
separated by 10 feet.
The applicant did not appear due to medical reasons – and the hearing was held open
until next month.

The Board granted a 90-day extension to obtain a Building Permit to Mr. & Mrs. John
Royce, 1016 Clay Avenue, 166.36-1-60.

The Board considered the application of Mr. & Mrs. Higgins, 128 Reed Avenue, 163.76-
1-21, for a variance to allow the extension of a house with a street setback of 16.8 feet
where 20 feet are required and an existing lot coverage of 3,239 square feet where 2,700
feet is permitted and 3,198 square feet is proposed.
After discussion, and upon motion duly made and seconded, it was unanimously resolved
that
WHEREAS, there are special circumstances and conditions applying to this building and
land which do not apply generally to the land and buildings in the neighborhood and have
not resulted from any act of the applicant subsequent to the adoption of the regulations
appealed; and
WHEREAS, the circumstances and conditions are such that the particular applications of
the conditions of the zoning ordinance would deprive the applicant of the reasonable use
of the land and building; and
WHEREAS, the granting of the variance sought will be in harmony with the general
purpose and intent of the zoning ordinance and will not be injurious to the neighborhood
or otherwise detrimental to the public welfare, and
NOW THEREFORE BE IT RESOLVED, That the application of Mr. & Mrs. Higgins,
128 Reed Avenue, 163.76-1-21, for a variance to allow the extension of a house with a
street setback of 16.8 feet where 20 feet are required and an existing lot coverage of
3,239 square feet where 2,700 feet is permitted and 3,198 square feet is proposed be and
hereby is granted.

Avenue, 166.36-1-57, for a special permit for a swimming pool (hot tub).
After discussion, and upon motion duly made and seconded, it was unanimously resolved
that
WHEREAS, the requirements for a special permit set forth in the zoning ordinance, as
pertains to this application, have been met,
NOW THEREFORE BE IT RESOLVED, That the application of Ms. Emily Tuckman &
Peter Bell, 999 Prospect Avenue, 166.36-1-57, for a special permit for a swimming pool
(hot tub), be and hereby is granted.
