Item #1 – Meeting called to order: The meeting of the Board of Trustees was called to order by Mayor Cassidy at 7:30 p.m. The following members of the Board of Trustees were present: Mayor Cassidy, Trustees Senerchia, Mutti, Marty, Volpe, McGoldrick, and Kagan Board of Trustees Regular Meeting Tuesday, April 22, 2014 The following members of the Board of Trustees were absent: Village staff in attendance: Village Administrator Robert Yamuder, Secretary to the Village Administrator Peter Bonington Item #2 – Pledge of Allegiance: The Pledge of Allegiance was led by Mayor Cassidy. Reports: Mayor Cassidy Report None Trustees Reports: Trustee Kagan Trustee Kagan reported that the next meeting with United Water is scheduled for April 30th. He added that since R&S Waste has taken over as the Village’s sanitation carter he has noticed that they appear to be much neater than the last carter. Trustee Marty Trustee Marty agreed that R&S is doing well. He added that people appear to be getting used to pickups which may be at a slightly earlier or later time than they are used to. He reminded Village merchants that collections will begin promptly at 9 am for the commercial district. Trustee Marty stated that he had met with EcoPel and said they have some good ideas for future consideration such as mulching leaves and increased recycling downtown. He said New Rochelle has already made the decision to not pickup leaves anymore but to provide a drop-off site for residents to dispose of their organic. Page 2 Board of Trustees Regular Meeting Tuesday, April 22, 2014 Trustee Mutti Trustee Mutti reported that Earth Day is Saturday. She thanked the DPW for the placement of a “Stop” sign at the intersection of Corlies Avenue and Franklin Place. She said that the MTA has acknowledged that the excess noise coming from the tracks is due to track joints that require maintenance. She said some equipment problems on their end have delayed the repair work. She added that new bike racks are being added to the station as well. She finished her report by saying that the Trotta Park dedication ceremony is scheduled for Sunday, May 18th. At 12:30 p.m. and the municipal government will have a table at the coming Street Fair in June. Trustee Reim None Trustee Senerchia Trustee Senerchia stated that the 3rd Street Relief Drain Project has a scheduled bid opening for Tuesday, May 13th at 1 p.m. He said the Pelham Art Center is having its annual Cherry Blossom event on Monday, April 26th. He added that the Antiques Flea Market would be operating out of Wolfs Lane Park as well. He reminded the public that the Street Fair will take place on June 7th and anyone interested in becoming a vendor should contact Dennis Brooks of the Pelham Chamber of Commerce. Trustee Senerchia finished his report by saying the Village Police Department will be having a prescription drug take back day on. Trustee Volpe Trustee Volpe reported that the Village is negotiating the collective bargaining agreements and noted progress on all fronts. He added that the Village continues to advertise for available parking spaces. Page 3 Board of Trustees Regular Meeting Tuesday, April 22, 2014 Village Administrator’s Report Administrator Yamuder reported that R&S Waste is performing the Village’s sanitation operations. He said since they began a few weeks ago, he has heard positive reports on their conduct. He reminded residents that loose leaf organic collection will end on April 30th. All organic collections will be performed by R&S Waste on Wednesday’s only after that date. Item #6–Public Comment None Item #7– Presentation of Junior League Woodland Park Mayor Cassidy stated the plan to revitalize Wolfs Lane Park goes back to 2007 with the original design concept drawn up by Hank White Landscape Architects. He said the Village currently has a $647,000 grant sponsored by Senator Klein to improve one section of the park. He reminded the public however that the scope is beyond what the Village can finance in one swoop. He said the current proposal to improve the woodland park is a viable step that can be taken with the help of the Junior League. Trustee Mutti introduced Fred Martin, a landscape architect working with the Junior League on the early design schematics. Fred Martin stated he is an environmental designer who specializes in natural playgrounds. He has worked in the past with Greenburgh Nature Center. He said the proposed site for the park is a low impact area and emphasized minimal amount of equipment in favor of natural and imaginative elements. Edith Ilino of Nyac Avenue stated there did not appear to be any plans for water or bathroom facilities on the schematic. She said this issue will come up in the future and must be addressed. Chris Perlman of Nyac Avenue stressed that it is worth the Board’s time and energy to do the hard research now rather than later. He stated however that no bathrooms on site may steer people towards local merchants. Tom Farley of Nyac Avenue stated that he feels there is already a nature park there now. He said although the plan is well intentioned it eats up critical green space in the community. Page 4 Board of Trustees Regular Meeting Tuesday, April 22, 2014 James Dorn of 2nd Street asked if any other locations had been considered for this project. He said the Greenburgh Nature Center is not located in a cluster of residences as this park is. Liz Perratin of Nyac Avenue said this proposed park would be a great asset which would draw new families to Pelham and enhance interaction among neighbors. Lisa Gilionella asked who would be monitoring the park at night. She said she believes it will become a dumping ground for bottles and other trash. Zoe Enriquez of the Junior League read a letter from Louise DeCicco into the record. It stated that DeCicco markets support the proposed park at that location. Kate Veith of Nyac Avenue stated that the Veith family is not against the park only the location. She asked when the scheduled vote will be for this issue. Mayor Cassidy stated there is no scheduled for for this project. Ms. Veith cited historical examples of park’s unviability at that location going back to the 1960’s and 1970’s. Margaret Veith of Rye, NY stated her concerns regarding the location of the park in terms of trees being mismarked for removal. She stated the recent example of a tree being removed she believed to be healthy. Trustee Mutti responded that the oak tree that was recently removed was diseased as determined by an arborist. She added the Village does not arbitrarily determine to remove trees. Ms. Veith said that removing the oak tree and the installment of new vegetation will introduce and invasive species into the park. She added the proposed maintenance will involve digging dangerously close to established tree roots. Fred Martin stated the proposed schematic details that any digging 20 feet out of the canopy of any standing tree and not 7 feet as suggested by Ms. Veith. He said no invasive species were involved in the project, just grasses. Ms. Veith stated there are invasive grasses that could affect the site. Mayor Cassidy said this is not the time for a debate. He said there is a lot of work to be done before a plan is developed that can be debated by the community. Trustee Senerchia stated that this may be a time to assess longstanding issues and address them. Trustee Volpe suggested Ms. Veith draft a letter stating all of her concerns as her past letters have not fully itemized them. He said these inquiries are legitimate and need to be addressed. Page 5 Board of Trustees Regular Meeting Tuesday, April 22, 2014 Trustee Reim said the Village could benefit from the expertise of someone like Ms. Veith. Trustee Mutti stated that the Junior League has already secured the services of Fred Martin to act as a landscape architect. Mayor Cassidy said the Board will take comments at this meeting but there is still a great deal of work to be done before this can be voted on. He said he did not see past experiences with various parks as a reason to deny this project at to the outset. He said there is not time frame the Board will listen to what the community has to say. Trustee Kagan asked about boundaries within the park to prevent kids from running into the road. Mr. Martin stated there is a small wooden boundary fence around the area. He said although it is still a parent and caretaker responsibility there is an impediment to accessing the road. Trustee Marty asked how durable the materials are that will be used in this project. Mr. Martin stated that the average lifespan for any park is approximately 15 years. Item #8– Fiscal Year 2014-2015 Village of Pelham Budget Adoption, All Resolutions Administrator Yamuder stated that this resolution will adopt the budget for Fiscal Year 2014-2015. He said it will be available for review at Village Hall and on the Village website. He said this budget was generated at three public works sessions with all Village departments represented. He said each resolution A through E must be individually voted on by the Board. Trustee Volpe applauded the efforts of the Mayor, Administrator, and Department Heads. He said he felt the Board had developed a budget that maintains a level of service that tax payers will be comfortable with. He added that the Village has remained within the property tax cap whereas many others have gone over. Trustee Reim said the Village Board had good mayoral leadership and exercised some belt tightening where necessary. Mayor Cassidy said this is a difficult process and it will be a continual process to stay under the tax cap. He added that the Village did not have to appropriate funds from the fund balance which helps to preserve the Village reserves. Administrator Yamuder thanked the Village Department Heads and the Village Staff for their efforts in bringing about this budget. John Cassone of 7th Avenue congratulated the Board on coming in under the cap. He said the Town and Schools, and Pelham Manor delivered fiscally sound budgets on time. Page 6 Board of Trustees Regular Meeting Tuesday, April 22, 2014 Summary is based on the Tentative Budget and amendments to date: The Village’s Fiscal Year runs from June 1 through May 31 every year. By State Law, Village Budgets must be adopted on or before April 30 of every year. Currently, the budget adoption is scheduled for April 22, 2014 at 7:30 p.m. Home Values in Pelham decreased overall by 1.864% Commercial Property Values in Pelham decreased overall by .428% The Tax rate has increased by 2.933% for homeowners, and it has increased by 3.014% for commercial properties. The Tax Levy was proposed at $10,465,256 up from $10,295,903. Initial Proposed Tax Levy Increase was 1.645%, but with cuts in expenses and small increases in some revenues, the revised tax levy is $10,429,024 and is currently at 1.293%. The increase in the Tax Levy, combined with the decrease in home values, is the truest indicator of the tax impact on the homeowner. The reason is that all properties in Pelham Village and Pelham Manor Village, within the Town of Pelham, are maintained at Full Value Assessments, which reflects changes in market values. These values are updated by the Assessor every year. Impact on the Average Homeowner: Average House Value – Using an Average assessment in Pelham of $636,840.00 vs. $635,307.00 for 2013, the average homeowners taxes would increase from $5,058.00 to $5,219.00. Resolution Authorizing Levy of Additional Taxes BUDGET RESOLUTION A VILLAGE OF PELHAM – APRIL 22, 2014 RESOLUTION AMENDING AND REVISING THE PROPOSED 2014-2015 VILLAGE BUDGET WHEREAS, the Board of Trustees has met at the times and places specified on the proposed budget and heard all persons desiring to be heard thereon; and, subsequently consulted with the appropriate Village officials on the contents thereof and determined that certain modifications would be desirable. NOW, THEREFORE, BE IT RESOLVED that the budget be amended and revised as follows: A motion was made by Trustee Volpe and seconded by Trustee Marty to adopt the resolution. The vote was approved by a vote of seven in favor, none opposed. BUDGET RESOLUTION B VILLAGE OF PELHAM APRIL 22, 2014 BUDGET ADOPTION RESOLUTION RESOLUTION ADOPTING A BUDGET FOR THE FISCAL YEAR COMMENCING JUNE 1, 2014 AND ENDING MAY 31, 2015 MAKING APPROPRIATIONS FOR THE CONDUCT OF THE VILLAGE GOVERNMENT AND ESTABLISHING THE RATES OF COMPENSATION FOR OFFICERS AND EMPLOYEES FOR SUCH PERIOD. Page 8 Board of Trustees Regular Meeting Tuesday, April 22, 2014 WHEREAS, this Board of Trustees has met at the time and place of April 10, 2014, as specified in the Notice of Public Hearing on the preliminary budget and heard all persons desiring to be heard thereon. NOW, THEREFORE, BE IT RESOLVED that the budget as amended at Work Sessions held on Monday, March 24, 2014, Wednesday, March 26, 2014 and Thursday, March 27, 2014 and as presented at the Budget Hearing held on Thursday, April 10, 2014 as hereinafter set forth is hereby adopted and the salaries and wages stated in the Salary Schedule of the budget are fixed at the amounts shown and are effective June 1, 2014, unless provided for by other means. BUDGET RESOLUTION C VILLAGE OF PELHAM RESOLUTION LEVYING TAXES FOR FISCAL YEAR 2014-2015 APRIL 22, 2014 RESOLUTION DATED APRIL 22, 2014, LEVYING THE 2014 VILLAGE TAX, ESTABLISHING THE TAX RATE, FIXING DATES OF PAYMENT. WHEREAS, pursuant to Section 5-508 of the Village Law, the Board of Trustees has adopted the Village Budget for the fiscal year commencing June 1, 2014 and ending May 31, 2015, and WHEREAS, such budget as adopted establishes a general Village tax levy of $10,429,024 for this period. NOW THEREFORE, BE IT RESOLVED that there are levied and assessed the sum of $10,429,024 against all taxable real property and special franchise in the Village, pursuant to this budget, as adopted, and the 2014 Village tax rate is set at $8.1949533 per thousand dollars of assessed valuation for Homestead Properties and $11.3789160 per thousand dollars of assessed valuation for Non-Homestead Properties. BUDGET RESOLUTION D 2014-2015 VILLAGE OF PELHAM BUDGET AUTHORIZATION FOR INVESTMENTS RESOLVED, that the Village Administrator/Treasurer and/or Deputy Treasurer, during the fiscal year beginning June 1, 2014 are authorized to invest monies not needed for immediate expenditure in accordance with the provisions of the General Municipal Law, the Local Finance Law and the Village’s investment policy. A motion was made by Trustee Volpe and seconded by Trustee Marty to adopt the resolution. The vote was approved by a vote of seven in favor, none opposed. BUDGET RESOLUTION E 2014-2015 VILLAGE OF PELHAM BUDGET RESOLUTION AUTHORIZING THE LEVY AND COLLECTION OF ADDITIONAL TAXES UPON TERMINATION OF EXEMPT STATUS RESOLVED, that the Town Assessor and Receiver of Taxes, during the fiscal year beginning June 1, 2014 are authorized to levy and collect additional Village taxes upon termination of exempt status of real property in accordance with provisions of Section 494 of the Real Property Tax Law. A motion was made by Trustee Kagan and seconded by Trustee Senerchia to adopt the resolution. The vote was approved by a vote of seven in favor, none opposed. Item #9– Site Plan Application by Denning for 415 Seventh Avenue for a Proposed Single-Family Dwelling The Board reviewed the plans for 415 7th Avenue and 417 7th Avenue. The developers stated these are modular homes that will be pre-made and installed on the site ideally within three months. A motion was made by Trustee Volpe and seconded by Trustee Senerchia to adopt the resolution. The vote was approved by a vote of seven in favor, none opposed. Page 12 Board of Trustees Regular Meeting Tuesday, April 22, 2014 RESOLVED, that the application for a Site Plan by Denning is approved, based on the review and recommendations by the Planning Board (hereinafter “Planning”), Architectural Review Board (hereinafter “the ARB”) which the Planning and ARB approval memos are attached to and made a part of this approval; and BE IT FURTHER RESOLVED, that the conditions applied by Planning and ARB are as follows: 1. All work shall be performed in compliance with Planning approval, NY State Building Code and Village of Pelham Zoning Code, as noted on plan drawings, dated January 29, 2014 as prepared by Michael Rino, Architects and Planners; 2. All plantings for the one family house be as per approved plans; 3. Administrator Yamuder stated that this resolution will allow the Village to participate with New Rochelle and several other municipalities in paving operations for the coming season. He said the Village has in the past received discounts on price per ton by taking part in this shared service. He added that this agreement is identical to the one the Village signed last year. He said the Village has also received capital highway improvement funds from the state which will be used as well. Trustee Volpe commented that Pelham benefits from these types of shared services. Mayor Cassidy agreed and stated that although the Village cannot completely repave all its streets, initiatives like these help to balance the community’s expectations. He stated the Village relies on its DPW who are out on the streets daily to inform them of the areas most in need of paving with the Village’s limited resources. A motion was made by Trustee Kagan and seconded by Trustee Volpe to adopt the resolution. The vote was approved by a vote of seven in favor, none opposed. WHEREAS , the Village of Pelham, Village of Pelham Manor, Village of Mamaroneck, Town of Mamaroneck , Village of Larchmont and the City of New Rochelle wish to enter into an agreement in order to publicly bid and award a contract for implementing a street pavement resurfacing contract, utilizing CHIPS funding , for various public roadways in each of the communities; and BE IT RESOLVED, that the Board of Trustees of the Village of Pelham hereby authorize the agreement provided by the City of New Rochelle (attached hereto and made a part hereof); and BE IT FURTHER RESOLVED, that the Mayor and the Village Administrator are authorized to sign this agreement and to take the necessary and appropriate actions to effect this agreement. Item #12– Resolution to Accept Gifted Funds from the Pelham Preservation Trustee Mutti stated the Pelham Preservation and Garden Society have offered the sum of $240 for mulch to be used on parts of Wolfs Lane Park by Pelhamdale Avenue and First Street. A motion was made by Trustee Kagan and seconded by Trustee Volpe to adopt the resolution. The vote was approved by a vote of seven in favor, none opposed. BE IT RESOLVED, that the Mayor and Board of Trustees of the Village of Pelham authorize the acceptance of the following donation, by the Pelham Preservation and Garden Society in the amount of $240.00 for the purchase of two truckloads of mulch for the garden bed at the west corner of Pelhamdale and First Street. He said he had gone through several drafts in the course of meetings with the Building Inspector, Village Prosecutor, and the Village Clerk. He said the result is a great plan has been developed that will answer the questions that have been raised by this issue. He said a copy is available on the Village website for anyone to review if they choose. A motion was made by Trustee Senerchia and seconded by Trustee Volpe to adopt the resolution.
