Item #1 – Meeting called to order: The meeting of the Board of Trustees was called to order by Deputy Mayor Volpe at 7:30 p.m. The following members of the Board of Trustees were present: Deputy Mayor Volpe, Trustees Senerchia, Mutti, Reim, and Kagan Board of Trustees Regular Meeting Tuesday, February 3, 2015 The following members of the Board of Trustees were absent: Mayor Cassidy, Trustee Marty Village staff in attendance: Administrator Yamuder, Secretary to the Village Administrator Peter Bonington Item #2 – Pledge of Allegiance: The Pledge of Allegiance was led by Deputy Mayor Volpe. Reports: Mayor Cassidy Report Absent Trustees Reports: Trustee Kagan Trustee Kagan stated the application to transfer control of the water system to United Water has been submitted to the Public Service Commission. He said a link to the P.S.C. site is available on the Village website. He said he expected to have more on this application sometime in April. He congratulated Detective Rick Deere on his retirement. Trustee Marty Absent Trustee Mutti Trustee Mutti reported that the Village is getting close to resubmitting the Wolfs Lane Park grant. Page 2 Board of Trustees Regular Meeting Tuesday, February 3, 2015 She stated that the proposed Woodland Park design is being drafted. She said she should have more to report at future meetings. Trustee Reim None Trustee Senerchia Trustee Senerchia congratulated Det. Deere on his retirement. He stated that his retirement party was well attended. He also commended the Village DPW for their snow removal efforts. Trustee Volpe Deputy Mayor Volpe thanked Det. Rick Deere for his service and led the audience in a round of applause. Village Administrator’s Report Administrator Yamuder thanked the DPW for their snow removal efforts. He reminded residents and merchants not to throw snow back into the street after the plows have passed through the area. Item #6– Public Comment None Item #7– Resolutions Authorizing the Appointments of Two Police Officers to the Pelham Police Department Deputy Mayor Volpe stated that the Board intends to hire two new police officers to replace an outgoing member of the Department as well as anticipate future retirements. He said the Village has two local candidates, Tom Burpee and Chris Hearle that it will be swearing in at tonight’s meeting. Page 3 Board of Trustees Regular Meeting Tuesday, February 3, 2015 Trustee Senerchia stated that he sat-in on the interviews and was impressed by both of these candidates. A motion was made by Trustee Senerchia and seconded by Trustee Mutti to approve the resolution to hire Christopher Hearle. The vote was approved by a vote of five in favor, none opposed. Mayor Cassidy and Trustee Marty were absent. A motion was made by Trustee Senerchia and seconded by Trustee Reim to approve the resolution to hire Thomas Burpee. The vote was approved by a vote of five in favor, none opposed. Mayor Cassidy and Trustee Marty were absent. Deputy Mayor Volpe swore both candidates into the Village of Pelham Police Department. BE IT RESOLVED, that the Board of Trustees of the Village of Pelham authorize the appointment by the Mayor of Thomas Burpee of Pelham, New York, to the position of Police Officer, attending the Police Academy starting Monday, February 2, 2015, with salary and effective date of employment determined by collective bargaining agreement with the Pelham Police and subject to the requirements of Civil Service, for a probationary period of eighteen months, conditioned upon the satisfactory completion of a pre-employment medical examination, and authorizes the Mayor, the Village Administrator and the Police Chief to take the necessary and appropriate actions to effect this offer and for Mr. Burpee to begin the Police Academy on February 2, 2015. BE IT RESOLVED, that the Board of Trustees of the Village of Pelham authorize the appointment by the Mayor of Christopher Hearle of Pelham, New York, to the position of Police Officer, attending the Police Academy starting Monday, February 2, 2015, with salary and effective date of employment determined by collective bargaining agreement with the Pelham Police and subject to the requirements of Civil Service, for a probationary period of eighteen months, conditioned upon the satisfactory completion of a pre-employment medical examination, and authorizes the Mayor, the Village Administrator and the Police Chief to take the necessary and appropriate actions to effect this offer and for Mr. Hearle to begin the Police Academy on February 2, 2015. Item #8– Resolution Authorizing the Promotion of a Pelham Police Officer to the Position of Detective Trustee Senerchia stated the Village will be promoting Joseph DiBenedetto, a Pelham police officer, to the rank of Detective to fill the vacancy left by Rick Deere. He said Mr. DiBenedetto is a Pelham resident and residents should take pride that they have fellow residents as their protectors. He said this fact makes the department what it is and he is proud to swear him in. Page 4 Board of Trustees Regular Meeting Tuesday, February 3, 2015 A motion was made by Trustee Senerchia and seconded by Trustee Reim to approve the resolution to promote Joseph DiBenedetto to Detective. The vote was approved by a vote of five in favor, none opposed. Mayor Cassidy and Trustee Marty were absent. Trustee Senerchia swore Officer DiBenedetto in as a Detective in the Pelham Police Department. BE IT RESOLVED, that the Board of Trustees authorizes the promotion and appointment by the Mayor of Police Officer Joseph DiBenedetto to the position of Detective, effective Monday, February 2, 2015 and authorizes the Mayor, Village Administrator and Police Chief to take the necessary and appropriate actions to effect this appointment. Item #9– Resolution Designating Certain Vehicles as Surplus and Available for Public Sale: 2007 Dodge Charger, 2008 Dodge Charger and a 1999 Tarc Big T-Vac (Leaf Vac). Deputy Mayor Volpe stated this resolution will authorize the sale of Village equipment that has outlived its usefulness to the municipality. A motion was made by Trustee Mutti and seconded by Trustee Senerchia to approve the resolution. The vote was approved by a vote of five in favor, none opposed. Mayor Cassidy and Trustee Marty were absent. WHEREAS, certain vehicles and equipment of the Village of Pelham are approaching the end of, or have exceeded, their useful life and purpose, and are hereby declared surplus so that they may be advertised and sold to the benefit of the Village of Pelham. BE IT RESOLVED, that the Board of Trustees of the Village of Pelham hereby declares the following equipment as surplus and authorizes their disposal at public sale, as follows: Year Make Model VIN Miles 2007 Dodge Charger 2B3KA43H27H818173 64,000 2008 Dodge Charger 2B3KA43H38H280231 58,000 1999 Tarc Big T-Vac (Leaf Vac) with a John Deere 4.5 Power Tech Diesel had 1100 hours (Not running) BE IT FURTHER RESOLVED, that the disposal of this equipment is authorized in compliance with the requirements of law, and the Mayor, the Administrator and other appropriate officials are authorized to take the necessary and appropriate actions to dispose of and sell this equipment. Page 5 Board of Trustees Regular Meeting Tuesday, February 3, 2015 Item #10– Resolution Authorizing Shared Services with Westchester County Administrator Yamuder stated this resolution pertains to a Government Efficiency Plan which is a shared services initiative from the County. He stated that there is a significant amount of legislation regarding this matter. The Board is required to save approximately 1% of the annual tax levy going forward. The property tax cap is not factored into this equation. He said the regulations currently apply only to shared service contracts and initiatives from 2012 to the present. He said although the Village has enacted shared services initiatives in past years, these would not be considered applicable at this time. Administrator Yamuder stated that this resolution will allow the Village to work with the County on drafting this Plan. Trustee Kagan asked if the Village would need our own Plan. Administrator Yamuder said that the Village would have to develop its own Plan however, by working with the County; it can make use of its information in writing the Pelham Plan. Trustee Kagan stated he wanted to confirm that this resolution before the Board was just establishing a headcount of interested municipalities for the County. Deputy Mayor Volpe stated he would authorize the Village to proceed as long as the resolution states that the Plan generated by the County is subject to review by the Village Board. A motion was made by Trustee Reim and seconded by Trustee Mutti to approve the resolution. The vote was approved by a vote of five in favor, none opposed. Mayor Cassidy and Trustee Marty were absent. BE IT RESOLVED, that the Board of Trustees of the Village of Pelham hereby authorizes the Village Administrator of the Village of Pelham to continue to participate in the Shared Services and Government Efficiency Plan (GEP) discussions with the County of Westchester in conformance with the intention of the Village of Pelham to participate with the GEP Property Tax Freeze Legislation subject to its review and approval of the final GEP by the Village of Pelham Board of Trustees. Item #11– Presentation About Updating the Village of Pelham Website Secretary Bonington briefed the Board of Trustees on the status of the website development companies the Village had reached out to so far. He said this is still an ongoing process but the Administrator and he were getting closer to making a formal recommendation for the Trustees in the next few weeks. Page 6 Board of Trustees Regular Meeting Tuesday, February 3, 2015 Trustee Mutti asked about the purchasing policy of the Village. Secretary Bonington stated that under the Purchasing Policy, the Village requires that any purchase under $20,000 require a minimum of three written bids. He stated anything over the $20,000 mark would require a formal bidding process. Deputy Mayor Volpe suggested developing a list of items the Board would like to have incorporated into the new site. Secretary Bonington stated that he could put together a rough list to be shared with the Trustees and Administrator. Item #12– Other Business None Item #13– Authorizing the Accounts Payable Trustee Mutti audited the Accounts Payable. A motion was made by Trustee Reim and seconded by Trustee Mutti to approve the resolution. The vote was approved by a vote of five in favor, none opposed. Mayor Cassidy and Trustee Marty were absent. RESOLUTION WHEREAS, pursuant to Section 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. NOW, THEREFORE, BE IT HEREBY RESOLVED, that the Board of Trustees after audit of the following claims, authorizes payment for services rendered and materials received, for the following items that have been submitted to the Treasurer's Office for payment and authorized by the Village Administrator: Fund Name: Amount General Fund $69,753.55 Water Fund $0.00 Capital Projects Fund $0.00 Trust and Agency Fund $0.00 CD NYS Main Street Fund $0.00 H3 Fund $0.00 Page 7 Board of Trustees Regular Meeting Tuesday, February 3, 2015 TE Expand Trust Fund $299.94 Grand Total $70,053.49 NOW, THEREFORE, BE IT RESOLVED, that this Board hereby approves payment of the above mentioned claims and authorizes payment thereof. Item #14– Authorizing Minutes of: January 20, 2015 The Board decided to table the minutes of January 20, 2015 until a later meeting. Item #15– Adjournment to Executive Session (if needed) A motion was made by Trustee Kagan with a second by Trustee Senerchia to adjourn the public portion of the Board meeting at 8:45 pm and go into Executive Session to discuss a personnel matter after which time the Board would adjourn for the evening.
