Item # 3 – Roll Call: Present were Trustees Kagan, Mutti and Reim. Richard Deere was appointed Village Trustee at 8:10 p.m. Trustees Ferrara and Reinke were absent. Also present were Village Administrator Yamuder and Assistant to the Village Administrator Scelza. Mayor’s Report: Mayor Volpe reported he attended a recent School Board meeting where outgoing School Board President Lisa Kiernan was honored for her 10 years of service to the community. Mayor Volpe thanked her for her service on behalf of the Village Board. Mayor Volpe reported that the Village was awarded a recognition by Con Edison under the Municipal Liaison Program. The Mayor urged all residents to act immediately if they smell gas. Mayor Volpe mentioned Village Administrator Yamuder recently was presented with a plaque by the NY State City/County Management Association and honored for his service and commitment as president of the association from June 2015 through May 2016. Mayor Volpe reminded the public that the Board will be on a summer schedule meeting only once in July and August. Trustees’ Report: Trustee Ferrara was absent. ******** Page 2 Board of Trustees Regular Meeting Tuesday, June 21, 2016 Trustee Kagan reported the fire hydrant flushing schedule from Suez has been posted on the Villages website. A temporary slight discoloration of the water and a decrease in water pressure may be noted as a result of opening the hydrants. If you experience this discoloration of water, please run your cold water in a basement sink for 15-20 minutes. Trustee Kagan mentioned he received a complaint from a Chester Park resident a few weeks ago and that he was still investigating along with the Village Prosecutor and Building Inspector. ******** Trustee Mutti reported that the Village was notified by the State Historic Preservation office that the NYW&B property was being reviewed at the National Level. Trustee Mutti reported that the Wolfs Lane Park redesign has gone to detailed drawings and they will presented at the July 12th meeting. ******** Trustee Reim congratulated the Pelham Civics on the success of their Golf Outing fundraiser. ******** Trustee Reinke was absent. Village Administrator’s Report: Village Administrator Yamuder reported that the Villages 2016 road resurfacing program utilizing CHIPS funding will take place on the following streets in early August:  Ancon Avenue between East Second Street and Elderwood Avenue  Highbrook Avenue between Irving Place and 1st Street  Linden Avenue in the vicinity of Willow Avenue and Central Avenue Village Administrator Yamuder also reported that Con Edison will be working on a gas construction project on Loring Avenue between between East Second Street & Colonial Avenue. Item # 7 – Public Comments John Cassone, 312 Seventh Avenue, highlighted the accomplishments during the tenure of Trustee/Mayor Timothy Cassidy and wished him well. Page 3 Board of Trustees Regular Meeting Tuesday, June 21, 2016 Non-Recurring Items Item # 8 – Mayoral Appointment to Fill Vacant Village Trustee Position Mayor Volpe administered the oath of office to Richard Deere who was appointed Village Trustee on June 21, 2016. Page 4 Board of Trustees Regular Meeting Tuesday, June 21, 2016 Item # 9 – Approving Membership in the New York State Municipal Workers’ Compensation Alliance Plan for the Period of July 1, 2016 through June 30, 2017 R.J. Impastato of FOA & Son Corporation reviewed the proposals for Worker’s Compensation Coverage with the Board. R.J. on behalf of the Village recently went out to bid. He said the Village had received three bids from New York State Municipal Workers’ Compensation Alliance for $449,687.00, PERMA for $603,017.00 and the New York State Insurance Fund for $729,000.00. The Board and R.J. had a lengthy discussion on the bids received. Carol Spawn, 95 Corona Avenue, asked if the premium was based on the best and lowest cost classification for employees. Village Administrator Yamuder responded that the Village monitors the classifications on an on-going basis. Resolution Approving Membership in the New York State Municipal Workers’ Compensation Alliance Plan for the Period of July 1, 2016 through June 30, 2017 Whereas, there has been proposed a “New York State Municipal Workers’ Compensation Alliance Plan Document” pursuant to § 50 3-a of the Workers’ Compensation Law (hereinafter “the Plan”); and Whereas, the Village of Pelham is eligible for membership in the Plan; and Whereas, the Village of Pelham has made an independent investigation of the Plan and reviewed the Plan document, and has concluded that it would be in the interests of the Village of Pelham to participate therein. Now, therefore, be it resolved, that the Village of Pelham enter into membership in the Plan pursuant to § 50 Subdivision 3-a of the Workers’ Compensation Law; and Be it further resolved, that the Village Administrator be and hereby is authorized and instructed to execute the Plan’s charter document on behalf of the Village of Pelham; and Be it further resolved, that the custody of all joint Plan moneys by the Plan Administrator under the Plan be and the same hereby is approved. Motion by: Trustee Reim Seconded by: Trustee Mutti Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 5 Board of Trustees Regular Meeting Tuesday, June 21, 2016 Item # 10 – Public Hearing on Proposed Local Law No. 1 of 2016 Regarding Development Regulations and Amending Chapter 98 of the Village Code Mayor Volpe opened the Public Hearing. Motion by: Trustee Kagan Seconded by: Trustee Mutti Vote: 5-0 Absent: Trustees Ferrara and Reinke Mayor Volpe stated he is in support of small pocket developments in the community. He asked AKRF to explore changes to the Village Code to allow for smaller developments to take place in the community. The floating zone legislation would coexist with the Villages’ existing Code. John Cassone, 312 Seventh Avenue, stated he would like to see senior housing as a priority as it relates to the proposed legislation. Michael Carpenter, 50 Central Avenue, stated in concept he is in favor of the law, however the way it is currently drafted he has some concerns. Mr. Carpenter proceeded to share numerous concerns with the Mayor. Carol Spawn, 95 Corona Avenue, stated she felt it was a bad idea to introduce this proposed local law during the summer months. She expressed her concerns over the lack of foot traffic in the Villages Downtown. Clive Anderson, 64 Lincoln Avenue, stated the proposed law would allow more people to live in Pelham who would end up commuting to NYC and not necessarily shop in the Villages Downtown. Nigel Scott Williams, 5 Pine Avenue, stated he felt the proposed law could open the Village up to a potential lawsuit. The Board decided to keep the Public Hearing open. Motion by: Trustee Reim Seconded by: Trustee Mutti Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 6 Board of Trustees Regular Meeting Tuesday, June 21, 2016 Item # 11 – Authorizing the Acceptance of a Donation from EcoPel for Additional Downtown Recycling Receptacles Mayor Volpe stated EcoPel has decided to donate additional recycling receptacles for the Villages Downtown. He thanked them for their contribution to the Village. Resolution Authorizing the Acceptance of a Donation from EcoPel for Additional Downtown Recycling Receptacles Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the acceptance of a donation from EcoPel for the purchase of additional recycling receptacles for the downtown valued at $4,607.00 with thanks to the donors for their contribution to the Village of Pelham community. Page 8 Board of Trustees Regular Meeting Tuesday, June 21, 2016 Recurring Items Item # 13 – Authorizing Budget Amendments and Transfers for Fiscal Year 2015-16 Resolution Authorizing Budget Amendments and Transfers for Fiscal Year 2015-16 Whereas, pursuant to the provisions of § 5-520 of the New York State Village Law, the Board of Trustees, by resolution, may increase existing appropriations by transferring funds from the unexpended balance of another appropriation, from the contingent account, from available cash surplus or unanticipated revenues within a fund, or by borrowing; and Whereas, in all cases, there are sufficient unexpended balances in other appropriation accounts, excess revenues or fund balances available to cover the amendments and transfers. Now, therefore, be it resolved, that pursuant to New York State Village Law § 5-520, the Board of Trustees of the Village of Pelham hereby authorizes and directs the proper Village officers to modify the 2015-16 Budget by making the following budget amendments and transfers (attached hereto and made part hereof). A brief discussion took place on voucher number 7098. Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. Now, therefore, be it resolved, that the Board of Trustees after audit of the following vouchers, authorizes payment for services rendered and materials received, for the following items that have been submitted to the Treasurer's Office for payment and authorized by the Village Administrator: Fund Name: Amount General Fund $350,657.82 Capital Projects Fund $0.00 Trust and Agency Fund $570.64 TE Expand Trust Fund $0.00 Grand Total $351,228.46 Be it further resolved, that this Board hereby approves payment of the above mentioned claims and authorizes payment thereof.
