Adjournment to Executive Session Approved Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 1 – Meeting called to order: The meeting of the Board of Trustees was called to order by Mayor Volpe at 8:00 p.m. Item # 2 – Pledge of Allegiance: The Pledge of Allegiance was led by Mayor Volpe. Item # 3 – Roll Call: Present were Trustees Deere, Kagan, Mutti and Reim. Trustees Ferrara, Reinke and Village Administrator were absent. Also present was Assistant to the Village Administrator Scelza. Mayor’s Report: Mayor Volpe stated the Village completed its annual road resurfacing program utilizing funding from the CHIPS program on the following streets:  Ancon Avenue between East Second Street and Elderwood Avenue  Highbrook Avenue between Irving Place and 1st Street  Linden Avenue in the vicinity of Willow Avenue and Central Avenue Mayor Volpe reported he would be meeting with two developers to discuss potential small development opportunities in the Village next week. Mayor Volpe thanked Trustees Deere, Kagan, Village Administrator Yamuder and Habitat for Humanity for their efforts in assisting an elderly resident in the Village with maintenance of her property. Mayor Volpe reminded residents that school will be opening in a few weeks and he urged everyone to drive carefully and exercise extra caution and patience at school intersections and crosswalks for the safety of all our children and school staff alike. Trustees’ Report: Trustee Deere echoed the Mayor’s comments on the work that was completed by Habitat for Humanity for an elderly resident on Linden Avenue. ******** Page 2 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Trustee Ferrara was absent. ******** Trustee Kagan reported that many residents particularly in the Heights have received notice from Suez Water that their water meters need to be replaced. He urged all property owners affected by this to schedule the replacement of their meter as soon as possible and if they have any issues to email him at adam.kagan@pelhamgov.com. Trustee Kagan reported he has filed a complaint against Con Edison with the New York State Public Service Commission over incorrect billing of certain Pelham Village residents. Specifically Con Edison is not giving the lower electricity rate that is part of the Village's Community Choice Aggregation contract with Sustainable Westchester to residents of what was North Pelham until its merger with the Village of Pelham in 1975. He thanked Pelham resident John Cassone for bringing this to his attention. ******** Trustee Mutti reported on behalf of Trustee Ferrara that the additional play equipment purchased for Woodland Park had been installed and was received well by the children and thanked the Junior League of Pelham for their donation. She also mentioned a significant amount of gardening has been completed at the Benedict Stairs, she is interested in painting the railings black and is seeking private donations. ******** Trustee Reim had nothing to report. ******** Trustee Reinke was absent. Village Administrator’s Report: Village Administrator was absent. Item # 7 – Public Comments John Cassone, 312 Seventh Avenue, thanked Trustee Kagan for all of his hard work on addressing billing errors with Con Edison under the Community Choice Aggregation program. Page 4 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 9 – Authorizing the Appointment of a Police Officer in the Village of Pelham Police Department Mayor Volpe swore in Kevin O’ Connor as a Police Officer in the Village of Pelham Police Department. Resolution Authorizing the Appointment of a Police Officer in the Village of Pelham Police Department Be it resolved, that the Board of Trustees of the Village of Pelham hereby confirms the Mayor’s appointment of Kevin O’Connor of Pelham, NY to the position of Police Officer Recruit from Civil Service Eligible List # 69-589, effective Monday, August 1, 2016 at an annual salary of $55,071.00 subject to the requirements of Westchester County Civil Service, the current Village of Pelham Police Department Collective Bargaining Agreement, Village of Pelham Employee Handbook and any other applicable regulations in place and for a probationary period of eighteen (18) months; and Be it further resolved, that the Mayor, Village Administrator and Police Chief are authorized to take the necessary and appropriate actions to effect this appointment. Motion by: Trustee Reim Seconded by: Trustee Deere Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 5 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 10 – Discussion on NYW&B Property Landscape Concept Plan Trustee Mutti presented a proposal from Sean Jancski Landscape Architect to create a concept plan for the NYW&B Property. This concept plan would leverage local projects and grant writing for the property. The total cost for the Concept Plan is $3,500 plus reimbursable expenses and any supplemental services not covered in the agreement. Trustee Kagan stated he would prefer the Village owning the documents instead of what is outlined in Article 3 of the agreement. Mayor Volpe, Trustee Kagan and Mutti will work together on tightening up the language before the Mayor executes the agreement. Resolution Authorizing a Professional Services Agreement with Sean Jancski Landscape Architect LLC for a Schematic/Concept Design Plan for the Highbrook Highline Property Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Mayor to execute the attached Professional Services Agreement with Sean Jancski Landscape Architect LLC dated August 9, 2016 in the amount of $3,500 for a Schematic/Concept Design Plan for the Highbrook Highline Property. Page 7 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 12 – Authorizing the Successful Completion of Probation for Police Officer Christopher Hearle Mayor Volpe reported that Police Officer Christopher Hearle was hired in February 2015 with a probationary period of eighteen months. He stated that Police Officer Hearle has successfully completed his probation and has been recommended by Police Chief Benefico to become a full member of the Department. Resolution Authorizing the Successful Completion of Probation for Police Officer Christopher Hearle Be it resolved, that the Board of Trustees of the Village of Pelham hereby authorize the acknowledgement of the Successful completion of probation for Christopher Hearle as a Police Officer, which is approved based on the positive evaluation and recommendation of the Police Chief; and Be it further resolved, that the Mayor, Village Administrator and Police Chief are authorized to take the necessary and appropriate actions to effect this resolution. Motion by: Trustee Kagan Seconded by: Trustee Mutti Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 8 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 13 – Authorizing the Successful Completion of Probation for Police Officer Thomas Burpee Mayor Volpe reported that Police Officer Thomas Burpee was hired in February 2015 with a probationary period of eighteen months. He stated that Police Officer Burpee has successfully completed his probation and has been recommended by Police Chief Benefico to become a full member of the Department. Motion by: Trustee Deere Seconded by: Trustee Reim Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 9 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 14 – Adopting Tax Exempt Bond Post Issuance Compliance Policy Mayor Volpe stated that Jeffery Storch, Bond Counsel for the Village has requested the Board adopt a Tax Exempt Bond Post Issuance Compliance Policy. Trustee Kagan asked if the Village Administrator is qualified to be the Compliance Officer. A brief discussion took place on the topic however the Mayor felt the item should be tabled so that the questions raised at the meeting could be sent to Bond Counsel for clarification. Resolution Adopting Tax Exempt Bond Post Issuance Compliance Policy Whereas, the Internal Revenue Service has issued new regulations requiring issuers of tax-exempt obligations to certify on Form 8038-G that they actively monitor compliance with federal tax rules following the issuance of such obligations; and Whereas, the Village is an occasional issuer of tax-exempt obligations and thus is subject to the aforementioned compliance requirements which are critical for the preservation of preferential tax status of those obligations; and Whereas, it is therefore in the best interest of the Village to adopt formal written procedures to ensure such compliance and to designate an official responsible for ensuring that such procedures are followed. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby adopts the post-issuance compliance procedures attached hereto as “Schedule A” and resolves to be governed thereby; and Be it further resolved, that this resolution shall take effect immediately upon its adoption. Page 10 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 15 – Authorizing the Village Administrator to Attend the Annual ICMA Conference Resolution Authorizing the Village Administrator to Attend the Annual ICMA Conference Whereas, the International City/County Management Association (“ICMA”) will hold its annual training program and business meeting in Kansas City, MO from Sunday, September 25, 2016 to Wednesday, September 28, 2016. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Village Administrator Robert A. Yamuder to attend the Annual ICMA Conference in Kansas City, MO on behalf of the Village of Pelham from Sunday, September 25, 2016 to Wednesday, September 28, 2016, cost of said conference including travel, hotel and conference registration fees totaling $1,639.20 as budgeted and will be charged to General Fund Account # A.1230.470. Motion by: Trustee Reim Seconded by: Trustee Kagan Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 11 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 16 – Approving Site Plan Application by 446 First Ave Estates LLC. at 446 First Avenue for a Proposed Single-Family Dwelling Resolution Approving Site Plan Application by 446 First Avenue Estates, LLC at 442 First Avenue for a Proposed Single-Family Dwelling Be it resolved, that the application for a Site Plan by 446 First Avenue Estates, LLC is approved, based on the review and recommendations by the Planning Board (hereinafter “Planning”), and Architectural Review Board (hereinafter “the ARB”) which the Planning and ARB approval memos are attached to and made a part of this approval along with the various reports accompanying those approvals; and Be it further resolved that the conditions applied by Planning and ARB are as follows: 1. All work shall be performed in compliance with Planning approval, NY State Building Code and Village of Pelham Zoning Code, as noted on plan drawings, dated April 19, 2016 with revisions on June 15, 2016 and July 20, 2016 as prepared by Dimovski Architecture, PLLC; 2. All plantings for the one family house be as per approved plans; 3. The house will be built in accordance with the plans which are approved by the Planning Board and/or the Architectural Review Board of the Village of Pelham; and 4. The Department of Public Works General Foreman Michael Shriman shall review the plans for the connection to the storm water system; and 5. The following conditions apply: It must be confirmed that the windows will meet egress requirements and if the sizes change as a result then the elevations must be updated and resubmitted to the ARB for review. Basement egress must be coordinated with the Building Inspector and if egress is on the front of the house it must be resubmitted to the ARB for review. Be it further resolved, that this application for a site plan to include a single family dwelling and landscaping at 442 First Avenue is subject to the procedures, regulations and requirements of the Pelham Village Code and Pelham Building Department; and Be it further resolved, that the Mayor, Village Administrator, Building Inspector and other appropriate Village officials are authorized to take the necessary and appropriate actions to effect this approval, including the imposition of additional conditions and requirements as may be necessary. Vote on page 13 Page 12 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Motion by: Trustee Reim Seconded by: Trustee Mutti Vote: 5-0 Absent: Trustees Ferrara and Reinke Page 13 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Item # 17 – Amending § 90-46 Schedule VII: Speed Regulations, as Authorized by § 90-10 Speed Regulations to Set the Maximum Speed Limits on Wolfs Lane, Fifth Avenue, Nyac Avenue and Fourth Avenue to 25 Miles Per Hour Resolution Amending § 90-46 Schedule VII: Speed Regulations, as Authorized by § 90-10 Speed Regulations to Set the Maximum Speed Limits on Wolfs Lane, Fifth Avenue, Nyac Avenue and Fourth Avenue to 25 Miles Per Hour Whereas, the Board of Trustees has determined that parking and/or traffic conditions on certain streets in the Village of Pelham create a greater risk of accidents and in some cases have in fact caused accidents; and Whereas, Wolfs Lane and Fifth Avenue often carry very heavy traffic and in the business areas these streets are often lined with parked cars and trucks; and Whereas, many pedestrians including but not limited to students walking to and from school and people in the Village to shop, to take advantage of the services offered by the Village’s local businesses and to enjoy meals at the local restaurants often cross Wolfs Lane and Fifth Avenue; and Whereas, Nyac Avenue often carries heavy traffic because many people use the street to drive students to both Pelham Middle School and Pelham Memorial High School, and many drivers use the street to avoid the traffic controls and heavy traffic on Wolfs Lane; and Whereas, many students walk along Nyac Avenue on their way to and from the Pelham Middle School and Pelham Memorial High School; and Whereas, Fourth Avenue carries increased traffic as drivers of motor vehicles use it to avoid the traffic and traffic controls in the business district along Fifth Avenue; and Whereas, the Board of Trustees has determined that lowering the maximum speed limit on Wolfs Lane, Fifth Avenue, Nyac Avenue and Fourth Avenue will benefit the health, safety and welfare of the public by reducing the chance of accidents. Now, therefore, be it resolved, that § 90-46 Schedule VII: Speed regulations, as authorized by § 90- 10 Speed regulations, is amended to state that the following streets have a maximum speed limit of 25 miles per hour: Wolfs Lane, Fifth Avenue, Nyac Avenue and Fourth Avenue. A discussion took place on the original proposal on the west side reducing it from 150 feet to 50 feet. Resolution Amending § 90-49 Schedule X: No Parking Any Time, as Authorized by § 90-15, to Create Additional No Parking Zones on Boulevard and Pelhamdale Avenue Whereas, the Board of Trustees has determined that emergency vehicles will be able to maneuver more safely and more easily if there are no parked vehicles on the south side of Boulevard between Highbrook Avenue and Cliff Avenue as well as on the east side of Pelhamdale Avenue from the intersection with Boulevard to a point approximately 150 feet north and on the west side of Pelhamdale Avenue from the intersection with Boulevard to a point 50 feet north; and Whereas, the Board of Trustees has determined that Boulevard and Pelhamdale Avenue often carry heavy traffic and many pedestrians, including commuters walking to and from the train station and students walking to and from Colonial School, Pelham Middle School and Pelham Memorial High School; and Whereas, the Board of Trustees has determined that creating additional no parking zones on Boulevard and Pelhamdale Avenue will benefit the health, safety and welfare of the public. A discussion took place on the specifics of the grant of which couldn’t be answered so this item was tabled. Resolution Authorizing Funding for the Village’s Share of the Preliminary Design Phase of the Three Legislated Pre-Disaster Mitigation Storm Drainage Projects Whereas, the Village of Pelham has been awarded with three (3) Legislated Pre-Disaster Mitigation (LPDM) Grants Application #’s 2008-015, 2009-003 and 2010-002 by the Federal Emergency Management Agency (“FEMA”) and the New York State Division of Homeland Security and Emergency Services State of Office of Emergency Management (“NYSEMO”); and Whereas, the Village’s required contribution for each of the subject grants is 25% with a Federal share of 75%; and Whereas, the Village’s required contribution for the preliminary design phase for all three grants totals $10,875.00. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein appropriates $10,875.00 from Fund Balance for the preliminary design phase of said grants. Page 19 Board of Trustees Regular Meeting Tuesday, August 16, 2016 Recurring Items Item # 23 - Authorizing the Accounts Payable Mayor Volpe audited the Accounts Payable. A brief discussion took place on voucher numbers 7048 and 7422. Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village.
