Adjournment to Executive Session Approved Next Regularly Scheduled BOT Meetings: Tuesday, January 3, 2017 Tuesday, January 17, 2017 All meetings start at 8:00 p.m. unless otherwise noted. *The Agenda is subject to change.* Board of Trustees Regular Meeting Tuesday, December 20, 2016 Item # 1 – Meeting called to order: The meeting of the Board of Trustees was called to order by Mayor Volpe at 8:10 p.m. Item # 2 – Pledge of Allegiance: The Pledge of Allegiance was led by Mayor Volpe. Item # 3 – Roll Call: Present were Trustees Deere (arrived at 8:20 p.m.), Ferrara, Kagan, Mutti, Reim and Reinke. Also present were Village Administrator Yamuder and Assistant to the Village Administrator Scelza. Mayor’s Report: Mayor Volpe reported that he attended a celebration commemorating the 225th anniversary of the final ratification of the Bill of Rights in the City of Mount Vernon and thanked Mayor Thomas for the invitation. Mayor Volpe stated significant progress has been made over the past year around the various school complexes in the Village regarding traffic safety. He further stated after the holiday recess a renewed effort to address some new traffic safety concerns will be investigated. Trustees’ Report: Trustee Deere had nothing to report. ******** Trustee Ferrara reported that all employees starting next payroll will see their applicable accrued benefits (sick, vacation, personal time and compensatory time) bi-weekly printed on their paychecks. She thanked Assistant to the Village Administrator Scelza for all of his work on this important project. ******** Trustee Kagan had nothing to report. ******** Page 2 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Trustee Mutti reported that she is continuing to work on updates to the Village parking map incorporating senior parking options. She also reported a banner will be ordered with the updated Wolfs Lane Park design on it and displayed during the construction. Trustee Mutti highlighted various park related initiatives achieved during 2016. ******** Trustee Reim thanked the Department of Public Works for making the Village look great during the Holiday Season. He also thanked the Fire and Police Departments for their response to a medical emergency in front of Town Hall earlier today. ******** Trustee Reinke had nothing to report. Village Administrator’s Report: Village Administrator Yamuder reported that the New York State Comptrollers Office has set the tax cap for the Village's Fiscal Year 2017-18 Budget at 1.15% but when you add the tax base growth factor of 0.36% it brings the total tax cap to 1.51%. He explained this will be the maximum increase in the tax levy over the current fiscal year's Village budget that will be permitted unless the Board votes to override it. Page 3 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Non-Recurring Items Item # 8 – Designating a Fire Lieutenant as Incident Safety Officer in the Village of Pelham Fire Department Mayor Volpe stated that Fire Chief DiNapoli has recommended Fire Lieutenant Phillip DeSimone to the position of Incident Safety Officer for the Department and has maintained the required certification. Resolution Designating a Fire Lieutenant as Incident Safety Officer in the Village of Pelham Fire Department Whereas, Fire Lieutenant Phillip DeSimone has been recommended by the Fire Chief to perform the duties of Incident Safety Officer and has maintained all of the required certifications to enable him to do so. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby confirms the Mayor’s appointment of Fire Lieutenant Phillip DeSimone upon the recommendation of the Fire Chief as Incident Safety Officer in the Village of Pelham Fire Department; and Be it further resolved, Fire Lieutenant Phillip DeSimone shall receive additional compensation of $750.00 annually. Motion by: Trustee Reim Seconded by: Trustee Ferrara Vote: 7-0 Page 4 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Item # 9 – Authorizing Street Sign Inventory Project Village Administrator Yamuder stated this resolution authorizes the hiring of an intern to assist the Village with data collection by using a smart phone application developed by the Westchester County Department of Geographic Information Systems to inventory and map street signs. The Board discussed the benefits of this project. Trustee Kagan inquired if the intern is the Village’s employee or Westchester County’s and asked the Village Administrator to confirm that the Village’s Insurance Policy covers interns. Resolution Authorizing Street Sign Inventory Project Whereas, the County of Westchester Department of Geographic Information Systems (“WCGIS”) has developed a smart phone mobile application for local governments to inventory and map street signs; and Whereas, to date 27,358 signs have been mapped in eleven (11) Westchester County municipalities; and Whereas, the Village is desirous of digitizing its inventory of approximately 2,000 signs Village-wide; and Whereas, the data collection will be completed by a college intern recommended by WCGIS who is paid $15 per hour to perform sign data collection for a fee not to exceed $2,100. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby authorizes the expenditure of up to $2,100 for street sign data collection. Motion by: Trustee Mutti Seconded by: Trustee Ferrara Vote: 7-0 Page 5 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Item # 10 – Authorizing the Execution of a Collective Bargaining Agreement with the Civil Service Employees Association, Inc. Representing School Crossing Guards, Parking Enforcement Officers/School Crossing Guards and Parking Enforcement Officer/Code Enforcement Officer Mayor Volpe stated over the course of a couple months negotiations have taken place between the Village and a new Bargaining Unit representing School Crossing Guards, Parking Enforcement Officers/School Crossing Guards and Parking Enforcement Officer/Code Enforcement Officer. The Board discussed the proposed Collective Bargaining Agreement at length and made numerous language changes. Mayor Volpe stated this Collective Bargaining Agreement is approved subject to the language changes which he will bring back to the Union for approval. Resolution Authorizing the Execution of a Collective Bargaining with the Civil Service Employees Association, Inc. Representing School Crossing Guards, Parking Enforcement Officers/School Crossing Guards and Parking Enforcement Officer/Code Enforcement Officer Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Mayor and Village Administrator to execute the attached Collective Bargaining Agreement with the Civil Service Employees Association, Inc. Representing School Crossing Guards, Parking Enforcement Officers/School Crossing Guards and Parking Enforcement Officer/Code Enforcement Officer regarding the terms and conditions of employment for the period of June 1, 2016 through May 31, 2019. Motion by: Trustee Mutti Seconded by: Trustee Ferrara Vote: 7-0 Page 6 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Item # 11 – Other Business Update on Business District Floating Zone Legislation Mayor Volpe stated that he has been waiting for an edited version of the proposed law, unfortunately due to an illness he has yet to receive the revised law. Mayor Volpe stated the following suggestions made at the November 28th Work Session have now been included in the re-draft: • the addition of the B3 zoning district (Previously only B1 and B2 districts were included) • the addition of provisions for townhomes • the addition of language not to interfere with backyards of exiting homes. Mayor Volpe also stated there is no longer a reference to a height definition in feet, but rather it refers to the number of floors permitted. Page 7 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Recurring Items Item # 12 – Authorizing Budget Amendments and Transfers for Fiscal Year 2016-17 Resolution Authorizing Budget Amendments and Transfers for Fiscal Year 2016-17 Whereas, pursuant to the provisions of § 5-520 of the New York State Village Law, the Board of Trustees, by resolution, may increase existing appropriations by transferring funds from the unexpended balance of another appropriation, from the contingent account, from available cash surplus or unanticipated revenues within a fund, or by borrowing; and Whereas, in all cases, there are sufficient unexpended balances in other appropriation accounts, excess revenues or fund balances available to cover the amendments and transfers. Now, therefore, be it resolved, that pursuant to New York State Village Law § 5-520, the Board of Trustees of the Village of Pelham hereby authorizes and directs the proper Village officers to modify the 2016-17 Budget by making the following budget amendments and transfers (attached hereto and made part hereof). Motion by: Trustee Mutti Seconded by: Trustee Reinke Vote: 7-0 Page 8 Board of Trustees Regular Meeting Tuesday, December 20, 2016 Item # 13 - Authorizing the Accounts Payable Trustee Mutti audited the Accounts Payable. A brief discussion took place on vouchers 7977 and 8038. Voucher 7977 was held for further review. Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. Now, therefore, be it resolved, that the Board of Trustees after audit of the following vouchers, authorizes payment for services rendered and materials received, for the following items that have been submitted to the Treasurer's Office for payment and authorized by the Village Administrator: Fund Name: Amount General Fund $343,194.91 Capital Projects Fund $64,493.75 Trust and Agency Fund $0.00 TE Expandable Trust Fund $0.00 Grand Total $407,688.66 Be it further resolved, that this Board hereby approves payment of the above mentioned claims and authorizes payment thereof.
