Mayor Volpe reported the DPW overtime has impacted the budget due to all of the storms. Mayor Volpe reported he finished reading Thomas Fenlon’s book, Pelham, New York: Memories of A Century After Incorporation, and additional copies are available at Village Hall for $10. Mayor Volpe reported the next budget work session will take place on Thursday, March 29th at 7pm, and the Board will work to get the budget in conformance with the tax cap. Mayor Volpe reported there is an Empathy Towards All Neighborhood Safety Workshop taking place tonight, from 6:15-7:45pm at the Daronco Town House. Mayor Volpe announced the Board issued an RFP for public-private partnership to redevelop several Village owned properties. Mayor Volpe reported he has three upcoming meetings with potential developers on Friday, March 30th to discuss this matter further. Mayor Volpe reported approximately $450,000 of the fund balance has been used this fiscal year to address infrastructure needs. Mayor Volpe stated the street paving project has been funded from bonding, chips, and in collaboration with other communities. Page 2 Board of Trustees Regular Meeting Tuesday, March 27, 2018 Mayor Volpe reported the foundation permit was granted to the 8 Boulevard West project, and the foundation will be poured this week. Mayor Volpe reported the Board anticipates a foundation permit being granted to 185 Lincoln Avenue soon. Mayor Volpe reported there are ongoing discussions between the Village, Pelham Picture House, and the owners of 163 Wolfs Lane on a use of the property that could benefit the community. Mayor Volpe reported almost all of the units in the new apartment building at 215 Fifth Avenue have commitments. Mayor Volpe reported the property on First Street across from Marbury Corners was sold, and the proposed development for this site is a 8 considering an unit development. Trustees’ Report: Trustee Ferrara reported the Eagle Scout troop 1 has decided to clean up Wolfs Lane Park, and she hopes to make this clean-up effort an annual project for the eagle scouts. Trustee Ferrara reported the Colonial School Girl Scout troop would like to donate and replace the plantings in Wolfs Lane Park as part of their Earth Day project. Trustee Ferrara reported the Pelham Preservation and Garden Society amended their plans for the proposed plantings on First Street to Nyac Avenue, so Trustee Ferrara will distribute the plans as soon as they are available. Trustee Ferrara reported the Pelhamwood Civic Association and the Pelham Preservation and Garden Society are working together to restore the pillars on Pelhamwood Avenue. Trustee Ferrara reported the Junior League of Pelham has renewed their grant for the maintenance/improvement of the park, so the Board is grateful for this grant because it has few restrictions. ******** Trustee Kagan thanked his colleagues for attending and participating in the Empathy Towards All Volleyball fundraising event, and he hopes Ms. Rosell is closer to achieving her goal. Trustee Kagan thanked Kimberly Rosell for hosting the event, and Mayor Volpe for sponsoring a team. Page 3 Board of Trustees Regular Meeting Tuesday, March 27, 2018 Trustee Kagan reported the grand opening of Flower Bake bakery was a success, and he would like to encourage residents in the community to patronize local businesses when possible, so please shop locally. ******** Trustee Mullen had nothing to report. ******** Trustee Potocki had nothing to report. ******** Trustee Reinke arrived late, so she missed the Trustees’ report. ******** Trustee Spira-Cohen announced the next Solarize workshop will take place on Wednesday, March 28th at Daronco Townhouse. Village Administrator’s Report: Village Administrator Gallagher reported spring leaf pick-up has started, so all loose leaves are to be placed curbside until April 30th. Village Administrator Gallagher reported street paving has begun on Boulevard, and there will be additional road work to follow on Linden Avenue, First Avenue, Pelhamwood Avenue, and Maple Avenue. Village Administrator Gallagher reported the Village of Pelham received a notice from Suez concerning water main replacement work between Third Street and 6th Avenue that will take place over the summer. Item # 7 – Public Comments John Cassone, 312 7th Avenue, commended the DPW crew on their excellent work in clearing the streets after the storms. Mr. Cassone announced he attended the Solarize Pelham workshop, and it was an informative, so he encourages seniors to attend a workshop session in the future. Page 4 Board of Trustees Regular Meeting Tuesday, March 27, 2018 Non-Recurring Items Item # 8 – Public Hearing on Local Law No. 3 of 2018 Creating Chapter 7 of the Village Code Entitled Sustainability Advisory Board The public hearing was opened after a motion by Trustee Spira-Cohen and seconded by Trustee Ferrara, vote 7-0. Mayor Volpe stated a couple edits have been made to the previous draft concerning §2 the organizational structure and §3 meetings and voting. Mayor Volpe suggested §1 purpose should be changed to broaden the scope of the best practices and lessons that the Sustainability Advisory Board can consider in making its recommendations. Trustee Potocki stated §4 removal and vacancies was unclear in its language about removing members, so Trustee Kagan suggested it should read “By vote of the majority of the Mayor and Village Board shall have the power to remove..” Public Comment: Karen Gardener, 914 Wynnewood Road, Pelham Manor, thanked the Board for allowing residents of the Village of Pelham Manor to join the Sustainability Advisory Board, and asked if trustees from the Village of Pelham Manor could sit on the Board as well. Mayor Volpe stated they are open to having a Pelham Manor trustee sitting, and Trustee Spira-Cohen stated the law does not preclude involvement from the Town or the Village of Pelham Manor in terms of participation. Aimee Kaplan, 204 Elderwood Avenue, serves on Eco-Pel and the Pelham Preservation Garden Society, and both of her groups are looking forward to working with the Sustainability Advisory Board, especially on matters respecting preservation, open space, and tree canopy work. Ms. Kaplan thanks the Board for the creation of the Sustainability Advisory Board. Violet Massie Vereker, 8th Avenue representing Pelham Eliminates Plastic (PEP), a student led initiative, stated the goal of PEP is to eliminate the use of single use plastic like straws, bags, and water bottles, so they recently partnered with DeCicco’s to increase the use of paper bags, and possibly instituting a plastic bag fee. Ms. Vereker would like to form a partnership with the Sustainability Advisory Board, and Mayor Volpe indicated revealed students can serve on the Sustainability Advisory Board. Tom White, 55 1st Street, commends the Board on the creation of the Sustainability Advisory Board, and he thinks it is important to coordinate with Westchester County, since the County has been progressive with sustainability issues. Trustee Kagan stated in the past, there was consideration for a local plastic bag ban, but at that time, it was thought it would disadvantage local businesses if neighboring communities did not impose such a ban. At the time, the Board felt that it would be better instituted at the Westchester County level or State level. Page 5 Board of Trustees Regular Meeting Tuesday, March 27, 2018 Ms. Gardener stated there are local towns and villages who have implemented the plastic bag ban, so the Board should consider revisiting this issue. Sarah O’Connor, Esplanade, representing PEP, revealed they worked with DeCicco’s to go plastic free for a day for plastic pollution awareness day, and they are continuing the conversation with DeCicco’s to ban plastic bags. David Brown, 134 Cliff Avenue, thanks the Board for the creation of the Sustainability Advisory Board, and he anticipates both Villages will collaborate on sustainability issues. Maggie Klein, Pelham Plus, asked about the application process, and Trustee Spira-Cohen revealed interested parties can apply for membership through the Village website or through the MyVOP app. Trustee Spira-Cohen read a statement from Nina Orville, chair of the Dobbs Ferry Sustainability Task Force, “I would like to commend the Village Board for considering creation of a Sustainability Advisory Board and am confident that such a board would provide great results in Pelham. The benefits that we’ve seen in my village of Dobbs Ferry stemming from activities of the Dobbs Ferry Sustainability Task Force can illustrate the positive results that may come from creating that kind of committee. The Village of Dobbs Ferry created the Sustainability Task Force (STF) (formerly known as the Energy Task Force) in 2008, and I have been honored to chair that committee since its inception. The committee, whose members are appointed by the Village Board, has worked in close partnership with elected officials and municipal staff and more recently has been expanding outreach to the schools and other village institutions. The STF has been a wonderful vehicle for people who are passionate about different aspects of sustainability to contribute to improvements in the Village. Some of the results of our work include: • Helping the Village secure over $775K in energy-related grant funds. • Providing recommendations for Village-funded energy projects. • Securing recognition from NYS through programs including Clean Energy Community designation and Climate Smart Community Certification. • Assisting in projects to study and improve pedestrian safety including Safe Routes to School grants. • A current effort to improve recycling performance and reduce waste. • Community outreach events related to sustainability. Based on my experience with the committed and talented volunteers I’ve had the pleasure to work with through Solarize Pelham, I am confident that a Sustainability Advisory Board in the Village would Page 6 Board of Trustees Regular Meeting Tuesday, March 27, 2018 be very successful. The combination of professionalism and passion that have been so apparent in Pelham are the key to effective work by this kind of committee or board.” The public hearing was closed after a motion by Trustee Ferrara and seconded by Trustee Spira- Cohen, vote 7-0 Page 7 Board of Trustees Regular Meeting Tuesday, March 27, 2018 Item # 9 – Adopting Local Law No. 3 of 2018 Creating Chapter 7 of the Village Code Entitled Sustainability Advisory Board Mayor Volpe stated minor, immaterial edits were made to Local Law No, 3 of 2018. Resolution Adopting Local Law No. 3 of 2018 Creating Chapter 7 of the Village Code Entitled Sustainability Advisory Board Whereas, the Board of Trustees of the Village of Pelham has proposed a Local Law to create Chapter 7 of the Village Code Entitled Sustainability Advisory Board; and Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the local law is a Type II Action and are therefore not subject to the requirements of the State Environmental Quality Review Act (“SEQRA”) and; Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper of the Village of Pelham; and Whereas, said public hearing was held on March 27, 2018 at or about 7:30 p.m. at Village Hall, 195 Sparks Avenue, Pelham, NY and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said to proposed local law or any part thereof. Now, therefore, be it resolved, as follows: 1. The Board of Trustees of the Village of Pelham hereby adopts Local Law No. 3 of 2018 of the Village of Pelham creating Chapter 7 of the Village Code entitled Sustainability Advisory Board; and 2. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Village Administrator to execute the attached Inter-Municipal Agreement between the County of Westchester and the Village of Pelham to provide for E-911 service for a period of five (5) years commencing retroactively to October 1, 2017 and ending September 30, 2022. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Village Administrator to execute an Inter-Municipal Agreement with the City of New Rochelle for street resurfacing and engineering services (attached hereto and made a part hereof); and Be it further resolved, that the Mayor and Village Administrator are authorized to take the necessary and appropriate actions to effect this resolution. Page 13 Board of Trustees Regular Meeting Tuesday, March 27, 2018 Recurring Items Item # 15 – Authorizing Budget Amendments and Transfers for Fiscal Year 2017-18 Resolution Authorizing Budget Amendments and Transfers for Fiscal Year 2017-18 Whereas, pursuant to the provisions of §5-520 of the New York State Village Law, the Board of Trustees, by resolution, may increase existing appropriations by transferring funds from the unexpended balance of another appropriation, from the contingent account, from available cash surplus or unanticipated revenues within a fund, or by borrowing; and Whereas, in all cases, there are sufficient unexpended balances in other appropriation accounts, excess revenues or fund balances available to cover the amendments and transfers. A brief discussion took place over vouchers #10143, #10143, and #10154. Resolution Authorizing the Accounts Payable Whereas, pursuant to §5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. Mayor Volpe stated it is important that people run for office, so different perspectives are represented. Trustee Reinke thanked her colleagues, and congratulated Trustee Kagan, Trustee Potocki, and newly elected Trustee-elect Kamal Eldahry on their respective wins. Mayor Volpe stated the Annual Organizational Meeting will take place on Monday, April 2nd at 7:30pm, and Mayor Volpe will meet with every Board member before to discuss their priorities for the next year. The public portion of the Board meeting was adjourned at 8:32 pm to enter into Executive Session to discuss a police personnel matters, after which time the Board would adjourn for the evening.
