Mayor Volpe reported Elk Homes sent a clean-up crew to clear the space at the Highbrook Highline. Mayor Volpe stated he is not inclined to install fencing at this time because he wants to evaluate the project’s landscape after the Eagle Scouts’ finish their project. Mayor Volpe thanked Gary Hirsch, from Elk Homes, for donating the cleaning services. Mayor Volpe announced the Memorial Day Parade is coming up, so he encourages all elected officials to attend. Mayor Volpe stated there is interest from developers from the RFP for public-private partnership to redevelop several Village owned properties. Mayor Volpe said some residents have expressed their concerns about the proposed developments, but Mayor Volpe assured the public that they will be sufficiently informed and he plans to address this further in a newsletter. Mayor Volpe reported 8 Boulevard West and 185 Lincoln are moving ahead with their excavations. Page 2 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Mayor Volpe reported 101 Wolfs Lane has gone to the land use boards, specifically ARB. Mayor Volpe reported 163 Wolfs Lane is reviewing possible ideas for the site, so they have not gone to any of the land use boards. Mayor Volpe reported there is a preliminary proposal for 8 apartment units on First Street across from Marbury Corners. Mayor Volpe reported the New York State Budget for FY 2019 authorizes local governments to establish charitable gift reserve funds and to offer real property tax credits. Mayor Volpe said this will need to be considered from a County, Town, and a Village perspective, but he will continue to look into this matter. Mayor Volpe reported the capital street paving project has been completed, but residents can expect additional paving in the summer with CHIPS funding. Trustees’ Report: Trustee Ferrara thanked Boy Scout Troop 1 for their work in cleaning up Wolfs Lane Park and for the new plantings. Trustee Ferrara also thanked Girl Scout Troop 2199 for the beautiful plantings around Woodlawn park as part of their Earth day project. ******** Trustee Kagan asked Village Administrator Gallagher to follow up with the Westchester County Health department concerning a property on Linden Avenue that is not in compliance, and Trustee Kagan reported the building inspector has cited this property, so Trustee Kagan would like the Health department to remove the water collecting vessels to avoid mosquito outbreaks. Trustee Kagan reported progress is being made on the Highbrook Highline project, and Elk Homes recently cleaned up the site. ******** Trustee Kamal Eldahry had nothing to report. ******** Trustee Mullen reported the Public Employee Safety and Health Bureau inspector (PESH) recently examined the fire house and found no outstanding issues. The Fire department was commended on resolving their issues so quickly. ******** Trustee Potocki had nothing to report. ******** Page 3 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Trustee Spira-Cohen reported there are two upcoming Solarize Pelham workshops Solarize Pelham Workshop at the Manor Club, on Thursday, April 26th, 7:00-8:30 pm and at the Town of Pelham Public Library, on Saturday May 5th, 2:00-3:30 pm. Village Administrator’s Report: Village Administrator Gallagher reported loose leaf pick-up will end on Monday, April 30th. Item # 7 – Public Comments Rachel Robertson, 517 Manor Ridge Road, expressed her concern about a potentially dangerous juncture from Colonial Avenue to Kingsway Highway, intersecting Boulevard Avenue, Ancon Ave, and Manor Ridge Road. Ms. Robertson would like to see these intersections painted to indicate pedestrians are crossing. Mayor Volpe revealed there are jurisdictional issues with this stretch as some of it belongs to Pelham Manor, but he expects the painting to be done during the summer. Mayor Volpe said he will meet with Mr. Luglio, traffic consultant, from Sam Schwartz, to discuss safe streets, and this intersection has already been flagged, so he hopes Mr. Luglio will have recommendations on how to tackle the issues at this intersection. Page 4 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Non-Recurring Items Item # 8 – Presentation by Superintendent of Schools Cheryl H. Champ on the Proposed 2018 School Bond Dr. Cheryl Champ, Superintendent of the Pelham Public School District, presented the Proposed 2018-19 Budget and Bond to the Board of Trustees. Dr. Champ stated in 2016,significant issues with the Hutchinson School’s exterior were observed, and this prompted the School Board to conduct an extensive analysis of the building and the school district. The analysis identified accessibility issues within and outside Hutchinson School and Prospect Hill School, and other issues with the Hutchinson School such as enrollment growth, infrastructure issues, and the expected usable lifespan of the portables. The School Board reviewed several different renovation/expansion options, and after an extensive debate and analysis, they decided to move forward with the new school option, which is included in the bond proposal along with an athletic facilities upgrade of the Glover complex. There are two projects in the school bond proposal: proposition 1(facilities upgrades) and proposition 2 (athletic facilities and fields). Proposition 1: Project Cost: $52,900,000 Annual Estimated Tax Impact:$79 per $100,000 on the assessed home value, and the anticipated full impact will be phased in by 2022-2023.  The construction of a new Hutchinson School  Renovation at PMHS/PMS to provide 6 additional classrooms, orchestra and storage rooms, science/research lab upgrades  Security and ADA accessibility upgrades for the Prospect Hill School  Replacement of the roof and parapets on the PMHS Annex and masonry repointing Proposition 2: Project Cost: $4,624,892 Annual Estimated Tax Impact: $7 per $100,000 on the assessed home value, and the anticipated full impact will be phased in by 2022-2023.  Turfing of the Glover baseball/practice fields  Tennis Court replacement  Irrigation and renovation of Prospect Hill field Dr. Champ stated proposition 2 will only be implemented if proposition 1 is approved because pairing proposition 2 with its respective building work will guarantee 39 % of state aid reimbursement. Dr. Champ explained the school district will receive 39% reimbursement in state aid for the projects, so they expect to receive approximately $13.9 million in state building aid for proposition 1 and $2.2 million in state building aid for proposition 2, for a total of approximately $16.1 million. The School bond referendum vote will take place Tuesday, May 15th, in the PMHS Main Gym from 7am-9pm. Page 5 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Item # 9 – Authorizing the Use of Street Trees in the Village Right-of-Way for the National Alliance on Mental Health Ribbon Campaign Trustee Kagan asked that NAMI be informed of their responsibility to remove the ribbons after the campaign’s conclusion. Resolution Authorizing the Use of Street Trees in the Village Right-of-Way for the National Alliance on Mental Health Ribbon Campaign Whereas, the National Alliance on Mental Health (“NAMI”) desires to use street trees in the Village of Pelham for their ribbon campaign in May 2018; and Whereas, the Village Board of Trustees desires to assist NAMI in their campaign with the use of street trees within the Village. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes NAMI to place a maximum of fifty (50) ribbons on street trees along Fifth Avenue and Wolfs Lane effective May 1, 2018 for thirty (30) days and to be removed by NAMI shortly thereafter; and Be it further resolved, that the Mayor, Village Administrator and Department of Public Works General Foreman are authorized to take the necessary steps to effectuate this resolution. Trustee Potocki stated the Village of Pelham has money available in the general fund balance, so why raise taxes when the money is readily available? Trustee Potocki also supports moving with the 1.997% tax levy rate. Trustee Spira-Cohen explained tax payers contribute to more than just employee salaries, but also the benefits (healthcare, pensions, etc.), which the Village does not control. Trustee Spira-Cohen revealed these expenses are increasing every year, and this year alone health care costs went up by 8%, but the Village revenues are not, so in the future the Village will potentially need to break the tax cap at some point in the future. Trustee Spira-Cohen does not support the 1.997% tax levy rate option. Trustee Mullen said this year requires a cautious approach with increased taxes at the County level, the possible school bond, and federal tax SALT cap, but he will not support the 1.997% tax levy rate. Trustee Mullen reiterated Trustee Spira-Cohen’s sentiments about the escalating cost of benefits, and healthcare costs for the employees have increased 8% or $300,000 already putting the Village at a disadvantage. Trustee Mullen explained a large portion of our budget is out of the Board’s control, so they have been trying to rectify the situation in a number of ways:  Structural changes to the Village Departments  Budget practice changes  Restructuring the debt service payments  Adjusting the fee schedule to bring in more revenue  Adding new sources of revenue like revisions to the Code for filming fees  Actively pursuing development opportunities through the passage of the BDFZ to increase our tax base on the non-homestead side  The distribution of the RFP for the public-private partnership to redevelop several Village owned properties  Implementing a Village wide spending freeze Even with all of these changes, the Village still has to appropriate money from the general fund balance to cover the costs. Trustee Mullen does not believe it is prudent to appropriate more fund balance than it is necessary this year. Page 9 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Trustee Ferrara said she is confident with the expected revenues for the next Fiscal Year, and believes it is important to practice fiscal responsibility. Trustee Ferrara said the new development in the Village will increase our tax base, and the changes to the fee schedule will pay off, so she is in favor of the 1.997%. Trustee Kamal Eldahry believes there is some uncertainty in the expected revenues for the next Fiscal Year, but the tax cap will need to be broken by a significant number in the future. Trustee Kamal Eldahry is in favor of the 1.997%. Trustee Kagan said the Board and Village staff have spent a considerable amount of time to get to a manageable budget, but State mandated increases to pension plans and escalating medical costs have put us in a position where Village staff have to perform their jobs with aging equipment. Furthermore, an arbitration agreement award added to our deficit, so even if everything goes as planned next year, expenses are $250,000 over the projected revenues. The question is how does the Village account for $250,000 shortfall, and Trustee Kagan listed four options:  Tax residents to the allowable 2.48% tax levy rate and appropriate $200,000 out of the general fund balance  Move forward with the 1.997% and appropriate $250,000 out of the general fund balance  Cut staff or resources  Break the tax cap levy Trustee Kagan stated without relief from the state and collective bargaining agreements, it seems likely that the tax cap will be broken in the future. Trustee Kagan is concerned that going below the allowable tax cap will only compound the problem down the road, but with the changes to the federal tax code still to really hit taxpayers, he cannot justify taxing the residents more in these uncertain times, so he supports the 1.997% rate. Mayor Volpe explained the general fund balance was used this year to pay for unplanned expenses that needed to be addressed this year:  7 storm drains  Flooding issues by Elderwood and Second Avenue and Fifth Avenue  Sinkhole on colonial avenue  A collapsed wall in parking lot 1  Emergency shoring for parking lot 2 Mayor Volpe hopes the new development in the Village will bring in more revenue on the non- homestead side. Whereas, pursuant to § 5-508 of the New York State Village Law, the Board of Trustees has adopted the Village Budget for the fiscal year commencing June 1, 2018 and ending May 31, 2019; and Whereas, such budget as adopted establishes a general Village Tax Levy of $11,002,839.00 for this period. Page 18 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Item # 15 – Discussion on Local Gun Safety Legislation Deborah Knapp, representing the Progressive Women of Pelham, asked the Board of Trustees to consider drafting a local gun safety ordinance to protect residents from gun violence and to promote safety. Ms. Knapp stated there are laws at the federal and state level, but these laws fall short, and local governments are uniquely situated to fill the loopholes in Federal, State, and County gun legislation. Ms. Knapp drafted and sent a memorandum to the Board of Trustees in support of gun legislation that could cover four areas:  use and possession  licensing  sale  ammunition Ms. Knapp stated the Giffords law center is a wonderful resource with model codes on local gun legislation, and the Giffords law center works with local governments to draft legislation. Trustee Kamal Eldahry revealed the Village of Pelham is on the list for the Gifford center’s legislative services. Mayor Volpe stated he needs input from the Police department, Westchester County, and the community, but he will research this matter further and continue the discussion. Page 19 Board of Trustees Regular Meeting Tuesday, April 24, 2018 Item # 16 – Other Business David Imamura, from the Village of Irvington, shared his experience with the Board of Trustees on moving the Board of Trustees election from March to November in 2012. Mr. Imamura was instrumental in passing the resolution to place the referendum on the ballot back in 2012. Mr. Imamura shared that since moving the elections from March to November, voter turnout has increased, so now they average about 2,000 voters in the November election whereas during March elections they averaged 700 voters. Mr. Imamura said there are benefits of moving the election from March to November such as the increase voter turnout and the cost savings, but Mayor Volpe said the County pays for our elections, so that’s not an issue for the Village of Pelham. Moving the election from March to November would require the Board to pass a resolution authorizing the referendum to be placed on the ballot in November for the residents to vote on. Mr. Imamura explained moving the election to November would change how candidates are added to the ballot, and under the new system candidates would have go through a signature process to add their name to the primary as opposed to the Village caucus. The new election system would also extend existing terms until November, but Mr. Imamura was unsure as to when the new term would start for the Village of Pelham. Trustee Mullen is in favor of making democracy easier, so he is open to this proposal. Mayor Volpe would like to discuss this matter again. John Cassone, 7th Avenue, said his resource at the Village of Mamaroneck went through this process a few years ago, and his resource said they lost their local flavor, and voters pay attention to the larger elections. RFP Discussion Mayor Volpe encouraged developers interested in redeveloping municipal spaces to send their proposals for review. Mayor Volpe said there is interested from a few developers such as RXR Realty, JMF properties, and Elk Homes, but additional meetings will follow to discuss this further and come to a compromise. Extenet Trustee Kagan reported the Building Inspector has not received the supplemental information he requested from Extenet, but he will keep us posted.
