Farrell ☒ ☐ ☐ Item # 4 – Trustees’ Report: Trustee Carpenter said the two probationary firefighters, Anthony Borsella and Chris Paolercio, began the academy in August and will graduate in December. He also thanked Captain Robert Benkwitt III for working with the Town of Pelham and Empress Emergency Medical Services for procuring a deal to purchase supplies at a lower cost than we would receive on our own. Lastly, Trustee Carpenter mentioned Ladder 2’s recent inspection led to the discovery of a crack in the aerial ladder. We are thankful to Chief DiNapoli and Seagrave Fire Apparatus, LLC for covering this repair under warranty. Trustee Greco had nothing to report. Trustee Hill-Ries mentioned a partnership with the Chamber of Commerce in the near future. Trustee Kamal Eldahry gave an update on the Sustainability Advisory Board’s (SAB) Heatsmart Campaign dual application with the Town of Pelham. Additionally, she thanked original SAB member Kevin Healy, for his volunteerism as he recently submitted his resignation. Trustee Potocki reported current standings on the 2020 Census. He also said he’s noticed random acts of kindness as per his hope. Board of Trustees Regular Meeting Tuesday, September 8, 2020 Trustee Spira-Cohen had nothing to report. Item # 5 – Village Administrator’s Report: Village Administrator Small said the RFP for the Village-wide Flow Monitoring System is available and the deadline for responses is September 18, 2020 at 10:00 AM. Additionally, Village Administrator Small said Con Edison will be replacing a transformer on Boulevard near Carol Avenue on September 19. Village Hall will put out notices regarding road closures and parking information in advance. Along the same lines, he said he continues to reiterate the importance of traffic light timeliness on First Avenue and Lincoln Avenue in regard to the Lincoln Avenue Bridge Project. Also, the Pedestrian Safety and Traffic Calming Committee is pooling reports relating to the committee’s tasks which will help us address issues. Lastly, he said there are door-hangers advertising the 2020 Census which will hopefully be going out mainly in multi-family buildings and apartments. Item # 6 – Mayor’s Report Mayor Mullen noted the upcoming memorial service on Friday, September 11 at 8:30 AM located at the 9/11 memorial across from Gazebo Park on Harmon Avenue. He shared the unfortunate news of a recent car crash on Wolfs Lane, luckily there were no serious injuries. Mayor Mullen announced the reopening of Pelham schools and noted some of their operational safety measures. On another note, Mayor Mullen reviewed the potential partnership with Pelham House which was presented to the public in March 2020. Details of which can be found on the Village of Pelham’s website at https://www.pelhamgov.com/mayor-board-trustees/news/downtown-revitalization-project. He urged residents to sign up for our email lists and NIXLE to receive up-to-date alerts regarding the community. Mayor Mullen acknowledged the progress of the Steering Committee on Policing and Inclusion. He posted the agenda which can be found on the Village of Pelham’s website at https://www.pelhamgov.com/home/news/steering-committee-policing-and-inclusion. Lastly, Mayor Mullen and Superintendent of Buildings and Public Works, Joe Senerchia, met Gavin Fear and Sanjay Seecharran at the Highbrook Highline to prepare for their eagle scout projects. Board of Trustees Regular Meeting Tuesday, September 8, 2020 Item # 7 – Public Comments Maryanne Joyce, of 142 Nyac Avenue, notified the board that she will be moving to another New York State Senator's Office (Shelley Mayer). The Village Board of Trustees gave the go-ahead for the SAB to apply for a grant which would cover the start-up costs including toters, signage, a 1- year supply of compostable liners and outreach supplies, totaling $3,000. Board of Trustees Regular Meeting Tuesday, September 8, 2020 Item # 11 – Discussion on Draft Local Law to Establish a Municipal Arts Council Trustee Carpenter led a conversation on the next steps and general guidance of the possible establishment of a Municipal Arts Council. After compiling data from many sources, he said he has three goals driving his decision to draft this local law: 1. Drafting a local law that established an Arts Council with statutory authority over the design and placement of all works of art to be acquired by the Village, placed on land owned or leased by the Village, anywhere in public right of way, or otherwise utilizing public resources, such as communication platforms and the Village’s Government Access Channel 2. Work with the Council to establish guidelines and procedures for considering temporary and permanent artworks in parks, streetscapes, and similar Village Property, and for broadcast on the Village’s Government Access Channel 3. Whereas, on January 30, 2020, the World Health Organization designated the novel coronavirus, COVID-19, outbreak as a Public Health Emergency of International Concern; and Whereas, on January 31, 2020, the United States Health and Human Services Secretary declared a public health emergency for the entire United States to aid the national healthcare community in responding to COVID-19; and Whereas, on March 7, 2020, pursuant to Section 28 of Article 2-B of the Executive Law, Governor Cuomo issued Executive Order Number 202, declaring a State disaster emergency for the entire State of New York. Thereafter, numerous additional Executive Orders were issued which prohibited in-person gatherings and prohibited non-essential construction work; and Whereas, on May 26, 2020, Governor Cuomo permitted non-essential construction work under Phase I of the New York State Forward Reopening Plan; and Whereas, 80 days elapsed between March 7, 2020 and May 26, 2020 in which non-essential construction work was prohibited, negatively impacting the building and construction trades industry. Whereas, the Village Board of Trustees acknowledges the hardship and adverse impacts that COVID-19 has had on the building and construction trades industry. Now, therefore, be it resolved, that the Village Board of Trustees of the Village of Pelham hereby calls for a Public Hearing on Local Law No. 3 of 2020 to Amend Chapter 98 Zoning, Article XX Administration; Penalties, Section 98-136.E ,Tuesday, September 22, 2020 at 7:30 PM or soon thereafter to be held by video as all in person public access to Village Board of Trustees Meetings has been suspended pursuant to Executive Order 202.1 issued by Governor Cuomo on March 12, 2020 to Amend Chapter 98 Zoning, Article XX Administration; Penalties. This means calling for the public hearing would be pushed back from September 22. Board of Trustees Regular Meeting Tuesday, September 8, 2020 Item # 15 – Resolution Authorizing Memorandum of Understanding with Sustainable Westchester, Inc., for the Continuation of the Community Choice Aggregation Program (2021- 2023) Resolution Authorizing Memorandum of Understanding with Sustainable Westchester, Inc., for the Continuation of the Community Choice Aggregation Program (2021-2023) Whereas, the Village of Pelham adopted local legislation to enable Community Choice Aggregation (CCA) (Village of Pelham Code Chapter 2B); and Whereas, the current Electric Service Agreement for the Sustainable Westchester, Inc. CCA program terminates on December 31, 2020; and Whereas, the Village wants to continue to engage the services of Sustainable Westchester, Inc. as the Program Manager for CCA and the operation and maintenance of the Program. Now, therefore, be it resolved, that upon review by the Village Attorney, the Mayor is authorized to sign a Memorandum of Understanding (MOU) with Sustainable Westchester, Inc.; and Be it further resolved, that the purpose of the MOU is to: a) establish the Village’s participation in the CCA program to be managed by Sustainable Westchester, Inc. under the 2021 Electric Service Agreement (ESA); b) to affirm that the Village and Sustainable Westchester, Inc. agree to adhere to the terms and conditions of the 2021 ESA in the event the ESA is executed; c) to affirm that the Village and Sustainable Westchester, Inc. agree to execute the 2021 ESA in accord with the terms of the MOU.
