Lastly, he urged residents to support local businesses and restaurants as the National Mom & Pop Business Owners Day is coming up on March 29th. Item # 5 – Acting Village Administrator’s Report: Acting Village Administrator Scelza had nothing to report. Village Board of Trustees Regular Meeting Tuesday, March 23, 2021 Item # 6 - Mayor’s Report: Mayor Mullen mentioned things are starting to reopen as the number of COVID-19 active cases are declining, but to remain diligent with safety precautions and following CDC Guidelines. He also said the Picture House kicked off their Centennial Campaign and they’ll have a fundraiser to support them for their next 100 years. Third, he said the Pelham House project is in the schematic drawings phase as dialogue about financing is beginning. Additionally, Mayor Mullen noted the recent reaction to hate crimes led by Westchester County Executive George Latimer and Westchester District Attorney Miriam E. Rocah have launched #SpeakUpWestchester, to fight back against these racist attacks. While hate incidents do not always violate the law, they should always be reported by those targeted and bystanders. The vote passed 7-0. Village Board of Trustees Regular Meeting Tuesday, March 23, 2021 Item # 12 - Resolution Adopting Governor Andrew M. Cuomo’s Executive Order No. 203: New York State Reform & Reinvention Plan Whereas, on May 25, George Floyd was killed by a Minneapolis police officer who held his knee on Mr. Floyd’s neck for 8 minutes and 46 seconds, and Whereas, on June 1, over 100 residents attended the first vigil organized by local residents, in Wolfs Lane Park. Attendees knelt in silence for 8 minutes and 46 seconds, and speakers were invited to share personal stories of how their lives have been impacted by inequity and discrimination. These vigils continued each evening for 27 consecutive days, and speakers included various local residents and leaders, including the Superintendent of Pelham Schools Dr. Cheryl Champ and Mayor Chance Mullen, among many others; and Whereas, rallies continued to be organized throughout the month of June by various local groups, including Pelham United, Pelham Together and the Progressive Women of Pelham; and Whereas, these actions that occurred throughout the summer months of 2020 all expressed a desire for Pelham’s local leaders (Town, School, Village, Manor) to engage in honest dialogue about the unjust and inequitable treatment often experienced by people of color, and embrace the need for systemic changes that can ensure racial equity. Whereas, on June 12, 2020, Governor Andrew M. Cuomo signed Executive Order No. 203, requiring municipalities with police departments to develop a reform plan based on community input; and Whereas, the Village of Pelham formed the Steering Committee on Policing and Inclusion (SCPI), which included residents who had either participated in local demonstrations, represented BIPOC-led organizations, or had contacted Mayor Mullen to express a desire to lead a review of local police department policies; and Whereas, the resident members of the SCPI (Krystal Howell, Okey Obudulu, Jeff Watkins, Veronica Stern, Ella Stern and Teisa Salmon) met 18 times over the next 5 months to review internal policies, working collaboratively alongside Mayor Mullen, Administrator Omar Small, Police Chief Jason Pallett and Trustee Ariel Spira-Cohen to create the Village’s Phase One Report, which included nearly 50 recommendations for ensuring racial equity in the Village of Pelham; and Whereas, the Phase One Report then served as a basis for two public planning sessions and three community forums, designed to elicit feedback on the preliminary findings and recommendations developed by the SCPI, which was then included in the final plan; and Whereas, the Village of Pelham organized these recommendations into 12 priority action areas, and sought feedback from professional staff and outside counsel to develop an implementation plan for each priority area; and Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper of the Village of Pelham; and Whereas, said public hearing was held on March 23, 2021 at or about 8:00 p.m. online via Zoom and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed action or any part thereof; and Whereas, following the public hearing, the Village Board of Trustees reviewed the action items proposed by the plan. Village Board of Trustees Regular Meeting Tuesday, March 23, 2021 Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby adopts the Village of Pelham Phase One Report’s Key Findings and Recommendations; and Be it further resolved, that certification of such plan (“Appendix B”) shall be transmitted to the New York State Budget Director as required by Executive Order No. 203. Infrastructure Capacity Studies, including 1. Traffic and Pedestrian Safety Study (2018) 2. Village Fire Station Assessment and Space Needs Study (2018-2019) 3. School Generation Study (2019) 4. Municipal Parking Facilities (2018-2019) 5. Sanitary Sewer Study (underway) 6. Village Hall and Police Station Space Needs Study (2018-2019) 7. Fair Share Impact Assessment (2019); and Whereas, the Village of Pelham adopted a Comprehensive Plan in 2008 and has taken significant steps towards implementing actions recommended in the Comprehensive Plan, including the following: Business Development Floating Zone (2016) that provides incentives for transit-oriented mixed-use development in the downtown. Fair Share Impact Assessment (2019); and Whereas, the Comprehensive Plan found that: (i) the current Village Hall lacks ADA accessibility and is substandard for meeting the administrative needs of the Village: and (ii) the Fire Station located at 219 Fifth Avenue and the nearby municipal parking structures, Parking Lots 2 and 3, are structurally deficient and require significant and costly structural repair and ongoing maintenance; and Whereas, the Village Board of Trustees has determined that it desires to evaluate additional steps toward implementing the Comprehensive Plan (and the subsequent planning assessments identified above); and Whereas, the Village Board of Trustees is proposing the following initiatives (collectively, the “Proposed Actions”): Village Board of Trustees Regular Meeting Tuesday, March 23, 2021 • A new Municipal Services Center to consolidate and support a new Fire House, Police Headquarters and Village Hall (collectively, the “Municipal Services Center”); • Expanding municipal parking on Parking Lot 2 (adjacent to the current Village Hall), and Parking Lot 3 at the corner of 3rd Street and Sixth Avenue (adjacent to the former Capital One bank building); • Conveying the parcels located at 219 Fifth Avenue and Parking Lot 2 (the existing fire station site, adjacent surface parking lot, and the parking lot at the corner of Fifth Avenue and Third Street – hereafter, the “Mixed-Use Project Site”) to a private developer in furtherance of a contemplated mixed- • use development consisting of ground floor commercial space, over 120 residential units, and a parking deck with approximately sixty (60) spaces for public use (“Mixed-Use Project”); • Considering amendments to the BDFZ to incentivize the provision of public parking in developments seeking inclusion in the BDFZ, including, for example, increasing the building coverage maximum and decreasing the lot area per unit requirement in the event a development includes public parking; • Considering including the Mixed-Use Project Site in the BDFZ, and a lot merger, site plan and other approvals to facilitate the Mixed-Use Project; • Implementing ‘complete streets’ improvements at several key intersection in the Village to increase pedestrian, bicycling safety and other new mobility options; and • Implementing improvements to the Village’s downtown to enhance the experience for residents, shoppers, businesses, and visitors. Some of the Proposed Actions will require a review and approval by the Village Board of Trustees and the involvement of the Pelham Local Development Corporation (“LDC”). The LDC’s role will include but not limited to the involvement in the new Municipal Services Center and Mixed-Use Project. As such, the LDC has entered into a Local Development Agreement (“LDA”) with a developer concerning the potential construction of the Municipal Services Center and the potential Mixed-Use Project, dated January 7, 2021. Whereas, the Village Board of Trustees has reviewed and considered an Environmental Assessment Form for the Proposed Actions (“EAF”); and Whereas, the Village Board of Trustees has identified the following as involved agencies: (a) Westchester County Department of Health; and (b) Town of Pelham, New York Now, therefore, be it resolved, that the Village Board of Trustees determines that: (a) the Proposed Actions is subject to the requirements of SEQRA; (b) the Proposed Actions is a Type I Action; and (c) the Proposed Actions is not located in an agricultural district.
