The Board of Trustees of the Village of Pelham hereby schedules a public hearing to be held at a
Special Meeting on Tuesday, August 2, 2022 at 7:00 pm or soon thereafter on a proposed local
law to amend Chapter 98-106.3 of the Pelham Village Code entitled “Business District Floating
Zone”. This meeting will be held virtually on Zoom and members of the public wishing to
present comments may do so online during the public comment phase of the public hearing by

Marilyn Hoyt from 110, Sixth Avenue asked if the east side of Fifth Avenue is part of the BDFZ.
Said homes looking west on Sixth Avenue are already facing issues. She stated she was worried
about whether lots can be merged, and the size of developments. She also asked if changes
were to be made to the BDFZ, how that may affect developments in the future. She had
concerns about the quality of life deteriorating in that particular area. The Mayor said he did not
know of any developments in that particular area but future boards will need to address any
concerns.
MaryAnn Joyce from 142 Nyac Avenue, asked after looking at the Local Law, whether there are
any incentives or requirements for affordable housing, and part two of her question was if there
are any requirements or incentives for green buildings? And are there any incentives or plans for
sustainable landscaping? The Mayor responded by saying that the way to address sustainable
development is to embed it in the zoning code rather than to amend the BDFZ.

Item # 5 – Resolution Adopting Local Law No. 6 of 2022 to Amend Chapter 98-106.3
of the Pelham Village Code Entitled “Business District Floating Zone”
Whereas, in adopting Local Law No. 2 of 2017 creating the Business District Floating Zone
“(BDFZ’), the Village Board of Trustees committed to reviewing the effectiveness of the BDFZ
regulations no later than March 31, 2022; and
Whereas, the Village Board of Trustees determined that to implement the proposed initiatives,
programs and proposed developments that were included in the proposed Downtown
Restoration Initiatives, amendments to § 98-106.3 of the Pelham Village Code were needed to
incentivize the provision of public parking and other public amenities in developments seeking
inclusion in the BDFZ; and
Whereas, pursuant to the State Environmental Quality Review Act (“SEQRA”), Article 8 of the
Environmental Conservation Law, and 6 NYCRR Part 617, the Village Board of Trustees had the
opportunity to review the social, economic, fiscal, land use, zoning and other factors related to
the proposed BDFZ amendments; and
Whereas, the Downtown Restoration Initiatives were classified as a Type I Action under SEQRA
and required the preparation of a Generic Environmental Impact Statement (“GEIS”); and
Whereas, the GEIS disclosed all pertinent information, and weighed and balanced the relevant
environmental impacts with social, economic, and other considerations for the Village Board of
Trustees to conclude that potential adverse environmental impacts will be avoided or minimized
to the maximum extent practicable by incorporating relevant mitigation measures that were
identified as practicable in the GEIS; and
Whereas, on July 26, 2022, the Village Board of Trustees adopted the Environmental Findings
Statement for the Downtown Restoration Initiatives; and
Whereas, as part of such review, the Village Board of Trustees has determined that
incorporating into the BDFZ several incentives for public amenities to foster downtown vibrancy
and redevelopment would be beneficial; and
Whereas, the Village Board of Trustees held a duly noticed public hearing on the proposed
local law on August 2, 2022, at which time all those interested had an opportunity to be heard,
and the public hearing was closed on August 2, 2022.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby
adopts Local Law No. 6 of 2022 to amend Chapter 98-106.3 of the Pelham Village entitled
“Business District Floating Zone”; and
Be it further resolved, that the Village Clerk is hereby directed to prepare said Law for filing
with the Secretary of State.
