Village Trustee Hill-Ries – The Chamber of Commerce has reached out to discuss the grant
application through the County for downtown improvement. Village Trustee Hill-Ries will be working
with the Chamber on this in the next few weeks.

Due to the weather today, commercial cardboard, bulk and garbage pick-up were suspended. The
revised schedule was posted on the website and email blasted.
The first day of in-house Village garbage pickup will be Monday, March 13th.

Item # 6 - Mayor’s Report
The Mayor has been working with The Westchester Municipal Officials Association Housing
Committee; they have been in dialog with the Governor’s team and the Division of Housing and
Community Renewal to share concerns regarding the Governor’s Housing Compact. Mayor Mullen will
be releasing a letter to the community, and more to follow on that.
Thank you to the DPW folks who worked through the night and into the morning during the
snowstorm to keep the streets looking great.

Scheduling a Public Hearing for Local Law No. 2 of 2023 to Amend Chapter 73, Article II of the
Pelham Village Code Entitled “Senior Citizens Tax Exemption” to Increase the Income Threshold as
Permitted Under New York State Real Property Tax Law.
The Board of Trustees of the Village of Pelham hereby schedules a public hearing to be held at 8:00
p.m. on Tuesday, February 28, 2023, on a proposed Local Law that would amend the Code of the
Village of Pelham, as follows. This meeting will be held virtually on Zoom and members of the public

Item # 9 – Resolution Adopting Local Law No. 2 of 2023 to Amend Chapter 73, Article II
of the Pelham Village Code Entitled “Senior Citizens Tax Exemption” to Increase the
Income Threshold as Permitted Under New York State Real Property Tax Law
Whereas, pursuant to Section 467 of Real Property Tax Law, local governments and school districts
in New York State can opt to grant a reduction on the amount of property taxes paid by qualifying
senior citizens by reducing the taxable assessment of the senior’s home by as much as 50%; and
Whereas, on August 8, 2022, the Governor signed legislation to amend Section 467 of the Real
Property Tax Law to increase the amount of income property owners may earn for the purpose of
eligibility for the senior citizen property tax exemption from $29,000 to $50,000; and
Whereas, the Board of Trustees of the Village of Pelham desires to Amend Chapter 73, Article II of
the Village Code to set the income limit to $50,000 for the 50% senior citizen property tax
exemption; and
Whereas, the Board of Trustees of the Village of Pelham wishes to adopt a sliding-scale to provide a
benefit to seniors with incomes greater than $50,000; and
Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the
local law is a Type II Action and are therefore not subject to the requirements of the New York State
Environmental Quality Review Act (SEQRA); and
Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper
of the Village of Pelham; and
Whereas, said public hearing was held on February 28, 2023, at or about 8:00 p.m. virtually via
Zoom and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said to proposed local law or any part thereof.
Now, therefore, be it resolved, as follows:
1. The Board of Trustees hereby adopts Local Law No. 2 of 2023 to Amend Chapter 73, Article II
of the Pelham Village Code Entitled “Senior Citizens Tax Exemption” to Increase the Income
Threshold as Permitted Under New York State Real Property Tax Law;
2. The Board of Trustees directs the Village Clerk to prepare said Law for filing with the Secretary
of State.

Be it resolved, that the Board of Trustees of the Village of Pelham hereby confirms the Mayor’s
appointment of Joseph Larios of Poughkeepsie, New York to the position of Laborer, First, in the
Village of Pelham Department of Public Works, effective Monday, March 13, 2023, at an annual
starting salary of $68,530.00, subject to the requirements of Westchester County Civil Service, for a
probationary period of one (1) year; and
Be it further resolved, that the Village Administrator is authorized to take the necessary and
appropriate actions to effect this appointment.

permanent), from Westchester County Civil Service Eligible List # 77-194, effective Wednesday March
1, 2023 at an annual salary of $132,364.00 subject to a one-year (1) probationary period and
requirements of Westchester County Civil Service; and

Item # 14 – Resolution Authorizing Street Closure for Pelham Little League Parade
Whereas, the Pelham Little League has requested permission to host the Pelham Little League
Parade on Saturday, April 15, 2023 (copy attached); and
Whereas, the Pelham Little League shall reimburse the Village for all costs incurred by the Village as
a result of the event, including but not limited to Police Department and Department of Public Works
overtime, and provide a certificate of liability insurance naming the Village as an additional insured in
a form and amount satisfactory to the Village.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the closing of Fifth Avenue between Lincoln Avenue and Colonial, and 3rd Street from
Fourth Avenue to Seventh Avenue on Saturday, April 15, 2023 from 8:30 a.m. to 10:30 a.m. for a
Pelham Little League Parade; and
Be it further resolved, that the Board of Trustees of the Village of Pelham authorize the
appropriate Village officials and staff to take the necessary and appropriate actions to allow this event
to take place.

(3rd Annual Toonerville Music Festival)
Whereas, on January 25, 2023 Pelham Civic Association submitted a special event request for
Pelham Music Festival in Municipal Parking Lot 7 on September 23, 2023; and
Whereas, Pelham is known for its commitment to the arts and this event will celebrate the arts and
bring the Pelham community together; and
Whereas, Pelham Civic Association shall reimburse the Village for all costs incurred by the Village as
a result of the event, including but not limited to Police Department and Department of Public Works
overtime, and provide a certificate of liability insurance naming the Village as an additional insured in
a form and amount satisfactory to the Village.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the appropriate Village officials and staff to take the necessary and appropriate actions to
allow this event to take place.

Item # 16 - Resolution Authorizing Pavement Management Services Proposal from
Pavement Management Group
Whereas, pavement management systems are a set of procedures for inspecting, collecting,
analyzing, maintaining, and reporting condition assessment data for decision-makers to find optimal
strategies for maintaining roadways over a given period for the lowest practical cost; and
Whereas, on Monday January 30, 2023, Pavement Management Group submitted a proposal and
management services agreement to conduct a pavement management study on behalf of the Village
of Pelham.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the Village Administrator to sign an agreement with Pavement Management Group for a
pavement management study for an amount not to exceed $11,000.00.

Item # 18 - Resolution Authorizing an Inter-Municipal Agreement Extension Between
the Village of Scarsdale and the Village of Pelham for the Disposal of Organic Waste
Whereas, historically, the Village of Pelham had an Agreement with the City of New Rochelle for the
disposal of organic waste; and
Whereas, the City of New Rochelle Yard Waste Transfer Station is under construction and will be
temporarily closed until August of 2023; and
Whereas, mirroring the Village of Pelham’s Sanitation Calendar for Spring and Fall Leaf Collection,
this agreement shall be active effective January 31, 2023 and terminate October 31, 2023; and
Whereas, New York State General Municipal Law, Article 5-G, authorizes the villages the ability to
enter into an inter-municipal agreement to jointly establish and operate such programs.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby
authorizes the Village Administrator to execute the attached Inter-Municipal Agreement between the
Village of Pelham and Village of Scarsdale for the disposal of organic waste.

Scheduling a Public Hearing for Local Law No. 2 of 2023 to Amend Chapter 73, Article II of the
Pelham Village Code Entitled “Senior Citizens Tax Exemption” to Increase the Income Threshold as
Permitted Under New York State Real Property Tax Law.
The Board of Trustees of the Village of Pelham hereby schedules a public hearing to be held at 8:00
p.m. on Tuesday, February 28, 2023, on a proposed Local Law that would amend the Code of the

Item # 9 – Resolution Adopting Local Law No. 2 of 2023 to Amend Chapter 73, Article II
of the Pelham Village Code Entitled “Senior Citizens Tax Exemption” to Increase the
Income Threshold as Permitted Under New York State Real Property Tax Law
Whereas, pursuant to Section 467 of Real Property Tax Law, local governments and school districts
in New York State can opt to grant a reduction on the amount of property taxes paid by qualifying
senior citizens by reducing the taxable assessment of the senior’s home by as much as 50%; and
Whereas, on August 8, 2022, the Governor signed legislation to amend Section 467 of the Real
Property Tax Law to increase the amount of income property owners may earn for the purpose of
eligibility for the senior citizen property tax exemption from $29,000 to $50,000; and
Whereas, the Board of Trustees of the Village of Pelham desires to Amend Chapter 73, Article II of
the Village Code to set the income limit to $50,000 for the 50% senior citizen property tax
exemption; and
Whereas, the Board of Trustees of the Village of Pelham wishes to adopt a sliding-scale to provide a
benefit to seniors with incomes greater than $50,000; and
Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the
local law is a Type II Action and are therefore not subject to the requirements of the New York State
Environmental Quality Review Act (SEQRA); and
Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper
of the Village of Pelham; and
Whereas, said public hearing was held on February 28, 2023, at or about 8:00 p.m. virtually via
Zoom and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said to proposed local law or any part thereof.
Now, therefore, be it resolved, as follows:
1. The Board of Trustees hereby adopts Local Law No. 2 of 2023 to Amend Chapter 73, Article II
of the Pelham Village Code Entitled “Senior Citizens Tax Exemption” to Increase the Income
Threshold as Permitted Under New York State Real Property Tax Law;
2. The Board of Trustees directs the Village Clerk to prepare said Law for filing with the Secretary
of State.

appointment of Joseph Larios of Poughkeepsie, New York to the position of Laborer, First, in the
Village of Pelham Department of Public Works, effective Monday, March 13, 2023, at an annual
starting salary of $68,530.00, subject to the requirements of Westchester County Civil Service, for a
probationary period of one (1) year; and
Be it further resolved, that the Village Administrator is authorized to take the necessary and
appropriate actions to effect this appointment.

Whereas, the Pelham Little League has requested permission to host the Pelham Little League
Parade on Saturday, April 15, 2023 (copy attached); and
Whereas, the Pelham Little League shall reimburse the Village for all costs incurred by the Village as
a result of the event, including but not limited to Police Department and Department of Public Works
overtime, and provide a certificate of liability insurance naming the Village as an additional insured in
a form and amount satisfactory to the Village.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the closing of Fifth Avenue between Lincoln Avenue and Colonial, and 3rd Street from
Fourth Avenue to Seventh Avenue on Saturday, April 15, 2023 from 8:30 a.m. to 10:30 a.m. for a
Pelham Little League Parade; and
Be it further resolved, that the Board of Trustees of the Village of Pelham authorize the
appropriate Village officials and staff to take the necessary and appropriate actions to allow this event
to take place.

Whereas, on January 25, 2023 Pelham Civic Association submitted a special event request for
Pelham Music Festival in Municipal Parking Lot 7 on September 23, 2023; and
Whereas, Pelham is known for its commitment to the arts and this event will celebrate the arts and
bring the Pelham community together; and
Whereas, Pelham Civic Association shall reimburse the Village for all costs incurred by the Village as
a result of the event, including but not limited to Police Department and Department of Public Works
overtime, and provide a certificate of liability insurance naming the Village as an additional insured in
a form and amount satisfactory to the Village.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein

Whereas, pavement management systems are a set of procedures for inspecting, collecting,
analyzing, maintaining, and reporting condition assessment data for decision-makers to find optimal
strategies for maintaining roadways over a given period for the lowest practical cost; and
Whereas, on Monday January 30, 2023, Pavement Management Group submitted a proposal and
management services agreement to conduct a pavement management study on behalf of the Village
of Pelham.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the Village Administrator to sign an agreement with Pavement Management Group for a
pavement management study for an amount not to exceed $11,000.00.

Item # 18 - Resolution Authorizing an Inter-Municipal Agreement Extension Between
the Village of Scarsdale and the Village of Pelham for the Disposal of Organic Waste
Whereas, historically, the Village of Pelham had an Agreement with the City of New Rochelle for the
disposal of organic waste; and
Whereas, the City of New Rochelle Yard Waste Transfer Station is under construction and will be
temporarily closed until August of 2023; and
Whereas, mirroring the Village of Pelham’s Sanitation Calendar for Spring and Fall Leaf Collection,
this agreement shall be active effective January 31, 2023 and terminate October 31, 2023; and
Whereas, New York State General Municipal Law, Article 5-G, authorizes the villages the ability to
enter into an inter-municipal agreement to jointly establish and operate such programs.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby
authorizes the Village Administrator to execute the attached Inter-Municipal Agreement between the
Village of Pelham and Village of Scarsdale for the disposal of organic waste.

Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit
all claims against the Village.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham after audit of
the following vouchers, authorizes payment for services rendered and materials received, for the
following items that have been submitted to the Treasurer's Office for payment and authorized by the
Village Administrator and Deputy Village Treasurer:
