CALL TO ORDER ITEM # 2. NEW CASES (PUBLIC HEARING) 2.1 Special Permit to Provide Tutoring at an Office Building located at 629 Fifth Avenue. Owner of 629 Fifth Avenue, more particularly described as Parcel ID 159.69-1-1 on the tax map of the Village of Pelham, appeals the Building Department denial to alter the second floor of an existing office building to allow for a child daycare /afterschool program for 10 students. The building permit is denied as after school programs are not a permitted use in the O-2 Zone. Applicant requests approval by Special Permit pursuant to Zoning Code §98-71-2. 2.2 Use Permit to Provide for Child Day-Care Center, a Non-Permitted Use, at 48-50 th Avenue (A-1 Zone). Owner of commercial building located at 48-50 Fifth Avenue (Zone B-1), more particularly described as Parcel 163-44-1-38 on the tax map of the Town of Pelham, appeals the Building Department denial of a child day-care center, a non-permitted use in Zone B-1.
